In Citizens Coal Council v. EPA, an en banc panel for the Sixth Circuit Court of Appeals considered a challenge to EPA regulations promulgated pursuant to the Clean Water Act (CWA). The EPA promulgated the regulations in an attempt to incentivize coal companies to remine once abandoned mine sites. Petitioners, two nonprofit environmental organizations, claimed that the regulations violated the Clean Water Act and Administrative Procedure Act by allowing coal companies to remine without adhering to any enforceable pollution limitations. The EPA countered that more remining would improve water quality at abandoned sites. The Sixth Circuit rejected Petitioners' claims, findingmore » that the EPA's regulations were reasonably consistent with the CWA's goal of restoring the integrity of the nation's waters. In so holding, the court struggled to understand the meaning of the CWA's complex procedural and technical language, and allowed the EPA to justify the rule based on the CWA's broad statement of purpose. Such superficial judicial review sets a dangerous precedent in environmental law, because it exacerbates the risk of agency capture. A captured agency promulgates regulations that benefit-industry, not the environment. Without the judiciary acting as a meaningful check against agency capture, the public loses a valuable tool in the fight against major-industrial polluters like the domestic coal industry. Citizens Coal Council therefore stands as a cautionary tale, a warning sign that the judiciary may be unable to identify agency capture where the regulations at issue are promulgated pursuant to a complex statute like the Clean Water Act.« less

Implementation of EPA's Stage 2 Disinfection Byproducts Rules (DBPR) in Northern Kentucky will cause a water rate increase of over 25%. Hence a review was undertaken, considering both economics and science in the context of President Obama's 2009 scientific integrity directive. The rules purport to avoid up to 0.49% of new bladder cancers by reducing the levels of DBPs in drinking water - a benefit so small that failure to implement will not cause unreasonable risk to health (URTH). It suggests at most one Northern Kentucky death avoided over 17 years for a cost of $136,000,000 ($1700 per household). Even this small benefit is probably overstated. EPA finds no "causal link" between DBPs and bladder cancer, and EPA acknowledges problems with the epidemiological data used in their calculation: the data appear contradictory and inconsistent, may be skewed toward "positive" results, and suggest different cancer sites than animal studies. Two similar international agencies disagree with EPA's conclusions. The science is based on the Linear No Threshold (LNT) dose response model for DBPs, but this may not be the correct model. 83% of EPA's epidemiological data show a statistical possibility that low levels of DBPs might be beneficial or have no effect.

An article in the Deseret News, one of two general circulation newspapers in Salt Lake City, Utah, dated December 13, 1996, reported that {open_quotes}David{close_quotes} took on {open_quotes}Goliath{close_quotes} and won. The article referred to the Davis County Solid Waste Management and Energy Recovery Special Service District`s (the {open_quotes}District{close_quotes}) victory on its challenge to the EPA`s municipal waste combustor rules. On December 6, 1996, the United States Court of Appeals for the District of Columbia Circuit ruled that the EPA violated the plain language of Section 129 of the Clean Air Act, when it wrote size categories for municipal waste combustors ({open_quotes}MWCs{close_quotes})more » based on aggregate plant capacity, rather than unit capacity. The District argued that Congress divided the universe of MWC units into two categories: those with unit capacities above 250 tons per day, and those with unit capacities equal to or less than 250 tons per day. The EPA, however, had set the dividing line at 248 tons per day aggregate plant capacity in its municipal waste combustor rule. The Court said this was wrong. The Deseret News report certainly echoed the feelings of the District. Those of you familiar with the EPA, the process of judicial review of administrative rule making, and the Biblical story of David and Goliath, however, will quickly see that this is not the best metaphor to describe what happened. When David slew Goliath, that was the end of Goliath. He didn`t get back up. Of course, that will not happen to the EPA in the Davis County case. Like an 800-pound gorilla, it will always get back up after being challenged by a mouse. This paper tells the story of the challenge to the MWC rule from the District`s perspective. The District has not been popular with either the EPA or many industry players. In 1997 then-US Environmental Protection Agency (EPA) Administrator Carol Browner adopted new National Ambient Air Quality Standards (NAAQS) for fine particulate matter (PM2.5). Browner recognized that 'there is uncertainty in the characterization of health effects attributable to exposure to ambient PM.' As a result, President Clinton promised to review the scientific basis for those standards prior to their implementation. Recently, before EPA has even promulgated rules concerning implementation of those standards, the agency proposed to revise those standards to make them significantly more stringent. ...The Agency is proposing to amend the Toxic Substances Control Act (TSCA) section 5(a) Significant New Use Rule (SNUR), for certain polybrominated diphenylethers (PBDEs) by: Designating processing of six PBDEs, or any combination of these chemical substances resulting from a chemical reaction, as a significant new use; designating manufacturing, importing, and processing of a seventh PBDE, decabromodiphenyl ether (decaBDE) for any use which is not ongoing after December 31, 2013, as a significant new use; and making inapplicable the article exemption for SNURs for this action. A person who intends to import or process any of the seven PBDEs included in the proposed SNUR, as part of an article for a significant new use would be required to notify EPA at least 90 days in advance to ensure that the Agency has an opportunity to review and, if necessary, restrict or prohibit a new use before it begins. EPA is also proposing a test rule under TSCA that would require any person who manufactures or processes commercial pentabromodiphenyl ether (c-pentaBDE), commercial octabromodiphenyl ether (c-octaBDE), or commercial decaBDE (c-decaBDE), including in articles, for any use after December 31, 2013, to conduct testing on their effects on health and the environment. EPA is proposing to designate all discontinued uses of PBDEs as significant new uses. The test rule would be promulgated if EPA determines that there are persons who intend to manufacture, import, or process c-pentaBDE, c-octaBDE, or c-decaBDE, for any use, including in articles, after December 31, 2013.

The Environmental Protection Agency has released the White House-instituted hold and review on the Bush Administration's last-minute rules and proposals. Of the 32 actions, EPA administrator Carol Browner has held back only one, which proposed a fee system for discharges to water. Any changes in the future were deemed to best be considered either in the comment period for proposals or with new proposed addendums for final rules, said Browner. Although a proposal concerning standards for reformulated gasoline was approved for publication, Browner emphasizes that the EPA can modify or drop provisions for ethanol mixtures and remains committed to negotiatedmore » rulemaking procedures. The proposed rule includes measures - set out by Bush last October - to grant ethanol a waiver from gasoline vapor pressure limits, resulting in a 30% market share for northern cities in violation of ozone limits. Ethanol could take a 20% share in southern cities. Under the ethanol waiver, refiners would have to offset the increased emissions from ethanol at a cost of at least $250 million, according to the American Petroleum Institute, API, state air pollution regulators, and environmentalists say the proposal violates a regulatory negotiation. Regarding the one-week delay, API says, The lengthy rule-making process already has drastically reduced the lead time available to refiners, who must begin selling this fuel on January 1, 1995'. Also released is the ozone-depleter phase-out proposal. In addition to chlorofluorocarbons, the Bush EPA slated methyl bromide for phase-outby the year 2000.« less

Under Executive Order 12898, the U.S. Environmental Protection Agency (EPA) must perform environmental justice (EJ) reviews of its rules and regulations. EJ analyses address the hypothesis that environmental disamenities are experienced disproportionately by poor and/or minority subgroups. Such analyses typically use communities as the unit of analysis. While community-based approaches make sense when considering where polluting sources locate, they are less appropriate for national air quality rules affecting many sources and pollutants that can travel thousands of miles. We compare exposures and health risks of EJ-identified individuals rather than communities to analyze EPA's Heavy Duty Diesel (HDD) rule as an example national air quality rule. Air pollutant exposures are estimated within grid cells by air quality models; all individuals in the same grid cell are assigned the same exposure. Using an inequality index, we find that inequality within racial/ethnic subgroups far outweighs inequality between them. We find, moreover, that the HDD rule leaves between-subgroup inequality essentially unchanged. Changes in health risks depend also on subgroups' baseline incidence rates, which differ across subgroups. Thus, health risk reductions may not follow the same pattern as reductions in exposure. These results are likely representative of other national air quality rules as well.

The US Environmental Protection Agency`s (EPA) proposed rule to certify that the Waste Isolation Pilot Plant (WIPP) meets compliance with the long-term radiation protection standards for geologic repositories (40CFR191 Subparts B and C), is one of the most significant milestones to date for the WIPP project in particular, and for the nuclear waste issue in general. The Environmental Evaluation Group (EEG) has provided an independent technical oversight for the WIPP project since 1978, and is responsible for many improvements in the location, design, and testing of various aspects of the project, including participation in the development of the EPA standardsmore » since the early 1980s. The EEG reviewed the development of documentation for assessing the WIPP`s compliance by the Sandia National Laboratories following the 1985 promulgation by EPA, and provided many written and verbal comments on various aspects of this effort, culminating in the overall review of the 1992 performance assessment. For the US Department of Energy`s (DOE) compliance certification application (CCA), the EEG provided detailed comments on the draft CCA in March, 1996, and additional comments through unpublished letters in 1997 (included as Appendices 8.1 and 8.2 in this report). Since the October 30, 1997, publication of the EPA`s proposed rule to certify WIPP, the EEG gave presentations on important issues to the EPA on December 10, 1997, and sent a December 31, 1997 letter with attachments to clarify those issues (Appendix 8.3). The EEG has raised a number of questions that may have an impact on compliance. In spite of the best efforts by the EEG, the EPA reaction to reviews and suggestions has been slow and apparently driven by legal considerations. This report discusses in detail the questions that have been raised about containment requirements. The U.S. Environmental Protection Agency (EPA) issued its draft scientific integrity policy on 5 August. The draft policy addresses scientific ethical standards, communications with the public, the use of advisory committees and peer review, and professional development. The draft policy was developed by an ad hoc group of EPA senior staff and scientists in response to a December 2010 memorandum on scientific integrity from the White House Office of Science and Technology Policy. ...The EPA is revising the rules for implementing the 1997 8-hour ozone national ambient air quality standards (NAAQS) to address certain limited portions of the rules vacated by the U.S. Court of Appeals for the District of Columbia Circuit. This final rule assigns Clean Air Act (CAA or Act) classifications and associated state planning and control requirements to selected ozone nonattainment areas. This final rule also addresses three vacated provisions of the 1997 8-hour NAAQS--Phase 1 Implementation Rule (April 30, 2004) that provided exemptions from the anti-backsliding requirements relating to nonattainment area New Source Review (NSR), CAA section 185 penalty fees, and contingency measures, as these three requirements applied for the 1-hour standard. This rule also reinstates the 1-hour contingency measures as applicable requirements that must be retained until the area attains the 1997 8- hour ozone standard. Finally, this rule deletes an obsolete provision that stayed the EPA's authority to revoke the 1-hour ozone standard pending the Agency's issuance of a final rule that revises or reinstates its revocation authority and considers and addresses certain other issues. That rule has now been issued.

Setting the Record Straight: Interest Group Influence on Climate Policy at the Environmental Protection Agency

It is clear that interest groups are involved in the rulemaking process at the Environmental Protection Agency (EPA), but it has been difficult to determine whether certain groups are more influential on outcomes. This debate persists because the literature illustrates that groups can be influential at discrete stages in the process, but the field rarely analyzes the entire rulemaking process. This uncertainty has spurred controversy regarding the EPA's recent climate change regulations. Therefore, this dissertation conducted three case studies of recent climate change regulations and addresses three questions. First, what, if any, strategies did interest groups use to influence the content of these climate change rules? Second, did these strategies translate into influence? Third, what can these climate change case studies tell us about the role of interest groups in other controversial rules at the EPA, and across the bureaucracy more broadly? Ultimately, I argue that interest group influence was generally balanced across each of the three case studies. These findings then serve as the basis to develop my Regulatory Spheres of Influence Framework. The framework illustrates that given the nature of EPA rulemakings, it is very difficult for one side either business or environmental to dominate the process in highly controversial rules. It is possible that these conclusions track to other controversial rules across the bureaucracy and I note that my framework could be applied in other contexts to test this assertion.

Playing by the Rules: Agency Policy and Procedure in Service Experience of IPV Survivors.

More than 1,800 programs exist in the United States, providing not only shelter but also transitional housing, advocacy and support, transportation, legal aid, and group and individual counseling for women who have experienced intimate partner violence (IPV). Shelter and transitional housing provide critical support for survivors, but have also been critiqued for having too many restrictive rules and code of conduct. More information is needed about the impact of rules and agency policy on women seeking services in IPV residential settings. This qualitative study explored the central research question, "How do rules shape IPV residential environment and survivor experiences in services?" Twenty-five women in four programs in two states who were currently residing in IPV residential services were interviewed about their experiences. Data were analyzed using grounded theory methods. Findings indicated rules affect individual survivors' and families' experiences and responses in services and of healing from IPV (micro), the relationships among residents and between residents and staff (mezzo), and participants' relationships with the agency as an institution and the help-seeking community (macro). An intriguing paradox is noted in that at their best, rules provide stability and motivation for some survivors. At their worst, rules create isolation and force exit from shelter into unsafe circumstances, causing a ripple effect of impact. Implications include the need to restructure rules and policies collaboratively with residents, and reduce the amount of rules used in services. Addressing rules will better enable IPV services to be survivor-centered and trauma-informed, ultimately increasing safety and healing.

Grid cells are based on densification of the USGS Quarterquad (1:12,000 scale or 12K) grids for the continental United States, Alaska, Hawaii and Puerto Rico and are roughly equivalent to 1:6000 scale (6K) quadrangles approximately 2 miles long on each side. In 1998, the United States Environmental Protection Agency (EPA) promulgated the maximum contaminant level (MCL) for bromate in drinking water at 10 microg/l, and the method for compliance monitoring of bromate in drinking water was established under Stage 1 of the Disinfectants/Disinfection By-Products Rule (D/DBP) as EPA Method 300.1. In January 2002, the United States Food and Drug Administration (FDA) regulated the bromate concentration in bottled waters at 10 microg/l. EPA anticipates proposing additional methods, which have improved performance for bromate monitoring, in addition to EPA Method 300.1, in the Stage 2 DBP Rule. Until the Stage 2 Rule is promulgated, EPA Method 300.1 will continue to be the only method approved for compliance monitoring of bromate. This manuscript describes the work completed at EPA's Technical Support Center (TSC) to assess the performance of recently developed suppressor technologies toward improving the trace level performance of EPA Method 300.1, specifically for the analysis of trace levels of bromate in high ionic matrices. Three different types of Dionex suppressors were evaluated. The baseline noise, return to baseline after the water dip, detection limits, precision and accuracy, and advantages/disadvantages of each suppressor are discussed. Performance data for the three different suppressors indicates that chemical suppression of the eluent, using the AMMS III suppressor, is the most effective means to reduce baseline noise, resulting in the best resolution and the lowest bromate detection limits, even when a high ionic matrix is analyzed. Incorporation of the AMMS III suppressor improves the performance of EPA Method 300.1 at and below 5.0 microg/l and is a quick way for laboratories to improve their bromate compliance monitoring.

Background Executive Order (EO) 13045, Protection of Children From Environmental Health Risks and Safety Risks, directs each federal agency to ensure that its policies, programs, activities, and standards address disproportionate environmental health and safety risks to children. Objectives We reviewed regulatory actions published by U.S. Environmental Protection Agency (EPA) in the Federal Register from April 1998 through December 2006 to evaluate applicability of EO 13045 to U.S. EPA actions and consideration of children’s health issues in U.S. EPA rulemakings. Discussion Although virtually all actions discussed EO 13045, fewer than two regulations per year, on average, were subject to the EO requirement to evaluate children’s environmental health risks. Nonetheless, U.S. EPA considered children’s environmental health in all actions addressing health or safety risks that may disproportionately affect children. Conclusion The EO does not apply to a broad enough set of regulatory actions to ensure protection of children’s health and safety risks, largely because of the small number of rules that are economically significant. However, given the large number of regulations that consider children’s health issues despite not being subject to the EO, other statutory requirements and agency policies reach a larger set of regulations to ensure protection of children’s environmental health. The Health Physics Society (HPS) provided comment to the U.S. Environmental Protection Agency (EPA) on options to consider when developing an action plan for President Trump's Executive Order to evaluate regulations for repeal, replacement, or modification. The HPS recommended that the EPA reconsider their adherence to the linear no-threshold (LNT) model for radiation risk calculations and improve several documents by better addressing uncertainties in low-dose, low dose-rate (LDDR) radiation exposure environments. The authors point out that use of the LNT model near background levels cannot provide reliable risk projections, use of the LNT model and collective-dose calculations in some EPA documents is inconsistent with the recommendations of international organizations, and some EPA documents have not been exposed to the public comment rule-making process. To assist in establishing a better scientific basis for the risks of low dose rate and low dose radiation exposure, the EPA should continue to support the "Million Worker Study," led by the National Council on Radiation Protection and Measurement.

The U.S. Environmental Protection Agency (EPA) Endocrine Disruptor Screening Program (EDSP) currently relies on an initial screening battery (Tier 1) consisting of five in vitro and six in vivo assays to evaluate a chemical's potential to interact with the endocrine system. Chemical companies may request test waivers based on Other Scientifically Relevant Information (OSRI) that is functionally equivalent to data gathered in the screening battery or that provides information on a potential endocrine effect. Respondents for 47 of the first 67 chemicals evaluated in the EDSP submitted OSRI in lieu of some or all Tier 1 tests, seeking 412 waivers, of which EPA granted only 93. For 20 of the 47 chemicals, EPA denied all OSRI and required the entire Tier 1 battery. Often, the OSRI accepted was either identical to data generated by the Tier 1 assay or indicated a positive result. Although identified as potential sources of OSRI in EPA guidance, Part 158 guideline studies for pesticide registration were seldom accepted by EPA. The 93 waivers reduced animal use by at least 3325 animals. We estimate 27,731 animals were used in the actual Tier 1 tests, with additional animals being used in preparation for testing. Even with EPA's shift toward applying 21st-century toxicology tools to screening of endocrine disruptors in the future, acceptance of OSRI will remain a primary means for avoiding duplicative testing and reducing use of animals in the EDSP. Therefore, it is essential that EPA develop a consistent and transparent basis for accepting OSRI. © 2013 Wiley Periodicals, Inc.

To improve public health and the environment, the United States Environmental Protection Agency (EPA) collects information about facilities, sites, or places subject to environmental regulation or of environmental interest. Through the Geospatial Data Download Service, the public is now able to download the EPA Geodata Shapefile, Feature Class or extensible markup language (XML) file containing facility and site information from EPA's national program systems. The files are Internet accessible from the Envirofacts Web site (https://www3.epa.gov/enviro/). The data may be used with geospatial mapping applications. (Note: The files omit facilities without latitude/longitude coordinates.) The EPA Geospatial Data contains the name, location (latitude/longitude), and EPA program information about specific facilities and sites. In addition, the files contain a Uniform Resource Locator (URL), which allows mapping applications to present an option to users to access additional EPA data resources on a specific facility or site.

Water and air pollution controls make significant contribution to the economy`s health, according to two EPA reports. Clean water provides billions of dollars in benefits to US industries, says a recently released study; and the agency`s draft report on the benefits of air pollution identifiesmore » $$20 in medical costs avoided for every dollar spent on pollution controls. The Clean Water Industry Coalition (CWIC) says the water report reaffirms the need to {open_quotes}modernize{close_quotes} the Clean Water Act (CWA), but EPA administrator Carol Browner says a CWA {open_quotes}rollback{close_quotes} supported by CWIC and passed by House Republicans last May would have jeopardized industries that depend on clean water by weakening effluent standards. Browner denies that the benefits of clean water as identified by the EPA report would have protected water standards from the bill`s cost-benefit requirements. A draft EPA report on clean air leaked by the American Lung Association estimates that tailpipe and smokestack controls for air pollution saved 79,000 lives and resulted in 15 million fewer respiratory illnesses in 1990 alone. As a collaborative and open approach to science, citizen science has the potential make science more actionable, applicable, and usable, especially when designed with scientists, communities and decision-makers as partners. In response to recent interest in citizen science from the US Environmental Protection Agency, the National Advisory Council for Environmental Policy and Technology provided EPA with advice and recommendations on how to integrate citizen science into the core work of EPA. The Council's 28 members—representatives of academia; business and industry; nongovernmental organizations; and state, local and tribal governments—identifies citizen science as an invaluable opportunity for EPA to strengthen public support for EPA's mission and the best approach for the Agency to connect with the public on environmental protection. The report recommends that EPA embrace citizen science as a core tenet of environmental protection, invest in citizen science for communities, partners, and the Agency, enable the use of citizen science data at the Agency, integrate citizen science into the full range of work of EPA. This presentation will outline principles and strategy for integrating citizen science into science and policy at the national level, increasing the usability of citizen science data for decision-making and policy, and leveraging citizen science for environmental protection.

...EPA is tailoring the applicability criteria that determine which stationary sources and modification projects become subject to permitting requirements for greenhouse gas (GHG) emissions under the Prevention of Significant Deterioration (PSD) and title V programs of the Clean Air Act (CAA or Act). This rulemaking is necessary because without it PSD and title V requirements would apply, as of January 2, 2011, at the 100 or 250 tons per year (tpy) levels provided under the CAA, greatly increasing the number of required permits, imposing undue costs on small sources, overwhelming the resources of permitting authorities, and severely impairing the functioning of the programs. EPA is relieving these resource burdens by phasing in the applicability of these programs to GHG sources, starting with the largest GHG emitters. This rule establishes two initial steps of the phase-in. The rule also commits the agency to take certain actions on future steps addressing smaller sources, but excludes certain smaller sources from PSD and title V permitting for GHG emissions until at least April 30, 2016.

A series of activities have been conducted by a core group of EPA scientists from across the Agency. The activities were initiated in 2012 and the focus was to increase the reuse and interoperability of science software at EPA. The need for increased reuse and interoperability is linked to the increased complexity of environmental assessments in the 21st century. This complexity is manifest in the form of problems that require integrated multi-disciplinary solutions. To enable the means to develop these solutions (i.e., science software systems) it is necessary to integrate software developed by disparate groups representing a variety of science domains. Thus, reuse and interoperability becomes imperative. This report briefly describes the chronology of activities conducted by the group of scientists to provide context for the primary purpose of this report, that is, to describe the proceedings and outcomes of the latest activity, a workshop entitled “Workshop on Advancing US EPA integration of environmental and information sciences”. The EPA has been lagging in digital maturity relative to the private sector and even other government agencies. This report helps begin the process of improving the agency’s use of digital technologies, especially in the areas of efficiency and transparency. This report contributes to SHC 1.61.2.

On September 20, 2013, the US Environmental and Protection Agency (EPA) proposed a revised rule for "Standards of Performance for Greenhouse Gas Emissions from New Stationary Sources: Electric Utility Generating Units". These performance standards set limits on the amount of carbon dioxide (CO2) that can be emitted per megawatt-hour (MWh) of electricity generation from new coal-fired and natural gas-fired power plants built in the US. These limits were based on determinations of "best system of emission reduction (BSER) adequately demonstrated". Central in this determination was evaluating whether Carbon Dioxide Capture and Storage (CCS) qualified as BSER. The proposed rule states that CCS qualifies as BSER for coal-fired generation but not for natural gas-fired generation. In this paper, we assess the EPA's analysis that resulted in this determination. We are not trying to judge what the absolute criteria are for CCS as the BSER but only the relative differences as related to coal- vs natural gas-fired technologies. We conclude that there are not enough differences between "base load" coal-fired and natural gas-fired power plants to justify the EPA's determination that CCS is the BSER for coal-fired power plants but not for natural gas-fired power plants.

The Environmental Protection Agency (EPA) Office of Superfund Remediation and Technology Innovation (OSRTI) and the Nuclear Regulatory Commission (NRC) are responsible for implementing the 'Memorandum of Understanding Between the Environmental Protection Agency and the Nuclear Regulatory Commission: Consultation and Finality on Decommissioning and Decontamination of Contaminated Sites'. This paper provides a brief overview of the origin of the Memorandum of Understanding (MOU), the major features of the MOU, and how the MOU has been implemented site specifically. EPA and NRC developed the MOU in response to direction from the House Committee on Appropriations to EPA and NRC to work togethermore » to address the potential for dual regulation. The MOU was signed by EPA on September 30, 2002 and NRC on October 9, 2002. The two agencies had worked on the MOU since March 2000. While both EPA and NRC have statutory authority to clean up these sites, the MOU provides consultation procedures between EPA and NRC to eliminate dual regulation. Under the MOU, EPA and NRC identified the interactions of the two agencies for the decommissioning and decontamination of NRC-licensed sites and the ways in which those responsibilities will be exercised. Except for Section VI, which addresses corrective action under the Resource Conservation and Recovery Act (RCRA), this MOU is limited to the coordination between EPA, when acting under its CERCLA authority, and NRC, when a facility licensed by the NRC is undergoing decommissioning, or when a facility has completed decommissioning, and the NRC has terminated its license. EPA believes that implementation of the MOU between the two agencies will ensure that future confusion about dual regulation does not occur regarding the cleanup and reuse of NRC-licensed sites. NRC and EPA have so far exchanged MOU consultation letters on eight NRC-licensed sites. EPA has responded to each consultation request with a letter expressing its views on

The U.S. Environmental Protection Agency (EPA) Method 1694 for the determination of pharmaceuticals in water recently brought a new challenge for treatment utilities, where pharmaceuticals have been reported in the drinking water of 41-million Americans. This proposed methodology, designed to address this important issue, consists of solid-phase extraction (SPE) followed by liquid chromatography-mass spectrometry (LC/MS-MS) using triple quadrupole. Under the guidelines of Method 1694, a multi-residue method was developed, validated, and applied to wastewater, surface water and drinking water samples for the analysis of 70 pharmaceuticals. Four distinct chromatographic gradients and LC conditions were used according to the polarity and extraction of the different pharmaceuticals. Positive and negative ion electrospray were used with two MRM transitions (a quantifier and a qualifier ion for each compound), which adds extra confirmation not included in the original Method 1694. Finally, we verify, for the first time, EPA Method 1694 on water samples collected in several locations in Colorado, where positive identifications for several pharmaceuticals were found. This study is a valuable indicator of the potential of LC/MS-MS for routine quantitative multi-residue analysis of pharmaceuticals in drinking water and wastewater samples and will make monitoring studies much easier to develop for water utilities across the US, who are currently seeking guidance on analytical methods for pharmaceuticals in their water supplies. 2010 Elsevier B.V. The Oil database contains information on Spill Prevention, Control, and Countermeasure (SPCC) and Facility Response Plan (FRP) subject facilities to prevent and respond to oil spills. FRP facilities are referred to as substantial harm facilities due to the quantities of oil stored and facility characteristics. FRS identifies and geospatially locates facilities, sites or places subject to environmental regulations or of environmental interest. Using vigorous verification and data management procedures, FRS integrates facility data from EPA's national program systems, other federal agencies, and State and tribal master facility records and provides EPA with a centrally managed, single source of comprehensive and authoritative information on facilities. This data set contains the subset of FRS integrated facilities that link to Oil facilities once the Oil data has been integrated into the FRS database. The United States Environmental Protection Agency's (US EPA) digital science "enterprise" plays a critical role in US EPA's efforts to achieve its mission to protect human health and the environment. This enterprise is an evolving cross-disciplinary research and development construct, with social and institutional dimensions. It has an active development community and produces a portfolio of digital science products including decision support tools, data repositories, Web interfaces, and more. Earth sciences and sustainable development organizations from around the world - including US government agencies - have achieved various levels of success in taking advantage of the rapidly-evolving digital age. Efficiency, transparency and ability to innovate are tied to an organization's digital maturity and related social characteristics. Concepts like participatory web, data and software interoperability, global technology transfer, ontological harmonization, big data, scaling, re-use and open science are no longer "new and emerging." They have emerged and - in some cases - are tied to US government directives. We assess maturity, describe future scenarios, discuss new initiatives and outline steps for better leveraging the information age to more effectively and efficiently achieve US EPA's mission. The path for incorporating new alternative methods and technologies into quantitative chemical risk assessment poses a diverse set of scientific challenges. Some of these challenges include development of relevant and predictive test systems and computational models to integrate and extrapolate experimental data, and rapid characterization and acceptance of these systems and models. The series of presentations will highlight a collaborative effort between the U.S. Environmental Protection Agency (EPA) and the Agency for Science, Technology and Research (A*STAR) that is focused on developing and applying experimental and computational models for predicting chemical-induced liver and kidney toxicity, brain angiogenesis, and blood-brain-barrier formation. In addressing some of these challenges, the U.S. EPA and A*STAR collaboration will provide a glimpse of what chemical risk assessments could look like in the 21st century. Wisconsin officials are receiving hundreds of complaints about the alleged health effects and other problems with MTBE added to gasoline, and Gov. Tommy Thompson is demanding that EPA suspend the RFG program until April 1. Rep.
