    The past twenty years have witnessed a huge increase in research activity on the government health system in Israel. Consequently, a number of questions of enhanced importance arise: to whom the resultant IP (intellectual property) belongs?--to the researcher or the employer? and what compensation should the researcher receive for his inventive efforts? The government found many cases where the IP was registered in the name of the inventor/researcher, thus denying the government ownership of the IP. In 2009, the government sued Omryx over ownership of such an IP. Following these developments, the government issued new rules for management of IP in the government health system. They came into effect in November 2010. In many respects, the new rules are more stringent than the Israeli Patent Law in respect of the inventor. However, the stipulation of awards to the inventor in the new rules is generous. In order for the new rules to be enforceable, the following guidelines are recommended: The new rules should be more aligned with the Patent Law and with the meaning given to the Law by the judicial system, and There is need for the assent and awareness of health system workers to the conditions set out in the new rules, preferably in the form of new work contracts that clearly and concurrently delineate the worker's duties, particularly those pertaining to IP.

    Issues of mental health and employee health have risen to increasing prominence in recent years. However, there have been few explorations of the clinical and administrative challenges that these issues raise, particularly in settings that are themselves mental health workplaces. In order to identify and understand such challenges, a brief case of acute employee illness in a mental health workplace is described followed by a discussion of salient clinical, administrative, and organizational considerations. The case raises questions about medicolegal responsibilities and relationships between clinicians and patients in mental health settings, illuminates tensions between clinical staff and human resources processes, and draws attention to the need for illness prevention and mental health promotion initiatives in the workplace. Increased awareness of these issues, complications, and potential solutions would benefit clinicians, administrators, and mental health institutions.

The new standards are intended to ensure more timely benefit determinations, to improve access to information on which a benefit determination is made, and to assure that participants and beneficiaries will be afforded a full and fair review of denied claims. When effective, the regulation will affect participants and beneficiaries of employee benefit plans, employers who sponsor employee benefit plans, plan fiduciaries, and others who assist in the provision of plan benefits, such as third-party benefits administrators and health service providers or health maintenance organizations that provide benefits to participants and beneficiaries of employee benefit plans.

    Administrative social influence is a principal tool for motivating employee behavior. The authors argue that the compliance of professional employees (e.g., doctors) with administrative social influence will depend on the degree to which these employees identify with their profession and organization. Professional employees were found to be most receptive to administrator social influence to adopt new work behavior when they strongly identified with the organization and weakly identified with the profession. In contrast, administrator social influence was counterproductive when professional employees strongly identified with the profession and weakly identified with the organization.

    This final occupational safety and health standard, promulgated today as a revised 29 CFR 1910.20, provides for employee, designated representative, and OSHA access to employer-maintained exposure and medical records relevant to employees exposed to toxic substances and harmful physical agents. Access is also assured to employer analyses using exposure and medical records. The final standard requires long term preservation of these records, contains provisions concerning informing employees of their rights under the standard, and includes provisions protective of trade secret information.

    The relation between ergonomic principles and quality management initiatives, both, in the private and public sector, has received increasing attention in the recent years. Customer orientation among employees is not only an important quality principle, but also an essential prerequisite for customer satisfaction, especially in service organizations. In this context, the objective of introducing new public management (NPM) in public-service organizations is to increase customer orientation among employees who are at the forefront of service providing. In this study, we developed a short scale to measure perceived customer orientation. In two separate longitudinal studies carried out in Austria and the US, we analyzed changes in customer orientation resulting from the introduction of NPM. In both organizations, we observed a significant increase in customer orientation. Perceived customer orientation was related to job characteristics, organizational characteristics and employee quality of working life. Creating positive influences on these characteristics within the framework of an organizational change process has positive effects on employee customer orientation.

    In the nineteenth century, "virus" commonly meant an agent (usually unknown) that caused disease in inoculation experiments. By the 1890s, however, some disease-causing agents were found to pass through filters that retained the common bacteria. Such an agent was called "filterable virus," the best known being the virus that caused tobacco mosaic disease. By the 1920s there were many examples of filterable viruses, but no clear understanding of their nature. However, by the 1930s, the term "filterable virus" was being abandoned in favor of simply "virus," meaning an agent other than bacteria. Visualization of viruses by the electron microscope in the late 1930s finally settled their particulate nature. This article describes the ever-changing concept of "virus" and how virologists talked about viruses. These changes reflected their invention and reinvention of the concept of a virus as it was revised in light of new knowledge, new scientific values and interests, and new hegemonic technologies.

    Written to commemorate the 150th anniversary of Freud's birth, this paper construes Nina Coltart's statement that "if Freud did not exist it would be necessary to invent him," with its implicit comparison of Freud to God, to refer to (a) the things that Freud taught that are incontrovertibly true; (b) the unavoidable subjectivity in all judgments of Freud; and (c) the resemblances between psychoanalysis and religion. This last comparison is likewise seen to have both positive and negative aspects. Freud's ideas have inspired many people, yet he unscientifically arrogated sovereign authority over psychoanalysis. Freud's admirers are reminded of his extreme difficulty in admitting he was wrong and changing his mind when he should have known better, while his detractors are encouraged to consider the evidence supporting many of Freud's core tenets and to recognize that his discovery of psychoanalysis is indeed one of the supreme achievements in human history.

    This retrospective population-based study assessed the long-term risk of repeat reported occupational injury or illness incidents among Veterans Health Administration (VHA) nursing employees. Using fiscal year (FY) 2002 as the start date for the longitudinal surveillance of incidents, descriptive analyses included all VHA nursing employees (N = 25,697) who reported an initial (index) incident that occurred between FY 2002 and FY 2005. Adjusted for total administrative loss rates (e.g., attrition, disability, retirements), approximately half of the "surviving" index cases reported repeat incidents during an ensuing 3-year period. This total increased to approximately two thirds during a 6-year period. Compared to their nurse counterparts, practical nurses and nursing assistants had higher cumulative probabilities of multiple reported repeat occupational injury or illness incidents. Study findings suggest that reported levels of repeat occupational injury or illness incidents represent a complex interplay between environmental factors (e.g., location) and nursing staff demographics (e.g., level of education).

    Presently, there is increased in research on job strain and the effects of religiosity on employee well-being. Despite increased recognition of religiosity as a moderator of well-being, limited research has focused on Islamic perspective of moderating job strain. This study examines the moderating effects of Islamic personal religiosity on the relationship between job strain and employee well-being in Malaysian universities. One hundred and seventeen (117) Muslim academic and administrative staff from four public universities were sampled. Data were collected via questionnaires, and our findings show that the effect of job strain on well-being is significant for employees and that personal religiosity of employees contributed to alleviating job strain and enhancing well-being. Thus, the study concludes that Islamic personal religiosity moderates the relationship between job strain and employee well-being.

This proposed regulation would establish new standards for the processing of group health disability, pension, and other employee benefit plan claims filed by participants and beneficiaries. In the case of group health plans, as well as certain plans providing disability benefits, the new standards are intended to ensure more timely benefit determinations, improved access to information on which a benefit determination is made, and greater assurance that participants and beneficiaries will be afforded a full and fair review of denied claims.     On September 30, 2015, the New Jersey Department of Health (NJDOH) was notified by an out-of-state health services company that an experienced nurse had reused syringes for multiple persons earlier that day. This occurred at an employee influenza vaccination clinic on the premises of a New Jersey business that had contracted with the health services company to provide influenza vaccinations to its employees. The employees were to receive vaccine from manufacturer-prefilled, single-dose syringes. However, the nurse contracted by the health services company brought three multiple-dose vials of vaccine that were intended for another event. The nurse reported using two syringes she found among her supplies to administer vaccine to 67 employees of the New Jersey business. She reported wiping the syringes with alcohol and using a new needle for each of the 67 persons. One of the vaccine recipients witnessed and questioned the syringe reuse, and brought it to the attention of managers at the business who, in turn, reported the practice to the health services company contracted to provide the influenza vaccinations.

Similarly, patentable discoveries can be made during the normal course of medical practice, e.g., the development of new biocompatible polymers, improved dental materials, new or modified catheters, new laboratory diagnostic tests, and improved medical devices. Many inventions may not be patented in federal organizations due to the lack of information available on the patenting process.     This study identifies training outcomes and educational preferences of employees who work within the Veterans Health Administration (VHA). Using a longitudinal pre-postsurvey design, 71 employees from one geographic region of VHA healthcare facilities participated in an evaluation of a brief standardized gatekeeper program and a needs assessment on training preferences for suicide and suicide prevention. Results indicate significant differences in knowledge and self-efficacy from pre to post (p < 0.001), although only self-efficacy remained significant at 1 year follow-up, (M = 3.01; SD = 0.87) as compared to pretraining (M = 2.50, SD = 1.05) (t = −5.64, p < 0.001). At post-training, 90% of the participants were willing to learn more about suicide, with 88% willing to spend more than 1 hour in future training activities on more advanced topics. This training program can increase the knowledge and abilities of VHA staff to engage, identify, and refer veterans at risk for suicide to appropriate care. PMID:19960817

    The America Invents Act of 2011 reformed the patent process in the United States. This study focused on the effect of one provision which allows the first inventor to file the application of patent to become the owner of the intellectual property. Prior to this, the Patent and Trademark Act of 1980 allowed small businesses, universities, and non-profit institutions to pursue ownership of intellectual property developed from federally funded research. This study examined 1,389 invention disclosure forms from March 2009 to March 2015 during three phases of the law: before it was signed, before the implementation of the first inventor to file provision in 2013, and after full enactment. The reported State of Development showed significant changes prior to implementation for large companies. The findings reveal disclosures were filed at an earlier stage of development, but no change was noted in the significance of the technology. A survey was also distributed using the framework of Organizational Justice theory. The results showed the disclosure reporting process was fair and unbiased. The research supports the efforts of management to keep employees informed about the disclosure process and the importance of technology transfer of government developed innovation.     This action delays for at least six months and not more than one year the applicability date for the regulation governing minimum requirements for benefit claims procedures of group health plans covered by Title I of the Employee Retirement Income Security Act. As published on November 21, 2000, the benefit claims procedure would be applicable to claims filed on or after January 1, 2002. The current action amends the regulation so that it will apply to group health claims filed on or after the first day of the first plan year beginning on or after July 1, 2002, but in no event later than January 1, 2003. This action provides a limited additional period within which group health plan sponsors, administrators, and service providers can bring their claims processing systems into compliance with the new requirements. A postponement of the applicability date with respect to group health claims will allow a more orderly transition to the new standards and will avoid the confusion and additional expense that would be caused if certain pending Congressional bills are enacted before or soon after the original applicability date. This action does not apply to pension plans or plans providing disability or welfare benefits (other than group health). For these plans, the regulation will continue to be applicable to claims filed on or after January 1, 2002.

    Suppose you have just created a revolutionary bicycle suspension which allows a bike to be ridden over rough terrain at 60 miles per hour. In addition, suppose that you are deeply concerned about the plight of hungry children. Which should you do: be sure all hungry children have bicycles; transfer the technology for your new suspension to bicycle manufacturers worldwide; or start a company to supply premium sports bicycle based on your patented technology, and donate the profits to a charity which feeds hungry children? Woven through this somewhat trivial example is the paradox of technology transfer - the supplier (owner) may want to transfer technology; but to succeed, he or she must reformulate the problem as a user need for which there is a new and better solution. Successful technology transfer is little more than good marketing applied to an existing invention, process, or capability. You must identify who needs the technology, why they need it, why the new technology is better than alternatives, how much the customers are willing and able to pay for these benefits, and how to distribute products based on the technology tc the target customers. In market-driven development, the term 'technology transfer' is rarely used. The developers focus on studying user needs and designing solution They may have technology needs, but they don't have technology in search of a use.

    In spite of all the controversy surrounding it and the problems encountered in the process leading to its adoption, the Directive on the legal protection of biotechnology inventions does not feature anything substantially new compared to the criteria used by patent offices in determining whether inventions of this type can be patented. The Directive's originality stems not so much from the interpretation given of patenting requirements but rather from the legal importance attached to issues of public policy or morality. It sets out and interprets for the member states of the European Union what is meant by the term. However, in our opinion this regulation of morality reflects above all else an attempt to satisfy the views of sectors opposed to the Directive. Clearly, there is some doubt as to whether in practice patents for genetic material can be turned down because they run counter to morality, except in blatant cases of immorality (applications for patents for human embryos, etc).

It is meant to serve as a guide, highlighting and summarizing what you need to know and informing you where you can go for more detailed information.     In September 2003, NASA signed a nonexclusive license agreement with Armor Forensics, a subsidiary of Armor Holdings, Inc., for the laser scaling device under the Innovative Partnerships Program. Coupled with a measuring program, also developed by NASA, the unit provides crime scene investigators with the ability to shoot photographs at scale without having to physically enter the scene, analyzing details such as bloodspatter patterns and graffiti. This ability keeps the scene's components intact and pristine for the collection of information and evidence. The laser scaling device elegantly solved a pressing problem for NASA's shuttle operations team and also provided industry with a useful tool. For NASA, the laser scaling device is still used to measure divots or damage to the shuttle's external tank and other structures around the launchpad. When the invention also met similar needs within industry, the Innovative Partnerships Program provided information to Armor Forensics for licensing and marketing the laser scaling device. Jeff Kohler, technology transfer agent at Kennedy, added, "We also invited a representative from the FBI's special photography unit to Kennedy to meet with Armor Forensics and the innovator. Eventually the FBI ended up purchasing some units. Armor Forensics is also beginning to receive interest from DoD [Department of Defense] for use in military crime scene investigations overseas."

    This paper examines the impact of bioethics on patent claims. The increase in research activities involving human biological materials, and the rush to commercialise inventions derived from such biological materials, can at times result in unethical conduct of research. Questions arise as to whether patent law should concern itself with tainted research that has resulted in an invention or whether it should grant patent rights solely on the basis of the technical improvements resulting from such research. This paper highlights the significance of ethical practice in biomedical research, an issue that may influence the decision to grant patents on inventions. It explores the relation between morality, bioethics and patents from the perspective of the objectives of the patent system and current developments in the law on patents. The inclusion of the morality provision in patent law introduces a mechanism through which inventions derived from tainted research can be filtered at an early stage.

    Patents are designed to protect and encourage creativity and innovation. Patenting a biomedical discovery can be a requirement before a pharmaceutical company or biotech entity will invest in the lengthy and costly clinical testing necessary to achieve patient benefit. Although scientists and clinicians are well versed in research publication requirements, patent descriptions and claims are formatted in a manner quite different from a research paper. Patents require (a) a series of logical statements clearly delineating the boundaries of the novel aspects of the invention and (b) sufficient disclosure of the invention so that it can be reproduced by others. Patents are granted only for inventions that meet three conditions: novelty, nonobviousness, and usefulness. In the present study, results of a discriminant analysis on employees in Israel indicated that a personality characteristic, time urgency, a subcomponent of Type A behavioral pattern, distinguished between punctual and late employees.     The invention of the gyroscope is usually attributed to the French physicist Jean-Bernard-Leon Foucault in 1852. He certainly invented the word and also used his gyroscope to demonstrate the rotation of the Earth. However, the gyroscope was actually invented around 1812 by German physicist Johann Bohnenberger who called his device simply the ``machine''. Several others, including American physicist Walter R. Johnson (who called his apparatus the ``rotascope''), independently invented the gyroscope in the 1830's. Each of these devices employed a central object (sphere or disc) that could spin freely on a shaft. This was placed between three independent gimbals, which could also move freely. Bohnenberger's ``machine'' has much the same appearance as an armillary sphere. Such devices had been produced for at least the preceding three centuries. They were used to display the movements of various celestial bodies. However, armillary spheres are only simulations of celestial appearances, not actual demonstrations of physical phenomena. Gimbal systems similar to those found in gyroscopes were used on ships to level oil lamps from at least the sixteenth century and the ideas behind armillary spheres date back at least a millennium before that. So why was the gyroscope invented so late? Some possible reasons will be presented for the long delay between the development of the individual underlying components and the eventual appearance of the gyroscope in its modern form.

    The purpose of this study was to utilize an invented rule with English language learners (ELLs) in a clinical setting to determine differences based on language and age of the children. The performance was correlated with teacher reports of strong and weak language learning. Using a within-participants design, ELLs of age three to five were taught to apply a nonsense morpheme to signal a semantic difference. The invented rule was taught and responses were elicited in both English and English with Spanish interpretation. No significant difference for language was identified. Effect sizes for age were large (English, eta = 0.389, and English + Spanish, eta = 0.430) with five-year-old participants more likely to apply the rule to novel stimuli regardless of language. The performance of the majority of the participants correlated with teacher reports. The invented rule may provide a mechanism for assessing processing independent of prior language knowledge.

The function of the patent system in Government research and the value of patents resulting from government sponsored research are examined. Three alternative patent policies, title in the contractor, title in the Government, and the waiver policy, are examined in terms of their effect on the commercialization of inventions, industrial competitions, disclosure of inventions, participation of research contractors and administrative costs.     The past few years have seen an increase in the amount of attention focused on invention and design education at the college and K-12 levels. Given these efforts, the dearth of research on students' preexisting conceptions of invention is surprising. Knowledge of invention beliefs and attitudes will inform educational efforts by allowing educators to target the curriculum and accompanying activities more effectively than is possible without this knowledge. In this study, 55 sixth-grade students completed open-ended survey questions related to their conceptions of invention. Results suggest that students have few or simplistic conceptions of the invention and patent processes. Prior exposure to invention instruction or previous experience with inventing did not appear to have an impact on students' conceptions of invention. In order to dispel these superficial implicit theories, educators involved with invention programs should consider the use of active, situated teaching techniques such as project- and problem-based learning.

    Artificial feeding of infants, called hand-feeding, was unsafe well into the 19th century. This paper aims to identify technical innovations which made artificial feeding less dangerous. In rapid succession from 1844 to 1886, the vulcanization of rubber, production of rubber teats, cooling machines for large-scale ice production, techniques for milk pasteurization, evaporation and condensation, and packing in closed tins were invented or initiated. Remarkably, most of these inventions preceded the discovery of pathogenic bacteria. The producers of proprietary infant formula made immediate use of these innovations, whereas in the private household artificial feeding remained highly dangerous - mostly because of ignorance about bacteria and hygiene, and partly because the equipment for safe storage, transport, preparation and application of baby food was lacking.

    Controlled drug delivery systems have been successful in introducing improved formulations for better use of existing drugs and novel delivery of biologicals. The initial success of producing many oral products and some injectable depot formulations, however, reached a plateau, and the progress over the past three decades has been slow. This is likely due to the difficulties of formulating hydrophilic, high molecular weight drugs, such as proteins and nucleic acids, for targeting specific cells, month-long sustained delivery, and pulsatile release. Since the approaches that have served well for delivery of small molecules are not applicable to large molecules, it is time to develop new methods for biologicals. The process of developing future drug delivery systems, termed as the invention cycle, is proposed, and it starts with clearly defining the problems for developing certain formulations. Once the problems are well-defined, creative imagination examines all potential options and selects the best answer and alternatives. Then, innovation takes over to generate unique solutions for developing new formulations that resolve the previously identified problems. Ultimately, the new delivery systems will have to go through a translational process to produce the final formulations for clinical use. The invention cycle also emphasizes examining the reasons for success of certain formulations, not just the reasons for failure of many systems. Implementation of the new invention cycle requires new mechanisms of funding the younger generation of scientists and a new way of identifying their achievements, thereby releasing them from the burden of short-termism.

    Performance management consists of significantly more than periodic evaluation of performance. It is the art and science of dealing with employees in a manner intended to positively influence their thinking and behavior to achieve a desired level of performance. It is essential for the manager to always model positive behavior concerning performance; what one does or says as a manager always has an influence on others. The kinds of employee behavior most likely encountered relative to performance management efforts stem from resistance to change and lack of complete understanding of what is expected. Employee participation must be elicited whenever possible for performance improvement; as far as the inner working details of a specific job are concerned, there is no one who knows the job better than the person who does it everyday. For each task to be done, an employee needs to know what output is expected, how this output will be measured, and what standards are applied in assessing the output. Managing employee performance requires ongoing contact with each employee, regular feedback, and whatever coaching, counseling, and training are necessary to bring an employee back on track when a problem appears. Sustaining efficient and effective employee performance requires the manager's ongoing attention and involvement.

    The Federal Employees' Compensation Act (FECA) program provides wage loss compensation and payments for medical treatment to federal civilian employees. Administered by the Department of Labor (DOL), FECA covers over 2.7 million federal employees in more than 70 different agencies. FECA costs rose from $1.4 billion in 1990 to $2.6 in 2006, while the federal workforce remained essentially unchanged. While federal civilian employees represent only 2.1% of all workers eligible for workers' compensation benefits, federal programs account for 6% of the benefits paid. Disability benefits under FECA are far greater than those in the state workers' compensation programs. The benefit payments often exceed the former salary of the injured employee. The last congressional hearings on the FECA program were held over thirty years ago. It is unlikely that Congressional review will occur any time soon, as the entrenched bureaucracy that benefits from the FECA program defines and protects its future.
