Over the past 20 years, the U.S. Congress has passed four acts relating to clean air. The 1970 act set out a comprehensive plan for federal-state partnership to require all areas in the country to meet National Ambient Air Quality Standards. In 1977, the act was amended and expanded, both to address many of the problems encountered in the 1970 act and to reorient the law to limit significantly emissions of any sort, even if there were no currently identified health-related reasons. In 1986, the Emergency Planning and Community Right-to-know Act was passed, as an amendment to a solid waste law, in response to the desire to prevent chemical release tragedies. After 10 years of effort, Congress finally passed the 1990 Clean Air Act amendments which require a number of new programs aimed at curbing urban ozone, rural acid rain, stratospheric ozone, toxic air pollutant emissions and vehicle emissions, and establishing a new, uniform national permit system. This paper discusses some of the consequences of the various acts and suggests ways that others might learn from our 20 years of experience. Certain programs have worked quite well, while some alternatives could have improved other programs.

Section 107(d) of the Clean Air Act, as amended in 1990 (the Act), required states to identify all areas that do not meet the national ambient air quality standards (NAAQS) for ozone, and directed the Environmental Protection Agency (EPA) to designate these areas as ozone nonattainment areas. Section 181 of the Act required EPA to classify each area as a marginal, moderate, serious, severe or extreme ozone nonattainment area. EPA classified all areas that were designated as in nonattainment for ozone at the time of the enactment of the 1990 Amendments, except for certain "nonclassifiable" areas (56 FR 56694, November 6, 1991).

...The Environmental Protection Agency (EPA) is granting the California Air Resources Board's (CARB's) request for a waiver of Clean Air Act preemption to enforce its Advanced Clean Car (ACC) regulations. The ACC combines the control of smog and soot causing pollutants and greenhouse gas (GHG) emissions into a single coordinated package of requirements for passenger cars, light-duty trucks and medium-duty passenger vehicles (and limited requirements related to heavy-duty vehicles). The ACC program includes revisions to California's Low Emission Vehicle (LEV) program as well as its Zero Emission Vehicle (ZEV) program. By today's decision, EPA has also determined that CARB's amendments to the ZEV program as they affect 2017 and prior model years (MYs) are within the scope of previous waivers of preemption granted to California for its ZEV regulations. In the alternative, EPA's waiver of preemption for CARB's ACC regulations includes a waiver of preemption for CARB's ZEV amendments as they affect all MYs, including 2017 and prior MYs. In addition, EPA is including CARB's recently adopted ``deemed to comply'' rule for GHG emissions in today's waiver decision. This decision is issued under section 209(b) of the Clean Air Act (the ``Act''), as amended.

In response to numerous requests for information related to odor thresholds, this document was prepared by the Air Risk Information Support Center in its role in providing technical assistance to State and Local government agencies on risk assessment of air pollutants. A discussion of basic concepts related to olfactory function and the measurement of odor thresholds is presented. A detailed discussion of criteria which are used to evaluate the quality of published odor threshold values is provided. The use of odor threshold information in risk assessment is discussed. The results of a literature search and review of odor threshold informationmore » for the chemicals listed as hazardous air pollutants in the Clean Air Act amendments of 1990 is presented. The 1990 Clean Air Act Amendments mandated attainment of the ozone standard established by the U.S. Environmental Protection Agency. Improved photochemical models validated by experimental data are needed to develop strategies for reducing near surface ozone concentrations downwind of urban and industrial centers. For more than 10 years, lidar has been used on large aircraft to provide unique information on ozone distributions in the atmosphere. However, compact airborne lidar systems are needed for operation on small aircraft of the type typically used on regional air quality investigations to collect data with which to develop and validate air quality models. Data presented in this paper will consist of a comparison between airborne differential absorption lidar (DIAL) and airborne in-situ ozone measurements. Also discussed are future plans to improve the airborne ultraviolet-DIAL for ozone and other gas observations and addition of a Fourier Transform Infrared (FTIR) emission spectrometer to investigate the effects of other gas species on vertical ozone distribution.

We used 2 approaches based on published information to compare the impacts on leukemia incidence and benzene exposure of the 1990 US Clean Air Act (CAA) amendments and smoking prevention and cessation efforts. We extrapolated leukemia mortality related to community air pollution levels and to cigarette smoking from data from the US Environmental Protection Agency and the US Surgeon General. We also estimated relative decline in total exposures to benzene (a known human leukemogen) owing to the CAA amendments and to smoking prevention and cessation efforts. We estimated that because of the CAA, there will be approximately 300 fewer leukemia deaths in the United States during the period 2000 through 2020. During the closest comparable period (1987-2007), we estimated that decline in cigarette smoking led to 7120 fewer leukemia deaths, of which 1282 to 3702 were attributable to benzene. Similarly, the decline in smoking led to about a tenfold greater decrease in total-population benzene exposure than did the 1990 CAA amendments. Both the CAA and smoking cessation activities contribute to a decrease in leukemia incidence. Smoking cessation activities have had a greater effect in the past.

In 1990 the U.S. Congress passed Title IV of the Clean Air Act Amendments, which was intended to reduce the adverse effects of acid deposition by reducing emissions of the acid precursors,sulfur dioxide (SO2) and nitrogen oxides (Nox). Passage of Title IV was a response to the findings of a decade of research performed in large part through the National Acid Precipitation Assessment Program (NAPAP), which concluded that acid deposition posed a current and future threat to vulnerable forest and aquatic ecosystems [NAPAP, 1991].Now,with reauthorization of the 1990 Clean Air Act Amendments scheduled for 2000, Congress is considering several bills that would further reduce emissions to ensure the restoration of damaged ecosystems. Title IV requires a 10 million ton per year reduction in SO2 emissions below 1980 levels by 2010 and establishes a national cap of 8.95 million tons per year on utility emissions by 2010. Atmospheric sulfur deposition began to decline in the late 1970s as a result of energy conservation and provisions of the Clean Air Act of 1980. Since implementation of Phase I of Title IV in 1995, SO2 emissions have dropped from more than 20 million tons per year in the early 1990s to 18.3 million tons in 1995 [NAPAP, 1998].Consequently, reductions in atmospheric sulfur deposition have accelerated throughout the United States since 1995.

Hazardous air pollutants are regulated under Title III of the 1990 Clean Air Act Amendments. The Amendments replace the risk-based approach mandated in the 1977 Amendments with a prescriptive, technology-based approach requiring that maximum achievable control technology (MACT) be applied to all major industrial sources of 189 hazardous air pollutants. The change reflects political, rather than scientific consensus that the public health benefits justify the costs. The choice is put into perspective by looking at the interface between science and policy that occurs as part of regular decisionmaking. Particular emphasis is given to examining the interrelationships among facts (science), judgments (science policy), and policy (values) in the context of the risk assessment paradigm. Science and policy are discussed in relation to Title III, contrasting the political consensus for action with the scientific uncertainty about risks and benefits. It is argued that a balanced research program is needed to get the facts right about hazardous air pollutants, including research to meet statutory requirements, to reduce uncertainties in risk assessment, and to address strategic issues. The uneven diffusion of local and state laws restricting the use of electronic nicotine delivery systems (ENDS) in the United States may be a function of inconclusive scientific evidence and lack of guidance from the federal government. The objective of this study was to assess whether the rationale for amending clean indoor air acts (CIAAs) is being conflated by issues that are not directly relevant to protecting the health of ENDS non-users. The bills were categorized into one of three groups: 1) bills amending comprehensive CIAAs ( n = 11), 2) bills prohibiting use of ENDS in places frequented by youth ( n = 5), and 3) remaining bills that varied between the two categories ( n = 9). Arguments presented in committee hearings were coded as scientific, public health, economic, enforcement, freedom, or regulatory. Arguments pertaining to amendment of clean indoor air acts spanned several categories, many of which were not directly relevant to the aims of the legislation. This finding could assist lawmakers and expert witnesses in making arguments that yield greater success in amending legislation. Alternatively, inconclusive scientific data on the hazards of ENDS aerosols might encourage lawmakers to propose legislation that prohibits ENDS use in places frequented by youths.

These revisions were proposed in the Federal Register on February 22, 2013 and concern construction and modification of stationary sources of air pollution within each District. We are approving local rules that regulate these emission sources under the Clean Air Act as amended in 1990 (CAA). Final approval of these rules makes the rules federally enforceable and corrects program deficiencies identified in a previous EPA rulemaking (76 FR 44809, July 27, 2011). EPA is also making a technical amendment to the Code of Federal Regulations (CFR) to reflect this previous rulemaking, which removed an obsolete provision from the California SIP.

None of the provisions of this act will have as great an impact on the waste management industry as will the General Operating Permit Provisions of Title V. Title V establishes a program for issuing operating permits to all major sources (and certain other sources) of air pollutants in the U.S. These permits will collect in one place all applicable requirements, limitations, and conditions governing regulated air emissions. Objectives. We used 2 approaches based on published information to compare the impacts on leukemia incidence and benzene exposure of the 1990 US Clean Air Act (CAA) amendments and smoking prevention and cessation efforts. Methods. We extrapolated leukemia mortality related to community air pollution levels and to cigarette smoking from data from the US Environmental Protection Agency and the US Surgeon General. We also estimated relative decline in total exposures to benzene (a known human leukemogen) owing to the CAA amendments and to smoking prevention and cessation efforts. Results. We estimated that because of the CAA, there will be approximately 300 fewer leukemia deaths in the United States during the period 2000 through 2020. During the closest comparable period (1987–2007), we estimated that decline in cigarette smoking led to 7120 fewer leukemia deaths, of which 1282 to 3702 were attributable to benzene. Similarly, the decline in smoking led to about a tenfold greater decrease in total-population benzene exposure than did the 1990 CAA amendments. Conclusions. Both the CAA and smoking cessation activities contribute to a decrease in leukemia incidence. Smoking cessation activities have had a greater effect in the past. PMID:22021318

In this direct final rule, DOE adopts amended energy conservation standards for residential furnaces and for residential central air conditioners and heat pumps. A notice of proposed rulemaking that proposes identical energy efficiency standards is published elsewhere in this issue of the Federal Register. If DOE receives adverse comment and determines that such comment may provide a reasonable basis for withdrawing the direct final rule, this final rule will be withdrawn, and DOE will proceed with the proposed rule.

The 1990 Clean Air Act Amendments prompted an increased urgency to find new ways to treat airstreams containing volatile organic compounds, which affect the nitrogen photolytic cycle and help produce ground-level ozone, hazardous air pollutants, and odorous air emissions such as hydrogen sulfide. Scientists at the New Jersey company Envirogen have adapted traditional biofiltration technology to perform airborne waste stream cleanup. Preliminary research on pollutants such as phenol, methylene chloride, benzene, and toluene indicates that Envirogen's biotrickling filter may remove an average of about 94% of total hazardous air pollutants. Scientists are working to identify microbes that will clean up more stubborn pollutants.

...EPA published a direct final rule on October 9, 2012 to amend the definition of heating oil in 40 CFR 80.1401 in the Renewable Fuel Standard (``RFS'') program under section 211(o) of the Clean Air Act. The direct final rule also amended requirements under EPA's diesel sulfur program related to the sulfur content of locomotive and marine diesel fuel produced by transmix processors, and the fuel marker requirements for 500 ppm sulfur locomotive and marine (LM) diesel fuel to allow for solvent yellow 124 marker to transition out of the distribution system. Because EPA received adverse comments on the heating oil definition and transmix amendments, we are withdrawing those portions of the direct final rule. Because EPA did not receive adverse comments with respect to the yellow marker amendments, those amendments will become effective as indicated in the direct final rule.

The 1990 Clean Air Act Amendments prompted an increased urgency to find new ways to treat airstreams containing volatile organic compounds, which affect the nitrogen photolytic cycle and help produce ground-level ozone, hazardous air pollutants, and odorous air emissions such as hydrogen sulfide. Scientists at the New Jersey company Envirogen have adapted traditional biofiltration technology to perform airborne waste stream cleanup. Preliminary research on pollutants such as phenol, methylene chloride, benzene, and toluene indicates that Envirogen's biotrickling filter may remove an average of about 94% of total hazardous air pollutants. Scientists are working to identify microbes that will clean up more stubborn pollutants. PMID:10753107

Photochemical Assessment Monitoring Stations (PAMS). This file provides information on the numbers and distribution (latitude/longitude) of air monitoring sites which measure ozone precursors (approximately 60 volatile hydrocarbons and carbonyl), as required by the 1990 Clean Air Act Amendments, in areas with persistently high ozone levels (mostly large metropolitan areas). In these areas, the States have established ambient air monitoring sites which collect and report detailed data for volatile organic compounds, nitrogen oxides, ozone and meteorological parameters. This file displays 199 monitoring sites reporting measurements for 2010. A wide range of related monitoring site attributes is also provided.

The capture of Federal regulatory agencies by the groups they were supposed to be regulating has been a topic of concern in the traditional literature of public administration. In his influential book The End of Liberalism, Professor Theordore Lowi suggested that capture resulted in part from vauge delegations of authority of Congress to regulatory agencies. Lowi argued that democracy would be better served if Congress were more specific in drafting laws, if agencies made greater use of formal rulemaking in implementing them, and if the courts rejected statutes which contained excessively vague delegations of authority - a remedy which hemore » labeled juridicial democracy. This dissertation examines Lowi's theory in light of the experience of Congress and the Environmental Protection Agency (EPA) with the requirements of the Clean Air Act to prevent the significant deterioration of air quality in areas where air was already relatively clean. The history of the program to develop and carry out these requirements, known as PSD, is described in detail from its inception in the late 1960's through EPA's final regulations in 1980. Special attention is given to the actions taken by EPA after environmental groups successfully used the courts to force EPA to develop a PSD program in 1974, how Congress responded by amending the Clean Air Act in 1977, and the difficulties these amendments and subsequent additional court reviews caused for EPA.« less

It has been four years since the Clean Air Act was amended in November of 1990. Much work has been done in this time, and the country is beginning to see real air quality benefits. Although these changes have not completely licked the urban ozone problem yet, they have made a lot of progress. All of the urban areas which have been required to reduce their ozone levels have done a good job of lowering their emissions. Following more than a decade of scientific debate about the setting of a standard for 222Rn in drinking water, Congress established a timetable for the promulgation of a standard in the 1996 Amendments to the Safe Drinking Water Act. As a result of those Amendments, the EPA contracted with the National Academy of Sciences to undertake a risk assessment for exposure to radon in drinking water. In addition, the resulting committee was asked to address several other scientific issues including the national average ambient 222Rn concentration and the increment of 222Rn to the indoor- air concentration arising from the use of drinking water in a home. A new dosimetric analysis of the cancer risk to the stomach from ingestion was performed. The recently reported risk estimates developed by the BEIR VI Committee for inhalation of radon decay products were adopted. Because the 1996 Amendments permit states to develop programs in which mitigation of air- producing health-risk reductions equivalent to that which would be achieved by treating the drinking water, the scientific issues involved in such 'multimedia mitigation programs' were explored.

EPCA also requires the U.S. Department of Energy (DOE) to determine whether more-stringent, amended standards for these products would be technologically feasible and economically justified, and would save a significant amount of energy. In this notice, DOE proposes energy conservation standards for residential furnaces and for residential central air conditioners and heat pumps identical to those set forth in a direct final rule published elsewhere in today's Federal Register. If DOE receives adverse comment and determines that such comment may provide a reasonable basis for withdrawing the direct final rule, DOE will publish a notice withdrawing the direct final rule and will proceed with this proposed rule.

The Environmental Protection Agency may reduce the fuel-emission standards for new boilers because the Council of Industrial Boiler Owners (CIBO) claims the standards assume stacks that are higher than those used for coal-fired boilers. CIBO is unique in concentrating on furnishing technical information rather than on broad policy issues. The report was prepared in accordance with Section 108(f) of the Clean Air Act, as amended, August 1977. It is intended to assist urban areas in developing State Implementation Plans and integrating their transportation system management and air quality planning programs as required by FHWA, UMTA, and EPA. The report analyzes the air quality, travel, energy consumption, economic, and cost impacts of three types of transportation programs: priority treatment for high occupancy vehicles on freeways and arterials; areawide carpool and vanpool programs; and transit fare reductions and service improvements. The Pittsburgh Energy Technology Center (PETC) of the US Department of Energy (DOE) has two current investigations, initiated before passage of the Clean Air Act Amendment (CAAA), that will determine the air toxic emissions from coal-fired electric utilities. DOE has contracted with Battelle Memorial Institute and Radian corporation to conduct studies focusing on the potential air toxics, both organic and inorganic, associated with different size fractions of fine particulate matter emitted from power plant stacks. Since the authorization of the Clean Air Act Amendments of 1990, the air quality in the USA has significantly improved because of strong public support. The lessons learned over the last 25 years are being shared with the policy analysts, technical professionals, and scientist who endeavor to improve air quality in their communities. This paper will review how the USA has achieved the "high" standard of air quality that was envisioned in the early 1990s. This document will describe SO 2 gas emission reduction technology and highlight operation of emission monitoring technology. This paper describes the basic process operation of an air pollution control scrubber. A technical review of measures required to operate and maintain a large-scale pollution control system will be described. Also, the author explains how quality assurance procedures in performance of continuous emission monitoring plays a significant role in reducing air pollution.

Enactment of the Clean Air Act Amendments (CAAA) of 1990 has resulted in increased ambient air monitoring needs for industry, some of which may be met efficiently using open-path optical remote sensing techniques. These techniques include Fourier transform spectroscopy, differential optical absorption spectroscopy, laser long-path absorption, differential absorption lidar, and gas cell correlation spectroscopy. With this regulatory impetus, it is an opportune time to consider applying these technologies to the remote and/or path-averaged measurement and monitoring of toxic gases covered by the CAAA. This article reviews the optical remote sensing technology and literature for that application.

One treatment method of municipal solid waste, incineration, has fallen in and out of public favor. In the 1970s, emerging consciousness of the threat to groundwater posed by leaking landfills made incineration an attractive option. Prompted by disrupted energy supplies and steeply rising prices, more than 100 municipalities began to generate electricity from the heat produced by burning trash. In the 1990s, the pendulum of public enthusiasm has swung away from incineration. Energy prices have declined dramatically, and safety and siting concerns complicate new projects. A recent Supreme Court decision ruled that municipal incinerator ash must be tested as hazardousmore » waste and disposed accordingly if levels of such pollutants as cadmium and lead exceed Resource Conservation and Recovery Act limits. So-called flow control regulations, which allowed municipalities to apportion garbage disposal to ensure steady supplies to incinerators, also have been struck down. EPA is tackling the issue of air emissions from waste-to-energy and non-energy-producing municipal waste combustors. A sorbent-based gas chromatographic method provides continuous quantitative measurement of phosgene, hydrogen cyanide, and cyanogen chloride in ambient air. These compounds are subject to workplace exposure limits as well as regulation under terms of the Chemical Arms Treaty and Title III of the 1990 Clean Air Act amendments. The method was developed for on-sit use in a mobile laboratory during remediation operations. Incorporated into the method are automated multi-level calibrations at time weighted average concentrations, or lower. Gaseous standards are prepared in fused silica lined air sampling canisters, then transferred to the analytical system through dynamic spiking. Precision and accuracy studies performed to validate the method are described. Also described are system deactivation and passivation techniques critical to optimum method performance.

This report provides an overview of the provisions of the Clean Air Act and its Amendments of 1990 that identify hazardous air pollutant (HAP) emissions and addresses their regulation by the US Environmental Protection Agency (EPA). It defines the major energy sector sources of these HAPs that would be affected by the regulations. Attention is focused on regulations that would cover coke oven emissions; chromium emission from industrial cooling towers and the electroplating process; HAP emissions from tank vessels, asbestos-related activities, organic solvent use, and ethylene oxide sterilization; and emissions of air toxics from municipal waste combustors. The possible implicationsmore » of Title III regulations for the coal, natural gas, petroleum, uranium, and electric utility industries are examined. In addition, this action includes the 5-year technology review of the new source performance standards and emission guidelines required under section 129 of the Clean Air Act. This action also promulgates other amendments that EPA believes are necessary to address air emissions from commercial and industrial solid waste incineration units.
