The substance of my remarks tonight will be far narrower in scope than the prescribed title of my talk would indicate. This reflects two considerations: first, this topical meeting is focused on technologies associated with nuclear weapons systems; and, second, President Reagan recently (i.e., on March 23, 1983) called for ``a program to counter the awesome Soviet missile threat with measures that are defensive.'' In light of these considerations, I will concentrate tonight on the case of anti-ballistic missile (ABM) systems as an example of a countinuing effort to limit technology by negotiated agreement? Why limit ABM systems? After all, such systems are defensive in nature, not offensive. Defensive systems are intended to protect people and the things of value to them. It is the offensive systems that cause death and destruction. Why don't we just go ahead and deploy the best available ABM system, and develop and test even better systems for deployment in the future?

Trust and technology: the social foundations of aviation regulation.

This paper looks at the dilemmas posed by 'expertise' in high-technology regulation by examining the US Federal Aviation Administration's (FAA) 'type-certification' process, through which they evaluate new designs of civil aircraft. It observes that the FAA delegate a large amount of this work to the manufacturers themselves, and discusses why they do this by invoking arguments from the sociology of science and technology. It suggests that - contrary to popular portrayal - regulators of high technologies face an inevitable epistemic barrier when making technological assessments, which forces them to delegate technical questions to people with more tacit knowledge, and hence to 'regulate' at a distance by evaluating 'trust' rather than 'technology'. It then unravels some of the implications of this and its relation to our theories of regulation and 'regulatory capture'.

Mapping technological and biophysical capacities of watersheds to regulate floods

Flood regulation is a widely valued and studied service provided by watersheds. Flood regulation benefits people directly by decreasing the socio-economic costs of flooding and indirectly by its positive impacts on cultural (e.g., fishing) and provisioning (e.g., water supply) ecosystem services. Like other regulating ecosystem services (e.g., pollination, water purification), flood regulation is often enhanced or replaced by technology, but the relative efficacy of natural versus technological features in controlling floods has scarcely been examined. In an effort to assess flood regulation capacity for selected urban watersheds in the southeastern United States, we: (1) used long-term flood records to assess relative influence of technological and biophysical indicators on flood magnitude and duration, (2) compared the widely used runoff curve number (RCN) approach for assessing the biophysical capacity to regulate floods to an alternative approach that acknowledges land cover and soil properties separately, and (3) mapped technological and biophysical flood regulation capacities based on indicator importance-values derived for flood magnitude and duration. We found that watersheds with high biophysical (via the alternative approach) and technological capacities lengthened the duration and lowered the peak of floods. We found the RCN approach yielded results opposite that expected, possibly because it confounds soil and land cover processes, particularly in urban landscapes, while our alternative approach coherently separates these processes. Mapping biophysical (via the alternative approach) and technological capacities revealed great differences among watersheds. Our study improves on previous mapping of flood regulation by (1) incorporating technological capacity, (2) providing high spatial resolution (i.e., 10-m pixel) maps of watershed capacities, and (3) deriving importance-values for selected landscape indicators. This is perhaps especially evident in debates around 'anticipatory governance' or 'upstream engagement'. Here, we interrogate this thesis using the example of the European Union's regulation of emerging health technologies (such as nanotechnology). In this case, citizen participation in regulatory debate is concerned with innovative objects for medical application that are considered to be emergent or not yet concrete. Through synthesising insights from law, regulatory studies, critical theory, and science and technology studies, we seek to cast new light on the promises, paradoxes, and pitfalls of citizen participation as a tool or technology of regulation in itself. As such we aim to generate a new vantage point from which to view the values and sociotechnical imaginaries that are both 'designed-in' and 'designed-out' of citizen participation. In so doing, we show not only how publics (do not) regulate technologies, but also how citizens themselves are regulated through the techniques of participation.

Innovation, Diffusion, and Regulation in Energy Technologies

The innovation and diffusion of new technologies is one of the central concerns of economics. New inventions or technological combinations do not spring fully formed into the world; as firms encounter and learn about new technologies they experiment, refine, and learn about them, improving productivity (and sometimes earning economic rents). Understanding the processes by which firms learn, and how these processes interact with regulations, is fundamental to understanding the emergence of new technologies, their contribution to growth, and the interaction of innovation and regulation. This dissertation addresses how firms learn and respond to regulations in the context of emerging technologies. Within this framework, I address several questions. When production inputs are socially controversial, do firms respond to disclosure laws by voluntarily constraining their inputs? Do these public disclosure laws facilitate knowledge transmission across firms, and if so, what are the implications for public welfare - for instance, do the gains from trade outweigh any effects of reduced incentives for innovation? I study these questions in the context of hydraulic fracturing, though the results offer insight for more general settings. Panning out to a much broader view, I also explore how energy-related technologies - in both generation and consumption - diffuse across national boundaries over time, and whether innovation and diffusion of energy-efficient technologies has led to more or less energy-efficient economic growth. In my first paper, I contribute to improved understanding of the conditions in which information-based regulations, which are increasingly common in multiple policy domains, decrease externalities such as environmental pollution. Specifically, I test whether information disclosure regulations applied to hydraulic fracturing chemicals caused firms to decrease their use of toxic inputs. To evaluate compliance with the self-regulation agreement of the food and drink vending machine sector in primary schools in Madrid, Spain. Cross-sectional study of the prevalence of vending machines in 558 primary schools in 2008. Using the directory of all registered primary schools in Madrid, we identified the presence of machines by telephone interviews and evaluated compliance with the agreement by visiting the schools and assessing accessibility, type of publicity, the products offered and knowledge of the agreement. The prevalence of schools with vending machines was 5.8%. None of the schools reported knowledge of the agreement or of its nutritional guidelines, and most machines were accessible to primary school pupils (79.3%) and packed with high-calorie, low-nutrient-dense foods (58.6%). Compliance with the self-regulation agreement of the vending machines sector was low. Stricter regulation should receive priority in the battle against the obesity epidemic. Copyright © 2013 SESPAS. Nowadays, it is becoming increasingly common to deploy sensors in public buildings or homes with the aim of obtaining data from the environment and taking decisions that help to save energy. Many of the current state-of-the-art systems make decisions considering solely the environmental factors that cause the consumption of energy. These systems are successful at optimizing energy consumption; however, they do not adapt to the preferences of users and their comfort. Any system that is to be used by end-users should consider factors that affect their wellbeing. Thus, this article proposes an energy-saving system, which apart from considering the environmental conditions also adapts to the preferences of inhabitants. The architecture is based on a Multi-Agent System (MAS), its agents use Agreement Technologies (AT) to perform a negotiation process between the comfort preferences of the users and the degree of optimization that the system can achieve according to these preferences. A case study was conducted in an office building, showing that the proposed system achieved average energy savings of 17.15%.

The Trans Pacific Partnership Agreement (TPP) is a large regional trade agreement involving 12 countries. It was signed in principle in February 2016 but has not yet been ratified in any of the participating countries. The TPP provisions place a range of constraints on how governments regulate the pharmaceutical sector and set prices for medicines. This article presents a prospective policy analysis of the possible effects of the TPP on these two points in Canada and Australia. Five chapters of relevance to pharmaceutical policy are analyzed: chapters on Technical Barriers to Trade (Chapter 8), Intellectual Property (Chapter 18), Investment (Chapter 9), Dispute Resolution (Chapter 28), and an annex of the chapter on Transparency and Anti-Corruption (Chapter 26, Annex 26-A). The article concludes that the TPP could have profound effects on the criteria these countries use to decide on drug safety and effectiveness, how new drugs are approved (or not) for marketing, post-market surveillance and inspection, the listing of drugs on public formularies, and how individual drugs are priced in the future. Furthermore, the TPP, if ratified and enforced, will reduce future policy flexibility to address the increasing challenge of rising drug prices. © The Author(s) 2016.

Validation of an instrument to measure students' motivation and self-regulation towards technology learning

Background:Few studies have examined students' attitudinal perceptions of technology. There is no appropriate instrument to measure senior high school students' motivation and self-regulation toward technology learning among the current existing instruments in the field of technology education. Purpose:The present study is to validate an instrument for assessing senior high school students' motivation and self-regulation towards technology learning. Sample:A total of 1822 Taiwanese senior high school students (1020 males and 802 females) responded to the newly developed instrument. Design and method:The Motivation and Self-regulation towards Technology Learning (MSRTL) instrument was developed based on the previous instruments measuring students' motivation and self-regulation towards science learning. Exploratory and confirmatory factor analyses were utilized to investigate the structure of the items. Cronbach's alpha was applied for measuring the internal consistency of each scale. Furthermore, multivariate analysis of variance was used to examine gender differences. Results:Seven scales, including 'Technology learning self-efficacy,' 'Technology learning value,' 'Technology active learning strategies,' 'Technology learning environment stimulation,' 'Technology learning goal-orientation,' 'Technology learning self-regulation-triggering,' and 'Technology learning self-regulation-implementing' were confirmed for the MSRTL instrument. Moreover, the results also showed that male and female students did not present the same degree of preference in all of the scales. Conclusions:The MSRTL instrument composed of seven scales corresponding to 39 items was shown to be valid based on validity and reliability analyses. While male students tended to express more positive and active performance in the motivation scales, no gender differences were found in the self-regulation scales.

Self-regulation of recombinant DNA technology in Japan in the 1970s.

Recombinant DNA technology was developed in the United States in the early 1970s. Leading scientists held an international Asilomar Conference in 1975 to examine the self regulation of recombinant DNA technology, followed by the U.S. National Institutes of Health drafting the Recombinant DNA Research Guidelines in 1976. The result of this conference significantly affected many nations, including Japan. However, there have been few historical studies on the self-regulation of recombinant technologies conducted by scientists and government officials in Japan. The purpose of this paper is to analyze how the Science Council of Japan, the Ministry of Education, Science adn Culture, and the Science and Technology Agency developed self-regulation policies for recombinant DNA technology in Japan in the 1970s. Groups of molecular biologist and geneticists played a key role in establishing guidelines in cooperation with government officials. Our findings suggest that self-regulation policies on recombinant DNA technology have influenced safety management for the life sciences and establishment of institutions for review in Japan.

Climate regulation enhances the value of second generation biofuel technology

Commercial scale implementation of second generation (2G) biofuels has long been 'just over the horizon - perhaps a decade away'. However, with recent innovations, and higher oil prices, we appear to be on the verge of finally seeing commercial scale implementations of cellulosic to liquid fuel conversion technologies. Interest in this technology derives from many quarters. Environmentalists see this as a way of reducing our carbon footprint, however, absent a global market for carbon emissions, private firms will not factor this into their investment decisions. Those interested in poverty and nutrition see this as a channel for lessening the biofuels' impact on food prices. But what is 2G technology worth to society? How valuable are prospective improvements in this technology? And how are these valuations affected by future uncertainties, including climate regulation, climate change impacts, and energy prices? This paper addresses all of these questions. We employ FABLE, a dynamic optimization model for the world's land resources which characterizes the optimal long run path for protected natural lands, managed forests, crop and livestock land use, energy extraction and biofuels over the period 2005-2105. By running this model twice for each future state of the world - once with 2G biofuels technology available and once without - we measure the contribution of the technology to global welfare. Given the uncertainty in how these technologies are likely to evolve, we consider a range cost estimates - from optimistic to pessimistic. In addition to technological uncertainty, there is great uncertainty in the conditions characterizing our baseline for the 21st century. For each of the 2G technology scenarios, we therefore also consider a range of outcomes for key drivers of global land use, including: population, income, oil prices, climate change impacts and climate regulation. We find that the social valuation of 2G technologies depends critically on climate change

The study examines both existing and emerging regulatory frameworks in order to determine which type of regulations that would be most effective at promoting clean coal technology adoption in development Asia Pacific Economic Co-operation (APEC) economies and would be practical to implement. regulations targeting air emissions; regulations targeting water use; and regulations concerning coal combustion by-products. When considering the potential effect of existing and new environmental regulations on the adoption of clean coal the analysis of technologies was organised into three categories: environmental control technologies; high efficiency coal combustion technologies; and carbon dioxide capture and storage (CCS). Increased government regulation of the medical device industry produces higher expenses, a longer time to return investment capital, and greater uncertainty. As a result there are fewer new ventures and reduced efforts to develop new technology in established companies. The current federal regulatory framework has shifted from monitoring the product to monitoring the process. The inability to reach perfect performance in such a regulated environment subject to continuous and fluid interpretation guarantees non-compliance and growing ethical tension. Without new medical technology, we may be unable to maintain quality medical coverage in the face of rising demand. The author proposes risk assessment to set regulatory priorities; the conversion of a national weapons lab to a national device testing lab; the establishment of device standards and the monitoring of in-use performance against these standards; and the education of patients and users as to the results of these examinations.

The life sciences present a politically and ethically sensitive area of technology development. NBIC convergence-the convergence of nanotechnology, biotechnology, and information and cognitive technology-presents an increased interaction between the biological and physical sciences. As a result the bio-debate is no longer dominated by biotechnology, but driven by NBIC convergence. NBIC convergence enables two bioengineering megatrends: "biology becoming technology" and "technology becoming biology." The notion of living technologies captures the latter megatrend. Accordingly, living technology presents a politically and ethically sensitive area. This implies that governments sooner or later are faced with the challenge of both promoting and regulating the development of living technology. This article describes four current political models to deal with innovation promotion and risk regulation. Based on two specific developments in the field of living technologies-(psycho)physiological computing and synthetic biology-we reflect on appropriate governance strategies for living technologies. We conclude that recent pleas for anticipatory and deliberative governance tend to neglect the need for anticipatory regulation as a key factor in guiding the development of the life sciences from a societal perspective. In particular, when it is expected that a certain living technology will radically challenge current regulatory systems, one should opt for just such a more active biopolitical approach.

Scientists have repurposed an adaptive immune system of single cell organisms to create a new type of gene-editing tool: CRISPR (clustered regularly interspaced short palindromic repeats)-Cas technology. Scientists in China have reported its use in the genome modification of non-viable human embryos. This has ignited a spirited debate about the moral, ethical, scientific, and social implications of human germline genome engineering. There have also been calls for regulations; however, FDA has yet to formally announce its oversight of clinical applications of CRISPR-Cas systems. This paper reviews FDA regulation of previously controversial biotechnology breakthroughs, recombinant DNA and human cloning. It then shows that FDA is well positioned to regulate CRISPR-Cas clinical applications, due to its legislative mandates, its existing regulatory frameworks for gene therapies and assisted reproductive technologies, and other considerations.

In the aftermath of allegations of the misuse of human eggs in the United States, questions are being raised about whether profitable reproductive services should continue to function in a free market under the aegis of physicians or should be regulated. Other countries in which reproductive technologies are employed to a significant degree have developed regulations governing their use, many as a result of recommendations made by inter-disciplinary commissions that solicited public input. Policy makers in the United States have been reluctant to regulate reproductive technologies, however, because their use is politically controversial, they want to whittle down government, some do not consider infertility an illness, and some believe regulation would interfere with the right to reproduce. Yet the unfettered use of reproductive technologies can create such harms as lack of informed consent, providing procedures not medically indicated for financial gain, practice by unqualified personnel, injury to patients and donors, failure to screen donated gametes, and inadequate medical record keeping. Americans place special value on the welfare of children and those who bring them into the world. Such values can outweigh individual procreative liberty when new reproductive technologies are at issue. Although the optimal course would be to establish a regulatory body to govern reproductive technologies, this is not politically feasible now. The newly established National Bioethics Advisory Commission provides a forum in which issues surrounding reproductive technologies should be addressed at this time in the United States.

Most of the IPCC's AR5 scenarios that achieve these objectives contemplate the large-scale deployment of so-called "negative emissions technologies," with an emphasis on bioenergy and carbon capture and storage (BECCS), and to a lesser degree afforestation. BECCS could assuredly help society avoid passing critical climatic thresholds, or address overshoot scenarios in this century and beyond. However, it could also profound implications for food production, the status of forests, access to lands for livelihoods by vulnerable populations, and the integrity of critical ecosystems. This, in turn could have serious ramifications for human rights of some of the world's most vulnerable populations, including the rights to food, water, livelihoods and the benefits of biodiversity. The Preamble to the Paris Agreement acknowledges the need to take into consideration the potential impact of responses to climate change, providing that "Parties should, when taking action to address climate change, respect, promote and consider their respective obligations on human rights." This presentation will outline how application of a human rights-based approach to assessing such options could help to reconcile the objectives of ameliorating potential climatic impacts while protecting the human rights of potentially affected individuals and groups. This will include the potential role of Human Rights Impacts Assessments and potential configuration of HRIAs at the national and international level. It will also briefly suggest how to operationalize this approach within the Paris Agreement framework, including institutional

The Safe Drinking Water Act and its Amendments have imposed a large number of new regulations on the US drinking-water industry. A major set of regulations currently under consideration will control disinfectants and disinfection by-products. Included in the development of these regulations is an Information Collection Rule and an Enhanced Surface Water Treatment Rule. These rules will require monitoring for microorganisms such as Giardia, Cryptosporidium, and viruses. Certain surface-water systems may be required to remove microbiological contaminants above levels currently required by the Surface Water Treatment Rule. Technology diffusion and environmental regulation: Evidence from electric power plants under the Clean Air Act

Even though environmental policy can greatly affect the path of technology diffusion, the economics literature contains limited empirical evidence of this relationship. My research will contribute to the available evidence by providing insight into the technology adoption decisions of electric generating firms. Since policies are often evaluated based on the incentives they provide to promote adoption of new technologies, it is important that policy makers understand the relationship between technological diffusion and regulation structure to make informed decisions. Lessons learned from this study can be used to guide future policies such as those directed to mitigate climate change. I first explore the diffusion of scrubbers, a sulfur dioxide (SO 2) abatement technology, in response to federal market-based regulations and state command-and-control regulations. I develop a simple theoretical model to describe the adoption decisions of scrubbers and use a survival model to empirically test the theoretical model. I find that power plants with strict command-and-control regulations have a high probability of installing a scrubber. These findings suggest that although market-based regulations have encouraged diffusion, many scrubbers have been installed because of state regulatory pressure. Although tradable permit systems are thought to give firms more flexibility in choosing abatement technologies, I show that interactions between a permit system and pre-existing command-and-control regulations can limit that flexibility. In a separate analysis, I explore the diffusion of combined cycle (CC) generating units, which are natural gas-fired generating units that are cleaner and more efficient than alternative generating units. I model the decision to consider adoption of a CC generating unit and the extent to which the technology is adopted in response to environmental regulations imposed on new sources of pollutants.
