For purposes of the Hanford facility dangerous waste permit application, the US Department of Energy`s contractors are identified as ``co-operators`` and sign in that capacity (refer to Condition I.A.2. of the Dangerous Waste Portion of the Hanford Facility Resource Conservation and Recovery Act Permit). Any identification of these contractors as an ``operator`` elsewhere in the application is not meant to conflict with the contractors` designation as co-operators but rather is based on the contractors` contractual status with the U.S. Department of Energy, Richland Operations Office. The Dangerous Waste Portion of the initial Hanford Facility Resource Conservation and Recovery Act Permit,more » which incorporated five treatment, storage, and/or disposal units, was based on information submitted in the Hanford Facility Dangerous Waste Permit Application and in closure plan and closure/postclosure plan documentation. During 1995, the Dangerous Waste Portion was modified twice to incorporate another eight treatment, storage, and/or disposal units; during 1996, the Dangerous Waste Portion was modified once to incorporate another five treatment, storage, and/or disposal units. The permit modification process will be used at least annually to incorporate additional treatment, storage, and/or disposal units as permitting documentation for these units is finalized. The units to be included in annual modifications are specified in a schedule contained in the Dangerous Waste Portion of the Hanford Facility Resource Conservation and Recovery Act Permit. Treatment, storage, and/or disposal units will remain in interim status until incorporated into the Permit. The Hanford Facility Dangerous Waste Permit Application is considered to be a single application organized into a General Information Portion (this document, DOE/RL-91-28) and a Unit-Specific Portion. The scope of the Unit-Specific Portion is limited to individual operating treatment, storage, and/or disposal units for which Part B permit application documentation has been, or is anticipated to be, submitted. Documentation for treatment, storage, and/or disposal units undergoing closure, or for units that are, or are anticipated to be, dispositioned through other options, will continue to be submitted by the Permittees in accordance with the provisions of the Hanford Federal Facility Agreement and Consent Order. However, the scope of the General Information Portion includes information that could be used to discuss operating units, units undergoing closure, or units being dispositioned through other options. Both the General Information and Unit-Specific portions of the Hanford Facility Dangerous Waste Permit Application address the contents of the Part B permit application guidance documentation prepared by the Washington State Department of Ecology and the U.S. Environmental Protection Agency, with additional information needs defined by revisions of Washington Administrative Code 173-303 and by the Hazardous and Solid Waste Amendments. Airports are active facilities with numerous on-going operations at their sites. The following operations may adversely affect the water quality of nearby aquatic environments: De-icing runways; de-icing taxiways; de-icing and anti-icing aircraft; aircraft maintenance; and salt de-icer application. Until the amendments to the Clean Water Act of 1972, referred to as the Water Quality Act of 1987, were passed by Congress, the majority of storm water discharges in the US were unregulated. Now in its ninth year of operations, the Advanced Communications Technology Satellite (ACTS) program has continued, although since May 2000 in a new operations arrangement involving a university based consortium, the Ohio Consortium for Advanced Communications Technology (OCACT), While NASA has concluded its experimental intentions of ACTS, the spacecraft's ongoing viability has permitted its further operations to provide educational opportunities to engineering and communications students interested in satellite operations, as well as a Ka-band test bed for commercial interests in utilizing Kaband space communications. The consortium has reached its first year of operations. This generous opportunity by NASA has already resulted in unique educational opportunities for students in obtaining "hands-on" experience, such as, in satellite attitude control. An update is presented on the spacecraft and consortium operations.

Understanding the impact of the Smoke-Free Ontario Act on hospitality establishments' outdoor environments: a survey of restaurants and bars.

The Smoke-Free Ontario Act (SFOA) came into effect in May 2006 and included restrictions to outdoor hospitality areas by only permitting smoking on a patio if the area had no roof. (1) To assess the impact of the SFOA on the prevalence of smoke-free patios in Ontario and (2) to determine the proportion of venues where structural alterations were made rather than going smoke-free in order to achieve compliance with the SFOA. A telephone survey of 403 hospitality sector operators/owners in four clustered samples of Ontario, Canada. Based on completed surveys, the SFOA resulted in an increase in prevalence of smoke-free patios, from 5% (n=21) to 25% (n=99). Of the patios where smoking was permitted before the SFOA (n=382), 42% (n=161) had physical structures that would make smoking not permissible under the new act. Operators of half of these venues (n=80) made their patios smoke-free, with most indicating they had no choice given the costs or physical limitations to changing their outdoor environment. The other half (n=81) reported making physical changes, including removing roof structures to achieve compliance. The SFOA resulted in greater protection from outdoor secondhand smoke; however, most patios still permitted smoking. Half of the venues that complied with the SFOA by going smoke-free did so involuntarily because of structural and/or financial limitations. The majority of venue operators preferred to permit smoking on their patios, and only made their patios smoke-free when they were required to do so by law.

A number of entrepreneurs are committed to the goal of developing and operating reusable launch vehicles for private human space travel. In order to promote this emerging industry, and to create a clear legal, regulatory, and safety regime, the United States (U.S.) Congress passed the Commercial Space Launch Amendments Act of 2004 (CSLAA). Signed on December 23, 2004 by U.S. President George W. Bush, the CSLAA makes the Federal Aviation Administration (FAA) responsible for regulating human spaceflight. The CSLAA, among other things, establishes an experimental permit regime for developmental reusable suborbital rockets. This paper describes the FAA's approach in developing guidelines for obtaining and maintaining an experimental permit, and describes the core safety elements of those guidelines.

On April 1, 2010, the Environmental Protection Agency (EPA) issued a set of new guidelines to several of its Regional offices regarding the compliance of surface coal mining operations in Appalachia with the provisions of the Clean Water Act (CWA), the National Environmental Policy Act, and the environmental justice Executive Order (E.O. 12898). The stated purpose of the guidance was to explain more fully the approach that the EPA will be following in permit reviews, and to provide additional assurance that its Regional offices use clear, consistent, and science-based standards in reviewing the permits. Although the new guidelines go into effect immediately, they will be subjected to review both by the public and by the EPA's Science Advisory Board, with a set of final guidelines to be issued no later than April 1, 2011.

Turbocompound systems can be used to affect engine operation using the energy in exhaust gas that is driving the available turbocharger. A first electrical device acts as a generator in response to turbocharger rotation. A second electrical device acts as a motor to put mechanical power into the engine, typically at the crankshaft. Apparatus, systems, steps, and methods are described to control the generator and motor operations to control the amount of power being recovered. This can control engine operation closer to desirable parameters for given engine-related operating conditions compared to actual. The electrical devices can also operate in "reverse," going between motor and generator functions. This permits the electrical device associated with the crankshaft to drive the electrical device associated with the turbocharger as a motor, overcoming deficient engine operating conditions such as associated with turbocharger lag.

Treatment and disposal of explosives and munitions items have represented a significant management challenge for Department of Defense (DOD) facilities, particularly in light of increased regulatory scrutiny under the Federal Facilities Compliance Act provisions of the Resource Conservation and Recovery Act (RCRA). Subpart X of the RCRA regulations for storage, treatment, and disposal of hazardous wastes was drafted specifically to address explosive wastes. Until just recently, any DOD facility that was performing open burning/open detonation (OB/OD) of explosives was doing so under interim status for RCRA Part B Subpart X. In August 1996, Eglin Air Force Base (AFB), Florida becamemore » the first Air Force facility to be issued a final Part B Subpart X permit to perform OB/OD operations at two Eglin AFB active test ranges. This presentation will examine how Eglin AFB worked proactively with the State of Florida Department of Environmental Protection (FDEP) and EPA Region IV to develop permit conditions based upon risk assessment considerations for both air and ground-water exposure pathways. It will review the role of air emissions and air dispersion modeling in assessing potential exposure and impacts to both onsite and offsite receptors, and will discuss how air monitoring will be used to assure that the facility remains in compliance during OB/OD activities. The presentation will also discuss the soil and ground-water characterization program and associated risk assessment provisions for quarterly ground-water monitoring to assure permit compliance. The project is an excellent example of how a collaborative working relationship among the permittee, their consultant and state, and EPA can result in an environmentally protective permit that assures operational flexibility and mission sensitivity.« less

The development of shale gas resources in the United States has been controversial as governments have been tardy in devising sufficient safeguards to protect both people and the environment. Alleged health and environmental damages suggest that other countries around the world that decide to develop their shale gas resources can learn from these problems and take further actions to prevent situations resulting in the release of harmful pollutants. Looking at U.S. federal regulations governing large animal operations under the permitting provisions of the Clean Water Act, the idea of a permitting program is proposed to respond to the risks of pollution by shale gas development activities. Governments can require permits before allowing the drilling of a new gas well. Each permit would include fluids and air emissions reduction plans containing best management practices to minimize risks and releases of pollutants. The public availability of permits and permit applications, as occurs for water pollution under various U.S. permitting programs, would assist governments in protecting public health. The permitting proposals provide governments a means for providing further assurances that shale gas development projects will not adversely affect people and the environment. During the fall of 1996, the Interstate Oil and Gas Compact Commission sponsored sessions for government and industry representatives to discuss concerns about the National Pollution Discharge Elimination System (NPDES) program under the Clean Water Act. In January 1997, the NPDES Education/Communication/Training Workgroup (ECT Workgroup) was established with co-leaders from the Environmental Protection Agency (EPA) and industry. The ECT Workgroup`s purpose was to develop ideas that would improve communication between NPDES regulators and the oil and gas industry regarding NPDES compliance issues. The Workgroup focused on several areas, including permit compliance monitoring and reporting, enforcement activity and options, and treatmentmore » technology. A hydraulic servo control mechanism of compact construction and low fluid requirements is described. The mechanism consists of a main hydraulic piston, comprising the drive output, which is connected mechanically for feedback purposes to a servo control piston. A control sleeve having control slots for the system encloses the servo piston, which acts to cover or uncover the slots as a means of controlling the operation of the system. This operation permits only a small amount of fluid to regulate the operation of the mechanism, which, as a result, is compact and relatively light. This mechanism is particuiarly adaptable to the drive and control of control rods in nuclear reactors. (auth)

Washington River Protection Services is considering the design and construction of a Solidification Treatment Unit (STU) for the Effluent Treatment Facility (ETF) at Hanford. The ETF is a Resource Conservation and Recovery Act-permitted, multi-waste, treatment and storage unit and can accept dangerous, low-level, and mixed wastewaters for treatment. The STU needs to be operational by 2018 to receive secondary liquid wastes generated during operation of the Hanford Tank Waste Treatment and Immobilization Plant (WTP). The STU to ETF will provide the additional capacity needed for ETF to process the increased volume of secondary wastes expected to be produced by WTP.

Many owners and operators of concentrated animal feeding operations (CAFO) need to secure National Pollutant Discharge Elimination System permits from the federal or state permitting authority. Because of the expense and inconvenience of permit applications, farm groups have challenged revisions to the federal CAFO Rule as well as state regulations claiming selected provisions exceeded the authority of the permitting agency. In 2011, 2 courts responded with decisions that clarify federal and state permitting regulations. Another goal of agricultural groups is to change the regulatory authority of the state from an environmental agency to a department of agriculture. These developments suggest that by altering the permitting authority, CAFO owners and operators may alleviate some of the burdens of the permitting process.

The New Hampshire Indoor Smoking Act was implemented in 1994 to protect the public's health by regulating smoking in enclosed places. A survey was conducted of New Hampshire restaurants to determine smoking policies, to determine restaurant characteristics associated with smoking policies, and to evaluate compliance with the Indoor Smoking Act. A list of New Hampshire restaurants was obtained from a marketing firm. Establishments were selected randomly until 400 had completed a 22-question telephone survey. Forty-four percent of restaurants permitted smoking. Characteristics positively associated with permitting smoking were being a non-fast-food restaurant, selling alcohol, selling tobacco, and having greater than the median number of seats. Of restaurants permitting smoking, 96.1% had a designated smoking area, 87.0% had a ventilation system to minimize secondhand smoke, 83.6% had a physical barrier between smoking and nonsmoking areas, and 53.1% exhibited signs marking the smoking area. Forty percent of restaurants permitting smoking met all four requirements of the Indoor Smoking Act. Smoking policies differ, by type of restaurant. Compliance with the Indoor Smoking Act is low.

An ecological risk assessment is required as part of the Resource Recovery and Conservation Act (RCRA) permit renewal process for Miscellaneous Units subject to 22 CCR 66270.23. This risk assessment is prepared in support of the RCRA permit renewal for the Explosives Waste Treatment Facility (EWTF) at Site 300 of the Lawrence Livermore National Laboratory (LLNL). LLNL collected soil samples and used the resulting data to produce a scoping-level ecological risk assessment pursuant to the Department of Toxic Substances Control, Guidance for Ecological Risk Assessment at Hazardous Waste Sites and Permitted Facilities, Part A: Overview, July 4, 1996. The scoping-levelmore » ecological risk assessment provides a framework to determine the potential interaction between ecological receptors and chemicals of concern from hazardous waste treatment operations in the area of EWTF. A scoping-level ecological risk assessment includes the step of conducting soil sampling in the area of the treatment units. The Sampling Plan in Support of the Human Health and Ecological Risk Assessment for the Operation of the Explosives Waste Treatment Facility at Site 300 of the Lawrence Livermore National Laboratory, (Terusaki, 2007), outlines the EWTF project-specific soil sampling requirements. Soil samples were obtained and analyzed for constituents from four chemical groups: furans, explosives, semi-volatiles and metals. Analytical results showed that furans, explosives and semi-volatiles were not detected; therefore, no further analysis was conducted. The soil samples did show the presence of metals. Soil samples analyzed for metals were compared to site-wide background levels, which had been developed for site -wide cleanup activities pursuant to the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). Total metal concentrations from 28 discrete soil samples obtained in the EWTF area were all below CERCLA-developed background levels. Therefore, following DTSC 1996 guidance, the EWTF hazardous waste treatment units exit the ecological risk evaluation process upon completion of the requirements of a scoping-level assessment report. This summary report documents that the requirements of a scoping-level assessment have been met.« less

The association between alcohol availability, alcohol consumption and, in turn, alcohol-related harms is well established. Policies to reduce alcohol-related harms focus on limiting accessibility through the regulation of the liquor industry, including trading hours. On 1 July 2016, the Queensland Government introduced legislation to reduce ordinary liquor trading hours, replacing 5 am closing times with 3 am cessation of liquor sales in designated entertainment precincts and 2 am cessation of sales across the rest of the state. However, the amendment was under-inclusive and did not apply to temporary extended trading permits, a provision of the Liquor Act 1992 allowing one-off variations in trading hours for special events. We use 24 months of data (1 January 2015 to 31 December 2016) from the Office of Liquor Gaming and Regulation to explore patterns of extended trading permit use across Queensland, pre- and post- 1 July 2016. We find that following the Amendment in 2016 there was also a distinct shift in the utilisation of temporary extended trading permits, with a 63% increase in approved permits between 2015 and 2016. Temporal clustering around key calendar events dissipated following 1 July 2016 with consistent concentration of permit utilisation over consecutive weeks. Using temporary extended trading permits venue owners avoided earlier closing times and continued to operate until 5 am. The findings provide lessons for future policy implementation by illustrating the capacity for under-inclusive legislation to result in the dilution of intended effects. © 2018 Australasian Professional Society on Alcohol and other Drugs.

There is significant interest in the interaction of aquatic organisms with current-based marine and hydrokinetic (MHK) technologies. Determining the potential impacts of MHK devices on fish behavior is critical to addressing the environmental concerns that could act as barriers to the permitting and deployment of MHK devices. To address these concerns, we use field monitoring and fish behavior models to characterize the behavioral responses of fish to MHK turbines and infer potential stimuli that may have elicited the observed behavioral changes.

...Under section 110(k)(6) of the Clean Air Act, EPA is proposing to correct our May 2004 final approval of revisions to the San Joaquin Valley Unified Air Pollution Control District portion of the California State Implementation Plan. EPA is also proposing to take action on three amended District rules, one of which was submitted on March 7, 2008 and the other two of which were submitted on March 17, 2009. Two of the submitted rules reflect revisions to approved District rules that provide for review of new and modified stationary sources (``new source review'' or NSR) within the District, and the third reflects revisions to an approved District rule that provides a mechanism by which existing stationary sources may be exempt from the requirement to secure a Federally-mandated operating permit. The NSR rule revisions relate to exemptions from permitting and from offsets for certain agricultural operations, to the establishment of NSR applicability and offset thresholds consistent with a classification of ``extreme'' nonattainment for the ozone standard, and to the implementation of EPA's NSR Reform Rules. With respect to the revised District NSR rules, EPA is proposing a limited approval and limited disapproval because, although the changes would strengthen the SIP, there are deficiencies in enforceability that prevent full approval. With respect to the operating permit rule, EPA is proposing a full approval. Lastly, EPA is proposing to rescind certain obsolete permitting requirements from the District portion of the California plan. If EPA were to finalize the limited approval and limited disapproval action, as proposed, then a sanctions clock, and EPA's obligation to promulgate a Federal implementation plan, would be triggered because certain revisions to the District rules that are the subject of this action are required under anti-backsliding principles established for the transition from the 1-hour to the 8-hour ozone standard.
