Evaluating public participation in environmental decision-making: EPA's superfund community involvement program.

This article discusses an 8-year, ongoing project that evaluates the Environmental Protection Agency's Superfund community involvement program. The project originated as a response to the Government Performance and Results Act, which requires federal agencies to articulate program goals, and evaluate and report their progress in meeting those goals. The evaluation project assesses how effective the Superfund community involvement program is in promoting public participation in decisions about how to clean up hazardous wastes at Superfund sites. We do three things in the article: (1) share our experience with evaluating an Agency public participation program, including lessons learned about methods of evaluation; (2) report evaluation results; and (3) address a number of issues pertaining to the evaluation of public participation in environmental decision-making. Our goal is to encourage more environmental managers to incorporate evaluation into their public participation programs as a tool for improving them. We found that written mail surveys were an effective and economical tool for obtaining feedback on EPA's community involvement program at Superfund sites. The evaluation focused on four criteria: citizen satisfaction with EPA information about the Superfund site, citizen understanding of environmental and human health risks associated with the site, citizen satisfaction with opportunities provided by EPA for community input, and citizen satisfaction with EPA's response to community input. While the evaluation results were mixed, in general, community members who were most informed about and involved in the cleanup process at Superfund sites generally were also the most satisfied with the community involvement process, and the job that EPA was doing cleaning up the site. We conclude that systematic evaluation provides meaningful and useful information that agencies can use to improve their public participation programs. However, there need to be

President Barack Obama's proposed fiscal year (FY) 2012 budget for the Environmental Protection Agency (EPA) is $8.97 billion, a 13% decrease from the agency's FY 2010 enacted budget of $10.3 billion. While Congress has approved a moderate continuing resolution (CR) to fund the federal government until 18 March, the House of Representatives also has passed a CR (House Resolution 1; HR 1) that would call for sharp cuts to the budget for EPA and other agencies for the current fiscal year (2011). EPA administrator Lisa Jackson acknowledged the difficult budget situation during a 14 February teleconference. The proposed budget “reflects the tough choices needed for our nation's short- and long-term fiscal health and allows EPA to maintain its fundamental mission of protecting human health and the environment,” she said. “This budget focuses our resources on the most urgent health and environmental challenges we face. Though it includes significant cuts, it provides EPA with what we need to fundamentally protect the health of the American people,” Jackson added.

In March 2010, the Environmental Protection Agency (EPA) collaborated with government and nongovernmental organizations to host a groundbreaking symposium, “Strengthening Environmental Justice Research and Decision Making: A Symposium on the Science of Disproportionate Environmental Health Impacts.” The symposium provided a forum for discourse on the state of scientific knowledge about factors identified by EPA that may contribute to higher burdens of environmental exposure or risk in racial/ethnic minorities and low-income populations. Also featured were discussions on how environmental justice considerations may be integrated into EPA's analytical and decision-making frameworks and on research needs for advancing the integration of environmental justice into environmental policymaking. We summarize key discussions and conclusions from the symposium and briefly introduce the articles in this issue. PMID:22028456

The U.S. Environmental Protection Agency (EPA) Method 1694 for the determination of pharmaceuticals in water recently brought a new challenge for treatment utilities, where pharmaceuticals have been reported in the drinking water of 41-million Americans. This proposed methodology, designed to address this important issue, consists of solid-phase extraction (SPE) followed by liquid chromatography-mass spectrometry (LC/MS-MS) using triple quadrupole. Under the guidelines of Method 1694, a multi-residue method was developed, validated, and applied to wastewater, surface water and drinking water samples for the analysis of 70 pharmaceuticals. Four distinct chromatographic gradients and LC conditions were used according to the polarity and extraction of the different pharmaceuticals. Positive and negative ion electrospray were used with two MRM transitions (a quantifier and a qualifier ion for each compound), which adds extra confirmation not included in the original Method 1694. Finally, we verify, for the first time, EPA Method 1694 on water samples collected in several locations in Colorado, where positive identifications for several pharmaceuticals were found. This study is a valuable indicator of the potential of LC/MS-MS for routine quantitative multi-residue analysis of pharmaceuticals in drinking water and wastewater samples and will make monitoring studies much easier to develop for water utilities across the US, who are currently seeking guidance on analytical methods for pharmaceuticals in their water supplies. 2010 Elsevier B.V. President Obama's proposed budget for the Environmental Protection Agency (EPA) for fiscal year (FY) 2013 is $8.34 billion, a 1.2% decrease from the agency's 2012 enacted budget. "This budget is focused on fulfilling EPA's core mission to protect health and the environment for millions of American families. It demonstrates the fiscal responsibility called for at this moment, while still supporting clean air, healthy waters, and innovative safeguards that are essential to an America built to last," said EPA administrator Lisa Jackson in a 13 February briefing announcing the budget proposal. Balancing tight funding environments with EPA's goals "has required taking a step back from programs we have worked on for years, programs were we have had great success," she said. "There are difficult choices throughout this budget, but they enable us to do what is required for our immediate priorities as well as challenges down the road."

In the early 1990s, the U.S. Environmental Protection Agency (U.S. EPA) started a grant program to assist communities redevelop brownfields, which are abandoned or underutilized sites that have real or perceived contamination. In addition to determining if the communities receiving the grants were the most distressed cities in the United States, we also evaluate the U.S. EPA program in terms of environmental justice at the macro scale. Using 1990 U.S. Census of Housing and Population data and a matched-cities methodology, we compared the brownfields pilot cities to other communities in the United States. We found that regardless of intent, the U.S. EPA program is environmentally just by disproportionately awarding grants to the most economically distressed cities. We also found that the cities that received funding in the early years of the program were more economically distressed than cities receiving the funding more recently.

We explore and contextualize changes at the Environmental Protection Agency (EPA) over the first 6 months of the Trump administration, arguing that its pro-business direction is enabling a form of regulatory capture. We draw on news articles, public documents, and a rapid response, multisited interview study of current and retired EPA employees to (1) document changes associated with the new administration, (2) contextualize and compare the current pro-business makeover with previous ones, and (3) publicly convey findings in a timely manner. The lengthy, combined experience of interviewees with previous Republican and Democratic administrations made them valuable analysts for assessing recent shifts at the Scott Pruitt-led EPA and the extent to which these shifts steer the EPA away from its stated mission to "protect human and environmental health." Considering the extent of its pro-business leanings in the absence of mitigating power from the legislative branch, we conclude that its regulatory capture has become likely-more so than at similar moments in the agency's 47-year history. The public and environmental health consequences of regulatory capture of the EPA will probably be severe and far-reaching.

The U.S. Environmental Protection Agency (EPA) Endocrine Disruptor Screening Program (EDSP) currently relies on an initial screening battery (Tier 1) consisting of five in vitro and six in vivo assays to evaluate a chemical's potential to interact with the endocrine system. Chemical companies may request test waivers based on Other Scientifically Relevant Information (OSRI) that is functionally equivalent to data gathered in the screening battery or that provides information on a potential endocrine effect. Respondents for 47 of the first 67 chemicals evaluated in the EDSP submitted OSRI in lieu of some or all Tier 1 tests, seeking 412 waivers, of which EPA granted only 93. For 20 of the 47 chemicals, EPA denied all OSRI and required the entire Tier 1 battery. Often, the OSRI accepted was either identical to data generated by the Tier 1 assay or indicated a positive result. Although identified as potential sources of OSRI in EPA guidance, Part 158 guideline studies for pesticide registration were seldom accepted by EPA. The 93 waivers reduced animal use by at least 3325 animals. We estimate 27,731 animals were used in the actual Tier 1 tests, with additional animals being used in preparation for testing. Even with EPA's shift toward applying 21st-century toxicology tools to screening of endocrine disruptors in the future, acceptance of OSRI will remain a primary means for avoiding duplicative testing and reducing use of animals in the EDSP. Therefore, it is essential that EPA develop a consistent and transparent basis for accepting OSRI. © 2013 Wiley Periodicals, Inc.

Background Executive Order (EO) 13045, Protection of Children From Environmental Health Risks and Safety Risks, directs each federal agency to ensure that its policies, programs, activities, and standards address disproportionate environmental health and safety risks to children. Objectives We reviewed regulatory actions published by U.S. Environmental Protection Agency (EPA) in the Federal Register from April 1998 through December 2006 to evaluate applicability of EO 13045 to U.S. EPA actions and consideration of children’s health issues in U.S. EPA rulemakings. Discussion Although virtually all actions discussed EO 13045, fewer than two regulations per year, on average, were subject to the EO requirement to evaluate children’s environmental health risks. Nonetheless, U.S. EPA considered children’s environmental health in all actions addressing health or safety risks that may disproportionately affect children. Conclusion The EO does not apply to a broad enough set of regulatory actions to ensure protection of children’s health and safety risks, largely because of the small number of rules that are economically significant. However, given the large number of regulations that consider children’s health issues despite not being subject to the EO, other statutory requirements and agency policies reach a larger set of regulations to ensure protection of children’s environmental health. The U.S. Environmental Protection Agency (EPA) issued its draft scientific integrity policy on 5 August. The draft policy addresses scientific ethical standards, communications with the public, the use of advisory committees and peer review, and professional development. The draft policy was developed by an ad hoc group of EPA senior staff and scientists in response to a December 2010 memorandum on scientific integrity from the White House Office of Science and Technology Policy. The agency is accepting public comments on the draft through 6 September; comments should be sent to osa.staff@epa.gov. Summary Report for the Environmental Protection Agency MERL/FRMAC Mission Alignment Exercise held at the Environmental Protection Agency Facility on June 24-26 2014

From June 24th thru June 26th 2014, members of the Federal Radiological Monitoring and Assessment Center (FRMAC), FRMAC Fly Away Laboratory, and the Environmental Protection Agency (EPA) participated in a joint nuclear incident emergency response/round robin exercise at the EPA facility in Las Vegas, Nevada. The purpose of this exercise was to strengthen the interoperability relationship between the FRMAC Fly Away Laboratory (FAL) and the EPA Mobile Environmental Radiation Laboratory (MERL) stationed in Las Vegas, Nevada. The exercise was designed to allow for immediate delivery of pre-staged, spiked samples to the EPA MERL and the FAL for sample preparation andmore » radiological analysis. Upon completion of laboratory analysis, data was reviewed and submitted back to the FRMAC via an electronic data deliverable (EDD). In order to conduct a laboratory inter-comparison study, samples were then traded between the two laboratories and re-counted. As part of the exercise, an evaluation was conducted to identify gaps and potential areas for improvements for FRMAC, FAL and EPA operations. Additionally, noteworthy practices and potential future areas of interoperability opportunities between the FRMAC, FAL and EPA were acknowledged. The exercise also provided a unique opportunity for FRMAC personnel to observe EPA sample receipt and sample preparation processes and to gain familiarity with the MERL laboratory instrumentation and radiation detection capabilities. The areas for potential improvements and interoperability from this exercise will be critical for developing a more efficient, integrated response for future interactions between the FRMAC and EPA MERL assets.« less

We explore and contextualize changes at the Environmental Protection Agency (EPA) over the first 6 months of the Trump administration, arguing that its pro-business direction is enabling a form of regulatory capture. We draw on news articles, public documents, and a rapid response, multisited interview study of current and retired EPA employees to (1) document changes associated with the new administration, (2) contextualize and compare the current pro-business makeover with previous ones, and (3) publicly convey findings in a timely manner. The lengthy, combined experience of interviewees with previous Republican and Democratic administrations made them valuable analysts for assessing recent shifts at the Scott Pruitt–led EPA and the extent to which these shifts steer the EPA away from its stated mission to “protect human and environmental health.” Considering the extent of its pro-business leanings in the absence of mitigating power from the legislative branch, we conclude that its regulatory capture has become likely—more so than at similar moments in the agency’s 47-year history. The public and environmental health consequences of regulatory capture of the EPA will probably be severe and far-reaching. PMID:29698086

EPA Pesticide Factsheets

To improve public health and the environment, the United States Environmental Protection Agency (EPA) collects information about facilities, sites, or places subject to environmental regulation or of environmental interest. Through the Geospatial Data Download Service, the public is now able to download the EPA Geodata Shapefile, Feature Class or extensible markup language (XML) file containing facility and site information from EPA's national program systems. The files are Internet accessible from the Envirofacts Web site (https://www3.epa.gov/enviro/). The data may be used with geospatial mapping applications. (Note: The files omit facilities without latitude/longitude coordinates.) The EPA Geospatial Data contains the name, location (latitude/longitude), and EPA program information about specific facilities and sites. In addition, the files contain a Uniform Resource Locator (URL), which allows mapping applications to present an option to users to access additional EPA data resources on a specific facility or site.

Conventionally, in its decision-making, the U.S. EPA has evaluated the effects and risks associated with a single pollutant in a single exposure medium. In reality, people are exposed to mixtures of pollutants or to the same pollutant through a variety of media, including the air, water, and food. It is now more recognized than before that environmental exposure to pollutants occurs via multiple exposure routes and pathways, including inhalation, ingestion, and dermal absorption. Moreover, chemical, biologic, radiologic, physical, and psychologic stressors are all acknowledged as affecting human health. Although many EPA offices attempt to consider cumulative risk assessment and cumulative effects in various ways, there is no Agency-wide policy for considering these risks and the effects of exposure to these risks when making environmental decisions. This article examines how U.S. courts might assess EPA’s general authority and discretion to use cumulative risk assessment as the basis for developing data in support of environmental decision-making, and how courts might assess the validity of a cumulative risk assessment methodology itself. The Integrated Risk Information System (IRIS) of the U.S. Environmental Protection Agency (EPA) has an important role in protecting public health. Originally it provided a single database listing official risk values equally valid for all Agency offices, and was an important tool for risk assessment communication across EPA. Started in 1986, IRIS achieved full standing in 1990 when it listed 500 risk values, the effort of two senior EPA groups over 5 years of monthly face-to-face meetings, to assess combined risk data from multiple Agency offices. Those groups were disbanded in 1995, and the lack of continuing face-to-face meetings meant that IRIS became no longer EPA's comprehensive database of risk values or their latest evaluations. As a remedy, a work group of the Agency's senior scientists should be re-established to evaluate new risks and to update older ones. Risk values to be reviewed would come from the same EPA offices now developing such information on their own. Still, this senior group would have the final authority on posting a risk value in IRIS, independently of individual EPA offices. This approach could also lay the groundwork for an all-government IRIS database, especially needed as more government Agencies, industries and non-governmental organizations are addressing evolving risk characterizations. The challenge to Federalism presented by the new wave of environmental statutes is, while not unique in our history, a significant strain on state and federal relations. Behind this tension is the question of who should enforce these laws, especially when the violator is a Federal agency. Traditionally Federal agencies have been free to perform their diverse missions without restraint either from other Federal agencies or the states. Computational toxicology combines data from high-throughput test methods, chemical structure analyses and other biological domains (e.g., genes, proteins, cells, tissues) with the goals of predicting and understanding the underlying mechanistic causes of chemical toxicity and for predicting toxicity of new chemicals and products. A key feature of such approaches is their reliance on knowledge extracted from large collections of data and data sets in computable formats. The U.S. Environmental Protection Agency (EPA) has developed a large data resource called ACToR (Aggregated Computational Toxicology Resource) to support these data-intensive efforts. ACToR comprises four main repositories: core ACToR (chemical identifiers and structures, and summary data on hazard, exposure, use, and other domains), ToxRefDB (Toxicity Reference Database, a compilation of detailed in vivo toxicity data from guideline studies), ExpoCastDB (detailed human exposure data from observational studies of selected chemicals), and ToxCastDB (data from high-throughput screening programs, including links to underlying biological information related to genes and pathways). The EPA DSSTox (Distributed Structure-Searchable Toxicity) program provides expert-reviewed chemical structures and associated information for these and other high-interest public inventories. Overall, the ACToR system contains information on about 400,000 chemicals from 1100 different sources. The entire system is built using open source tools and is freely available to download. With the advent and encouragement of recent initiatives by EPA and state environmental regulators for the development and use by business entities of voluntary environmental compliance and audit programs has come an increased concern over the potential for criminal prosecution of individuals charged with the responsibility for ensuring environmental compliance. With the EPA avoiding the issue of whether audit findings will be used as evidence in a joint civil and criminal investigation (i.e., multi-media inspection), a sense of heightened concern has been prevalent in the regulated community. This paper will address the use of audit methodologies that incorporate law enforcement/criminalmore » investigatory techniques as well as suggested attorney-client reporting structure that should be applied in auditing in order to prevent/mitigate the potential for criminal enforcement actions. The goals of the paper are to enable both corporate compliance managers and environmental auditors to be aware of the potential pitfalls and/or liabilities associated with compliance audit findings. Additionally, to educate auditors on when and how to take further steps, through the use of investigatory interviewing techniques, in order to develop answers to questionable data and/or confirm findings of the environmental audit to avoid civil and criminal penalties. The goals of an environment audit should be to avoid both civil and criminal prosecution through the advanced identification of liabilities and the subsequent development of protocols to achieve compliance. This web feature service contains location and facility identification information from EPA's Facility Registry Service (FRS) for the subset of facilities that link to the Clean Air Markets Division Business System (CAMDBS). Administered by the EPA Clean Air Markets Division, within the Office of Air and Radiation, CAMDBS supports the implementation of market-based air pollution control programs, including the Acid Rain Program and regional programs designed to reduce the transport of ozone. FRS identifies and geospatially locates facilities, sites or places subject to environmental regulations or of environmental interest. Using vigorous verification and data management procedures, FRS integrates facility data from EPA's national program systems, other federal agencies, and State and tribal master facility records and provides EPA with a centrally managed, single source of comprehensive and authoritative information on facilities. A series of activities have been conducted by a core group of EPA scientists from across the Agency. The activities were initiated in 2012 and the focus was to increase the reuse and interoperability of science software at EPA. The need for increased reuse and interoperability is linked to the increased complexity of environmental assessments in the 21st century. This complexity is manifest in the form of problems that require integrated multi-disciplinary solutions. To enable the means to develop these solutions (i.e., science software systems) it is necessary to integrate software developed by disparate groups representing a variety of science domains. Thus, reuse and interoperability becomes imperative. This report briefly describes the chronology of activities conducted by the group of scientists to provide context for the primary purpose of this report, that is, to describe the proceedings and outcomes of the latest activity, a workshop entitled “Workshop on Advancing US EPA integration of environmental and information sciences”. The EPA has been lagging in digital maturity relative to the private sector and even other government agencies. This report helps begin the process of improving the agency’s use of digital technologies, especially in the areas of efficiency and transparency. This report contributes to SHC 1.61.2.

The Health Physics Society (HPS) provided comment to the U.S. Environmental Protection Agency (EPA) on options to consider when developing an action plan for President Trump's Executive Order to evaluate regulations for repeal, replacement, or modification. The HPS recommended that the EPA reconsider their adherence to the linear no-threshold (LNT) model for radiation risk calculations and improve several documents by better addressing uncertainties in low-dose, low dose-rate (LDDR) radiation exposure environments. The authors point out that use of the LNT model near background levels cannot provide reliable risk projections, use of the LNT model and collective-dose calculations in some EPA documents is inconsistent with the recommendations of international organizations, and some EPA documents have not been exposed to the public comment rule-making process. To assist in establishing a better scientific basis for the risks of low dose rate and low dose radiation exposure, the EPA should continue to support the "Million Worker Study," led by the National Council on Radiation Protection and Measurement.

The Denver Radium Site consists of properties in the Denver area having radioactive contamination left from radium processing in the early 1900s. The properties are divided into 11 groups or operable units'' to facilitate remedial action management of the Site. Under the provisions of the Superfund Amendments and Reauthorization Act (SARA) of 1986, the US Environmental Protection Agency (EPA) is authorized to respond to a release of a hazardous substance or to a substantial threat of such a release into the environment. EPA or the state conducts a site inspection and uses the Hazard Ranking System to determine placement onmore » the EPA National Priorities List (NPL). In 1983, EPA placed the Denver Radium Site on the NPL, making it eligible for cleanup under the EPA Superfund Program. Through a series of interagency agreements,EPA has enlisted the support of the US Department of Energy Grand junction Projects Office and Chem-Nuclear Geotech, Inc., for remedial design and remedial action activities at the Denver Radium Superfund Site.The US Bureau of Reclamation (USBR) is managing the waste transportation and disposal contract.« less

In 1997 then-US Environmental Protection Agency (EPA) Administrator Carol Browner adopted new National Ambient Air Quality Standards (NAAQS) for fine particulate matter (PM2.5). Browner recognized that 'there is uncertainty in the characterization of health effects attributable to exposure to ambient PM.' As a result, President Clinton promised to review the scientific basis for those standards prior to their implementation. Recently, before EPA has even promulgated rules concerning implementation of those standards, the agency proposed to revise those standards to make them significantly more stringent. Are the proposed revisions to the standards appropriate? The author argues. 41 refs.

Computational toxicology is the application of mathematical and computer models to help assess chemical hazards and risks to human health and the environment. Supported by advances in informatics, high-throughput screening (HTS) technologies, and systems biology, the U.S. Environmental Protection Agency EPA is developing robust and flexible computational tools that can be applied to the thousands of chemicals in commerce, and contaminant mixtures found in air, water, and hazardous-waste sites. The Office of Research and Development (ORD) Computational Toxicology Research Program (CTRP) is composed of three main elements. The largest component is the National Center for Computational Toxicology (NCCT), which was established in 2005 to coordinate research on chemical screening and prioritization, informatics, and systems modeling. The second element consists of related activities in the National Health and Environmental Effects Research Laboratory (NHEERL) and the National Exposure Research Laboratory (NERL). The third and final component consists of academic centers working on various aspects of computational toxicology and funded by the U.S. EPA Science to Achieve Results (STAR) program. The Compliance Program Data Management System (DMS) developed at the Idaho National Engineering Laboratory (INEL) validates and maintains the integrity of data collected to support the Consent Order and Compliance Agreement (COCA) between the INEL and the Environmental Protection Agency (EPA). The system uses dBase III Plus programs and dBase III Plus in an interactive mode to enter, store, validate, manage, and retrieve analytical information provided on EPA Contract Laboratory Program (CLP) forms and CLP forms modified to accommodate 40 CFR 264 Appendix IX constituent analyses. Data analysis and presentation is performed utilizing SAS, a statistical analysis software program. Archivingmore » of data and results is performed at appropriate stages of data management. Environmental protection in the United States has reached a critical juncture. It has become clear that to address the complex and interrelated environmental challenges we face, we must augment our traditional approaches. The scientific community must build upon its deep understanding of risk assessment, risk management, and reductionism with tools, technologies, insights and approaches to pursue sustainability. The U.S. Environmental Protection Agency (EPA) has recognized this need for systemic change by implementing a new research paradigm called "The Path Forward." This paper outlines the principles of the Path Forward and the actions taken since 2010 to align EPA's research efforts with the goal of sustainability.
