  1. NRC (Nuclear Regulatory Commission) staff evaluation of the General Electric Company Nuclear Reactor Study (''Reed Report'')

    In 1975, the General Electric Company (GE) published a Nuclear Reactor Study, also referred to as ''the Reed Report,'' an internal product-improvement study. GE considered the document ''proprietary'' and thus, under the regulations of the Nuclear Regulatory Commission (NRC), exempt from mandatory public disclosure. Nonetheless, members of the NRC staff reviewed the document in 1976 and determined that it did not raise any significant new safety issues. The staff also reached the same conclusion in subsequent reviews. However, in response to recent inquiries about the report, the staff reevaluated the Reed Report from a 1987 perspective. This re-evaluation, documented in this staff report, concluded that: (1) there are no issues raised in the Reed Report that support a need to curtail the operation of any GE boiling water reactor (BWR); (2) there are no new safety issues raised in the Reed Report of which the staff was unaware; and (3) although certain issues addressed by the Reed Report are still being studied by the NRC and the industry, there is no basis for suspending licensing and operation of GE BWR plants while these issues are being resolved.

    The Panel finds that the first criterion, pertaining to whether the accident caused a discharge of radioactive material or levels of radiation offsite as defined in 10 CFR 140.84, has not been met. It further finds that there is presently insufficient information to support any definitive finding as to whether or not the second criterion, relating to damage to persons or property offsite as defined in 10 CFR 140.85, has been met. Since the Panel has not found that both criteria have been met, it recommends that the Commission determine that the accident at Three Mile Island did not constitute an extraordinary nuclear occurrence.

    Gregory Jaczko, chair of the U.S. Nuclear Regulatory Commission (NRC), announced on 21 May that he will resign once his successor is appointed. His resignation will end a stormy 3-year chairmanship during which he was accused of bullying NRC staff, lying to Congress, and being too close to the political process. Jaczko formerly served as science advisor to Sen. Harry Reid (D-Nev.). As NRC chair, Jaczko halted the commission's license application review for storing nuclear waste at Nevada's Yucca Mountain. In addition, during his NRC tenure the commission focused on identifying and implementing lessons from Japan's Fukushima Daiichi reactors damaged by the 2011 tsunami.

    In the US, the current regulatory framework was developed in the 1970s when general wall thinning was the dominant degradation mechanism; and, as a result of changes in the forms of degradation being observed and improvements in inspection and tube repair technology, the regulatory framework needs to be updated. Operating experience indicates that the current U.S. requirements should be more stringent in some areas, while in other areas they are overly conservative. To date, this situation has been dealt with on a plant-specific basis in the US. However, the NRC staff is now developing a proposed steam generator rule as a generic framework for ensuring that the steam generator tubes are capable of performing their intended safety functions. This paper discusses the current U.S. regulatory framework for assuring steam generator (SG) tube integrity, the need to update this regulatory framework, the objectives of the new proposed rule, the US Nuclear Regulatory Commission (NRC) regulatory guide (RG) that will accompany the rule, how risk considerations affect the development of the new rule, and some outstanding issues relating to the rule that the NRC is still dealing with.

    The Nuclear Regulatory Commission (NRC) is amending its regulations regarding hospitals licensed to use radioactive byproduct material for human applications. Currently, such a license requires that the hospital have a Medical Isotopes Committee to review clinical aspects of the use of radioactive materials within the hospital. The amendment requires instead a Radiation Safety Committee with a simplified membership that will focus on the radiation safety of workers and the general public. The rule change acknowledges the Food and Drug Administration's role in regulating the safety and effectiveness of radioactive drugs with respect to the patient.     In the face of sweeping changes in utility markets and regulatory practices, public utility commissions are being forced to change in fundamental ways--to substantially transform themselves rather than to make only incremental changes in their operations. Managing this process of radical change is complicated by the fact that for the foreseeable future some portions of utility markets (e.g., water utilities) will function much as they have before. Some envision commissions in the future that are more externally focussed, that rely more on dispute resolution than adjudicatory proceedings, that concentrate on identifying and understanding competitive markets, that are more automated, and that are more likely to question old assumptions and definitions. This report identifies the considerations commissions might apply for identifying what mix of skills or fields of experise should compromise the technical staff. Factors are also identified which point towards a sectoral arrangement of staff and those factors which point toward a functional approach.

    The Federal Energy Regulatory Commission (Commission) stores furniture, automated data processing equipment, and office supplies in a warehouse located in Landover, Maryland. The annual operating cost for this space (25,830 square feet) approximates $455,000-$245,000 in lease costs and $210,000 for contractor personnel. The purpose of the audit was to assess the effectiveness of the Commission`s use of warehouse space. The specific audit objective was to determine whether the Commission was minimizing the need for warehouse space for the storage of office supplies, furniture, and equipment. Federal Property Management Regulations and prudent business practices require Government agencies to minimize their need for space. More space was being leased than needed because Commission officials understood that they were obligated by terms of the lease to -pay for the space until March 31, 2002. We found, however, that there was a misunderstanding by officials, and that the Commission could at any time relinquish warehouse space by giving 120 days notice. Because of this misunderstanding and the recent relocation of the Commission to a newly furnished facility, about 16,000 square feet of warehouse space was being used to store furniture and equipment that was no longer needed by the Commission. An additional 6,000 square feet of space was used to store office supplies instead of using a more frequent ordering program that would reduce space requirements.

The purpose of this paper is as follows: 1. present a change in regulatory staff position regarding the requirements of 10 CFR 50, Appendix A, General Design Criteria 28 (GDC28) and changes in regulatory guidance provided in Regulatory Guide (RG) 1.77, RG 1.195, RG 1.183, and previous versions of NUREG-0800 SRP; 2. describe the implementation strategy and schedule for both new reactors and the existing fleet; and 3. encourage licensees and nuclear fuel vendors to (1) develop improved core physics analytical methods to allow a more deliberate transition to the new fuel cladding failure criteria and (2) develop the technical basis to address the new core coolability criteria.     In June 1995, the New York Public Service Commission (NYPSC) released a Staff investigation of Orange and Rockland Utilities, Inc. (O&R). The primary focus of the Staffs investigation was the Corporate Policy and External Affairs Department, a restricted disbursements account, the Internal Auditing Department, and O&R officer malfeasance. The Staffs` investigation uncovered widespread, alleged instances of lax internal controls, unethical and illegal actions, and lavish officer behavior. In addition, the Staff investigated O&R`s internal control and purchasing functions.     The Waste Isolation Pilot Plant (WTPP) is a one of its kind research and development facility operated by the Department of Energy, Carlsbad Area Office. Located in southeastern New Mexico, the WTPP is designed to demonstrate the safe, permanent disposal of transuranic (TRU) radioactive nuclear waste, accumulated from 40 years of nuclear weapons production. Before the waste can be disposed of, it must first be safely transported from generator storage sites to the WIPP. To accomplish this, the TRUPACT-II was designed and fabricated. This double containment, non-vented waste packaging successfully completed a rigorous testing program, and in 1989 received a Certificate of Compliance (C of C) from the Nuclear Regulatory Commission (NRC). Currently, the TRUPACT-II is in use at Idaho National Engineering Laboratory to transport waste on site for characterization. The DOE/CAO is responsible for maintaining the TRUPACT-II C of C. The C of C requires performance of nondestructive examination (NDE), e.g., visual testing (VT), dimensional inspections, Liquid Dye Penetrant testing (PT), and Helium Leak Detection (HLD). The Waste Isolation Division (WID) uses HLD for verification of the containment integrity. The following HLD tests are performed on annual basis or when required, i.e. repairs or component replacement: (1) fabrication verification leak tests on both the outer containment vessel (OCV) and the inner containment vessel (ICV); (2) assembly verification leak tests on the OCV and ICV upper main o-rings; and (3) assembly verification leak tests on the OCV and the ICV vent port plugs. These tests are addressed in detail as part of this presentation.

    Regulators operate in a constantly changing environment characterized by new technologies, increased competition in regulated fields, and heightened environmental awareness. In such an environment, they must maintain a balance between the customers` interest in low rates for safe and reliable utility service, and the need to maintain solvent utilities that have the ability to attract capital at a reasonable cost. Concentration on either end of that balance by a regulatory agency during any particular period brings almost inevitably, charges of unfairness by champions representing the other side of the balance. If, for example, a Public Utilities Commission (PUC) sees the need to concentrate on the financial health of the utilities under its jurisdiction, consumers will likely feel the sting of rate increases. In the author`s view, Capture Theory, a theory of regulatory behavior which held sway for decades, resulted from scholars viewing regulatory agencies during the part of a cycle of regulation, when the concentration was on that side of the issue. But even while the various forms of Capture Theory were ascendant in the mid-1970`s, events in the field of public utility regulation were serving to refute them all. {open_quotes}Instead of having the happy task of presiding over a process that seemed to bestow benefits upon everyone, regulators in the 1970`s were faced with the unpleasant duty of allocating misery among rival and intensely vocal groups.{close_quotes}

    Nuclear power plant construction regulations issued after the Three Mile Island accident have affected 11 plants, only five of which remain committed to construction although all are in jeopardy. A review of the cancellations identifies prohibitive costs and financing problems due to the new regulations as the deciding factor. There are three classes of new rules: a probabilistic risk assessment within two years of receiving a construction permit, stronger containment structures, and more-sophisticated hydrogen-control features. The Nuclear Regulatory Commission (NRC) now appears to be joining the administration's goal of streamlining regulations, particularly in the areas of backfitting and final-design-approval rules based on standardization. Some observers are critical of the standardization approach because of plant complexity, but they foresee efforts toward simplification as manufacturers plan designs for reference approval. (DCK)

    Following the hydraulic rupture of a UF cylinder at the Sequoyah Fuels Facility on January 4, 1986, the US Nuclear Regulatory Commission's (NRC's) executive director for operations (EDO) established an augmented inspection team to investigate the accident. The investigation is reported in NUREG-1179. The EDO then formed a lessons-learned group to report on the action NRC might reasonably take to prevent similar accidents. The group's recommendations are reported in NUREG-1198. In addition, the EDO formed an independent materials safety regulation review study group (MSRRSG) to review the licensing and inspection program for NRC-licensed fuel cycle and materials facilities. During the same period of time that the MSRRSG report was being prepared and evaluated, the staff undertook an independent action to assess operational safety at each of the 12 major fuel facilities licensed by the NRC. The facilities included the 2 facilities producing uranium hexafluoride, the 7 facilities producing commercial nuclear reactor fuel, and the 3 facilities producing naval reactor fuel. The most important safety issues identified as needing attention by licensees were in the areas of fire protection, chemical hazards identification and mitigation, management controls or quality assurance, safety-related instrumentation and maintenance, and emergency preparedness.

The first requirement is that the Commission review automatic adjustment clauses in utility rate schedules to examine whether the clauses effectively provide incentives for efficient use of resources and also whether the clauses reflect only those costs that are either subject to periodic fluctuations or not susceptible to precise determinations in rate cases prior to the time the costs are incurred. The second requirement is that the Commission review the practices of each public utility under automatic adjustment clauses to insure efficient use of resources under such clauses. In response to these requirements, the Commission instituted a study and a staff investigation to examine the matters specifically identified in the Act. This report describes the progress that has been made in the study during the first two years since the passage of the Act related to the issues involved. The principal types of automatic adjustment clauses appearing in rate schedules subject to FERC jurisdiction are described and the extent of use of the types of clauses is indicated. The nature and results of the efforts made to analyze incentive effects, variability and predictability of certain costs, and the fuel procurement practices of utilities as related to automatic adjustment clauses are discussed. Preliminary staff conclusions from the review and analysis effort are presented.

    Maintenance and inspection at nuclear power plants consumes a large portion of a utility`s resources, making resource allocation for such procedures vital. The NRC Maintenance Rule, due to be implemented in July of 1996, requires utilities to select systems, structures, and components (SSCS) important to safety and to develop a monitoring program to ensure that these SSCs are capable of fulfilling their intended functions. In light of these concerns, two ratios were developed to compare the risk significance of individual components with the amount of plant staff time, or burden, associated with inspecting the component. These risk/burden ratios point out existing disparities between current inspection practices and safety concerns. These ratios can be used to develop new inspection schedules constituting a more equitable risk to burden distribution.

    At the 8th Symposium on Space Nuclear Power Systems, 6-10 January 1990, the Union of Soviet Socialist Republics displayed a TOPAZ II thermionic space nuclear reactor. Underlying that exhibition was a regulatory quagmire created by a decision of the Nuclear Regulatory Commission that an import license was required to bring the device into the United States, and that an amendment to their regulations governing exports was required to return the device to the Soviet Union latter that summer. This paper briefly reviews the jurisdictional issue of how the Nuclear Regulatory Commission exerted its authority over the TOPAZ II reactor system, as well as the manner in which the import and export licensing actions were accomplished. In sum, the paper offers an independent interpretation of the applicable import and export regulations, and concludes that the Nuclear Regulatory Commission likely need not have exercised its import jurisdiction, and notwithstanding the initial assumption of jurisdiction, an export license likely could have been issued without an amendment to the then existing regulations.

    This paper is in response to the US Nuclear Regulatory Commission (NRC) ten questions posed at the Modeling Workshop held November 13 and 14, 1997. The ten questions were developed in advance of the workshop to allow model developers to prepare a presentation at the Workshop. This paper is an expanded version of the Multimedia Environmental Pollutant Assessment System (MEPAS) presentation given at the Modeling Workshop by Pacific Northwest National Laboratory (PNNL) staff. This paper is organized by the ten questions asked by the NRC, each section devoted to a single question. The current version of methodology is MEPAS 3.2 (NRC 1997) and the discussion in this paper will pertain to that version. In some cases, MEPAS 4.0, which is currently being developed under the Framework for Risk Analysis in Multimedia Environmental Systems (FRAMES) (Whelan et al. 1997), will be referenced to inform the reader of potential capabilities in the near future. The commission's qualitative goals state that individual members of the public should be provided a level of protection from the consequences of nuclear power plant operation such that they bear no significant additional risk to life and health, and societal risks to life and health from nuclear power should be comparable to or less than the risks of generating electricity by viable competing technologies and should not be a significant addition to other societal risks.     This is the 42nd volume of issuances of the U.S. Nuclear Regulatory Commission (NRC) and its Atomic Safety and Licensing Boards, Administrative Law Judges, and Office Directors. This book is a reprinting, containing corrections of numerous printing errors in a previously distributed book. It covers the period from July 1, 1995 to December 31, 1995. Atomic Safety and Licensing Boards conduct adjudicatory hearings on applications to construct and operate nuclear power plants and related facilities, and issue initial decisions which, subject to internal review and appellate procedures, become the final Commission action with respect to those applications. The hardbound edition of the Nuclear Regulatory Commission Issuances is a final compilation of the monthly issuances. It includes all of the legal precedents for the agency within a 6-month period.     We have completed an inspection of the Federal Energy Regulatory Commission's (FERC) Daycare Center (Center). The purpose of the inspection was to review for efficiency, economy and compliance with laws and regulations, FERC's establishment and operation of the Center. The inspection objectives were to review: (1) FERC's compliance with Federal laws and requirements of the General Services Administration and the District of Columbia; (2) the source and amount of funds for establishing and operating the Center; and (3) the organizational relationships between FERC, the Center and the contractor operating the Center.

    The major objective of this report is to help the US Nuclear Regulatory Commission (NRC) in its regulatory mission, particularly with respect to improving the use of cost-benefit analysis and the economic evaluation of resources within the NRC. The objectives of this effort are: (1) to identify current and future NRC requirements (e.g., licensing) for valuing nonmarket goods; (2) to identify, highlight, and present the relevant efforts of selected federal agencies, some with over two decades of experience in valuing nonmarket goods, in this area; and (3) to review methods for valuing nonmarket impacts and to provide estimats of their magnitudes. Recently proposed legislation may result in a requirement for not only more sophisticated valuation analyses, but more extensive applications of these techniques to issues of concern to the NRC. This paper is intended to provide the NRC with information to more efficiently meet such requirements.
