The U.S. Environmental Protection Agency (EPA) Endocrine Disruptor Screening Program (EDSP) currently relies on an initial screening battery (Tier 1) consisting of five in vitro and six in vivo assays to evaluate a chemical's potential to interact with the endocrine system. Chemical companies may request test waivers based on Other Scientifically Relevant Information (OSRI) that is functionally equivalent to data gathered in the screening battery or that provides information on a potential endocrine effect. Respondents for 47 of the first 67 chemicals evaluated in the EDSP submitted OSRI in lieu of some or all Tier 1 tests, seeking 412 waivers, of which EPA granted only 93. For 20 of the 47 chemicals, EPA denied all OSRI and required the entire Tier 1 battery. Often, the OSRI accepted was either identical to data generated by the Tier 1 assay or indicated a positive result. Although identified as potential sources of OSRI in EPA guidance, Part 158 guideline studies for pesticide registration were seldom accepted by EPA. The 93 waivers reduced animal use by at least 3325 animals. We estimate 27,731 animals were used in the actual Tier 1 tests, with additional animals being used in preparation for testing. Even with EPA's shift toward applying 21st-century toxicology tools to screening of endocrine disruptors in the future, acceptance of OSRI will remain a primary means for avoiding duplicative testing and reducing use of animals in the EDSP. Therefore, it is essential that EPA develop a consistent and transparent basis for accepting OSRI. © 2013 Wiley Periodicals, Inc.

Statutory complexity disguises agency capture in Citizens Coal Council v. EPA

In Citizens Coal Council v. EPA, an en banc panel for the Sixth Circuit Court of Appeals considered a challenge to EPA regulations promulgated pursuant to the Clean Water Act (CWA). The EPA promulgated the regulations in an attempt to incentivize coal companies to remine once abandoned mine sites. Petitioners, two nonprofit environmental organizations, claimed that the regulations violated the Clean Water Act and Administrative Procedure Act by allowing coal companies to remine without adhering to any enforceable pollution limitations. The EPA countered that more remining would improve water quality at abandoned sites. The Sixth Circuit rejected Petitioners' claims, findingmore » that the EPA's regulations were reasonably consistent with the CWA's goal of restoring the integrity of the nation's waters. In so holding, the court struggled to understand the meaning of the CWA's complex procedural and technical language, and allowed the EPA to justify the rule based on the CWA's broad statement of purpose. Such superficial judicial review sets a dangerous precedent in environmental law, because it exacerbates the risk of agency capture. A captured agency promulgates regulations that benefit-industry, not the environment. Without the judiciary acting as a meaningful check against agency capture, the public loses a valuable tool in the fight against major-industrial polluters like the domestic coal industry. Citizens Coal Council therefore stands as a cautionary tale, a warning sign that the judiciary may be unable to identify agency capture where the regulations at issue are promulgated pursuant to a complex statute like the Clean Water Act.« less

The Integrated Risk Information System (IRIS) of the U.S. Environmental Protection Agency (EPA) has an important role in protecting public health. Originally it provided a single database listing official risk values equally valid for all Agency offices, and was an important tool for risk assessment communication across EPA. Started in 1986, IRIS achieved full standing in 1990 when it listed 500 risk values, the effort of two senior EPA groups over 5 years of monthly face-to-face meetings, to assess combined risk data from multiple Agency offices. Those groups were disbanded in 1995, and the lack of continuing face-to-face meetings meant that IRIS became no longer EPA's comprehensive database of risk values or their latest evaluations. As a remedy, a work group of the Agency's senior scientists should be re-established to evaluate new risks and to update older ones. Risk values to be reviewed would come from the same EPA offices now developing such information on their own. Still, this senior group would have the final authority on posting a risk value in IRIS, independently of individual EPA offices. This approach could also lay the groundwork for an all-government IRIS database, especially needed as more government Agencies, industries and non-governmental organizations are addressing evolving risk characterizations. The Substance Registry Services (SRS) is the authoritative resource for basic information about substances of interest to the U.S. EPA and its state and tribal partners. Substances, particularly chemicals, can have many valid synonyms. For example, toluene, methyl benzene, and phenyl methane, are commonly used names for the same chemical. EPA programs collect environmental data for this chemical using each of these names, plus others. This diversity leads to problems when a user is looking for programmatic data for toluene but is unaware that the data is stored under the synonym methyl benzene. For each substance, the SRS identifies the statutes, EPA programs, as well as organization external to EPA, that track or regulate that substance and the synonym used by that statute, EPA program or external organization. Besides standardized information for each chemical, such as the Chemical Abstracts Services name and the Chemical Abstracts Number and the EPA Registry Name (the EPA standard name), the SRS also includes additional information, such as molecular weight and molecular formula. Additionally, an SRS Internal Tracking Number uniquely identifies each substance, enabling cross-walking between synonyms. EPA is providing a large .ZIP file providing the SRS data in CSV format, and a separate small metadata file in XML containing the field names and definitions.

The draft policy addresses scientific ethical standards, communications with the public, the use of advisory committees and peer review, and professional development. The draft policy was developed by an ad hoc group of EPA senior staff and scientists in response to a December 2010 memorandum on scientific integrity from the White House Office of Science and Technology Policy. The agency is accepting public comments on the draft through 6 September; comments should be sent to osa.staff@epa.gov. In this Final Rule, EPA is amending both the Asbestos Worker Protection Rule (WPR) and the Asbestos-in-Schools Rule. The WPR amendment protects State and local government employees from the health risks of exposure to asbestos to the same extent as private sector workers by adopting for these employees the Asbestos Standards of the Occupational Safety and Health Administration (OSHA). The WPR's coverage is extended to State and local government employees who are performing construction work, custodial work, and automotive brake and clutch repair work. This final rule cross-references the OSHA Asbestos Standards for Construction and for General Industry, so that future amendments to these OSHA standards are directly and equally effective for employees covered by the WPR. EPA also amends the Asbestos-in-Schools Rule to provide coverage under the WPR for employees of public local education agencies who perform operations, maintenance, and repair activities. EPA is issuing this final rule under section 6 of the Toxic Substances Control Act (TSCA).

The US Environmental Protection Agency (EPA) AirNow program provides Air Quality Index (AQI) information to the public, decision-makers, researchers and the media (data and forecasts) mainly for ozone and PM2.5 (particles smaller than 2.5 μm in median diameter). EPA wants to provide the best information available to the public and integrating NASA satellite-derived surface PM2.5 concentrations with ground-level PM2.5 observations has proved promising. The AirNow Satellite Data Processor (ASDP) uses daily PM2.5 estimates and uncertainties derived from average Aqua and Terra MODerate resolution Imaging Spectrometer (MODIS) AOD in near-real-time over the United States and fuses the results with observed PM2.5 measurements to create several air quality products for evaluation. In addition to the description of the AirNow program and the AirNow ASDP, several case studies will be presented to show the value that NASA satellite information adds to maps of air quality.

The Remote Sensing Information Gateway was developed by the U.S. Environmental Protection Agency (EPA) to assist researchers in easily obtaining and combining a variety of environmental datasets related to air quality research. Current datasets available include, but are not limited to surface PM2.5 and O3 data, satellite derived aerosol optical depth , and 3-dimensional output from U.S. EPA's Models 3/Community Multi-scale Air Quality (CMAQ) modeling system. The presentation will include a demonstration that illustrates several scenarios of how researchers use the tool to help them visualize and obtain data for their work; with a particular focus on episode analysis related to biomass burning impacts on air quality. The presentation will provide an overview on how RSIG works and how the code has been—and can be—adapted for other projects. One example is the Virtual Estuary, which focuses on automating the retrieval and pre-processing of a variety of data needed for estuarine research. RSIG’s source codes are freely available to researchers with permission from the EPA principal investigator, Dr. Jim Szykman. RSIG is available to the community and can be accessed online at http://www.epa.gov/rsig. Once the JAVA policy file is configured on your computer you can run the RSIG applet on your computer and connect to the RSIG server to visualize and retrieve available data sets. The applet allows the user to specify the temporal/spatial areas of interest, and the types of data to retrieve. The applet then communicates with RSIG subsetter codes located on the data owners’ remote servers; the subsetter codes assemble and transfer via ordinary Internet protocols only the specified data to the researcher’s computer. This is much faster than the usual method of transferring large files via FTP and greatly reduces network traffic. The RSIG applet then visualizes the transferred data on a latitude-longitude map, automatically locating the data in the correct

EPA Pesticide Factsheets

To improve public health and the environment, the United States Environmental Protection Agency (EPA) collects information about facilities, sites, or places subject to environmental regulation or of environmental interest. Through the Geospatial Data Download Service, the public is now able to download the EPA Geodata Shapefile, Feature Class or extensible markup language (XML) file containing facility and site information from EPA's national program systems. The files are Internet accessible from the Envirofacts Web site (https://www3.epa.gov/enviro/). The data may be used with geospatial mapping applications. (Note: The files omit facilities without latitude/longitude coordinates.) The EPA Geospatial Data contains the name, location (latitude/longitude), and EPA program information about specific facilities and sites. In addition, the files contain a Uniform Resource Locator (URL), which allows mapping applications to present an option to users to access additional EPA data resources on a specific facility or site.

This web feature service contains location and facility identification information from EPA's Facility Registry Service (FRS) for the subset of facilities that link to the Toxic Release Inventory (TRI) System. TRI is a publicly available EPA database reported annually by certain covered industry groups, as well as federal facilities. It contains information about more than 650 toxic chemicals that are being used, manufactured, treated, transported, or released into the environment, and includes information about waste management and pollution prevention activities. FRS identifies and geospatially locates facilities, sites or places subject to environmental regulations or of environmental interest. Using vigorous verification and data management procedures, FRS integrates facility data from EPA's national program systems, other federal agencies, and State and tribal master facility records and provides EPA with a centrally managed, single source of comprehensive and authoritative information on facilities. Industrial Ethernet is a new technology for industrial network communications developed in recent years. In the field of industrial automation in China, EPA is the first standard accepted and published by ISO, and has been included in the fourth edition IEC61158 Fieldbus of NO.14 type. According to EPA standard, Field devices such as industrial field controller, actuator and other instruments are all able to realize communication based on the Ethernet standard. The Atmel AT91RM9200 embedded development board and open source embedded Linux are used to develop an information inquiry service system of EPA protocol based on embedded ARM Linux in this paper. The system is capable of designing an EPA Server program for EPA data acquisition procedures, the EPA information inquiry service is available for programs in local or remote host through Socket interface. The EPA client can access data and information of other EPA equipments on the EPA network when it establishes connection with the monitoring port of the server.

A series of activities have been conducted by a core group of EPA scientists from across the Agency. The activities were initiated in 2012 and the focus was to increase the reuse and interoperability of science software at EPA. The need for increased reuse and interoperability is linked to the increased complexity of environmental assessments in the 21st century. This complexity is manifest in the form of problems that require integrated multi-disciplinary solutions. To enable the means to develop these solutions (i.e., science software systems) it is necessary to integrate software developed by disparate groups representing a variety of science domains. Thus, reuse and interoperability becomes imperative. This report briefly describes the chronology of activities conducted by the group of scientists to provide context for the primary purpose of this report, that is, to describe the proceedings and outcomes of the latest activity, a workshop entitled “Workshop on Advancing US EPA integration of environmental and information sciences”. The EPA has been lagging in digital maturity relative to the private sector and even other government agencies. This report helps begin the process of improving the agency’s use of digital technologies, especially in the areas of efficiency and transparency. This report contributes to SHC 1.61.2.

This article discusses an 8-year, ongoing project that evaluates the Environmental Protection Agency's Superfund community involvement program. The project originated as a response to the Government Performance and Results Act, which requires federal agencies to articulate program goals, and evaluate and report their progress in meeting those goals. The evaluation project assesses how effective the Superfund community involvement program is in promoting public participation in decisions about how to clean up hazardous wastes at Superfund sites. We do three things in the article: (1) share our experience with evaluating an Agency public participation program, including lessons learned about methods of evaluation; (2) report evaluation results; and (3) address a number of issues pertaining to the evaluation of public participation in environmental decision-making. Our goal is to encourage more environmental managers to incorporate evaluation into their public participation programs as a tool for improving them. We found that written mail surveys were an effective and economical tool for obtaining feedback on EPA's community involvement program at Superfund sites. The evaluation focused on four criteria: citizen satisfaction with EPA information about the Superfund site, citizen understanding of environmental and human health risks associated with the site, citizen satisfaction with opportunities provided by EPA for community input, and citizen satisfaction with EPA's response to community input. While the evaluation results were mixed, in general, community members who were most informed about and involved in the cleanup process at Superfund sites generally were also the most satisfied with the community involvement process, and the job that EPA was doing cleaning up the site. We conclude that systematic evaluation provides meaningful and useful information that agencies can use to improve their public participation programs. However, there need to be

The United States Environmental Protection Agency's (US EPA) digital science "enterprise" plays a critical role in US EPA's efforts to achieve its mission to protect human health and the environment. This enterprise is an evolving cross-disciplinary research and development construct, with social and institutional dimensions. It has an active development community and produces a portfolio of digital science products including decision support tools, data repositories, Web interfaces, and more. Earth sciences and sustainable development organizations from around the world - including US government agencies - have achieved various levels of success in taking advantage of the rapidly-evolving digital age. Efficiency, transparency and ability to innovate are tied to an organization's digital maturity and related social characteristics. Concepts like participatory web, data and software interoperability, global technology transfer, ontological harmonization, big data, scaling, re-use and open science are no longer "new and emerging." They have emerged and - in some cases - are tied to US government directives. We assess maturity, describe future scenarios, discuss new initiatives and outline steps for better leveraging the information age to more effectively and efficiently achieve US EPA's mission. This asset includes the EPA Federal Agency Hazardous Waste Compliance Docket (Docket), which is required by Section 120(c) of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA). The Docket contains information reported to EPA by federal facilities that manage hazardous waste or from which hazardous substances, pollutants or contaminants have been or may be released. The Docket serves three major purposes:1. To identify all federal facilities that must be evaluated through the site assessment process to determine whether they pose a risk to human health and the environment sufficient to warrant inclusion on the National Priorities List (NPL); 2. To compile and maintain the information submitted to EPA on such facilities under the provisions listed in section 120(c) of CERCLA; and3. To provide a mechanism to make the information available to the public.The docket includes facilities which have provided information to EPA through documents such as reports under a Federal agency environmental restoration program, regardless of the absence of section 103 reporting. E-Docket is an internal business management tool that will improve the tracking and record keeping of information about facilities that have been identified as potential Docket sites. The Environmental Protection Agency (EPA) Office of Superfund Remediation and Technology Innovation (OSRTI) and the Nuclear Regulatory Commission (NRC) are responsible for implementing the 'Memorandum of Understanding Between the Environmental Protection Agency and the Nuclear Regulatory Commission: Consultation and Finality on Decommissioning and Decontamination of Contaminated Sites'. This paper provides a brief overview of the origin of the Memorandum of Understanding (MOU), the major features of the MOU, and how the MOU has been implemented site specifically. EPA and NRC developed the MOU in response to direction from the House Committee on Appropriations to EPA and NRC to work togethermore » to address the potential for dual regulation. The MOU was signed by EPA on September 30, 2002 and NRC on October 9, 2002. The two agencies had worked on the MOU since March 2000. While both EPA and NRC have statutory authority to clean up these sites, the MOU provides consultation procedures between EPA and NRC to eliminate dual regulation. Under the MOU, EPA and NRC identified the interactions of the two agencies for the decommissioning and decontamination of NRC-licensed sites and the ways in which those responsibilities will be exercised. Except for Section VI, which addresses corrective action under the Resource Conservation and Recovery Act (RCRA), this MOU is limited to the coordination between EPA, when acting under its CERCLA authority, and NRC, when a facility licensed by the NRC is undergoing decommissioning, or when a facility has completed decommissioning, and the NRC has terminated its license. EPA believes that implementation of the MOU between the two agencies will ensure that future confusion about dual regulation does not occur regarding the cleanup and reuse of NRC-licensed sites. NRC and EPA have so far exchanged MOU consultation letters on eight NRC-licensed sites. EPA has responded to each consultation request with a letter expressing its views on

Computational toxicology combines data from high-throughput test methods, chemical structure analyses and other biological domains (e.g., genes, proteins, cells, tissues) with the goals of predicting and understanding the underlying mechanistic causes of chemical toxicity and for predicting toxicity of new chemicals and products. A key feature of such approaches is their reliance on knowledge extracted from large collections of data and data sets in computable formats. The U.S. Environmental Protection Agency (EPA) has developed a large data resource called ACToR (Aggregated Computational Toxicology Resource) to support these data-intensive efforts. ACToR comprises four main repositories: core ACToR (chemical identifiers and structures, and summary data on hazard, exposure, use, and other domains), ToxRefDB (Toxicity Reference Database, a compilation of detailed in vivo toxicity data from guideline studies), ExpoCastDB (detailed human exposure data from observational studies of selected chemicals), and ToxCastDB (data from high-throughput screening programs, including links to underlying biological information related to genes and pathways). The EPA DSSTox (Distributed Structure-Searchable Toxicity) program provides expert-reviewed chemical structures and associated information for these and other high-interest public inventories. Overall, the ACToR system contains information on about 400,000 chemicals from 1100 different sources. The entire system is built using open source tools and is freely available to download. This article is a case study on how administrative agencies interact with each other in cases of shared regulatory jurisdiction. The theoretical literature on the topic of overlapping jurisdiction both (1) makes predictions about how agencies are expected to behave when they share jurisdiction, and (2) in recent iterations argues that overlapping jurisdiction can confer unique policymaking benefits. Through the lens of that theoretical literature, this article examines the relations between the Food and Drug Administration (FDA) and the Environmental Protection Agency (EPA) regarding the public health risks posed by mercury in fish. It concludes that the FDA-EPA case study (1) corroborates the extant theoretical accounts of how agencies behave in cases of overlapping jurisdiction, (2) supports the conclusion of the recent scholarship that overlapping jurisdiction can confer unique policy benefits, and (3) reveals a few wrinkles not given adequate treatment in the extant literature.

This web feature service contains location and facility identification information from EPA's Facility Registry Service (FRS) for the subset of facilities that link to the Permit Compliance System (PCS) or the National Pollutant Discharge Elimination System (NPDES) module of the Integrated Compliance Information System (ICIS). PCS tracks NPDES surface water permits issued under the Clean Water Act. This system is being incrementally replaced by the NPDES module of ICIS. Under NPDES, all facilities that discharge pollutants from any point source into waters of the United States are required to obtain a permit. The permit will likely contain limits on what can be discharged, impose monitoring and reporting requirements, and include other provisions to ensure that the discharge does not adversely affect water quality. FRS identifies and geospatially locates facilities, sites or places subject to environmental regulations or of environmental interest. The application is relatively easy to use and builds on the same mapping model as Google, Bing, MapQuest and other commonly used mapping interfaces. EPA Recovery Mapper tracks each award made by each program and gives basic Quick Facts information for each award including award name, location, award date, dollar amounts and more. Data Summaries for each EPA program or for each state are provided displaying dollars for Total Awarded, Total Received (Paid), and Total Jobs This Quarter by Recovery for the latest quarter of data released by Recovery.gov. The data are reported to the government and EPA four times a year by the award recipients. The latest quarterly report will always be displayed in the EPA Recovery Mapper. In addition, the application provides many details about each award. Users will learn more about how to access and interpret these data later in this document. Data shown in the EPA Recovery Mapper are derived from information reported back to FederalReporting.gov from the recipients of Recovery Act funding. EPA

The US Environmental Protection Agency removed a restrictive evaporative index requirement on the Clean Air Act waiver which had been granted to E.I. DuPont de Nemours and Company. On January 17, 1985, EPA granted DuPont a waiver to produce an unleaded gasoline/methanol blend, which contains 5% methanol and 2.5% cosolvent alcohols, provided producers did not exceed an evaporative index designed to limit the release of vapors to the atmosphere. The reconsideration came after a petition by the Oxygenated Fuels Association (OFA) and after EPA reexamined the relevant data. Originally EPA said it did not think the ASTM Standard D439 wasmore » acceptable for controlling the volatility of the methanol blend, because most gasoline being sold actually had a lower volatility. EPA's more recent information, however, shows that volatility levels in commercial gasoline have been rising and are near ASTM's D439 standard. Therefore, applying the ASTM standard to the DuPont blend will mean that evaporative emissions from vehicles using the DuPont blend will be no higher than those from vehicles using other gasolines. Other conditions of the waiver are discussed. These include the use of specific corrosion inhibitors, and 99.85% purity level of methanol. 1 table.« less
