    In Citizens Coal Council v. EPA, an en banc panel for the Sixth Circuit Court of Appeals considered a challenge to EPA regulations promulgated pursuant to the Clean Water Act (CWA). The EPA promulgated the regulations in an attempt to incentivize coal companies to remine once abandoned mine sites. Petitioners, two nonprofit environmental organizations, claimed that the regulations violated the Clean Water Act and Administrative Procedure Act by allowing coal companies to remine without adhering to any enforceable pollution limitations. The EPA countered that more remining would improve water quality at abandoned sites. The Sixth Circuit rejected Petitioners' claims, finding that the EPA's regulations were reasonably consistent with the CWA's goal of restoring the integrity of the nation's waters. In so holding, the court struggled to understand the meaning of the CWA's complex procedural and technical language, and allowed the EPA to justify the rule based on the CWA's broad statement of purpose. Such superficial judicial review sets a dangerous precedent in environmental law, because it exacerbates the risk of agency capture. A captured agency promulgates regulations that benefit-industry, not the environment. Without the judiciary acting as a meaningful check against agency capture, the public loses a valuable tool in the fight against major-industrial polluters like the domestic coal industry. Citizens Coal Council therefore stands as a cautionary tale, a warning sign that the judiciary may be unable to identify agency capture where the regulations at issue are promulgated pursuant to a complex statute like the Clean Water Act.

    The U.S. EPA Regional Oxidant Model (ROM) and NEROS data base are described. The model incorporates a comprehensive description of the physical and chemical processes thought to be important to tropospheric O3 production on 1000-km scales. The data base employed for the first application of the ROM was collected during the summers of 1979 and 1980 in the Northeast U.S. It contains meteorological and air-quality data from regular monitoring networks and from enhanced networks or special field-project measurements during that period. The evaluation procedure that will be used to determine the ROM performance on this data base is outlined. A number of episodes will be simulated from the period July 23 through August 16, 1980, for which performance statistics will be developed. The evaluation of any given day within an episode will proceed in two distinct stages. The first stage will focus on model performance for an individual model realization, irrespective of all other realizations. Model realizations for a given day are functions of the possible flow fields that existed for the day. The second stage will attempt to evaluate model performance using the full probabilistic abilities of the ROM that consider all realizations concurrently. The focus of the evaluation will be on O3. The exact pathway through the evaluation study will be determined by the resources available at the time.

    The U.S. Environmental Protection Agency (EPA) Method 1694 for the determination of pharmaceuticals in water recently brought a new challenge for treatment utilities, where pharmaceuticals have been reported in the drinking water of 41-million Americans. This proposed methodology, designed to address this important issue, consists of solid-phase extraction (SPE) followed by liquid chromatography-mass spectrometry (LC/MS-MS) using triple quadrupole. Under the guidelines of Method 1694, a multi-residue method was developed, validated, and applied to wastewater, surface water and drinking water samples for the analysis of 70 pharmaceuticals. Four distinct chromatographic gradients and LC conditions were used according to the polarity and extraction of the different pharmaceuticals. Positive and negative ion electrospray were used with two MRM transitions (a quantifier and a qualifier ion for each compound), which adds extra confirmation not included in the original Method 1694. Finally, we verify, for the first time, EPA Method 1694 on water samples collected in several locations in Colorado, where positive identifications for several pharmaceuticals were found. This study is a valuable indicator of the potential of LC/MS-MS for routine quantitative multi-residue analysis of pharmaceuticals in drinking water and wastewater samples and will make monitoring studies much easier to develop for water utilities across the US, who are currently seeking guidance on analytical methods for pharmaceuticals in their water supplies.

    A Monte Carlo procedure for the construction of complementary cumulative distribution functions (CCDFs) for comparison with the US Environmental Protection Agency (EPA) release limits for radioactive waste disposal (40 CFR 191, Subpart B) is described and illustrated with results from a recent performance assessment (PA) for the Waste Isolation Pilot Plant (WIPP). The Monte Carlo procedure produces CCDF estimates similar to those obtained with stratified sampling in several recent PAs for the WIPP. The advantages of the Monte Carlo procedure over stratified sampling include increased resolution in the calculation of probabilities for complex scenarios involving drilling intrusions and better use of the necessarily limited number of mechanistic calculations that underlie CCDF construction.

    The basis for the school asbestos hazard program of the Environmental Protection Agency (EPA) is reviewed. Risk of disease following asbestos exposure is discussed. For industrial exposures, lung cancer risks cluster between 1 and 10 percent per fiber year per milliliter. For mesothelioma, estimates range from 0.01 to 0.06 percent. For nonoccupational exposure, lung cancer risks range from 2 to 40 per million exposed persons. Mesothelioma risks range from 2 to 100 per million. The indirect quantitative risk assessment of EPA for asbestos associated cancers due to exposures at schools in early life is discussed. As of May, 1982, approximately 8,600 schools contain friable asbestos and approximately 2 to 6 million students and 100,000 to 300,000 teachers, administrators, and other staff are potentially exposed to airborne asbestos in these schools.

    In the present study, we hypothesised whether in vitro digestion of salmon oil would release different amounts of PUFA depending on the origin of the lipolytic enzymes used. For this purpose, in vitro digestion of salmon oil (SO) was performed using human duodenal juice (HDJ) or a commercial enzyme preparation consisting of porcine pancreatin and bile (PB). The lipolytic effect was determined by measuring the release of fatty acids (FA) using solid-phase extraction and GC-flame ionisation detection, withdrawing samples every 20 min during digestion. The amount of FA released indicated that a plateau was reached after 80 min with approximately similar amounts of FA detected using both HDJ and PB (379 (sd 18) and 352 (sd 23) mg/g SO, respectively). However, the release of 18 : 2, EPA (20 : 5) and DHA (22 : 6) was significantly different during in vitro digestion. At 80 min, HDJ and PB released 43 and 33% of 18 : 2, 14 and 9% of EPA and 11 and 9% of DHA, respectively. Both enzyme preparations released approximately the same amounts of the other FA analysed. The effect of the addition of bile salts (BS) was significantly different in the two enzyme systems, where porcine pancreatin highly responded to the increase in BS concentration, in contrast to HDJ.

    The U.S. Environmental Protection Agency (EPA) Endocrine Disruptor Screening Program (EDSP) currently relies on an initial screening battery (Tier 1) consisting of five in vitro and six in vivo assays to evaluate a chemical's potential to interact with the endocrine system. Chemical companies may request test waivers based on Other Scientifically Relevant Information (OSRI) that is functionally equivalent to data gathered in the screening battery or that provides information on a potential endocrine effect. Respondents for 47 of the first 67 chemicals evaluated in the EDSP submitted OSRI in lieu of some or all Tier 1 tests, seeking 412 waivers, of which EPA granted only 93. For 20 of the 47 chemicals, EPA denied all OSRI and required the entire Tier 1 battery. Often, the OSRI accepted was either identical to data generated by the Tier 1 assay or indicated a positive result. Although identified as potential sources of OSRI in EPA guidance, Part 158 guideline studies for pesticide registration were seldom accepted by EPA. The 93 waivers reduced animal use by at least 3325 animals. We estimate 27,731 animals were used in the actual Tier 1 tests, with additional animals being used in preparation for testing. Even with EPA's shift toward applying 21st-century toxicology tools to screening of endocrine disruptors in the future, acceptance of OSRI will remain a primary means for avoiding duplicative testing and reducing use of animals in the EDSP. Therefore, it is essential that EPA develop a consistent and transparent basis for accepting OSRI.

    The U.S. EPA's particulate research and development program, divided between an in-house laboratory effort and extramural work at various research institutes, makes use of electrostatics in most of the work associated with stack or ducted emissions. Research facilities which offer a large degree of flexibility and capability are described. Significant work currently underway, making use of electrostatics, includes: (1) smooth large-diameter discharge electrodes (9-10 mm), that have been evaluated in 1/3- and 10-MW pilot units; (2) the multistage electrostatic precipitator (ESP), consisting of several two-stage ESPs in series, each using cold-pipe prechargers and collectors with large diameter electrodes; (3) the E-SOX process, combining the multistage ESP with a spray dryer in an existing ESP, for simultaneous SO2 and fly ash removal (including injections of soda ash and lime slurry droplets); and (4) electrostatically augmented fabric filtration with fly ash (including spray drying by-product material).

In section 4.1.3, EPA states, "... effects that appear to be adaptive, non-adverse, or beneficial may not be mentioned." This statement may be perceived as precluding risk assessments based on non-default risk models, including the hormetic--or biphasic--dose-response model. This commentary examines several potential interpretations of this statement and the anticipated impact of ignoring hormesis, if present, in light of necessary conservatism for protecting human and environmental health, and the potential for employing alternative risk assessment approaches.

    The Uranium Mill Tailings Remedial Action (UMTRA) Project involves stabilizing 24 inactive uranium mill tailings piles in 10 states. Remedial work must meet standards established by the US Environmental Protection Agency (EPA). Remedial action must be designed and constructed to prevent dispersion of the tailings and other contaminated materials, and must prevent the inadvertent use of the tailings by man. This report is prepared primarily for distribution to parties involved in the UMTRA Project, including the US Nuclear Regulatory Commission (NRC), and states and tribes. It is intended to record the work done by the DOE since publication of the proposed EPA groundwater protection standards, and to show how the DOE has attempted to respond and react in a positive way to the new requirements that result from the proposed standards. This report discusses the groundwater compliance strategies now being defined and implemented by the DOE, and details the changes in disposal cell designs that result from studies to evaluate ways to facilitate compliance with the proposed EPA groundwater protection standards. This report also serves to record the technical advances, planning, and progress made on the UMTRA Project since the appearance of the proposed EPA groundwater protection standards. The report serves to establish, document, and disseminate technical approaches and engineering and groundwater information to people who may be interested or involved in similar or related projects. 24 refs., 27 figs., 8 tabs.

Using vigorous verification and data management procedures, FRS integrates facility data from EPA's national program systems, other federal agencies, and State and tribal master facility records and provides EPA with a centrally managed, single source of comprehensive and authoritative information on facilities.     Nearly 4 billion pounds of tracked toxic chemicals were released into the environment throughout the United States during 2010, according to an analysis by the U.S. Environmental Protection Agency (EPA) of the Toxics Release Inventory (TRI), the agency announced on 5 January. This is a 16% increase above 2009. The agency said the increase is mainly due to changes in the metal-mining sector, where differences in the chemical composition of ore being mined can result in significant changes in the amount of toxic chemicals. The chemical and primary metals industries were other sectors with increases in toxic releases in 2010, the latest year for which data collection is complete. EPA also noted that although releases in 2010 were higher than during the previous 2 years, they were lower than in 2007 and in prior years.

    Computational toxicology combines data from high-throughput test methods, chemical structure analyses and other biological domains (e.g., genes, proteins, cells, tissues) with the goals of predicting and understanding the underlying mechanistic causes of chemical toxicity and for predicting toxicity of new chemicals and products. A key feature of such approaches is their reliance on knowledge extracted from large collections of data and data sets in computable formats.     An easy-to-use indoor-air-quality (IAQ) model is described. It is multi-compartmented and based on a well-mixed mixing model. Sources and sinks are allowed in each compartment. A menu-driven fill-in-the-form user interface controls program flow and is used to obtain data from the user. On-screen graphical output is provided. The model estimates the effects of heating, ventilation, and air conditioning (HVAC), air cleaning, room-to-room air movement, and natural ventilation on pollutant concentrations. Experiments conducted in the EPA test house using moth crystal cakes for model verification are described. The agreement between small chamber emission factors, model predictions, and test house data is very good. Predicted weight loss of the moth crystal cakes was within 5% of the measured weight loss. Predicted room concentrations of p-dichlorobenzene are within 20% of the measured values. Future directions for model development and experimental studies are discussed.

    This report presents a comparison between two computerized methodologies for estimating the radiation dose to man from radionuclide releases to the atmosphere. The COMRADEX-IV code was designed to provide a means of assessing potential radiological consequences from postulated power reactor accidents. The AIRDOS-EPA code was developed primarily to assess routine radionuclide releases from nuclear facilities. Although a number of different calculations are performed by these codes, three calculations are in common - atmospheric dispersion, estimation of internal dose from inhalation, and estimation of external dose from immersion in air containing gamma emitting radionuclides. The models used in these calculations were examined and found, in general, to be the same. Most differences in the doses calculated by the two codes are due to differences in values chosen for input parameters and not due to model differences. A sample problem is presented for illustration.

    The Wave Propagation Laboratory (WPL) participated in the Environmental Protection Agency's Complex Terrain Model Development Project, whose objective is development of numerical air-quality models valid in complex terrain. Particular attention was given to impaction of elevated plumes on high terrain during stable (nocturnal) conditions. WPL operated a plume-mapping lidar, acoustic sounders (some with Doppler capability), sonic anemometers, a tethered sonde, and crosswind optical anemometers. Measurements were usually displayed in real time for experimental guidance and later processed with quality assurance for quantitative analysis. A synopsis of data acquisition and archiving is given for each experiment, including a review of the results of scientific analyses already completed.

Eight sets of particulate-loaded filters were provided to SwRI by the sponsor. The filters were soxhlet-extracted in methylene chloride, and the extracts were dried and weighed. The organic extracts were analyzed using the Ames bioassay at Southwest Foundation for Biomedical Research (SFBR), formerly Southwest Foundation for Research and Education. The data were analyzed using linear and non-linear regression methods.

    Computational toxicology combines data from high-throughput test methods, chemical structure analyses and other biological domains (e.g., genes, proteins, cells, tissues) with the goals of predicting and understanding the underlying mechanistic causes of chemical toxicity and for predicting toxicity of new chemicals and products. A key feature of such approaches is their reliance on knowledge extracted from large collections of data and data sets in computable formats.     In December 1993, the US Environmental Protection Agency (EPA) released its final rule that sets for the details for requirements to sell reformulated gasoline (RFG) in certain ozone non-attainment areas. At the same time, EPA also issued a proposed rule to require that 30% of the oxygen required in RFG be based on a renewable oxygenate.     This document announces the conclusions of the EPA evaluation of the 'Super-Mag Fuel Extender' device under provisions of Section 511 of the Motor Vehicle Information and Cost Savings Act. On December 10, 1980, the EPA received a written request from the Metropolitan Denver District Attorney's Office of Consumer Fraud and Economic Crime to test at least one 'cow magnet' type of fuel economy device. Following a survey of devices being marketed, the Metropolitan Denver District Attorney's Office selected the 'Super-Mag' device as typical of its category and on April 13, 1981 provided EPA with units for testing. The EPA evaluation of the device using three vehicles showed neither fuel economy nor exhaust emissions were affected by the installation of the 'Super-Mag' device. In addition, any differences between baseline test results and results from tests with the device installed were within the range of normal test variability.

The device is claimed to improve fuel economy and driveability and to reduce exhaust emissions and required engine maintenance. The device is classified by EPA as a vapor-air bleed device. EPA fully considered all of the information submitted by the applicant. The evaluation of the POWERFuel Extender System was based on that information and on EPA's experience with other similar devices. Although, in theory, the introduction of alcohol and water could have a favorable effect on an engine's cleaniness, power and maintenance requirements and could even allow some vehicles to use lower octane fuel, data were not submitted to substantiate that the POWERFuel Extender System could cause these benefits.

    Although Environmental Protection Agency chief Carol Browner tried to portray the numbers in a positive light, a budget cut is a budget cut and that is what she was handed by her new boss. Despite Clinton Administration rhetoric on the environment, the $6.4-billion EPA budget for fiscal 1994 is down almost 8% for 1993. The superfund program is hit hardest, down 6%, to $1.5 billion. Browner counts funds from the President's 1993 stimulus bill--currently in limbo in Congress--in her 1994 budget to arrive at an increase. She says 1994 will bring greater emphasis to pollution prevention, collaborative programs with industry on toxic releases, and improvement in EPA's science and research activities. EPA's air and pesticides programs will get more money, as well hazardous waste, which EPA says will [open quotes]eliminate unnecessary and burdensome requirements[close quotes] on industry and speed up corrective action. Water quality programs will be cut, as will the toxic substances program, although the Toxic Release Inventory will get a boost.

    During the spring of 2011, the U.S. Environmental Protection Agency (EPA) used its national radiation monitoring and sampling system, RadNet, to detect, identify, and inform the public about radioactive material in the United States resulting from Japan's Fukushima Daiichi Nuclear Power Plant release. The RadNet system monitors ambient air, drinking water, precipitation, and pasteurized milk for radionuclides. To supplement its existing stationary (fixed) continuous air monitoring system, EPA deployed additional air monitors to Saipan, Guam, and locations in the western United States. The Agency also accelerated the regular quarterly sampling of milk and drinking water and collected an additional round of samples. For two months, staff located at EPA's Headquarters Emergency Operations Center, west coast regional offices, and National Air and Radiation Environmental Lab worked seven days a week to handle the increased radiochemical sample analysis from air filters, precipitation, drinking water, and milk; provide interagency scientific input; and answer press and public inquiries. EPA's data was consistent with what was expected from the Fukushima Daiichi Nuclear Power Plant release. The levels of radioactivity were so low that the readings from the near-real-time RadNet air monitors stayed within normal background ranges. Detailed sample analyses were needed to identify the radionuclides associated with the release. Starting at the end of April and continuing through May 2011, levels of radioactive material decreased as expected.

However, the agency's scientific practices and performance at times have been criticized by the U.S. General Accounting Office, the National Academies of Science (NAS), Congress, and EPA's own science advisory board, as well as in a number of lawsuits.New legislation introduced by Rep. Vernon Ehlers (R-Mich.), chair of the House of Representatives' Science Subcommittee on Environment, Technology, and Standards, includes measures meant to improve the agency's science component.     Computational toxicology is the application of mathematical and computer models to help assess chemical hazards and risks to human health and the environment. Supported by advances in informatics, high-throughput screening (HTS) technologies, and systems biology, the U.S. Environmental Protection Agency EPA is developing robust and flexible computational tools that can be applied to the thousands of chemicals in commerce, and contaminant mixtures found in air, water, and hazardous-waste sites. The Office of Research and Development (ORD) Computational Toxicology Research Program (CTRP) is composed of three main elements. The largest component is the National Center for Computational Toxicology (NCCT), which was established in 2005 to coordinate research on chemical screening and prioritization, informatics, and systems modeling. The second element consists of related activities in the National Health and Environmental Effects Research Laboratory (NHEERL) and the National Exposure Research Laboratory (NERL).     This report discusses three wellhead-protection projects undertaken in Region One: the Cape Cod Aquifer Management Plan (CCAMP); Region One's Priority Ground Water Resource-Based Mapping Project: the Nashua Regional Planning Commission Pilot Area; and the Chesprocott Groundwater Protection Project. All three projects are aimed at preventing contamination of community wells. CCAMP serves as a prototype for Region One's wellhead protection efforts and may be broken down into four main phases: delineating the critical groundwater recharge area of each community well (the Wellhead Protection Area), identifying and assessing the risk of existing and future sources of contaminants within the Wellhead Protection Area (WHPA), examining the adequacy of existing management strategies to prevent groundwater contamination, and implementing local management controls based on the results of the first steps. All three of the projects develop and refine management ideas and methodologies on the prevention of groundwater contamination. Many of these techniques may be used by local and regional agencies concerned with protecting their groundwater resources.

    The proposed ERTS-DCS system is designed to allow EPA the capability to evaluate, through demonstrable hardware, the effectiveness of automated data collection techniques. The total effectiveness of any system is dependent upon many factors which include equipment cost, installation, maintainability, logistic support, growth potential, flexibility and failure rate. This can best be accomplished by installing the system at an operational environmental control agency (CAMP station) to insure that valid data is being obtained and processed. Consequently, it is imperative that the equipment interface must not compromise the validity of the sensor data nor should the experimental system effect the present operations of the CAMP station. Since both the system which is presently in use and the automatic system would be in operation in parallel, conformation and comparison are readily obtained.

The budget has $77.3 million, a $7.3 million increase, for the Leaking Underground Storage Tank (LUST) program. EPA's water infrastructure program would take a $404 million hit in FY 1996, down to $2.37 billion.
