Large scale Concentrated Solar Power (CSP) plants need large plots of land with very high solar resource and thus are often deployed in desert areas which are usually owned by the state or a municipal authority. This study discusses the implication and practices of land lease policies with regards to CSP development. The strategy followed on a land lease is examined by definition on a case-specific basis and this text is by no means exhaustive with regards to its content. The study also discusses the pricing of land in various cases, presents the governing types of land lease and their effect on the economic performance of hypothetical CSP projects under various cases.

Pursuant to the Geothermal Steam Act of 1970 and the regulations published on December 21, 1973, the first Federal geothermal competitive lease sale was held on January 22, 1974, by the Department of the Interior, offering 33 tracts totalling over 50,000 acres in three Known Geothermal Resource Areas in California. On January 1, 1974, Federal lands outside Known Geothermal Resource Areas were opened to noncompetitive lease applications, of which, 3,763 had been received by June 1, 1974. During fiscal year 1974, a total of 22 competitive leases had been issued in California and Oregon. The principal components in the Department involved in the leasing program are the Geological Survey and the Bureau of Land Management. The former has jurisdiction over drilling and production operations and other activities in the immediate area of operations. The latter receives applications and issues leases and is responsible for managing leased lands under its jurisdiction outside the area of operations. The interrelationships of the above agencies and the procedures in the leasing program are discussed.

Despite the Obama administration's efforts to make millions of acres of public lands available for oil and gas development, most of the acreage onshore and offshore of the contiguous United States remains idle, according to “Oil and gas lease utilization, onshore and offshore,” a 15 May report issued by the Department of the Interior (DOI). The report, which is being disputed by industry representatives, notes that 72% of the nearly 36 million leased offshore acres currently are inactive and that 50.6% of onshore leased acres (about 20.8 million acres) also are idle. “As part of the Obama administration's all-of- the-above energy strategy, we continue to make millions of acres of public lands available for safe and responsible domestic energy production on public lands and in federal waters,” said DOI secretary Ken Salazar. “These lands and waters belong to the American people, and they expect those energy supplies to be developed in a timely and responsible manner and with a fair return to taxpayers. We will continue to encourage companies to diligently bring production online quickly and safely on public lands already under lease.”

Tables summarize the legal status of federal lands with respect to access for oil and gas exploration and production and a state-by-state description of the acreage formally withdrawn from the operation of the mineral leasing laws. There is likely some overlap between land currently under lease and that which is formally withdrawn because of pre-existing rights, a situation which also exists with land pending wilderness designation. The report examines various types of withdrawal authority: general; for the conservation of minerals; for scenic, historic, or recreational values; to protect fish and wildlife; to protect wild and natural areas; for military uses;more » for multiple use; and lands under lease. The paper concludes that closure of land to mineral leasing has made access to a large portion of federal land impossible. Until information is available on the extent of oil and gas resources, the true significance of the access status will remain unknown. 22 tables.« less

The US Department of Energy (DOE) has prepared a programmatic environmental assessment (EA) of the proposed action to continue leasing withdrawn lands and DOE-owned patented claims for the exploration and production of uranium and vanadium ores. The Domestic Uranium Program regulation, codified at Title 10, Part 760.1, of the US Code of Federal Regulations (CFR), gives DOE the flexibility to continue leasing these lands under the Uranium Lease Management Program (ULMP) if the agency determines that it is in its best interest to do so. A key element in determining what is in DOE`s ``best interest`` is the assessment ofmore » the environmental impacts that may be attributable to lease tract operations and associated activities. In August 2006, the Aboriginal Land Rights (Northern Territory) Amendment Bill 2006 (Cwlth) was passed into law, introducing, among other things, a system of 99-year leases over Indigenous townships. The leasing scheme will diminish the control that traditional owners previously exercised over their lands. This is at odds with research indicating that control over land is a positive influence on Indigenous health.
