Quality assurance (QA) and quality control (QC) data are required in order to have confidence in the results from analytical tests and the equipment used to produce those results. Some AOAC water methods include specific QA/QC procedures, frequencies, and acceptance criteria, but these are considered to be the minimum controls needed to perform a microbiological method successfully. Some regulatory programs, such as those at Code of Federal Regulations (CFR), Title 40, Part 136.7 for chemistry methods, require additional QA/QC measures beyond those listed in the method, which can also apply to microbiological methods. Essential QA/QC measures include sterility checks, reagent specificity and sensitivity checks, assessment of each analyst's capabilities, analysis of blind check samples, and evaluation of the presence of laboratory contamination and instrument calibration and checks. The details of these procedures, their performance frequency, and expected results are set out in this report as they apply to microbiological methods. The specific regulatory requirements of CFR Title 40 Part 136.7 for the Clean Water Act, the laboratory certification requirements of CFR Title 40 Part 141 for the Safe Drinking Water Act, and the International Organization for Standardization 17025 accreditation requirements under The NELAC Institute are also discussed.

Essential QC measures include method calibration, reagent standardization, assessment of each analyst's capabilities, analysis of blind check samples, determination of the method's sensitivity (method detection level or quantification limit), and daily evaluation of bias, precision, and the presence of laboratory contamination or other analytical interference. Other than the Rivers and Harbors Act of 1899, which was designed to protect navigation, Federal criminal sanctions were not applicable to water pollution offenses. This paper briefly discusses the more significant provisions of the Fish and Wildlife Coordination Act (1958). It covers pertinent aspects of legislative history, the development and current status (April 1980) of certain policies relevant to administering the Act, and other matters. It is directed primarily to practicing fish and wildlife agency field biologists, planners, and decisionmakers engaged in water resources development activities under the Act. It is not intended to be exhaustive in its treatment. The Fish and Wildlife Coordination Act provides a basic procedural framework for the orderly consideration of fish and wildlife conservation measures to be incorporated into Federal and Federally permitted or licensed water development projects. The principal provisions of the Act include: 1. a statement of Congressional purpose that fish and wildlife conservation shall receive equal consideration with other project features; 2. mandatory consultation with wildlife agencies with a view to achieving such conservation; 3. full consideration by action of the recommendations stemming from consultation; 4. authority for action agencies to implement such recommendations as they find acceptable. The FWCA in effect amends, conditions, or supplements other Federal laws and is thus closely linked in its application and interpretation. It is similarly linked to Federal planning standards and procedures. Because of this, interpretations tend to be flexible and evolve, adapting to changing situations. The following reference matrix outlines selected sections of the Fish and Wildlife Coordination Act which are of particular relevance to planners.

Should the Clean Water Act Follow Stream Water Underground? Managing Beyond the Stream Banks

The Clean Water Act was designed to protect the integrity of surface waters of the United States. Originally limited to solely waters that were traditionally navigable, the jurisdictional bounds of the Clean Water Act have been expanded to include many other ‘waters of the United States,’ some of which are in fact unnavigable. This expansion of the definition of ‘navigable waters’ has brought many litigative challenges to the true jurisdictional limits of the Act. The recent Supreme Court opinions in Rapanos v. United States (2006) and the subsequent interpretation by lower federal courts have set the precedent for a new approach to jurisdictional determinations, where considerations of function and effect act as gatekeepers for inclusion under the CWA. Justice Kennedy’s significant nexus standard from Rapanos (2006) limits jurisdictional coverage under the Clean Water Act to ‘waters that have a significant nexus with traditional navigable waters.’ Thus, establishing a ‘significant nexus’ between a water body in question and traditionally navigable waters satisfies the requisites needed for inclusion within the scope of the Clean Water Act. By and large there has been a lack of consideration for the near subsurface components of streams when discussing the application of the significant nexus standard. We propose that hyporheic zones, a volume of alluvial aquifer that hosts the exchange of stream water, should be covered under the Clean Water Act, since these zones are intimately connected with their adjoining surface waters and facilitate many processes that are key to supporting healthy stream ecosystems and good water quality. Given the opinions rendered in Rapanos (2006) and the guidance offered by the EPA and Corps following the decision, we demonstrate that the hyporheic zone fulfills each of the functional and ecological example factors used to establish a significant nexus. The Clean Water Act is the principal federal law protecting the integrity of waters in the United States (e.g., rivers, streams, wetlands, lakes). Clean Water Act protection after U.S. Supreme Court decisions in Solid Waste Agency of Northern Cook County (SWANCC) (2001) and Rapanos (2006) is determined based on case-by-case analyses of connections among waters. Determining a water's status as a "water of the US" protected by the Act typically requires data and analysis of characteristics such as its flow, and biological and chemical relationships with downstream waters. When such data is not available, the Clean Water Act might not protect the quality and integrity of the water in question. This raises a number of legal and technical challenges for implementation, as well as questions regarding underlying aquatic sciences. In addition, many of the terms used by the court are not fully consistent with similar scientific terms, potentially causing confusion among policymakers and scientists alike. This presentation will discuss the Clean Water Act, and how currently its protections for aquatic resources are dependent on connectivity with larger downstream waters, particularly for those that do not flow perennially. The presentation will focus on the role science has played in forming and informing policy making, areas where science and policy may not be fully consistent, areas where research is still needed, and provide a policy "dictionary" for scientists interested in working on this evolving issue.

The Federal Facility Compliance Act (FFCA) was signed by President Bush on October 6, 1992. This Act amends the Resource Conservation and Recovery Act (RCRA), the primary law governing hazardous waste management in the US The most significant provision of the FFCA was the waiver of sovereign immunity. This waiver subjects Federal facilities to the same ``incentives`` as the private sector for compliance. While the waiver has broad implications for all Federal facilities, other provisions of the FFCA impact specific sectors of the Federal complex. The focus of this paper is the FFCA Munitions Provisions, which have the potential tomore » change some aspects of the structure of munitions management within the military. The Munitions Provisions, contained in Section 107 of the FFCA, modifies Section 3004 of RCRA by adding a new subsection (y) on Munitions. Section 107 requires the Environmental Protection Agency (EPA) to develop, after consultation with the Department of Defense (DOD) and appropriate State officials, regulations identifying when military munitions (including conventional and chemical munitions) become hazardous waste, and to provide for the safe transportation and storage of such waste. The FFCA requires EPA to promulgate the final ``Munitions Rule`` by October 6, 1994. These are the only provisions of the FFCA that require a new rulemaking. It is clear that the Munitions Rule could have a significant effect on the way in which DOD manages munitions. Demilitarization, range management, training activities, and emergency response actions may be affected. It is important for DOD, the Services, and individual installations, to be aware of potential impacts of the FFCA on munitions management operations. Congress assigned the Federal government the responsibility for setting substantive environmental quality standards and the states the responsibility for implementing and enforcing those standards in four statutes--the National Environmental Policy Act; the Federal Water Pollution Control Act; Clean Air Act; and the Noise Control Act. In two recent decisions (EPA v. California ex rel. State Water Resources Council Bd., 96 S. Ct. 2022, 1976 and Hancock v. Train, 96 S. Ct. 2006, 1976) the U.S. Supreme Court considered the extent to which Congress intended these environmental statutes to waive Federal immunity from state regulation. In June, President Reagan signed the Federal Employees' Retirement System Act of 1986 (Public Law 99-335), which establishes the Federal Employees' Retirement System (FERS) for employees hired after December 31, 1983. The program, which goes into effect on January 1, 1987, features a defined benefit retirement plan to augment mandatory coverage under social security. It also permits FERS participants to contribute up to 10 percent of their earnings, on a tax-deferred basis, to a thrift savings plan, with partial matching by the Government. This article describes the provisions of the new system, including survivor annuities and disability benefits. It also explains how employees covered under the Civil Service Retirement System may freeze their earned benefits under that program and transfer to FERS during the period July-December 1987.

Main-stem reservoirs were constructed and agricultural production flourished to the point of crop surpluses in the Missouri River basin. Consequently, the irrigation that was promised for the upper-basin states was not pursued as originally planned. The result was unappropriated surplus water available for commitments to future use. In recent years, when the nation's need for increased energy production became a reality, attention began focusing on the actual commitments of those surpluses. Conflicts between water for energy and water for agriculture were inevitable. On February 24, 1975 Secretaries of the Army and Interior entered into a ''Memorandum of Understanding'' concerning themore » marketing of surplus water from six reservoirs on the main stem of the Missouri River. The memorandum was executed in order to expedite plans for using large amounts of coal in the Dakotas, Montana, and Wyoming for developing new energy supplies. The purpose of the memorandum was to permit the possible execution of industrial-water-service contracts of approximately one million acre feet of main-stem storage water. This Comment examines two initial questions raised by the Federal proposals to sell impounded reservoir water to industrial users. First, what are the rights or powers of the states to control water within their borders, and second, what legal authority, constitutional, legislative, or otherwise, do the Departments of the Interior and Army have for industrial water marketing from Federal reservoirs. Other collateral yet significant issues are considered as well. Although reauthorization of the Clean Water Act was scheduled for 1992, action has stalled due to debate over the contentious wetland issue and is not likely to pick up again until after the first of the year. The subject of the debate, regulation of wetlands, is found in Section 404, which makes up only a small part of the Clean Water Act.At the meeting, “New Directions in Clean Water Policy,” held in Charlottesville, Va., July 28-31, Ralph Heimlich, an economist with the Office of Policy and Planning Evaluation at the Environmental Protection Agency, said “it is unfortunate that the Section 404 Dredge and Fill permit program, our only national wetland regulation, is part of the Clean Water Act.” The controversy over wetland reform, he added, “has delayed and threatens to poison action on Clean Water Act reauthorization, provisions that may be more directly significant in improving water quality.”

With U.S. geothermal power production expected to more than triple by 2040, and the majority of this growth expected to occur in arid and water-constrained areas, it is imperative that decision-makers understand the potential long-term limitations to and tradeoffs of geothermal development due to water availability. To this end, water consumption data, including documentation triggered by the National Environmental Policy Act (NEPA) of 1969, production and injection data, and water permit data, were collected from state and federal environmental policy sources in an effort to determine water consumption across the lifecycle of geothermal power plants. Values extracted from these sourcesmore » were analyzed to estimate water usage during well drilling; to identify sourcing of water for well drilling, well stimulation, and plant operations; and to estimate operational water usage at the plant level. Nevada data were also compared on a facility-by-facility basis with other publicly available water consumption data, to create a complete picture of water usage and consumption at these facilities. Environmental Management and the New Politics of Western Water: The Animas-La Plata Project and Implementation of the Endangered Species Act.

/ This paper explores the new politics of western water policy through an examination of the Animas-La Plata water project and implementation of the Endangered Species Act. It is suggested that the focus of western water programming has shifted from the source of distributed funds, the United States Congress, to the agencies originally created to deliver federal benefits because funding for new project construction has not been forthcoming. Under this new system, members of Congress continue to excite their constituents with promises of money for new project starts, while the administrative agencies perform the myriad duties needed to keep these projects alive. The result is that political objectives have replaced operational/management objectives in administrative processes. In this case, the author demonstrates how resource managers in the Bureau of Reclamation manipulated hydrological analysis to control administrative process, why their manipulation was unfair, and perhaps illegal, and why biologists from the US Fish and Wildlife Service accepted the analysis. While ostensibly protecting all interests, the result is that none of the objectives of federal water programming are achieved. McNary Lock and Dam were completed in 1953, creating McNary Reservoir, or Lake Wallula. The shoreline of the reservoir is federally owned and as a result the U.S. Army Corps of Engineers (USACE) has certain land and fish habitat management responsibilities to balance with other multipurpose benefits. The Endangered Species Act (ESA) listing of Columbia and Snake River salmon stocks has changed the management of salmon harvest, hydropower operations, hatchery practices, and habitat management in recent years. There are 12 salmon Oncorhynchus spp., steelhead Oncorhynchus mykiss, and bull trout Salvelinus confluentus evolutionarily significant units (ESU‘s) that use this reach of the Columbia River at one or more stages in their life history. Of those 12, 8 are listed as threatened or endangered under the federal Endangered Species Act. The entire portion of the Columbia River in the Hanford Reach and McNary Reservoir is designated critical habitat for seven ESA-listed salmon species. The USACE is in the process of updating the 1983 McNary Lakeshore Management Plan. The updated Shoreline Plan provides criteria for private use of the federal shoreline of McNary Reservoir, specifically the permitting of private docks, over-water structures, and modifications to shoreline vegetation by adjacent land owners. The previous Shoreline Plan was written prior to the federal listing of salmon species. At the request of the USACE, the purpose of this report is to review information from the literature and determine the extent to which the criteria proposed by USACE for the docks and over-water structures are supported by the current body of scientific knowledge.

In Europe different types of water are marketed, each strictly defined by EC Directive 80/777 (Natural Mineral Water, Spring and Table Water) or 80/778 (Drinking Water). In Germany, an additional type of water is common in the market: curative/medical water. Product quality and safety, registration as medicine, and pharmaceutical control are defined by the German Federal Medicine Act. A medical water is treated as any other medicine and may be sold only in pharmacies. The use of any water in Germany is controlled and strictly regulated by the Federal Water Act (Fricke 1981). The following requirements are set by the act: (1) No water use without a permit, which is limited in time and quantity. (2) No single or juristic person may own water. (3) Water resources of public interest and their recharge areas are to be protected by the definition of water protection zones. (Natural mineral water is not of public interest and therefore is not required to be protected by the definition of water protection zones, although it represents a market value of more than US2 billion. Medical water is of public interest). The definition of water protection zones impacts private property rights and has to be handled carefully. In order to protect water resources, sometimes the economic basis of a traditional industrial and/or agricultural infrastructure is destroyed. The concerns and needs all citizens, including industry, must be considered in analyzing the adequacy of water protection zones.

Drinking Water Management and Governance in Canada: An Innovative Plan-Do-Check-Act (PDCA) Framework for a Safe Drinking Water Supply

Drinking water management in Canada is complex, with a decentralized, three-tiered governance structure responsible for safe drinking water throughout the country. The current approach has been described as fragmented, leading to governance gaps, duplication of efforts, and an absence of accountability and enforcement. Although there have been no major waterborne disease outbreaks in Canada since 2001, a lack of performance improvement, especially in small drinking water systems, is evident. The World Health Organization water safety plan approach for drinking water management represents an alternative preventative management framework to the current conventional, reactive drinking water management strategies. This approach has seen successful implementation throughout the world and has the potential to address many of the issues with drinking water management in Canada. This paper presents a review and strengths-weaknesses-opportunities-threats analysis of drinking water management and governance in Canada at the federal, provincial/territorial, and municipal levels. Based on this analysis, a modified water safety plan (defined as the plan-do-check-act (PDCA)-WSP framework) is proposed, established from water safety plan recommendations and the principles of PDCA for continuous performance improvement. This proposed framework is designed to strengthen current drinking water management in Canada and is designed to fit within and incorporate the existing governance structure.

Airports are active facilities with numerous on-going operations at their sites. The following operations may adversely affect the water quality of nearby aquatic environments: De-icing runways; de-icing taxiways; de-icing and anti-icing aircraft; aircraft maintenance; and salt de-icer application. Until the amendments to the Clean Water Act of 1972, referred to as the Water Quality Act of 1987, were passed by Congress, the majority of storm water discharges in the US were unregulated. The Water Quality Act of 1987 was promulgated as an effort to manage the pollution resulting from storm water runoff. Many industrial facilities, especially airports, were faced withmore » complex problems in attempting to comply with these new federal regulations. National Pollution Discharge Elimination System (NPDES) permits for airports with more than 50,000 flight operations per year require periodic monitoring of receiving waters and storm sewer outfalls. To discuss changes in the law that allow community pharmacy loyalty programs to include and offer incentives to Medicare and Medicaid beneficiaries. The retailer rewards exception of the Patient Protection and Affordable Care Act of 2010 and its change to the definition of remuneration in the civil monetary penalties of the Anti-Kickback Statute now allow incentives to be earned on federal benefit tied prescription out-of-pocket costs. The criteria required to design a compliant loyalty program are discussed. Community pharmacies can now include Medicare and Medicaid beneficiaries in compliant customer loyalty programs, where allowed by state law. There is a need for research directly on the influence of loyalty programs and nominal incentives on adherence.

The American Indian Religious Freedom Act of 1978 (AIRFA) requires federal agencies to ensure that none of their actions interfere with the inherent right of individual Native Americans (including American Indians, Eskimos, Aleuts, and Native Hawaiians) to believe, express, and exercise their traditional religions. These rights include access to religious sites, use and possession of sacred objects, and the freedom to worship through traditional ceremonials and rites. Since regulations have not been developed to implement the law, many federal agencies have integrated consultation under AIRFA with the existing environmental assessment process required for compliance with the National Environmental Policy Actmore » of 1969 (NEPA). Background information on Native American religions, the relationship of AIRFA to the First Amendment, and resources belonging to Native Americans is provided in this document to assist project managers in understanding the concerns of Native Americans with regard to federal developments. Since many native religious leaders are unwilling to discuss their religion with outsiders, consultation through intermediaries, such as tribal political leaders and/or private Indian organizations, may often be needed to ensure that appropriate input is received from the religious leaders. It is this consultation with the traditional religious leaders, either directly or through surrogates, that is the ultimate objective in complying with AIRFA. When a federal agency finds, upon consultation, that its proposed action would deny the free exercise of religion and yet determines that there is a compelling need for the action, the decision to proceed may be made, but appropriate mitigation measures to reduce religious interference to the lowest possible level must be included. 28 refs.« less

Dispersed development, also referred to as urban growth or sprawl, is a pattern of low-density development spread over previously rural landscapes. Such growth can result in adverse impacts to air quality, water quality, human health, aquatic and terrestrial ecosystems, agricultural land, military training areas, water supply and wastewater treatment, recreational resources, viewscapes, and cultural resources. The U.S. Environmental Protection Agency (U.S. EPA) is charged with protecting public health and the environment, which includes consideration of impacts from dispersed development. Specifically, because federal infrastructure projects can affect the progress of dispersed development, the secondary impacts resulting from it must be assessed in documents prepared under the National Environmental Policy Act (NEPA). The Council on Environmental Quality (CEQ) has oversight for NEPA and Section 309 of the Clean Air Act requires that U.S. EPA review and comment on federal agency NEPA documents. The adverse effects of dispersed development can be induced by federal infrastructure projects including transportation, built infrastructure, modifications in natural infrastructure, public land conversion and redevelopment of properties, construction of federal facilities, and large traffic or major growth generation developments requiring federal permits. This paper presents an approach that U.S. EPA reviewers and NEPA practitioners can use to provide accurate, realistic, and consistent analysis of secondary impacts of dispersed development resulting from federal infrastructure projects. It also presents 24 measures that can be used to mitigate adverse impacts from dispersed development by modifying project location and design, participating in preservation or restoration activities, or informing and supporting local communities in planning.

To date, numerous Jurassic hydrocarbon fields and pools have been discovered in the Cotton Valley Group, Haynesville Formation, Smackover Formation and Norphlet Formation in the tri-state area of Mississippi, Alabama and Florida, and in Alabama State coastal waters and adjacent Federal waters area. Petroleum traps are basement highs, salt anticlines, faulted salt anticlines and extensional faults associated with salt movement. Reservoirs include continental and marine sandstones, limestones and dolostones. Hydrocarbon types are oil, condensate and natural gas. The onshore stratigraphic and structural information can be used to establish a regional geologic framework for the Jurassic for the State coastal waters and adjacent Federal waters areas. Evaluation of the geologic information along with the hydrocarbon data from the tri-state area indicates that at least three Jurassic hydrocarbon trends (oil, oil and gas condensate, and deep natural gas) can be identified onshore. These onshore hydrocarbon trends can be projected into the Mobile area in the Central Gulf of Mexico and into the Pensacola, Destin Dome and Apalachicola areas in the Eastern Gulf of Mexico. Substantial reserves of natural gas are expected to be present in Alabama State waters and the northern portion of the Mobile area. Significant accumulations of oil and gas condensate may be encountered in the Pensacola, Destin Dome, and Apalachicola areas. ?? 1989.

Energy efficiency isn't just a good idea; it's a necessity, both for cost reasons and to meet federal regulatory requirements. First, rising energy unit costs continue to erode NASA's mission budget. NASA spent roughly $156M on facility energy in FY 2007. Although that represents less than one per cent of NASA's overall annual budget, the upward trend in energy costs concerns the agency. While NASA reduced consumption 13%, energy unit costs have risen 63%. Energy cost increases counteract the effects of energy conservation, which results in NASA buying less yet spending more. The second factor is federal energy legislation. The National Energy Conservation Policy Act, as amended by the Energy Policy Act of 2005, Executive Order (EO) 13423 (January, 2007), and the Energy Independence and Security Act (December, 2007), mandates energy/water conservation goals for all federal agencies, including NASA. There are also reporting requirements associated with this legislation. The Energy/Water Management Task was created to support NASA Headquarters Environmental Management Division (HO EMD) in meeting these requirements. With assistance from TEERM, HQ EMD compiled and submitted the NASA Annual Report to the Department of Energy FY 2007. The report contains information on how NASA is meeting federally mandated energy and water management goals. TEERM monitored input for timeliness, errors, and conformity to the new energy/water reporting guidelines and helped compile the information into the final report. TEERM also assists NASA Energy/Water Management with proposal and award calls, updates to the energy/water management database, and facilitating communication within the energy/water management community. TEERM is also supporting NASA and the Interagency Working Group (IWG) on Hydrogen and Fuel Cells. Water resource management requires collaborative solutions that cross institutional and political boundaries. This work describes the development and use of a computer-based tool for assessing the impact of additional water allocation from the Gila River and the San Francisco River prescribed in the 2004 Arizona Water Settlements Act. Between 2005 and 2010, Sandia National Laboratories engaged concerned citizens, local water stakeholders, and key federal and state agencies to collaboratively create the Gila-San Francisco Decision Support Tool. Based on principles of system dynamics, the tool is founded on a hydrologic balance of surface water, groundwater, and their associated coupling between watermore » resources and demands. The tool is fitted with a user interface to facilitate sensitivity studies of various water supply and demand scenarios. The model also projects the consumptive use of water in the region as well as the potential CUFA (Consumptive Use and Forbearance Agreement which stipulates when and where Arizona Water Settlements Act diversions can be made) diversion over a 26-year horizon. Scenarios are selected to enhance our understanding of the potential human impacts on the rivers ecological health in New Mexico; in particular, different case studies thematic to water conservation, water rights, and minimum flow are tested using the model. The impact on potential CUFA diversions, agricultural consumptive use, and surface water availability are assessed relative to the changes imposed in the scenarios. On August 8, 2005, the President signed the Energy Policy Act of 2005 (EPAct) into law. In Subtitle F of EPAct, Congress set forth various provisions that would change the way certain federal agencies (Agencies) coordinate to authorize the use of land for a variety of energy-related purposes. As part of Subtitle F of EPAct, Section 368 addresses the issue of energy transportation corridors on federal land for oil, gas, and hydrogen pipelines, as well as electricity transmission and distribution facilities. Because of the critical importance of improving the nation's electrical transmission grid, Congress recognized that electricity transmission issues shouldmore » receive added attention when the Agencies address corridor location and analysis issues. In Section 368, Congress specifically directed the Agencies to consider the need for upgraded and new facilities to deliver electricity: In carrying out [Section 368], the Secretaries shall take into account the need for upgraded and new electricity transmission and distribution facilities to (1) improve reliability; (2) relieve congestion; and (3) enhance capability of the national grid to deliver electricity. Section 368 does not require the Agencies to consider or approve specific projects, applications for rights-of-way (ROWs), or other permits within designated energy corridors. Importantly, Section 368 does not direct, license, or otherwise permit any on-the-ground activity of any sort. If an applicant is interested in obtaining an authorization to develop a project within any corridor designated under Section 368, the applicant would have to apply for a ROW authorization and applicable permits. The U.S. Geological Survey Federal-State Cooperative Water Resources Program is a partnership between the Geological Survey and State and local agencies for the collection of the hydrologic information needed for the continuing determination and evaluation of the quantity, quality, and use of the Nation 's water resources. The Cooperative Program has served the Nation for more than 80 years, and in 1981 more than 800 State and local agencies have cooperative programs with the Geological Survey with total funding over $80 million. The process of project selection in the Cooperative Water Resources Program is a mutual effort in which Geological Survey represents national interests, including the needs of other Federal agencies, and the cooperator represents State and local interests. The result is a balanced program that involves careful evaluation of needs, priorities, and resources. The cost sharing ratio of 50-50 is examined and determined to be the best ratio to effectively assess the Nation 's water resources. The Cooperative Program is and has been relevant to the problems of the day. Much of the current technology in ground-water management, ground-water quality, and flood-plain management--to name a few--was developed as part of the Cooperative Program. (USGS)

In the American southwest, over-allocated water supplies, groundwater depletion, and potential climate change impacts are major water management concerns. It may therefore seem counterintuitive that the resolution of outstanding senior tribal water claims, essentially reallocating finite water supplies to tribes, could support improved water supply reliability for many water users as is the case with the 2004 Arizona Water Settlements Act. The large size of the settlement and its multiple components translate to significant impacts on water policy in Arizona. Key water management solutions incorporated into the settlement and associated legislation have expanded the water manager's "toolbox" and are expected to enhance water supply reliability both within and outside Arizona's active management areas. Many of these new tools are transferable to water management applications in other states.

In September, 1988, the 100th Congress passed the Indian Gaming Regulatory Act, concluding five years of debate over the Indian Gaming issue - brought to a head by a Supreme Court decision in February, 1987, that barred states from regulating Indian Gaming. That case (State of California v. Cabazon Band of Mission Indians) forced the legislature to take a serious look at issues of gaming on Indian lands. The result was the creation of a three-tiered system whereby tribes will control ceremonial games, the federal government will control bingo, and the states and tribes will negotiate agreements to cover casino games, parimutuel racing, and jai alai, if such games are legal in that particular state. In light of the case of the Cabazon Indians and the passage of the Indian Gaming Regulatory Act, this paper will address the following competing issues: tribal sovereignty, state interests, federal interests, and states like Nevada, which have a regulated gaming industry.

The U.S. Department of Energy is currently preparing an assessment of the effects of climate change on federal hydropower, as directed by Congress in Section 9505 of the Secure Water Act of 2009 (P.L. 111-11). This paper describes the assessment approach being used in a Report to Congress currently being prepared by Oak Ridge National Laboratory. The 9505 assessment will examine climate change effects on water available for hydropower operations and the future power supplies marketed from federal hydropower projects. It will also include recommendations from the Power Marketing Administrations (PMAs) on potential changes in operation or contracting practices thatmore » could address these effects and risks of climate change. Potential adaption and mitigation strategies will also be identified. Federal hydropower comprises approximately half of the U.S. hydropower portfolio. The results from the 9505 assessment will promote better understanding among federal dam owners/operators of the sensitivity of their facilities to water availability, and it will provide a basis for planning future actions that will enable adaptation to climate variability and change. Adolescents aged 11-14 years (n 326), belonging to organized sports federations in the Federal District, Brazil were interviewed. Subjects (n 107) provided four non-consecutive days of food consumption and 219 subjects provided two non-consecutive days of intake. The objective was to assess their nutrient and water intake according to dietary reference intake values and their energy and macronutrient intake by sex and sports groups they were engaged in: endurance, strength-skill or mixed, according to the guidelines established by the American College of Sport Medicine (ACSM). Dietary data were corrected for intra-individual variation. Total energy expenditure was higher among endurance athletes (P < 0.001) following their higher training time (P < 0.001) when compared to adolescents engaged in strength-skill or mixed sports. Total energy intake was only significantly higher among endurance-engaged females (P = 0.05). Protein intake of males was above the guidelines established by the ACSM for all sports groups. All male sport groups fulfilled the intake levels of carbohydrate per kg body weight but only females engaged in endurance sports fulfilled carbohydrate guidelines. Intakes of micronutrients with low prevalence of adequate intake were: vitamins B1, E and folate, magnesium and phosphorus. Few adolescents ( < 5 %) presented adequate intake for calcium, fibre, drinking water and beverages. For micronutrients, prevalence of adequacies were lower for females than males, except for liquids and water. Nutrition guidance is needed to help adolescents fulfil specific guidelines of macronutrient intake for their sports and to improve their intake of micronutrients and water. Special attention should be given to female adolescent athletes.

The Federal Food, Drug, and Cosmetic Act (the FD&C Act) authorizes the Food and Drug Administration (FDA or Agency) to award priority review vouchers (PRVs) to tropical disease product applicants when the applications meet certain criteria. The FD&C Act lists the diseases that are considered to be tropical diseases for purposes of obtaining PRVs, and also provides for Agency expansion of that list to include other diseases that satisfy the definition of ``tropical diseases'' as set forth in the FD&C Act. FDA has determined that Chagas disease and neurocysticercosis satisfy this definition, and therefore is adding them to the list of designated tropical diseases whose product applications may result in the award of PRVs. Sponsors submitting certain applications for the treatment of Chagas disease and neurocysticercosis may be eligible to receive a PRV if such applications are approved by FDA.

The Safe Drinking Water Act 2011 was introduced in South Australia to provide clear direction to drinking water providers on how to achieve water safety. The Act requires drinking water providers to register with SA Health and develop a risk management plan (RMP) for their water supply that includes operational and verification monitoring plans and an incident notification and communication protocol. During the first year of operation, 212 drinking water providers registered under the Act, including one major water utility and a range of small to medium sized providers in regional and remote areas of the State. Information was captured on water source(s) used and water treatment. Rainwater was the most frequently reported drinking water source (66%), followed by bore water (13%), on-supply or carting of mains water (13%), mixed source (rainwater with bore water backup) (6%) and surface water (3%). The majority of providers (91%) treated the water supply, 87% used disinfection. During the first year of operation, 16 water quality incidents were formally reported to SA Health. These included both microbial and chemical incidents. Case studies presented highlight how the RMPs are assisting drinking water providers to identify incidents of potential health concern and implement corrective actions.

Within the Federal government, the U. S. Fish and Wildlife Service (Service) has primary responsibility for legal and policy responsibility for introduced exotic species. The Lacey Act of 1900 authorizes the Service to prohibit the importation of species that are potentially injurious to native fish and wildlife. However, regulations under authority of the Lacey Act cover only a few species. The Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 established a Task Force co-chaired by the Director of the Service and Under Secretary of Commerce for Oceans and Atmosphere. The Task Force consults with the Secretary of Transportation to develop regulations to prevent the importation and spread of aquatic nuisance species into the Great Lakes through exchange of ballast water. Federal agencies must comply with Presidential Executive Order 1198, Exotic Organisms, that prohibits Federal agencies or activities they fund or authorize from introducing exotic species. The Service conducts research and evaluation of exotic species to support Federal, State, and local efforts to prevent further importation of harmful species. Effective regulation will also depend on the full cooperation with Canada.
