Aleksandr Solzhenitsyn, The First Circle When authors submit an article for publication, most publishers will ask for a signature from the author on a copyright form. The relationship between an author and the publisher is then a partnership but one that many authors are reluctant to enter into. After all, why should a publisher take copyright from an author of an article when the author had the idea and has done all the hard work for the content of the article? In response to this question, publishers will generally claim that copyright transfer agreements protect authors from copyright infringements such as plagiarism, libel and unauthorised uses as well as protecting the integrity of the article. Copyright in the UK was originally concerned with preventing the unlawful copying of printed material in the 17th century in response to the then new technology of book printing. The first copyright act in the UK, the Statute of Anne in 1710, was subtitled 'An Act for the Encouragement of Learning', and granted privileges and monopolies to book printers. Since then, copyright law has evolved to incorporate many forms of communication, including photography, film, music, computers, engraving, designs on t-shirts and digital technology among other forms of media. The most recent act in the UK is the Copyright, Designs and Patents Act 1988. While copyright covers an author's right to copy, distribute and revise the work, it does not protect ideas--just their fixation or expression.   9. The association between exaggeration in health related science news and academic press releases: retrospective observational study

    Objective To identify the source (press releases or news) of distortions, exaggerations, or changes to the main conclusions drawn from research that could potentially influence a reader’s health related behaviour. Design Retrospective quantitative content analysis. Setting Journal articles, press releases, and related news, with accompanying simulations. Sample Press releases (n=462) on biomedical and health related science issued by 20 leading UK universities in 2011, alongside their associated peer reviewed research papers and news stories (n=668). Main outcome measures Advice to readers to change behaviour, causal statements drawn from correlational research, and inference to humans from animal research that went beyond those in the associated peer reviewed papers. Results 40% (95% confidence interval 33% to 46%) of the press releases contained exaggerated advice, 33% (26% to 40%) contained exaggerated causal claims, and 36% (28% to 46%) contained exaggerated inference to humans from animal research. When press releases contained such exaggeration, 58% (95% confidence interval 48% to 68%), 81% (70% to 93%), and 86% (77% to 95%) of news stories, respectively, contained similar exaggeration, compared with exaggeration rates of 17% (10% to 24%), 18% (9% to 27%), and 10% (0% to 19%) in news when the press releases were not exaggerated. Odds ratios for each category of analysis were 6.5 (95% confidence interval 3.5 to 12), 20 (7.6 to 51), and 56 (15 to 211). At the same time, there was little evidence that exaggeration in press releases increased the uptake of news. Conclusions Exaggeration in news is strongly associated with exaggeration in press releases. Improving the accuracy of academic press releases could represent a key opportunity for reducing misleading health related news. PMID:25498121

    Amidst continuing confusion on what constitutes ‘fair use’ photocopying of copyrighted material, the first legal action taken against an academic institution and individual professors for alleged violations of copyright law has been partly settled. Nine book publishers charged last December that New York University (NYU), several of its faculty, and an off-campus commercial photocopying establishment had violated copyright law. The action against NYU and its faculty was settled out of court. The portion of the lawsuit directed against Unique Copy Center will continue, however.

    Adapting the Marsh (1990) Academic Self-Description Questionnaire (ASDQ), this study examined the academic self-concept of students in a school of commerce in Hong Kong (N = 212). Confirmatory factor analysis found that students clearly distinguished among self-concept constructs in English, Chinese, Math and Statistics, Economics, and Principles of Accounting, and each of these constructs was highly associated with a global Academic self-concept construct, reflecting the validity of each construct in measuring an academic component of self-concept. Domain-specific self-concepts were more highly related with students' intention of course selection in corresponding areas than in nonmatching areas, further supporting the multidimensionality of the students' academic self-concept. Students' self-concepts in the five curriculum domains can be represented by the global Academic self-concept, supporting the hierarchical structure of students' academic self-concept in an educational institution with a specific focus, such as commercial studies.     Copyright law concerns the rights of an individual to make copies of published works. Changes in technology, be they the introduction of the printing press or the proliferation of photocopy machines, affect how these "copy rights" are interpreted. The transmission of published works over digital networks and the introduction of new and relatively inexpensive ways to conduct commerce over the same networks will have a profound effect on how medical school faculty protect their own published works and how they make use of the published works of others. When copyright law moves from tangible objects such as books and journals to intangible bits carried over a network, many historic notions about the nature of publications and libraries will be called into question. The authors review the history of copyright law and some basic concepts of copyright, particularly "first sale" and "fair use." They also discuss the effects past technological changes have had on the law and on the often-competing concerns of authors, publishers, and readers/users. Finally, they discuss the implications for medical schools of digital publications, digital libraries, and the proposed changes to copyright law. PMID:8540964

    Among the most controversial of current information technology projects on the Internet is the Google Book Search project. Google, owner and operator of a leading Internet search engine, has contracted with a variety of libraries to scan the contents of the books held in these libraries, many of which are under current copyright. From the scanned images, Google uses search engine technology to map the relationship of words in the scanned text to the other words in the text. Access to this index is provided via an online interface. However, Google has not sought the permission of copyright holders, and book publishers through their professional association have sued Google for copyright infringement, charging that the scanning process creates unauthorized digital copies of many copyrighted works. While Google has asserted a defense to these claims under the doctrine of fair use, a far more difficult and more far-reaching issue for database technologies is the legal status of the index created by Google, which maps the positions of the words in the books. This metadata is not technically a “copy” of the books in question, but the books can be recreated from such metadata. The ownership and control of such metadata is becoming an increasingly contested question in database construction, and the resolution of this question presents a difficult but critically important problem of copyright doctrine and policy in the United States and around the world.

    This level sets the stage for the design philosophy called “Triadic Game Design” (TGD). This design philosophy can be summarized with the following sentence: it takes two to tango, but it takes three to design a meaningful game or a game with a purpose. Before the philosophy is further explained, this level will first delve into what is meant by a meaningful game or a game with a purpose. Many terms and definitions have seen the light and in this book I will specifically orient at digital games that aim to have an effect beyond the context of the game itself. Subsequently, a historical overview is given of the usage of games with a serious purpose which starts from the moment we human beings started to walk on our feet till our contemporary society. It turns out that we have been using games for all kinds of non-entertainment purposes for already quite a long time. With this introductory material in the back of our minds, I will explain the concept of TGD by means of a puzzle. After that, the protagonist of this book, the game Levee Patroller, is introduced. Based on the development of this game, the idea of TGD, which stresses to balance three different worlds, the worlds of Reality, Meaning, and Play, came into being. Interested?     The chapter provides a broad overview to the topic of search engine liability for copyright infringement. In doing so, the chapter examines some of the key copyright law principles and their application to search engines. The chapter also provides a discussion of some of the most important cases to be decided within the courts of the United States, Australia, China and Europe regarding the liability of search engines for copyright infringement. Finally, the chapter will conclude with some thoughts for reform, including how copyright law can be amended in order to accommodate and realise the great informative power which search engines have to offer society.

    An important victory for the financial health and future of scientific journals was won July 23 when Judge Pierre Leval of the Federal District Court in New York handed down his decision on the copyright infringement suit, American Geophysical Union, et al. v. Texaco Inc. Leval ruled that profit-making companies cannot photocopy copyrighted journal articles without permission and without compensating the copyright holder.The class action suit was brought in 1985 by AGU and six other scientific publishers on behalf of 8500 publishers worldwide who make their titles available for legal copying under licenses granted by the Copyright Clearance Center, Inc. This licensing system was designed in cooperation with major corporations to facilitate compliance with the 1976 Copyright Act. Although more than 200 companies now use the center, some corporations, such as Texaco, have not. The suit was initiated to force compliance with copyright law. The current decision is very important because it establishes legal precedents on the “fair use” issue.

    Dry pressing of technical ceramics is a fundamental method of producing high-quality ceramic components. The goals of dry pressing technical ceramics are uniform compact size and green density, consistent part-to-part green density and defect-free compact. Dry pressing is the axial compaction of loosely granulated dry ceramic powders (< 3% free moisture) within a die/punch arrangement. The powder, under pressure, conforms to the specific shape of the punch faces and die. Powder compaction occurs within a rigid-walled die and usually between a top and bottom punch. Press configurations include anvil, rotary, multiple-punch and multiple-action.

    Objective: This paper presents the results of data gathered on copyright questions asked at an academic health sciences library. Methods: Collected data include questioner's status or discipline, the subject of the questions, the types of activities that the questioners were engaged in, the communication mode, and the length of time it took to answer the questions. Results: Overall results showed most questions were about permissions. Staff asked the most questions, followed by faculty and students. Conclusions: Copyright education is needed at universities, and further analysis of queries will determine the direction of the education. PMID:24860269

  19. Effect of Students' After-School Activities on Teachers' Academic Expectancies.

    Teacher expectancies can have an impact on students' academic achievement. These expectancies can be based on diverse student characteristics, only one of which is past academic performance. The present study investigated three student individual differences that teachers may use when forming academic expectancies: the sex of the student, the family socioeconomic status (SES) of the student, and the student's after-school activities. Results indicated teachers held higher grade, graduation, and college attendance expectancies for females than for males and for middle-SES than low-SES students. Also, students who participated in extracurricular activities were expected to achieve more academically than either students who were employed after school or who did nothing after school. The latter two groups did not elicit different teacher expectancies. Interactions revealed that (a) lowest expectations were held for low-SES males who did nothing after school and (b) the difference in graduation expectancies between the SES groups was only half as great for students who took part in extracurricular activities than it was for students who had no involvements after school or who had jobs.     Limited by the characters of GIS vector data, such as variety and complexity of expression, universality, mass, disorder and pretty good privacy, etc., the traditional copyright protection methods for image and audio productions cannot be applied into GIS vector data productions directly. In this paper, a solution to copyright protection of GIS vector data productions is proposed. Firstly, information characteristics, data organization and storage characteristics and attack characteristics of GIS vector data are comprehensively analyzed. Secondly, based on hash, file filter driver, dynamic encryption and decryption, the key techniques including zero-watermarking generation, access control, and data content protection are described. Finally, a copyright protection frame of GIS vector data is put forward.

    This study is based on analysis of copyright policies and 26 interviews with science and engineering faculty at three research universities on the topic of copyright beliefs, values, and practices, with emphasis on copyright of instructional materials, courseware, tools, and texts. Given that research universities now emphasize increasing external revenue flows through marketing of intellectual property, we expected copyright to follow the path of patents and lead to institutional emphasis of policies and practices that enhanced universities' intellectual property portfolios, accompanied by an increase in copyrighting by professors. Although this pattern occurred with regard to institutions, professors offered a more varied pattern, with some fully participating in commercialization of copyright and embracing entrepreneurial values, while others resisted or subverted commercial activity in favor of traditional science and engineering values.     The arms race between copyright agencies and P2P users is an ongoing and evolving struggle. On the one hand, content providers are using several techniques to stealthily find unauthorized distribution of copyrighted work in order to deal with the problem of Internet piracy. On the other hand, P2P users are relying increasingly on blacklists and anonymization methods in order to avoid detection. In this work, we propose a number of techniques to reveal copyright monitors' current approaches and evaluate their effectiveness. We apply these techniques on data we collected from more than 2.75 million BitTorrent swarms containing 71 million IP addresses. We provide strong evidence that certain nodes are indeed copyright monitors, show that monitoring is a world-wide phenomenon, and devise a methodology for generating blacklists for paranoid and conservative P2P users.

    Today, users themselves are becoming subjects of content creation. The fact that blog, wiki, and UCC have become very popular shows that users want to participate to create and modify digital content. Users who participate in composing content also want to have their copyrights on their modification parts. Thus, a copyright protection system for the content which can be modified by multiple users is required. However, the conventional DRM (Digital Rights Management) systems like OMA DRM are not suitable for the modifiable content because they do not support the content created and modified by different users. Therefore in this paper, we propose a new copyright protection system which allows each modifier of the content created and modified by multiple users to have one's own copyright. We propose data formats and protocols, and analyze the proposed system in terms of the correctness and security. Performance evaluation in the view of response time shows that the proposed system is 2 to 18 times shorter than other comparative schemes.

    We recently published an article in the New England Journal of Medicine describing a crisis in cognitive testing, as doctors and medical researchers increasingly face copyright claims in sets of questions used for testing mental state. We encouraged the creation of a cultural norm in medicine, in which medical researchers would ensure continued availability of their tests through open source licensing for any copyrights that might exist. In this piece, we consider the legal side of the question. Although copyrights are being copiously asserted in medical testing, are those rights valid, and should they be upheld? The legal precedents in this area are anything but clear, and the courts are divided in the few analogous circumstances that have arisen. We examine analogies in standardized testing, computer compilations and baseball pitching forms to consider the marvelous question of how to conceptualize a process—which is the purview of patent law—when that process consists of words—which are the purview of copyright law. We also look from an economics perspective at the issue of investment and value creation in the development of de facto standards. Legal scholars are so often in the position of looking backwards, teasing out solutions to problems that have developed within a doctrinal or theoretical area. Rarely does one have the opportunity to affect the course of events before problems become so deeply entrenched that they are intractable. This is such a moment, and the legal and medical fields should take advantage of the opportunities presented. PMID:25221427

    A mixture containing glass 70 to 95 and BN or B4C powder (0.1-10 microns) 5 to 30 vol. % is used as a secondary pressure medium in hot isostatic pressing of ceramics. Thus, Pyrex beads were mixed with 15% vol. BN powder (average diameter 2 microns), fused at 1400 deg for 2 h, cooled, crushed, and put into a graphite crucible. A Si3N4 sintered body was embedded in the powder, heated in vacuum at 1200 deg for 2 h, treated in a hot isostatic press furnace at 1700 deg and 1000 atm. for 1 h, and cooled to give a Si3N4 ceramic. It was easily separated from the crucible.

    The structural performance of the IGNITOR machine relies upon a combination of both bucking between Toroidal Field Coils (TFCs), Central Solenoid (CS) and the Central Post (CP), and wedging in a well-defined area of the TFCs and of the magnet mechanical structure (called C-Clamps). This requires a pre-loading system to enhance the load bearing capability. Several solutions have been assessed and compared with each other within the operational scenarios and eventually a radial electromagnetic press has been selected as reference(Pizzuto A. et al., ENEA Report IGN/MAC/001/96). The loading system is made up by active coils and passive restraining rings. The radial active press consists of two pairs of coils (200x200mm each), symmetrically located relative to the machine equatorial plane and seating onto the passive rings. The permanent pre--load of the rings is applied through a wedging system with a load of about 120 MN. A radial electromagnetic press has the purpose of modulating the axial pressure on the TFC inner legs during the pulse. Design aspects including stress analysis, manufacturing, assembly and operational scenarios of the selected solution are presented in this paper.
