    The basis for the school asbestos hazard program of the Environmental Protection Agency (EPA) is reviewed. Risk of disease following asbestos exposure is discussed. For industrial exposures, lung cancer risks cluster between 1 and 10 percent per fiber year per milliliter. For mesothelioma, estimates range from 0.01 to 0.06 percent. For nonoccupational exposure, lung cancer risks range from 2 to 40 per million exposed persons. Mesothelioma risks range from 2 to 100 per million. The indirect quantitative risk assessment of EPA for asbestos associated cancers due to exposures at schools in early life is discussed. As of May, 1982, approximately 8,600 schools contain friable asbestos and approximately 2 to 6 million students and 100,000 to 300,000 teachers, administrators, and other staff are potentially exposed to airborne asbestos in these schools.

    In Citizens Coal Council v. EPA, an en banc panel for the Sixth Circuit Court of Appeals considered a challenge to EPA regulations promulgated pursuant to the Clean Water Act (CWA). The EPA promulgated the regulations in an attempt to incentivize coal companies to remine once abandoned mine sites. Petitioners, two nonprofit environmental organizations, claimed that the regulations violated the Clean Water Act and Administrative Procedure Act by allowing coal companies to remine without adhering to any enforceable pollution limitations. The EPA countered that more remining would improve water quality at abandoned sites. The Sixth Circuit rejected Petitioners' claims, finding that the EPA's regulations were reasonably consistent with the CWA's goal of restoring the integrity of the nation's waters. In so holding, the court struggled to understand the meaning of the CWA's complex procedural and technical language, and allowed the EPA to justify the rule based on the CWA's broad statement of purpose. Such superficial judicial review sets a dangerous precedent in environmental law, because it exacerbates the risk of agency capture. A captured agency promulgates regulations that benefit-industry, not the environment. Without the judiciary acting as a meaningful check against agency capture, the public loses a valuable tool in the fight against major-industrial polluters like the domestic coal industry. Citizens Coal Council therefore stands as a cautionary tale, a warning sign that the judiciary may be unable to identify agency capture where the regulations at issue are promulgated pursuant to a complex statute like the Clean Water Act.

    The U.S. EPA Regional Oxidant Model (ROM) and NEROS data base are described. The model incorporates a comprehensive description of the physical and chemical processes thought to be important to tropospheric O3 production on 1000-km scales. The data base employed for the first application of the ROM was collected during the summers of 1979 and 1980 in the Northeast U.S. It contains meteorological and air-quality data from regular monitoring networks and from enhanced networks or special field-project measurements during that period. The evaluation procedure that will be used to determine the ROM performance on this data base is outlined. A number of episodes will be simulated from the period July 23 through August 16, 1980, for which performance statistics will be developed. The evaluation of any given day within an episode will proceed in two distinct stages. The first stage will focus on model performance for an individual model realization, irrespective of all other realizations. Model realizations for a given day are functions of the possible flow fields that existed for the day. The second stage will attempt to evaluate model performance using the full probabilistic abilities of the ROM that consider all realizations concurrently. The focus of the evaluation will be on O3. The exact pathway through the evaluation study will be determined by the resources available at the time.

    During emergencies in the United States, the Environmental Protection Agency (EPA) currently recommends using bottled water, or boiling or treating water by adding 1/8 teaspoon (or 8 drops) of bleach to 1 gal of water. This bleach recommendation is internally inconsistent, a relatively high chlorine dose (5.55-8.67 mg/L), and unsupported by evidence. In this study, bleach was added in three different dosages to six waters available to emergency-affected populations in each of six states; free chlorine residual (FCR) and Escherichia coli/total coliforms were measured 1-24 h after treatment. Data were analyzed using four efficacy criteria. Results indicated the dosages in the current EPA recommendation are unnecessarily high to ensure (1) maintenance of FCR for 24 h after treatment, (2) absence of E. coli/total coliforms, and (3) establishment of a CT-factor sufficient to inactivate Giardia lamblia and enteric viruses 1 h after treatment. Additionally, emergency-prone populations did not have the materials to complete treatment with bleach in their household. Therefore, we recommend EPA review and revise the current recommendation to establish an internally consistent, criteria-based recommendation that is usable by emergency-affected populations. We also recommend investigating the use of new or commercially available water treatment products for emergency response in the United States.

    On October 9, 1991, the US Environmental Protection Agency (EPA) published in the Federal Register a rule relating to municipal solid waste landfill units, 40 CFR 258, also known as the State and Tribal Implementation Rule, or STIR. This set into motion federal mandates established under Subtitle D of the Resource Conservation and Recovery Act of 1976 (RCRA), as amended, which requires state adoption and implementation of a solid waste permit program or other system of prior approval, with approval of the state program by the EPA required by October 9, 1993. Washington State's solid waste permit program is, in comparison with other states' programs, unique, since the state of Washington does not issue permits. This task is and has remained the responsibility of local jurisdiction health departments since Washington State promulgated its first solid waste laws in 1969. The challenge of the state is to develop a strategy for adequacy determination'' that meets federal criteria yet addresses the historical traditions of Washington State. This paper outlines the strategy and process followed and issues examined by the state of Washington's Department of Ecology as it has prepared its application for determination of adequacy with the EPA to meet the federal requirements established under RCRA Subtitle D.

  13. Analysis of 70 Environmental Protection Agency priority pharmaceuticals in water by EPA Method 1694.

    The U.S. Environmental Protection Agency (EPA) Method 1694 for the determination of pharmaceuticals in water recently brought a new challenge for treatment utilities, where pharmaceuticals have been reported in the drinking water of 41-million Americans. This proposed methodology, designed to address this important issue, consists of solid-phase extraction (SPE) followed by liquid chromatography-mass spectrometry (LC/MS-MS) using triple quadrupole. Under the guidelines of Method 1694, a multi-residue method was developed, validated, and applied to wastewater, surface water and drinking water samples for the analysis of 70 pharmaceuticals. Four distinct chromatographic gradients and LC conditions were used according to the polarity and extraction of the different pharmaceuticals. Positive and negative ion electrospray were used with two MRM transitions (a quantifier and a qualifier ion for each compound), which adds extra confirmation not included in the original Method 1694. Finally, we verify, for the first time, EPA Method 1694 on water samples collected in several locations in Colorado, where positive identifications for several pharmaceuticals were found. This study is a valuable indicator of the potential of LC/MS-MS for routine quantitative multi-residue analysis of pharmaceuticals in drinking water and wastewater samples and will make monitoring studies much easier to develop for water utilities across the US, who are currently seeking guidance on analytical methods for pharmaceuticals in their water supplies.

    ENERGY STAR is a voluntary energy efficiency-labeling program operated jointly by the United States Department of Energy and the United States Environmental Protection Agency (US EPA). Since the program inception in 1992, ENERGY STAR has become a leading international brand for energy efficient products. ENERGY STAR's central role in the development of regional, national, and international energy programs necessitates an open process whereby its program achievements to date as well as projected future savings are shared with committed stakeholders. Through 2006, US EPA?S ENERGY STAR labeled products saved 4.8 EJ of primary energy and avoided 82 Tg C equivalent. We project that US EPA?S ENERGY STAR labeled products will save 12.8 EJ and avoid 203 Tg C equivalent over the period 2007-2015. A sensitivity analysis examining two key inputs (carbon factor and ENERGY STAR unit sales) bounds the best estimate of carbon avoided between 54 Tg C and 107 Tg C (1993 to 2006) and between 132 Tg C and 278 Tg C (2007 to 2015).

    The Uranium Mill Tailings Remedial Action (UMTRA) Project involves stabilizing 24 inactive uranium mill tailings piles in 10 states. Remedial work must meet standards established by the US Environmental Protection Agency (EPA). Remedial action must be designed and constructed to prevent dispersion of the tailings and other contaminated materials, and must prevent the inadvertent use of the tailings by man. This report is prepared primarily for distribution to parties involved in the UMTRA Project, including the US Nuclear Regulatory Commission (NRC), and states and tribes. It is intended to record the work done by the DOE since publication of the proposed EPA groundwater protection standards, and to show how the DOE has attempted to respond and react in a positive way to the new requirements that result from the proposed standards. This report discusses the groundwater compliance strategies now being defined and implemented by the DOE, and details the changes in disposal cell designs that result from studies to evaluate ways to facilitate compliance with the proposed EPA groundwater protection standards. This report also serves to record the technical advances, planning, and progress made on the UMTRA Project since the appearance of the proposed EPA groundwater protection standards.     Twenty-three missions were flown using the EPA's panoramic camera to obtain color and color infrared photographs of landslide and flood damage in Utah. From the state's point of view, there were many successes. The biggest single obstacle to smooth and continued performance was unavailable aircraft. The Memorandum of Understanding between the State of Utah, the Environmental Protection Agency, and the Center for Remote Sensing and Cartography is included along with forms for planning enviropod missions, for requesting flights, and for obtaining feedback from participating agencies.

    The EPA Airborne Spectral Photometric Environmental Collection Technology (ASPECT) Program provides airborne ortho-rectified imagery, video, chemical and now radiological information directly to emergency response personnel via a commercial satellite link onboard the aircraft. EPA initiated the ASPECT Gamma Emergency Mapper GEM Project in 2008 to improve its airborne gamma-screening and mapping capability for monitoring any ground-based gamma contamination. This paper will provide an overview of the system, which can be configured to carry six 2"x4"x16" NaI(Tl) detectors and two 3"x3" LaBr3(Ce) detectors or eight 2"x4"x16" NaI(Tl) detectors. The paper will provide an overview of the analysis of gamma radiation spectra, system limitations, and emergency response applications.

    The U.S. Environmental Protection Agency (EPA) Endocrine Disruptor Screening Program (EDSP) currently relies on an initial screening battery (Tier 1) consisting of five in vitro and six in vivo assays to evaluate a chemical's potential to interact with the endocrine system. Chemical companies may request test waivers based on Other Scientifically Relevant Information (OSRI) that is functionally equivalent to data gathered in the screening battery or that provides information on a potential endocrine effect. Respondents for 47 of the first 67 chemicals evaluated in the EDSP submitted OSRI in lieu of some or all Tier 1 tests, seeking 412 waivers, of which EPA granted only 93. For 20 of the 47 chemicals, EPA denied all OSRI and required the entire Tier 1 battery. Often, the OSRI accepted was either identical to data generated by the Tier 1 assay or indicated a positive result. Although identified as potential sources of OSRI in EPA guidance, Part 158 guideline studies for pesticide registration were seldom accepted by EPA. The 93 waivers reduced animal use by at least 3325 animals. We estimate 27,731 animals were used in the actual Tier 1 tests, with additional animals being used in preparation for testing. Even with EPA's shift toward applying 21st-century toxicology tools to screening of endocrine disruptors in the future, acceptance of OSRI will remain a primary means for avoiding duplicative testing and reducing use of animals in the EDSP. Therefore, it is essential that EPA develop a consistent and transparent basis for accepting OSRI.

    The U.S. EPA's particulate research and development program, divided between an in-house laboratory effort and extramural work at various research institutes, makes use of electrostatics in most of the work associated with stack or ducted emissions. Research facilities which offer a large degree of flexibility and capability are described. Significant work currently underway, making use of electrostatics, includes: (1) smooth large-diameter discharge electrodes (9-10 mm), that have been evaluated in 1/3- and 10-MW pilot units; (2) the multistage electrostatic precipitator (ESP), consisting of several two-stage ESPs in series, each using cold-pipe prechargers and collectors with large diameter electrodes; (3) the E-SOX process, combining the multistage ESP with a spray dryer in an existing ESP, for simultaneous SO2 and fly ash removal (including injections of soda ash and lime slurry droplets); and (4) electrostatically augmented fabric filtration with fly ash (including spray drying by-product material).

    The educational role of state geological surveys is increasing yet state funding for this role is commonly lacking. Staff members of the Geological Survey of Alabama/State Oil and Gas Board of Alabama have developed and implemented a succesful Outside Funding Model to support educational outreach programs. Staff members created an informal organization within the agency and raised money specifically for educational outreach. The primary vehicles for fund raising are an annual charity golf tournament, sales of t-shirts and field-trip guidebooks, and small grants awarded by a variety of organizations. The money raised is used to fund a wide variety of educational activities that would not be possible otherwise. The Alabama Outside Funding Model could be duplicated by surveys or similar agencies in other states.

  19. A Case Study Perspective on Working with ProUCL and a State Environmental Agency in Determining Background Threshold Values.

    ProUCL is a software package made available by the Environmental Protection Agency (EPA) to provide environmental scientists with better tools with which to conduct statistical analyses. ProUCL has been in production for over ten years and is in its fifth major version. In time, it has included more sophisticated and appropriate analysis tools. However, there is still substantial criticism of it among statisticians for its various omissions and even its philosophical approach. Due to limited resources, some state agencies have set ProUCL as a standard by which all state-mandated environmental analyses are compared, despite the EPA's more open acceptance of other software products and methodologies. As such, it can be difficult for state-supervised sites to convince the state to allow the use of more appropriate methodologies or different software. In the current case study, several such instances arose and substantial resources were invested to demonstrate the appropriateness of alternative methodologies, sometimes without acquiring acceptance by the state despite sound statistical demonstration. In particular, efforts were made to address: inappropriate outlier detection, upper tolerance limit (UTL) calculations based on gamma distributions when non-detects were present, and inappropriate use of nonparametric UTL formulas.

Many of the suggested revisions will add increased flexibility to the utility industry in implementing and complying with the requirements of Part 75. Other revisions will clarify existing provisions in an effort to make the regulation more understandable.     Computational toxicology combines data from high-throughput test methods, chemical structure analyses and other biological domains (e.g., genes, proteins, cells, tissues) with the goals of predicting and understanding the underlying mechanistic causes of chemical toxicity and for predicting toxicity of new chemicals and products. A key feature of such approaches is their reliance on knowledge extracted from large collections of data and data sets in computable formats. The U.S. Environmental Protection Agency (EPA) has developed a large data resource called ACToR (Aggregated Computational Toxicology Resource) to support these data-intensive efforts. ACToR comprises four main repositories: core ACToR (chemical identifiers and structures, and summary data on hazard, exposure, use, and other domains), ToxRefDB (Toxicity Reference Database, a compilation of detailed in vivo toxicity data from guideline studies), ExpoCastDB (detailed human exposure data from observational studies of selected chemicals), and ToxCastDB (data from high-throughput screening programs, including links to underlying biological information related to genes and pathways). The EPA DSSTox (Distributed Structure-Searchable Toxicity) program provides expert-reviewed chemical structures and associated information for these and other high-interest public inventories. Overall, the ACToR system contains information on about 400,000 chemicals from 1100 different sources. The entire system is built using open source tools and is freely available to download. This review describes the organization of the data repository and provides selected examples of use cases.

    An easy-to-use indoor-air-quality (IAQ) model is described. It is multi-compartmented and based on a well-mixed mixing model. Sources and sinks are allowed in each compartment. A menu-driven fill-in-the-form user interface controls program flow and is used to obtain data from the user. On-screen graphical output is provided. The model estimates the effects of heating, ventilation, and air conditioning (HVAC), air cleaning, room-to-room air movement, and natural ventilation on pollutant concentrations. Experiments conducted in the EPA test house using moth crystal cakes for model verification are described. The agreement between small chamber emission factors, model predictions, and test house data is very good. Predicted weight loss of the moth crystal cakes was within 5% of the measured weight loss. Predicted room concentrations of p-dichlorobenzene are within 20% of the measured values. Future directions for model development and experimental studies are discussed.

    As part of an agency evaluation of the development of risk assessment tools, the U.S. Environmental Protection Agency (U.S. EPA) issued a staff paper in March 2004 describing the current state of practices and policies regarding risk assessment from the agency's perspective. The staff paper provided a rationale for the agency's positions regarding technical topics frequently the subject of comments or complaints. Considerations relevant to ecological risk assessment were included, primarily in a single chapter focused on this topic. This commentary highlights four technical issues important to the advancement of ecological risk assessment practice and discusses how some of the points raised by the U.S. EPA in the staff paper have significance to ecological risk assessors. Discussion regarding incorporating population- and community-level analysis into risk assessments and the apparent reluctance of the U.S. EPA to adopt advances in this area is provided. Also, continuing inconsistencies in the body weight scaling of toxicity values between human health and ecological risk assessment practices are discussed. Ideas for refining the calculation of exposure point concentrations for ecological receptors and the progression between screening steps and comprehensive risk assessment are also discussed.

    The Wave Propagation Laboratory (WPL) participated in the Environmental Protection Agency's Complex Terrain Model Development Project, whose objective is development of numerical air-quality models valid in complex terrain. Particular attention was given to impaction of elevated plumes on high terrain during stable (nocturnal) conditions. WPL operated a plume-mapping lidar, acoustic sounders (some with Doppler capability), sonic anemometers, a tethered sonde, and crosswind optical anemometers. Measurements were usually displayed in real time for experimental guidance and later processed with quality assurance for quantitative analysis. A synopsis of data acquisition and archiving is given for each experiment, including a review of the results of scientific analyses already completed.

    This report describes filter extractions and Ames bioassay of filter extracts performed for the Emission Control Technology Division of Environmental Protection Agency. Eight sets of particulate-loaded filters were provided to SwRI by the sponsor. The filters were soxhlet-extracted in methylene chloride, and the extracts were dried and weighed. The organic extracts were analyzed using the Ames bioassay at Southwest Foundation for Biomedical Research (SFBR), formerly Southwest Foundation for Research and Education. The data were analyzed using linear and non-linear regression methods.

    This Record of Decision (ROD) documents the U.S. Environmental Protection Agency`s (EPA`s) selection of the remedial action for the Anchor Chemical Superfund Site (the `Site`). EPA, in consultation with the State of New York, has determined that the Achor Chemical Superfund Site does not pose a significant threat to human health or the environment and, therefore, further remediation is not appropriate. This determination is based on the findings of the Remedial Investigation and the baseline Risk Assessment. The risks posed by the Site are within EPA`s acceptable risk range and therefore do not pose a threat to human health or the environment.

    Computational toxicology combines data from high-throughput test methods, chemical structure analyses and other biological domains (e.g., genes, proteins, cells, tissues) with the goals of predicting and understanding the underlying mechanistic causes of chemical toxicity and for predicting toxicity of new chemicals and products. A key feature of such approaches is their reliance on knowledge extracted from large collections of data and data sets in computable formats. The U.S. Environmental Protection Agency (EPA) has developed a large data resource called ACToR (Aggregated Computational Toxicology Resource) to support these data-intensive efforts. ACToR comprises four main repositories: core ACToR (chemical identifiers and structures, and summary data on hazard, exposure, use, and other domains), ToxRefDB (Toxicity Reference Database, a compilation of detailed in vivo toxicity data from guideline studies), ExpoCastDB (detailed human exposure data from observational studies of selected chemicals), and ToxCastDB (data from high-throughput screening programs, including links to underlying biological information related to genes and pathways). The EPA DSSTox (Distributed Structure-Searchable Toxicity) program provides expert-reviewed chemical structures and associated information for these and other high-interest public inventories. Overall, the ACToR system contains information on about 400,000 chemicals from 1100 different sources. The entire system is built using open source tools and is freely available to download.     Texas offers a good model for the introduction of remotely sensed data products into the daily operations of state agencies by virtue of its large size and population. The diversity of the Texas landscape coupled with the long distances traveled to perform site inspections place special burdens on the land resource agencies responsible for monitoring crop conditions, water availability, environmental hazards and other natural resource issues. To assist these agencies, the Texas Synergy team has adopted a two-phase approach that incorporates framework geospatial data products designed for the broad user community with remote sensing applications developed for user-specific analyses. A key element to the success of the effort is the development of remote sensing products within a Texas Reference Frame that corresponds to the components of the high-resolution National Spatial Data Infrastructure developed by the state, such as 1-meter CIR digital orthophotographs, digital elevation models, and vector layers for hypsography, hydrography, soils, transportation and boundaries. Users accustomed to working with NSDI products can easily begin to include recently-collected EOS data presented within the same reference frame. Examples of statewide data products made available through the Texas Synergy project are AVHRR NDVI and MODIS imagery, Landsat 7 ETM+ scenes and SPOT 10-meter panchromatic image tiles. Delivery of the products involves a number of mechanisms from CD distribution to Internet FTP downloads, but increasingly relies upon Internet map services, such as ESRI's ArcIMS. Beyond release of the base imagery products, the Texas Synergy team has worked with the Texas Parks and Wildlife Department, Texas Soil and Water Conservation Board, Texas Department of Agriculture, Texas Water Development Board, National Park Service and USDA Natural Resources Conservation Service on a wide range of data applications.     ProUCL is a software package made available by the Environmental Protection Agency (EPA) to provide environmental scientists with better tools with which to conduct statistical analyses. ProUCL has been in production for over ten years and is in its fifth major version. In time, it has included more sophisticated and appropriate analysis tools. However, there is still substantial criticism of it among statisticians for its various omissions and even its philosophical approach. Due to limited resources, some state agencies have set ProUCL as a standard by which all state-mandated environmental analyses are compared, despite the EPA’s more open acceptance of other software products and methodologies. As such, it can be difficult for state-supervised sites to convince the state to allow the use of more appropriate methodologies or different software. In the current case study, several such instances arose and substantial resources were invested to demonstrate the appropriateness of alternative methodologies, sometimes without acquiring acceptance by the state despite sound statistical demonstration. In particular, efforts were made to address: inappropriate outlier detection, upper tolerance limit (UTL) calculations based on gamma distributions when non-detects were present, and inappropriate use of nonparametric UTL formulas.
