The purpose of an EPA Record of Decision is to evaluate a Superfund Site with the goal of protecting human health and the environment while ensuring consistency of evaluations in contamination and clean-up of all Superfund sites. The ROD is a public document signed by the appropriate Regional Administrator which details cleanup, cost estimates, and EPA`s responsiveness to the public comment summary. The ROD may be litigated, thus it is important to have all current updates to the signed EPA decision. The ROD may be amended with an Amendment or supplemented by an Explanation of Significant Difference (ESD). A Superfundmore » Site may have multiple RODs, as each Superfund Site may be further redefined as Operable Units and Events. This allows EPA`s decisions to evolve as new technology presents itself. ...The Environmental Protection Agency (EPA) is proposing a Federal Implementation Plan (FIP) to address regional haze in the State of Montana. EPA developed this proposal in response to the State's decision in 2006 to not submit a regional haze State Implementation Plan (SIP) revision. EPA is proposing to determine that the FIP satisfies requirements of the Clean Air Act (CAA or ``the Act'') that require states, or EPA in promulgating a FIP, to assure reasonable progress towards the national goal of preventing any future and remedying any existing man-made impairment of visibility in mandatory Class I areas. In addition, EPA is also proposing to approve a revision to the Montana SIP submitted by the State of Montana through the Montana Department of Environmental Quality on February 17, 2012. The State's submittal contains revisions to the Montana Visibility Plan that includes amendments to the ``Smoke Management'' section, which adds a reference to Best Available Control Technology (BACT) as the visibility control measure for open burning as currently administered through the State's air quality permit program. This change was made to meet the requirements of the Regional Haze Rule. EPA will act on the remaining revisions in the State's submittal in a future action.

...The EPA is proposing to amend the new source performance standards (NSPS) for stationary gas turbines and stationary combustion turbines. These amendments are primarily in response to issues raised by the regulated community. On July 6, 2006, the EPA promulgated amendments to the new source performance standards for stationary combustion turbines. On September 5, 2006, the Utility Air Regulatory Group filed a petition for reconsideration of certain aspects of the promulgated standards. The EPA is proposing to amend specific provisions in the NSPS to resolve issues and questions raised by the petition for reconsideration, and to address other technical and editorial issues. In addition, this proposed rule would amend the location and wording of existing paragraphs for clarity. The proposed amendments would increase the environmental benefits of the existing requirements because the emission standards would apply at all times. The proposed amendments would also promote efficiency by recognizing the environmental benefit of combined heat and power and the beneficial use of low energy content gases.

...On June 24, 2008, the EPA promulgated amendments to the Standards of Performance for Petroleum Refineries and new standards of performance for petroleum refinery process units constructed, reconstructed or modified after May 14, 2007. The EPA subsequently received three petitions for reconsideration of these final rules. On September 26, 2008, the EPA granted reconsideration and issued a stay for the issues raised in the petitions regarding process heaters and flares. On December 22, 2008, the EPA addressed those specific issues by proposing amendments to certain provisions for process heaters and flares and extending the stay of these provisions until further notice. The EPA also proposed technical corrections to the rules for issues that were raised in the petitions for reconsideration. In this action, the EPA is finalizing those amendments and technical corrections and is lifting the stay of all the provisions granted on September 26, 2008 and extended until further notice on December 22, 2008.

The 2.6-acre Novaco Industries site is a one building site in Temperance, Michigan. Land use in the area is predominantly residential and agricultural. The estimated 85 residences located within 1/2 mile of the site use the underlying sand/gravel and limestone aquifer as their drinking water supply. A 1986 Record of Decision (ROD) addressed a final remedy for ground water contamination and provided for ground water pumping and treatment using electrochemical reduction/ion exchange polishing, followed by onsite discharge to surface water. The ROD amends the 1986 ROD. The amended remedial action for the site is no further action.
Asbestos worker protection. Environmental Protection Agency (EPA). Final rule.
2000-11-15
In this Final Rule, EPA is amending both the Asbestos Worker Protection Rule (WPR) and the Asbestos-in-Schools Rule. The WPR amendment protects State and local government employees from the health risks of exposure to asbestos to the same extent as private sector workers by adopting for these employees the Asbestos Standards of the Occupational Safety and Health Administration (OSHA). The WPR's coverage is extended to State and local government employees who are performing construction work, custodial work, and automotive brake and clutch repair work. This final rule cross-references the OSHA Asbestos Standards for Construction and for General Industry, so that future amendments to these OSHA standards are directly and equally effective for employees covered by the WPR. EPA also amends the Asbestos-in-Schools Rule to provide coverage under the WPR for employees of public local education agencies who perform operations, maintenance, and repair activities. EPA is issuing this final rule under section 6 of the Toxic Substances Control Act (TSCA).

This ROD Amendment changes a component of the selected remedial action for contaminated soil. The original selected remedy documented in the March 1996 Record of Decision (ROD) is a series of remedial actions that address the principal threats at the Site, by removing the most highly contaminated soil, extracting nonaqueous phase liquid (NAPL) from and treating contaminated groundwater, and capping the most highly contaminated sediment. Because significant levels of dioxin are present in soil areas originally identified for excavation and on-site biological treatment (i.e, areas where contamination exceeds the action levels for PCP and PAHs), it now appears unlikely thatmore » this intended treatment will achieve the level of risk reduction contemplated in the 1996 ROD. Accordingly, DEQ and EPA have selected an alternative remedy for contaminated soil at the McCormick and Baxter site.« less

...Recent EPA gas audit results indicate that some gas cylinders used to calibrate continuous emission monitoring systems on stationary sources do not meet EPA's performance specification. Reviews of stack test reports in recent years indicate that some stack testers do not properly follow EPA test methods or do not correctly calculate test method results. Therefore, EPA is proposing to amend its Protocol Gas Verification Program (PGVP) and the minimum competency requirements for air emission testing (formerly air emission testing body requirements) to improve the accuracy of emissions data. EPA is also proposing to amend other sections of the Acid Rain Program continuous emission monitoring system regulations by adding and clarifying certain recordkeeping and reporting requirements, removing the provisions pertaining to mercury monitoring and reporting, removing certain requirements associated with a class-approved alternative monitoring system, disallowing the use of a particular quality assurance option in EPA Reference Method 7E, adding an incorporation by reference that was inadvertently left out of the January 24, 2008 final rule, and clarifying the language and applicability of certain provisions.

Waste-law amendments are taxing EPA's resources

1985-05-13
This paper explains why the Environmental Protection Agency (EPA) is feeling the burden of having to meet the multiple deadlines imposed by last year's changes in the Resource Conservation and Recovery Act. The 1984 amendments are far more than an attempt to close a few loopholes to catch midnight dumpers of hazardous waste. The way the U.S. disposes of most of its 250 million metric tons/yr of hazardous waste will have to change. One of EPA's most difficult jobs in implementing the latest RCRA amendments is the seriousness of Congress's intention to unequivocally restrict land disposal of hazardous waste, beginningmore » with dioxins and solvents, in November, 1986.« less

National RCRA Hazardous Waste Biennial Report Data Files
The United States Environmental Protection Agency (EPA), in cooperation with the States, biennially collects information regarding the generation, management, and final disposition of hazardous wastes regulated under the Resource Conservation and Recovery Act of 1976 (RCRA), as amended. Collection, validation and verification of the Biennial Report (BR) data is the responsibility of RCRA authorized states and EPA regions. EPA does not modify the data reported by the states or regions. Any questions regarding the information reported for a RCRA handler should be directed to the state agency or region responsible for the BR data collection. BR data are collected every other year (odd-numbered years) and submitted in the following year. The BR data are used to support regulatory activities and provide basic statistics and trend of hazardous waste generation and management. BR data is available to the public through 3 mechanisms. 1. The RCRAInfo website includes data collected from 2001 to present-day (https://rcrainfo.epa.gov/rcrainfoweb/action/main-menu/view). Users of the RCRAInfo website can run queries and output reports for different data collection years at this site. All BR data collected from 2001 to present-day is stored in RCRAInfo, and is accessible through this website. 2. An FTP site allows users to access BR data files collected from 1999 - present day (ftp://ftp.epa.gov/rcrainfodata/). Zip files are available for download directly from this

...This notice announces EPA's order for the amendment to terminate uses, voluntarily requested by the registrant and accepted by the Agency, of products containing the pesticide, Busan 1024, pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). This cancellation order follows an August 13, 2008 Federal Register Notice of Receipt of Request for Amendments to Delete Uses from the registrant listed in Table 2, to voluntarily amend to terminate uses of this product registration. This is the last product containing this pesticide registered for use in the United States. In the August 13, 2008 notice, EPA indicated that it would issue an order implementing the amendment to terminate uses, unless the Agency received substantive comments within the 30-day comment period that would merit its further review of this request, or unless the registrant withdrew the request within this period. The Agency did not receive any comments on the notice. Further, the registrant did not withdraw the request. Accordingly, EPA hereby issues in this notice a cancellation order granting the requested amendment to terminate uses. Any distribution, sale, or use of the products subject to this cancellation order is permitted only in accordance with the terms of this order, including any existing stocks provisions.

...In this Notice of Proposed Rulemaking, EPA is proposing amendments to three separate sets of regulations relating to fuels. First, EPA is proposing to amend certain of the renewable fuels standard (RFS2) program regulations. We believe these proposals will facilitate the introduction of new renewable fuels as well as improve implementation of the program. This proposal includes various changes related to biogas, including changes related to the revised compressed natural gas (CNG)/liquefied natural gas (LNG) pathway and amendments to various associated registration, recordkeeping, and reporting provisions. This proposed regulation includes the addition of new pathways for renewable diesel, renewable naphtha, and renewable electricity (used in electric vehicles) produced from landfill biogas. Adding these new pathways will enhance the ability of the biofuels industry to supply advanced biofuels, including cellulosic biofuels, which greatly reduce the greenhouse gas emissions (GHG) compared to the petroleum-based fuels they replace. It also addresses ``nameplate capacity'' issues for certain production facilities that do not claim exemption from the 20% greenhouse gas (GHG) reduction threshold. In this notice, EPA addresses issues related to crop residue and corn kernel fiber and proposes an approach to determining the volume of cellulosic RINs produced from various cellulosic feedstocks. We also include a lifecycle analysis of advanced butanol and discuss the potential to allow for commingling of compliant products at the retail facility level as long as the environmental performance of the fuels would not be detrimental. Several other amendments to the RFS2 program are included. Second, EPA is also proposing various changes to the E15 misfueling mitigation regulations (E15 MMR). Among the E15 changes proposed are technical corrections and amendments to sections dealing with labeling, E15 surveys, product transfer documents, and prohibited acts. We also propose to amend the definitions in order to address a concern about the rounding of test results for ethanol content violations. Lastly, EPA is proposing changes to the survey requirements associated with the ultra-low sulfur diesel (ULSD) program.

The Northside Sanitary Landfill site is a hazardous and solid waste disposal facility in Boone County, Indiana. Adjacent to the Northside Sanitary Landfill (NSL) site is another Superfund site, Enviro-Chem which, prior to the Record of Decision (ROD) amendment, was to be remediated in a combined remedy for both sites. Land use in the area is agricultural to the south and east, and residential to the north and west. The ROD amendment provides a comprehensive remedy and addresses both source control and ground water remediation. The primary contaminants of concern affecting the soil and ground water are VOCs including benzene, more » PCE, TCE, and toluene; other organics including phenols; metals including arsenic, chromium, and lead; and oils. The amended remedial action for the site includes constructing a pipeline to pump ground water and leachate offsite to the city sewer system at the city wastewater treatment plant and constructing a hydraulic isolation wall system.« less

Section 107(d) of the Clean Air Act, as amended in 1990 (the Act), required states to identify all areas that do not meet the national ambient air quality standards (NAAQS) for ozone, and directed the Environmental Protection Agency (EPA) to designate these areas as ozone nonattainment areas. Section 181 of the Act required EPA to classify each area as a marginal, moderate, serious, severe or extreme ozone nonattainment area. EPA classified all areas that were designated as in nonattainment for ozone at the time of the enactment of the 1990 Amendments, except for certain "nonclassifiable" areas (56 FR 56694, November 6, 1991).

...The Environmental Protection Agency (EPA) is granting the California Air Resources Board's (CARB's) request for a waiver of Clean Air Act preemption to enforce its Advanced Clean Car (ACC) regulations. The ACC combines the control of smog and soot causing pollutants and greenhouse gas (GHG) emissions into a single coordinated package of requirements for passenger cars, light-duty trucks and medium-duty passenger vehicles (and limited requirements related to heavy-duty vehicles). The ACC program includes revisions to California's Low Emission Vehicle (LEV) program as well as its Zero Emission Vehicle (ZEV) program. By today's decision, EPA has also determined that CARB's amendments to the ZEV program as they affect 2017 and prior model years (MYs) are within the scope of previous waivers of preemption granted to California for its ZEV regulations. In the alternative, EPA's waiver of preemption for CARB's ACC regulations includes a waiver of preemption for CARB's ZEV amendments as they affect all MYs, including 2017 and prior MYs. In addition, EPA is including CARB's recently adopted ``deemed to comply'' rule for GHG emissions in today's waiver decision. This decision is issued under section 209(b) of the Clean Air Act (the ``Act''), as amended.

The 7-acre Midco II site is an abandoned chemical waste storage and disposal facility in Gary, Indiana. Land use in the surrounding area is predominantly industrial. The underlying aquifer, which is used primarily for non-drinking purposes, is highly susceptible to contamination from surface sources. From 1976 to 1978, the site was used for treatment, storage, and disposal of chemical and bulk liquid wastes. The ROD amends a 1989 ROD that addressed the remaining contaminated soil, pit wastes, and ground water by treatment of an estimated 35,000 cubic yards of soil wastes. The amended remedy reduces the estimated amount of soilmore » to be treated, as a result of new information on arsenic data and amended soil CALs, further defines the site cover requirements, and further defines the requirements for deep well injection of contaminated ground water. The primary contaminants of concern affecting the subsurface soil, sediment, and ground water are VOCs, including methylene chloride, benzene, toluene, TCE, and xylenes; other organics, including PCBs, phenols, and PAHs; and metals, including chromium, and lead. The New Brighton/Arden Hills site is an area of organic solvent contamination in ground water northwest of Minneapolis, Minnesota. The Record of Decision (ROD) amends a June 1986 ROD calling for the installation of a new well to provide part of the drinking water supply to New Brighton. EPA has concluded that a new well is no longer necessary to protect human health in New Brighton. Originally it was anticipated that low contamination levels in Well No. 7more » (one of nine municipal wells) could not be assured and that a replacement well in a deeper aquifer was needed to provide an alternate supply of water. However, further data from Well No. 7 indicate contamination is not increasing. This order follows a September 10, 2010 Federal Register Notice of Receipt of Request from the registrant listed in Table 2 to voluntarily amend their tetrahydro-3, 5-dimethyl-2H-1, 3, 4-thiadiazine-2-thione (Dazomet) product registrations to terminate or delete one or more uses. The request would terminate the uses listed in Table 1 of Unit II. The request would delete the uses listed in Table 2 of Unit II. The request would not terminate the last tetrahydro-3, 5-dimethyl-2H-1, 3, 4-thiadiazine- 2-thione products registered for use in the United States and would result in retention of some registered uses for those products. In the September 10, 2010 notice, EPA indicated that it would issue an order implementing the amendments to terminate uses, unless the Agency received substantive comments within the 30-day comment period that would merit its further review of these requests, or unless the registrant withdrew their request within this period. The Agency did not receive any comments on the notice. Further, the registrant did not withdraw their request. Accordingly, EPA hereby issues in this notice a cancellation order granting the requested amendment to terminate uses. Any distribution, sale, or use of the products subject to this cancellation order is permitted only in accordance with the terms of this order, including any existing stocks provisions.

...This action promulgates amendments to Methods 201A and 202. The final amendments to Method 201A add a particle-sizing device to allow for sampling of particulate matter with mean aerodynamic diameters less than or equal to 2.5 micrometers (PM2.5 or fine particulate matter). The final amendments to Method 202 revise the sample collection and recovery procedures of the method to reduce the formation of reaction artifacts that could lead to inaccurate measurements of condensable particulate matter. Additionally, the final amendments to Method 202 eliminate most of the hardware and analytical options in the existing method, thereby increasing the precision of the method and improving the consistency in the measurements obtained between source tests performed under different regulatory authorities. This action also announces that EPA is taking no action to affect the already established January 1, 2011 sunset date for the New Source Review (NSR) transition period, during which EPA is not requiring that State NSR programs address condensable particulate matter emissions.

The Enviro-chem site is a former waste recovery/reclamation/brokerage facility in Boone County, Indiana. Adjacent to the site is another Superfund site, the Northside Sanitary Landfill (NSL) which, prior to the Record of Decision (ROD) amendment, was to be remediated in a combined remedy for both sites. Land use in the area is agricultural and residential to the north and west. In May 1982, the State ordered Enviro-Chem to close and environmentally secure the site because it failed to reduce hazardous waste inventories. Subsequently, two emergency removal actions were conducted to remove the major sources of contamination. The ROD amends themore » 1987 ROD and provides a comprehensive site remedy for the Enviro-Chem site addressing source control instead of ground water remediation. The primary contaminants of concern affecting the soil are VOCs including PCE, TCE, toluene; and other organics including phenols. The amended remedial action for the site includes treating contaminated soil onsite using soil vapor extraction with a granulated activated carbon system to control the extracted vapor and implementing a contingent remedy for a subsurface ground water collection and treatment system.« less

...EPA is finalizing a limited approval and limited disapproval of two permitting rules submitted by California as a revision to the Placer County Air Pollution Control District (PCAPCD) and Feather River Air Quality Management District (FRAQMD) portion of the California State Implementation Plan (SIP). These revisions were proposed in the Federal Register on February 22, 2013 and concern construction and modification of stationary sources of air pollution within each District. We are approving local rules that regulate these emission sources under the Clean Air Act as amended in 1990 (CAA). Final approval of these rules makes the rules federally enforceable and corrects program deficiencies identified in a previous EPA rulemaking (76 FR 44809, July 27, 2011). EPA is also making a technical amendment to the Code of Federal Regulations (CFR) to reflect this previous rulemaking, which removed an obsolete provision from the California SIP.

...The EPA is proposing to amend specific provisions of the Greenhouse Gas Reporting Rule to provide greater clarity and flexibility to facilities subject to reporting emissions from certain source categories. These source categories will report greenhouse gas (GHG) data for the first time in September of 2012. The proposed changes are not expected to significantly change the overall calculation and monitoring requirements of the Greenhouse Gas Reporting Rule or add additional requirements for reporters, but are expected to correct errors and clarify existing requirements in order to facilitate accurate and timely reporting. The EPA is also proposing confidentiality determinations for four new data elements for the fluorinated gas production source category of the Greenhouse Gas Reporting Rule. Lastly, we are proposing an amendment to Table A-7 of the general provisions to add a data element used as an input to an emission equation in the fluorinated gas production source category.

The Anderson Development site is an active chemical manufacturing facility in Adrian, Lenawee County, Michigan. The site occupies approximately 12.5 acres within a 40-acre industrial park, which is surrounded by residential areas. Site features include several onsite buildings used for manufacturing, storage, laboratories, and offices, as well as a 0.5-acre former process wastewater pretreatment lagoon. From 1970 to 1979, the Anderson Development Corporation (ADC) produced specialty chemicals onsite including 4,4-methylene bis (2-chlororaniline) (MBOCA), a hardening agent for the production of polyurethane plastics. The ROD amends the 1990 ROD, which provided for treatment of the contaminated media using in-situ vitrification, andmore » documents the selection of low temperature thermal desorption (LTTD) as the preferred treatment technology. The selected amended remedial action for this site includes excavating and staging 3,000 to 4,000 tons of contaminated soil, clay, and lagoon sludge with MBOCA concentrations above the 1.6 mg/kg clean-up action level in an LTTD device.« less

The EPA is considering a number of amendments to the transportation control plan which it promulgated Nov. 8, 1973 for the Metropolitan Boston Intrastate Air Quality Control Region. Included in the proposed amendments is a revised regulation for reduction of commuter travel which would include students and employees. This program would be implemented in conjunction with the carpool matching program being developed by the Commonwealth of Massachusetts and the employee pass program offered by the Massachusetts Bay Transportation Authority. A new provision for limiting overall hydrocarbon emissions from major users of organic compounds is included. Also published are a proposalmore » for encouraging bicycle use, new proposals for controlling carbon monoxide levels outside the Boston core area, and a new procedure for periodic monitoring and updating of the plan. Other features of the original plan are retained with modifications in areas including the ceiling on the level of commercial parking spaces in the so-called ''freeze'' area, limitations of on-street commuter parking, a semiannual inspection and maintenance program, a retrofit program, and incentives for carpool and transit use.« less

The 50-acre South Andover site is composed of several privately owned parcels of land near Minneapolis in Anoka County, Minnesota. There are several source areas where former activities included drum storage, waste storage, and waste burning. Solid and liquid chemical waste dumping and open pit burning of solvents occurred during the 1960's and 1970's. Investigations showed that drum storage and chemical waste disposal sites were partially obscured by auto salvage operations and more than 3 million waste tires. The ROD amendment changes the 1988 ROD for ground water based on current data from a 1990 Design Investigation. The primary contaminantsmore » of concern affecting the ground water are VOCs, including acetone, ethyl benzene, methylchloride, PCE, TCE, toluene; and metals, including arsenic, chromium, and lead.« less
This asset includes hazardous waste information, which is mostly contained in the Resource Conservation and Recovery Act Information (RCRAInfo) System, a national program management and inventory system addressing hazardous waste handlers. In general, all entities that generate, transport, treat, store, and dispose of hazardous waste are required to provide information about their activities to state environmental agencies. These agencies pass on that information to regional and national EPA offices. This regulation is governed by the Resource Conservation and Recovery Act (RCRA), as amended by the Hazardous and Solid Waste Amendments of 1984. RCRAInfo Search can be used to determine identification and location data for specific hazardous waste handlers and to find a wide range of information on treatment, storage, and disposal facilities regarding permit/closure status, compliance with Federal and State regulations, and cleanup activities. ...On January 30, 2012, the EPA proposed revisions to several provisions of the final National Emission Standards for Hazardous Air Pollutants for Chemical Manufacturing Area Sources. The proposed revisions were made, in part, in response to a petition for reconsideration received by the Administrator following the promulgation of the October 29, 2009, final rule (``2009 final rule''). In this action, the EPA is finalizing those amendments, lifting the stay of the title V permit requirement issued on March 14, 2011, and lifting the stay of the final rule issued on October 25, 2012. In addition, this final action includes revisions to the EPA's approach for addressing malfunctions and standards applicable during startup and shutdown periods. This final action also includes amendments and technical corrections to the final rule to clarify applicability and compliance issues raised by stakeholders subject to the 2009 final rule. The revisions to the final rule do not reduce the level of environmental protection or emissions control on sources regulated by this rule but provide flexibility and clarity to improve implementation. This action also extends the compliance date for existing sources and the EPA's final response to all issues raised in the petition for reconsideration.

...EPA is amending the requirements under EPA's diesel sulfur program related to the sulfur content of locomotive and marine (LM) diesel fuel produced by transmix processors and pipeline facilities. These amendments will reinstate the ability of locomotive and marine diesel fuel produced from transmix by transmix processors and pipeline operators to meet a maximum 500 parts per million (ppm) sulfur standard outside of the Northeast Mid-Atlantic Area and Alaska and expand this ability to within the Northeast Mid-Atlantic Area provided that: the fuel is used in older technology locomotive and marine engines that do not require 15 ppm sulfur diesel fuel, and the fuel is kept segregated from other fuel. These amendments will provide significant regulatory relief for transmix processors and pipeline operators to allow the petroleum distribution system to function efficiently while continuing to transition the market to virtually all ultra-low sulfur diesel fuel (ULSD, i.e. 15 ppm sulfur diesel fuel) and the environmental benefits it provides.

The United States Environmental Protection Agency (U.S. EPA) is changing a portion of the remedy selected in the operable unit one (OU1) Record of Decision (ROD) dated September 30, 1986, for the Metamora Landfill Site. Operable Unit 1 ROD (OU1 ROD) addresses the remediation of drummed waste and contaminated soils in Drum Area 1 and Drum Area 4. OU1 ROD selected off-site incineration of the drums and soils in Drum Area 1 and Drum Area 4. State lead remedial action work began in the spring of 1989 and continued until December 1990. During the summer of 1990, off-site incineration capacitymore » became extremely limited and drums awaiting disposal began to accumulate at the site. In addition, many more drums were discovered than originally estimated in the Remedial Design. In April of 1991 a settlement was reached that addressed the completion of all remedial activity remaining at the site, including the completion of OU1.« less

The capture of Federal regulatory agencies by the groups they were supposed to be regulating has been a topic of concern in the traditional literature of public administration. In his influential book The End of Liberalism, Professor Theordore Lowi suggested that capture resulted in part from vauge delegations of authority of Congress to regulatory agencies. Lowi argued that democracy would be better served if Congress were more specific in drafting laws, if agencies made greater use of formal rulemaking in implementing them, and if the courts rejected statutes which contained excessively vague delegations of authority - a remedy which hemore » labeled juridicial democracy. This dissertation examines Lowi's theory in light of the experience of Congress and the Environmental Protection Agency (EPA) with the requirements of the Clean Air Act to prevent the significant deterioration of air quality in areas where air was already relatively clean. The history of the program to develop and carry out these requirements, known as PSD, is described in detail from its inception in the late 1960's through EPA's final regulations in 1980. Special attention is given to the actions taken by EPA after environmental groups successfully used the courts to force EPA to develop a PSD program in 1974, how Congress responded by amending the Clean Air Act in 1977, and the difficulties these amendments and subsequent additional court reviews caused for EPA.« less

The All Indian Pueblo Council (AIPC) through the Pueblo Office of Environmental Protection (POEP) implements and provides a variety of environmental programs and services to the 19 Indian Pueblos of New Mexico. Specifically, the POEP Superfund Program investigates and evaluates potential hazardous waste sites within Pueblo lands. The POEP Superfund Program began in September 1991 when the 19 Pueblo Governors signed a Superfund Memorandum of Agreement with the US Environmental Protection Agency (EPA) Region 6. The goal of the POEP Superfund Program is to determine those sites that are eligible for Superfund-financed remedial action by placing those sites on themore » National Priorities List (NPL), while including the Pueblo perspective. Because the 19 Pueblos are each unique, sovereign nations, several differences and gaps associated with the current Superfund law and EPA methodologies exist. Currently, the Superfund Hazard Ranking System (HRS) model does not account for Indian religious and ceremonial impacts from these sites. Due to their importance in Pueblo life, culturally significant plants, animals, ceremonial surface water use, and sacred areas should be considered as critical impacts when evaluating the various pathways of exposure of the HRS. Tribal environmental equality is an aspect that will be included into all environmental laws. AIPC and POEP are working to address this issue under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA), as amended by the Superfund Amendments and Reauthorization Act of 1986 (SARA).« less

Three representatives of the Environmental Protection Agency (EPA) testified in response to questions over the agency's apparent approval of the land disposal of toxic materials in contradiction to the ban implicit in the Hazardous and Solid Waste Amendments of 1984. In new regulations, EPA interprets the ban as applying only when migration of toxic materials exceeds its screening levels. EPA also cites its screening levels to place a cap on waste treatment. At issue was EPA's effort to avoid the mandate of the 1984 legislation and its acceptance of screening levels which may assume a lower threat than actually exists.more » EPA representatives explained the rulemaking, and defended the use of screening levels as a basis for treatment and exemption. ...EPA is issuing a direct final rule to amend the diesel sulfur regulations to allow refiners, importers, distributors, and retailers of highway diesel fuel the option to use an alternative affirmative defense if the Agency finds highway diesel fuel samples above the specified sulfur standard at retail facilities. This alternative defense consists of a comprehensive program of quality assurance sampling and testing that would cover all participating companies that produce and/or distribute highway diesel fuel if certain other conditions are met. The sampling and testing program would be carried out by an independent surveyor. The program would be conducted pursuant to a survey plan approved by EPA that is designed to achieve the same objectives as the current regulatory quality assurance requirement. EPA Facility Registry Service (FRS): RCRA
This web feature service contains location and facility identification information from EPA's Facility Registry Service (FRS) for the subset of hazardous waste facilities that link to the Resource Conservation and Recovery Act Information System (RCRAInfo). EPA's comprehensive information system in support of the Resource Conservation and Recovery Act (RCRA) of 1976 and the Hazardous and Solid Waste Amendments (HSWA) of 1984, RCRAInfo tracks many types of information about generators, transporters, treaters, storers, and disposers of hazardous waste. FRS identifies and geospatially locates facilities, sites or places subject to environmental regulations or of environmental interest. Using vigorous verification and data management procedures, FRS integrates facility data from EPA's national program systems, other federal agencies, and State and tribal master facility records and provides EPA with a centrally managed, single source of comprehensive and authoritative information on facilities. This data set contains the subset of FRS integrated facilities that link to RCRAInfo hazardous waste facilities once the RCRAInfo data has been integrated into the FRS database. ...Today's action proposes changes to the existing EPA emission inventory reporting requirements on state, local, and tribal agencies in the current Air Emissions Reporting Requirements rule published on December 17, 2008. The proposed amendments would lower the current threshold for reporting Pb sources as point sources; eliminate the requirement for reporting emissions from wildfires and prescribed fires; and replace a requirement for reporting mobile source emissions with a requirement for reporting the input parameters that can be used to run the EPA models that generate the emissions estimates. In addition, the proposed amendments would reduce the reporting burden on state, local, and tribal agencies by removing the requirements to report daily and seasonal emissions associated with carbon monoxide (CO), ozone (O3), and particulate matter up to 10 micrometers in size (PM10) nonattainment areas and nitrogen oxides (NOX) State Implementation Plan (SIP) call areas, although reporting requirements for those emissions would remain in other regulations. Lastly, the proposed amendments would clarify, remove, or simplify some current emissions reporting requirements which we believe are not necessary or are not clearly aligned with current inventory terminology and practices.

EPA may modify Du Pont waiver for methanol fuel blends
DOE Office of Scientific and Technical Information (OSTI.GOV)
Anderson, E.V.
1985-09-02
The Environmental Protection Agency (EPA) granted a Clean Air ACt waiver to DuPont's blendstock of methanol and other cosolvent alcohols for use in unleaded gasoline. The waiver included some stringent fuel volatility requirements to control evaporative emissions that have kept the waiver from becoming the marketing tool for fuel alcohols that everyone expected it to be. EPA seems willing to amend the waiver as long as evaporative emissions controls are kept, but there are some difficult procedural issues to resolve first. To date, only small amounts of alcohol blends have been sold under the DuPont waiver because the blendstock tendsmore » to increase the volatility of gasoline.« less

...EPA and NHTSA, on behalf of the Department of Transportation, are each finalizing rules to establish a comprehensive Heavy-Duty National Program that will reduce greenhouse gas emissions and fuel consumption for on-road heavy-duty vehicles, responding to the President's directive on May 21, 2010, to take coordinated steps to produce a new generation of clean vehicles. NHTSA's final fuel consumption standards and EPA's final carbon dioxide (CO2) emissions standards are tailored to each of three regulatory categories of heavy-duty vehicles: Combination Tractors; Heavy-duty Pickup Trucks and Vans; and Vocational Vehicles. The rules include separate standards for the engines that power combination tractors and vocational vehicles. Certain rules are exclusive to the EPA program. These include EPA's final hydrofluorocarbon standards to control leakage from air conditioning systems in combination tractors, and pickup trucks and vans. These also include EPA's final nitrous oxide (N2O) and methane (CH4) emissions standards that apply to all heavy- duty engines, pickup trucks and vans. EPA's final greenhouse gas emission standards under the Clean Air Act will begin with model year 2014. NHTSA's final fuel consumption standards under the Energy Independence and Security Act of 2007 will be voluntary in model years 2014 and 2015, becoming mandatory with model year 2016 for most regulatory categories. Commercial trailers are not regulated in this phase of the Heavy-Duty National Program. The agencies estimate that the combined standards will reduce CO2 emissions by approximately 270 million metric tons and save 530 million barrels of oil over the life of vehicles sold during the 2014 through 2018 model years, providing over $7 billion in net societal benefits, and $49 billion in net societal benefits when private fuel savings are considered. EPA is also finalizing provisions allowing light-duty vehicle manufacturers to use CO2 credits to meet the light-duty vehicle N2O and CH4 standards, technical amendments to the fuel economy provisions for light-duty vehicles, and a technical amendment to the criteria pollutant emissions requirements for certain switch locomotives.

This report provides current information on the Safe Drinking Water Act and recent amendments. The report describes the evolution of the Safe Drinking Water Act and the responsibilities of base personnel involved in compliance with the Act. It also describes the monitoring requirements, analytical requirements, best available technology for controlling contaminants, and public notification requirements for regulated contaminants. The appendixes include proposed contaminants and state water quality agencies. Each Air Force public water distribution system (PWDS) must comply with the SDWA, and the National Primary Drinking Water Regulations (NPDWRs). In the United States and its territories, the provisions of themore » SDWA and the NPDWRs are enforced by the states except in the few instances in which the state has not been delegated primary enforcement responsibility (primacy) by the EPA. States that have primacy may establish drinking water regulations, monitoring schedules, and reporting requirements more stringent than, or in addition to, those in the NPDWRs. Air Force public water systems in these states are required to comply with these additional requirements as well as federal enforcement actions as carried out by the EPA Regional Office.« less

EPA production of N. oceanica CY2 was stimulated when it was grown in 100% DSW amended with 1.5 g L -1 NaNO 3 , achieving a EPA content of 3.1% and a biomass concentration of 3.3 g L -1 . An outdoor-simulated microalgae cultivation system was also conducted to validate the feasibility of outdoor cultivation of the CY2 strain in plastic bag-type PBRs. Using an inoculum size of 0.6 g/L, the biomass concentration in the PBR culture was 3.5 g L -1 , while the EPA content and productivity reached a maximal level of 4.12% and 7.49 mg L -1 d -1 , respectively. When the PBRs were operated on semi-batch mode, the EPA productivity could further increase to 9.9 mg L -1 d -1 with a stable EPA content of 4.1%. Copyright © 2017 Elsevier Ltd. All rights reserved.

UST Financial Assurance Information
Subtitle I of the Resource Conservation and Recovery Act, as amended by the Hazardous Waste Disposal Act of 1984, brought underground storage tanks (USTs) under federal regulation. As part of that regulation, Congress directed EPA to develop financial responsibility regulations for UST owners and operators. Congress wanted owners and operators of underground storage tanks (USTs) to show that they have the financial resources to clean up a site if a release occurs, correct environmental damage, and compensate third parties for injury to their property or themselves.Owners and operators have several options: obtain insurance coverage from an insurer or a risk retention group; demonstrate self-insurance using a financial test; obtain corporate guarantees, surety bonds, or letters of credit; place the required amount into a trust fund administered by a third party; or rely on coverage provided by a state financial assurance fund.Information in this data asset includes state documentation to support this requirement. Many states have developed financial assurance funds to help owners and operators meet financial responsibility requirements and to help cover the costs of cleanups. State financial assurance fund programs, which supplement or are a substitute for private insurance, have been especially useful for small-to-medium sized petroleum marketers.EPA requires its Regional Offices to conduct annual reviews of state financial assurance funds. Representatives of a variety of environmental agencies and citizen organizations as well as officials from all levels of government testified on proposed amendments to the Resource Conservation and Recovery Act (RCRA) that call for the Environmental Protection Agency (EPA) to develop criteria guidelines for siting hazardous waste facilities. Uncertainty issues were raised because the guidelines would apply to existing as well as new facilities. The 16 witnesses examined whether the guidelines would be adequate to protect public health. The testimony of critics focused on specific situations involving PCB plants and other hazards in which the site selection standards proved inadequate.more » EPA representatives described siting relationships which EPA considers to be important. ...EPA is proposing to approve in part and disapprove in part state implementation plan (SIP) revisions submitted by California to provide for attainment of the 1997 fine particulate matter (PM2.5) national ambient air quality standards in the San Joaquin Valley (SJV). These SIP revisions are the SJV 2008 PM2.5 Plan (revised 2010 and 2011) and SJV-related provisions of the 2007 State Strategy (revised 2009 and 2011). EPA is proposing to approve the emissions inventories; air quality modeling; the reasonably available control measures/reasonably available control technology, reasonable further progress, and attainment demonstrations; and the transportation conformity motor vehicle emissions budgets. EPA is also proposing to grant California's request to extend the attainment deadline for the SJV to April 5, 2015 and to approve commitments to measures and reductions by the SJV Air Pollution Control District and the California Air Resources Board. Finally, it is proposing to disapprove the SIP's contingency measures. In 2002, the EPA amended 40 CFR 61 Subpart H and 40 CFR 61 Appendix B Method 114 to include requirements from ANSI/HPS N13.1-1999 Sampling and Monitoring Releases of Airborne Radioactive Substances from the Stack and Ducts of Nuclear Facilities for major emission points. Additionally, the WDOH amended the Washington Administrative Code (WAC) 246-247 Radiation protection-air emissions to include ANSI/HPS N13.1-1999 requirements for major and minor emission points when new permitting actions are approved. A result of the amended regulations is the requirement to prepare a written technical basis for the radiological air emission sampling and monitoring program. A keymore » component of the technical basis is the Potential Impact Category (PIC) assigned to an emission point. This paper discusses the PIC assignments for the Pacific Northwest National Laboratory (PNNL) Integrated Laboratory emission units; this revision includes five PIC categories.« less

Neither the Environmental Protection Agency nor the Office of Management and Budget is violating the law by reviewing or revising the Agency for Toxic Substances and Disease Registry's budget request before the President submits it to Congress. The review also does not violate section III (n) of the superfund Amendments and Reauthorization Act of 1986 which secures minimum funding for ATSDR that can only be changed by Congress. However, GAO believes that this provision prohibits EPA from specifying how ATSDR should spend superfund money. It is therefore recommending that EPA not place any restrictions on the use of funds earmarkedmore » for ATSDR under section III(n) of SARA.« less

The US Department of Energy, under its Surplus Facilities Management Program (SFMP), is responsible for cleanup activities at the Weldon Spring site, located near Weldon Spring, Missouri. The site consists of two noncontiguous areas: (1) a raffinate pits and chemical plant area and (2) a quarry. This engineering evaluation/cost analysis (EE/CA) report has been prepared to support a proposed removal action to manage 15 nonprocess buildings, identified as the 15 Series buildings, at the chemical plant on the Weldon Spring site. These buildings have been nonoperational for more than 20 years, and the deterioration that has occurred during this timemore » has resulted in a potential threat to site workers, the general public, and the environment. The EE/CA documentation of this proposed action is consistent with guidance from the US Environmental Protection Agency (EPA) that addresses removal actions at sites subject to the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) of 1980, as amended by the Superfund Amendments and Reauthorization Act of 1986. Actions at the Weldon Spring site are subject to CERCLA requirements because the site is on the EPA`s National Priorities List. The objectives of this report are to (1) identify alternatives for management of the nonprocess buildings; (2) document the selection of response activities that will mitigate the potential threat to workers, the public, and the environment associated with these buildings; and (3) address environmental impact associated with the proposed action.« less

...EPA is proposing a limited approval of a revision to the Alabama state implementation plan (SIP) submitted by the State of Alabama through the Alabama Department of Environmental Management (ADEM), on July 15, 2008, that addresses regional haze for the first implementation period. This revision addresses the requirements of the Clean Air Act (CAA or Act) and EPA's rules that require states to prevent any future and remedy any existing anthropogenic impairment of visibility in mandatory Class I areas (national parks and wilderness areas) caused by emissions of air pollutants from numerous sources located over a wide geographic area (also referred to as the ``regional haze program''). States are required to assure reasonable progress towards the national goal of achieving natural visibility conditions in Class I areas. EPA is proposing a limited approval of this SIP revision to implement the regional haze requirements for Alabama on the basis that the revision, as a whole, strengthens the Alabama SIP. Additionally, EPA is proposing to rescind the federal regulations previously approved into the Alabama SIP on November 24, 1987, and to rely on the provisions in Alabama's July 15, 2008, SIP submittal to meet the long-term strategy (LTS) requirements for reasonably attributable visibility impairment (RAVI). EPA has previously proposed a limited disapproval of the Alabama regional haze SIP because of deficiencies in the State's regional haze SIP submittal arising from the remand by the U.S. Court of Appeals for the District of Columbia Circuit (DC Circuit) to EPA of the Clean Air Interstate Rule (CAIR). Consequently, EPA is not proposing to take action in this rulemaking to address the State's reliance on CAIR to meet certain regional haze requirements.
