On the Misuse of the Laplace Law in Bio Fluid Dynamics

The Laplace law is commonly applied in biomechanical analyses of blood vessels, lung alveoli, and the gastrointestinal tract, often without concern to assumptions that underlie its use. This ``law'' is a simple force balance applied across the wall of a static pressurized (δP) vessel for small thickness-to-radius ratio τ/r. However, the true thin-wall requirement is more severe than τ/r << 1. Furthermore, because the Laplace law estimates total stress rather than deviatoric stress, the common practice of evaluating material stiffness by plotting Laplace law stress against strain is, in principle, incorrect. To study the validity of the Laplace law in biomechanical applications, we solved exactly the model problem of an axisymmetric pressurized cylinder of arbitrary thickness, linearly elastic isotropic material, in steady state, with the no-load state (δP = 0) as the zero stress state. Vessel radii and all stresses (total, deviatoric, hydrostatic) are predicted as functions of δP. We find that the Laplace law is invalid for many biomechanical applications and that total stress is not an appropriate surrogate for deviatoric stress to evaluate stiffness. We propose a model for deviatoric stress that we argue should replace the Laplace law for many biomechanical applications.

A Study of Experience Credit for Professional Engineering Licensure

Oak Ridge National Laboratory performed a study of experience credit for professional engineering licensure for the Department of Energy's Industrial Assessment Center (IAC) Program. One of the study's goals was to determine how state licensure boards grant experience credit for engineering licensure, particularly in regards to IAC experience and experience prior to graduation. Another goal involved passing IAC information to state licensure boards to allow the boards to become familiar with the program and determine if they would grant credit to IAC graduates. The National Council of Examiners for Engineers and Surveyors (NCEES) has adopted a document, the ''Model Law''.more » This document empowers states to create state engineering boards and oversee engineering licensure. The board can also interpret and adopt rules and regulations. The Model Law also gives a general ''process'' for engineering licensure, the ''Model Law Engineer''. The Model Law Engineer requires that an applicant for professional licensure, or professional engineering (PE) licensure, obtain a combination of formal education and professional experience and successfully complete the fundamentals of engineering (FE) and PE exams. The Model Law states that a PE applicant must obtain four years of ''acceptable'' engineering experience after graduation to be allowed to sit for the PE exam. Although the Model Law defines ''acceptable experience,'' it is somewhat open to interpretation, and state boards decide whether applicants have accumulated the necessary amount of experience. The Model Law also allows applicants one year of credit for postgraduate degrees as well as experience credit for teaching courses in engineering. The Model Law grants states the power to adopt and amend the bylaws and rules of the Model Law licensure process. It allows state boards the freedom to modify the experience requirements for professional licensure. This power has created variety in experience requirements, and licensure requirements can differ from state to state. Before this study began, six questions were developed to help document how state boards grant experience credit. Many of the questions were formulated to determine how states deal with teaching experience, postgraduate credit, experience prior to graduation, PE and FE waivers, and the licensure process in general. Data were collected from engineering licensure boards for each of the fifty states and the District of Columbia. Telephone interviews were the primary method of data collection, while email correspondence was also used to a lesser degree. Prior to contacting each board, the researchers attempted to review each state's licensure web site. Based on the data collected, several trends and patterns were identified. For example, there is a general trend away from offering credit for experience prior to graduation. The issue becomes a problem when a PE from one state attempts to gain a license in another state by comity or endorsement. Twenty states, the District of Columbia, and the Virgin Islands enacted erosion and sediment control legislation during the past decade to provide for the implementation or the strengthening of statewide erosion and sediment control plans for rural and/or urban lands. That legislation and the state programs developed to implement these laws are quoted and reviewed. The natural resource data requirements of each program are also extracted. The legislation includes amendments to conservation district laws, water quality laws, and erosion and sediment control laws. Laws which provides for legislative review of administrative regulations and LANDSAT applications and/or information systems that were involved in implementing or gathering data for a specific soil erosion and sediment control program are summarized as well as principal concerns affecting erosion and sediment control laws.

Liability for space activities is a much discussed subject and the advent of commercial space operations has only added to its importance. Articles VI and VII Outer Space Treaty, together with Articles II and III Liability Convention, remain the main entry level for state liability for damage arising from private space activities. Few space-faring nations have introduced national space statutes that include a flow down of their international obligations. The European Union (EU) Regulation on the law applicable to non-contractual obligations—hereinafter Rome II Regulation—could harbour developments for liability law in the context of damage resulting from space operations. Space activities were not the main focus of the Regulation but may well turn out to be an interesting spin-off. The Regulation prescribes general rules that will determine the law applicable to damage scenarios where more than one legal system applies. It is important for trans-national tort cases in that it does not limit the rules of applicable law to EU Member States only. This paper focuses on the common rules applicable to damage actions based on torts or other non-contractual obligations as they apply to damage caused by space activities. After an assessment of the relevant international and national law norms, the impact of the Rome II Regulation will be addressed.

Measuring the stringency of states' indoor tanning regulations: instrument development and outcomes.

We sought to describe the development of an instrument to quantify the stringency of state indoor tanning legislation in the United States, and the instrument's psychometric properties. The instrument was then used to rate the stringency of state laws. A 35-item instrument was developed. An overall stringency measure and 9 stringency subscales were developed, including one measuring minors' access to indoor tanning. Stringency measures showed good internal consistency and interrater reliability. In all, 55% of the 50 states and the District of Columbia had any indoor tanning law, and 41% had any law addressing minors' access. Oregon, Illinois, South Carolina, Florida, Indiana, Iowa, and Rhode Island had high overall stringency scores, and Texas and New Hampshire were the most restrictive with regard to minors' access. Measurement of actual enforcement of the laws was not included in this study. The instrument appears to be an easy-to-use, reliable, and valid methodology. Application of the instrument to actual laws showed that, in general, state laws are relatively weak, although there was considerable variability by state.

Removing Firearms From Those Prohibited From Possession by Domestic Violence Restraining Orders: A Survey and Analysis of State Laws.

Under federal and many state laws, persons under domestic violence restraining orders (DVROs) are prohibited from possession of firearms. Using multiple sources and a Lexis Nexis search, we developed a list of state laws pertaining to the relinquishment or removal of firearms from persons prohibited from possession by DVROs. After downloading the text of each law, we conducted a legal analysis to enumerate provisions of the laws specifying implementation. We found 49 laws in 29 states and Washington, DC. The laws were conceptualized as instructions to the court, the respondent, and law enforcement. We detail the content of each state's law, including such elements as whether it applies to ex parte DVROs; whether certain criteria must be met, such as previous use of a firearm in domestic violence or lack of an employment exemption, before the law can be applied; and whether the application of the law is mandatory. We also detail instructions to the respondent regarding to whom firearms may be relinquished, whether the respondent must seek permission to transfer the firearm to a third party, and the time by which dispossession must occur. Finally, whether law enforcement bears the responsibility for removing the firearm or whether the law gives the court the authority to order a search and seizure for the firearms is discussed. The purpose of the research is to provide an overview of these state laws that can be used by key stakeholders in legislative, judicial, advocacy, or research roles. Implications are discussed.

State-based laws for reporting of health care-associated infections (HAI) have developed and changed dramatically in recent years, affecting the costs of reporting and impact on infection rates. It is necessary for practitioners of infection control to understand these changing legal frameworks and their application to practice. Employing systematic state-based research, the researchers have documented legislation and administrative regulations for institution-specific HAI reporting, using this information to create a comprehensive resource on state-based laws for mandatory HAI reporting. As of August 27, 2007, 24 states have adopted laws requiring reporting of HAI rates, with an additional 7 states currently considering legislation that would require HAI reporting and 19 states employing detailed regulation in the absence of any current legislative authorization specific to HAI. This study documents (1) which states require reporting of HAI and, if so, whether this is done by legislation or administrative regulation; (2) whether the specific HAIs to be reported are identified in state law or codified generally as "diseases of public health importance," with reporting specified by administrative regulation; and (3) what reporting policies and procedures are detailed in law. Through analysis of the collected information, the researchers have examined the degree to which states have modernized their respective public health laws to approach mandatory reporting by way of general legislation regarding "matters of public health importance" and subsequent detailed administrative regulation to specify those matters.

In this paper, the Child-Langmuir law and Langmuir-Blodgett law are generalized to the relativistic regime by a simple method. Two classical laws suitable for the nonrelativistic regime are modified to simple approximate expressions applicable for calculating the space-charge-limited currents of one-dimensional steady-state planar diodes and coaxial diodes under the relativistic regime. The simple approximate expressions, extending the Child-Langmuir law and Langmuir-Blodgett law to fit the full range of voltage, have small relative errors less than 1% for one-dimensional planar diodes and less than 5% for coaxial diodes.

Quantum thermodynamics of general quantum processes.

Accurately describing work extraction from a quantum system is a central objective for the extension of thermodynamics to individual quantum systems. The concepts of work and heat are surprisingly subtle when generalizations are made to arbitrary quantum states. We formulate an operational thermodynamics suitable for application to an open quantum system undergoing quantum evolution under a general quantum process by which we mean a completely positive and trace-preserving map. We derive an operational first law of thermodynamics for such processes and show consistency with the second law. We show that heat, from the first law, is positive when the input state of the map majorizes the output state. Moreover, the change in entropy is also positive for the same majorization condition. This makes a strong connection between the two operational laws of thermodynamics.

GPC-Based Stable Reconfigurable Control

This paper presents development of multi-input multi-output (MIMO) Generalized Pre-dictive Control (GPC) law and its application to reconfigurable control design in the event of actuator saturation. A Controlled Auto-Regressive Integrating Moving Average (CARIMA) model is used to describe the plant dynamics. The control law is derived using input-output description of the system and is also related to the state-space form of the model. The stability of the GPC control law without reconfiguration is first established using Riccati-based approach and state-space formulation. A novel reconfiguration strategy is developed for the systems which have actuator redundancy and are faced with actuator saturation type failure. An elegant reconfigurable control design is presented with stability proof. Several numerical examples are presented to demonstrate the application of various results.

State laws concerning decision-making authority for voluntary inpatient substance abuse (SA) treatment of minors may be a potential barrier to appropriate treatment. We sought to identify and classify relevant laws related to the provision of voluntary inpatient SA treatment to adolescents 12 to 17 years (minors) as an exploratory assessment to improve understanding of how these laws might affect treatment decisions. In summer 2006, we conducted a survey of statutes, regulations, and legal cases in the 50 states and the District of Columbia regarding the authority of parents (or guardians) and minors to make treatment decisions for voluntary inpatient SA treatment. All 50 states have laws applicable to voluntary inpatient SA treatment for adolescents, and the laws vary significantly throughout the nation. If a minor and parent disagree about SA treatment, some states defer to the decision-making authority of the minor, whereas other states defer to the parent. Most significantly, the majority of states fail to specify whether the minor's or the parent's decision will control in the event of a conflict. The lack of clarity in state laws regarding decision-making authority for voluntary inpatient SA treatment of minors may create a potential barrier to treatment for adolescents, especially those with more serious SA problems. This lack of clarity could lead to confusion among parents, adolescents, healthcare professionals, and treatment facilities, and ultimately could result in a failure to treat adolescents in need of medical attention. Policymakers should ensure that state laws clearly specify procedures to enable treatment if a conflict arises between adolescents and parents, including procedures to ensure that the due process rights of adolescents are protected.

An approach to the design of low-order controllers for large scale systems is proposed. The method is derived from the theory of linear state function observers. First, the realization of a state feedback control law is interpreted as the observation of a linear function of the state vector. The linear state function to be reconstructed is the given control law. Then, based on the derivation for linear state function observers, the observer design is formulated as a parameter optimization problem. The optimization objective is to generate a matrix that is close to the given feedback gain matrix. Based on that matrix, the form of the observer and a new control law can be determined. A four-disk system and a lightly damped beam are presented as examples to demonstrate the applicability and efficacy of the proposed method.

Candidate autopilot control laws that control the engine failure transient sink rates by demonstrating the engineering application of modern state variable control theory were defined. The results of approximate modal analysis were compared to those derived from full state analyses provided from computer design solutions. The aircraft was described, and a state variable model of its longitudinal dynamic motion due to engine and control variations was defined. The classical fast and slow modes were assumed to be sufficiently different to define reduced order approximations of the aircraft motion amendable to hand analysis control definition methods. The original state equations of motion were also applied to a large scale state variable control design program, in particular OPTSYS. The resulting control laws were compared with respect to their relative responses, ease of application, and meeting the desired performance objectives.

Abstract Mobile health applications are increasingly being used as tools of medicine. Outside of the clinic, some of these applications may contribute to diagnoses made absent a physician's care. We argue that this contravenes reservations of diagnosis to healthcare professionals in the law of two Canadian provinces: Quebec and Ontario. On the one hand, the law conceives of diagnosis in relatively broad terms. Drawing an association between symptoms and illness, for example, has been recognized in case law as sufficient. On the other hand, provincial law reserves diagnosis to physicians and other healthcare professionals. We argue that a number of health applications are capable of drawing associations between symptoms and disease and, in doing so, of delivering diagnoses in contravention of the law of Quebec and Ontario. This places mobile health applications in a poorly understood legal space. While prosecution is unlikely, the increasing ubiquity and technological sophistication of health applications promises to make such diagnosis widespread. We suggest that the legal status of such mobile health apps should be given serious attention. While our analysis focuses on the state of the law in Canada's largest provinces, we suggest that our argument will have implications in other jurisdictions. PMID:29707219

A theoretical method is proposed for the calculation of the photon counting probability distribution during a bin time. Two-state fluorescence and steady excitation are assumed. A key feature is a kinetic scheme that allows for an extensive class of stochastic waiting time distribution functions, including power laws, expanded as a sum of weighted decaying exponentials. The solution is analytic in certain conditions, and an exact and simple expression is found for the integral contribution of “bright” and “dark” states. As an application for power law kinetics, theoretical results are compared with experimental intensity histograms from a number of blinking CdSe/ZnSmore » quantum dots. The histograms are consistent with distributions of intensity states around a “bright” and a “dark” maximum. A gap of states is also revealed in the more-or-less flat inter-peak region. The slope and to some extent the flatness of the inter-peak feature are found to be sensitive to the power-law exponents. Possible models consistent with these findings are discussed, such as the combination of multiple charging and fluctuating non-radiative channels or the multiple recombination center model. A fitting of the latter to experiment provides constraints on the interaction parameter between the recombination centers. This article educates healthcare practitioners on the legal framework prohibiting abusive practices in urine drug testing (UDT) in medical settings, discusses several profit-driven UDT schemes that have resulted in enforcement actions, and provides recommendations for best practices in UDT to comply with state and federal fraud and anti-kickback statutes. The authors carefully reviewed and analyzed statutes, regulations, adivsory opinions, case law, court documents, articles from legal journals, and news articles. Certain facts-driven UDT arrangements tend to violate federal and state healthcare laws and regulations, including Stark law, the anti-kickback statute, the criminal health care fraud statute, and the False Claims Act. Healthcare practitioners who use UDT can help ensure that they are in compliance with applicable federal and state laws by evaluating whether their actions are motivated by providing proper care to their patients rather than by profits. They must avoid schemes that violate the spirit of the law while appearing to comply with the letter of the law. Such a simple self-evaluation of motive can reduce a practitioner's likelihood of civil fines and criminal liability.

In the spring of 2011, the American state of Texas passed into law an act limiting the liability of commercial space flight entities. Under it, those companies would not be liable for space flight participant injuries, except in cases of intentional injury or injury proximately caused by the company's gross negligence. Three laws of robotics and surgery.

In 1939, Isaac Asimov solidified the modern science fiction genre of robotics in his short story "Strange Playfellow" but altered our thinking about robots in Runaround in 1942 by formulating the Three Laws. He took an engineer's perspective on advanced robotic technologies. Surgical robots by definition violate the first law, yet his discussions are poignant for our understanding of future potential of robotic urologic surgery. We sought to better understand Asimov's visions by reading his fiction and autobiography. We then sought to place his perceptions of science fact next to the Three Laws (he later added a fourth law, the zeroth). Asimov's Three Laws are often quoted in medical journals during discussions about robotic surgery. His First Law states: "A robot may not injure a human being, or, through inaction, allow a human being to come to harm. " This philosophy would directly conflict with the application in surgery. In fact, most of his robotic stories deal with robots that come into conflicts with the laws. Robots in his cleverly orchestrated works evolve unique solutions to complex hierarchical conflicts with these laws. Asimov anticipated the coming maelstrom of intelligent robotic technologies with prescient unease. Despite his scholarly intuitions, he was able to fathom medical/surgical applications in many of his works. These fictional robotic physicians were able to overcome the first law and aid in the care and management of the sick/injured. Isaac Asimov published over 500 books on topics ranging from Shakespeare to science. Despite his widespread influence, he refused to visit the MIT robotics laboratory to see current, state-of-the-art systems. He managed to lay the foundation of modern robotic control systems with a human-oriented safety mechanism in his laws. "If knowledge can create problems, it is not through ignorance that we can solve them " (I Asimov).

The second law of thermodynamics represents a universal principle applicable to all natural processes, physical systems, and engineering devices. Hatano and Sasa have recently put forward an extended form of the second law for transitions between nonequilibrium stationary states [Phys. Rev. Lett. 86, 3463 (2001)]. In this paper we further extend this form to an instantaneous interpretation, which is satisfied by quite general time-dependent stochastic processes including master-equation models and Langevin dynamics without the requirements of the stationarity for the initial and final states. The theory is applied to several thermodynamic processes, and its consistence with the classical thermodynamics is shown.

Single-Gimbal Control Moment Gyro (SGCMG) systems have been investigated for attitude control of the Large Space Telescope (LST) and the High Energy Astronomy Observatory (HEAO). However, various proposed steering laws for the SGCMG systems thus far have some defects because of singular states of the system. In this report, a steering law for a roof-type SGCMG system is proposed which is based on a new momentum distribution scheme that makes all the singular states unstable. This momentum distribution scheme is formulated by a treatment of the system as a sampled-data system. From analytical considerations, it is shown that this steering law gives control performance which is satisfactory for practical applications. Results of the preliminary computer simulation entirely support this premise.

This article summarizes public health legal issues that need to be considered in preparing for and responding to nuclear detonation. Laws at the federal, state, territorial, local, tribal, and community levels can have a significant impact on the response to an emergency involving a nuclear detonation and the allocation of scarce resources for affected populations. An understanding of the breadth of these laws, the application of federal, state, and local law, and how each may change in an emergency, is critical to an effective response. Laws can vary from 1 geographic area to the next and may vary in an emergency, affording waivers or other extraordinary actions under federal, state, or local emergency powers. Public health legal requirements that are commonly of concern and should be examined for flexibility, reciprocity, and emergency exceptions include liability protections for providers; licensing and credentialing of providers; consent and privacy protections for patients; occupational safety and employment protections for providers; procedures for obtaining and distributing medical countermeasures and supplies; property use, condemnation, and protection; restrictions on movement of individuals in an emergency area; law enforcement; and reimbursement for care.

A control method applicable to multiple-input multiple-output nonlinear time-invariant systems in which desired behavior can be expressed explicitly as a trajectory in system state space is developed. The precomputed state dependent control method is basically a synthesis technique in which a suboptimal control law is developed off-line, prior to system operation. This law is obtained by conducting searches at a finite number of points in state space, in the vicinity of some desired trajectory, to obtain a set of constant control vectors which tend to return the system to the desired trajectory. These vectors are used to evaluate the unknown coefficients in a control law having an assumed hyperellipsoidal form. The resulting coefficients constitute the heart of the controller and are used in the on-line computation of control vectors. Two examples of PSDC are given prior to the more detailed description of the NERVA control system development.

The Association of Women's Health, Obstetric and Neonatal Nurses (AWHONN) opposes laws and other policies that require nurses to report the results of screening for intimate partner violence (IPV) to law enforcement or other regulatory agencies without the consent of the woman who experiences the IPV. Nurses and other health care professionals, however, should become familiar with laws on mandatory reporting in their states and comply as applicable. Women should be universally screened for IPV in private, safe settings where health care is provided. Nurses are ideally positioned to screen for IPV for the purpose of initiating a referral for services and support when applicable. To protect the woman's safety, AWHONN supports policies that require a woman's consent before reporting occurs.

In 1967 California adopted updated therapeutic abortion laws which were more liberal than previous laws but which did not allow abortion for fetal indications nor for minor psychiatric reasons. Between November 8, 1967, and September 30, 1968, there were 4291 applicants for abortion in California. 91% of these were approved and 88% performed. Of the applications, 86% were for mental health, 6% for physical health, and 9% for rape or incest. 63% of the abortions were performed in the 9 bay area counties around San Francisco although only 23% of the states births occur in that area. The author feels that these liberalized laws will help to lead to the eventual legalization of abortion in California.

The Theoretical Mechanics Branch has as one of its long-range goals to work toward solving real-time trajectory optimization problems on board an aircraft. This is a generic problem that has application to all aspects of aviation from general aviation through commercial to military. Overall interest is in the generic problem, but specific problems to achieve concrete results are examined. The problem is to develop control laws that generate approximately optimal trajectories with respect to some criteria such as minimum time, minimum fuel, or some combination of the two. These laws must be simple enough to be implemented on a computer that is flown on board an aircraft, which implies a major simplification from the two point boundary value problem generated by a standard trajectory optimization problem. In addition, the control laws allow for changes in end conditions during the flight, and changes in weather along a planned flight path. Therefore, a feedback control law that generates commands based on the current state rather than a precomputed open-loop control law is desired. This requirement, along with the need for order reduction, argues for the application of singular perturbation techniques.

Prescribed-performance fault-tolerant control for feedback linearisable systems with an aircraft application

This paper investigates fault-tolerant control (FTC) for feedback linearisable systems (FLSs) and its application to an aircraft. To ensure desired transient and steady-state behaviours of the tracking error under actuator faults, the dynamic effect caused by the actuator failures on the error dynamics of a transformed model is analysed, and three control strategies are designed. The first FTC strategy is proposed as a robust controller, which relies on the explicit information about several parameters of the actuator faults. To eliminate the need for these parameters and the input chattering phenomenon, the robust control law is later combined with the adaptive technique to generate the adaptive FTC law. Next, the adaptive control law is further improved to achieve the prescribed performance under more severe input disturbance. Finally, the proposed control laws are applied to an air-breathing hypersonic vehicle (AHV) subject to actuator failures, which confirms the effectiveness of the proposed strategies.

This article discusses the significance of the Directive 2011/24/EU on the application of patients' rights in cross-border healthcare for the protection of individual patients' rights in the Netherlands by describing how its provisions are implemented in Dutch health law. The responsible Dutch authorities take the view that most of the Directive's provisions and requirements are covered in existing Dutch law. Implementation of the Directive would only require adaptations to national legislation with regard to the establishment of a national contact point for cross-border healthcare and the recognition of medical prescriptions issued in another Member State. This article looks into the question of how far the Dutch law meets the requirements of the Directive in relation to the individual patients' rights addressed in this special issue of the European Journal of Health Law.

We discuss a constitutive model describing the permanent densification of fused silica under large applied pressures and shear stresses. The constitutive law is assumed to be rate- independent, and uses a yield function coupling hydrostatic pressure and shear stress, a flow rule describing the evolution of permanent strains after initial densification, and a hardening rule describing the dependence of the incremental densification on the levels of applied stresses. The constitutive law accounts for multiaxial states of stress, since during polishing and grinding operations complex stress states occur in a thin surface layer due to the action of abrasive particles. Due to frictional and other abrasive forces, large shear stresses are present near the surface during manufacturing. We apply the constitutive law in estimating the extent of the densified layer during the mechanical interaction of an abrasive grain and a flat surface.

Computer simulations of the one-on-one aerial combat encounter are generated under the control of specified guidance laws. Given an initial state, the vehicle and atmospheric characteristics, and the guidance laws, the aerial combat encounter is simulated by forward integration of the two vehicles' motions. The development of a combat guidance law which converts positional advantage into an improved firing opportunity is reported. A combination of lag, line of sight, and lead pursuit steering paths are followed in the guidance law. The law is based on steering error, target angle-off and the relative velocities. It readily is automated either as an onboard aid to manned aircraft pilots or as a combat guidance law for unmanned vehicles.

In almost all states in the United States, to carry a concealed handgun legally requires a permit from the police. Many states have changed from may-issue laws (where the local police chief has discretion about to whom to issue a license) to shall-issue laws (where the police chief must issue a permit if the applicant passes a computerized federal background check). Studies conflict on the effect on crime. None considered the situation in may-issue states when police used discretion and refused to issue a permit. We provide suggestive evidence from a December 2013 survey of police chiefs in Massachusetts' 351 cities and towns. Of the 121 responding police chiefs, a large majority favored retaining police discretion. Chiefs issued few discretionary denials - median 2 per year, citing providing false information, a history of assault (often domestic violence), a history of drug or alcohol abuse, or of mental-health issues as the most common reasons for denial.

A direct method for synthesizing low-order optimal feedback control laws with application to flutter suppression

A direct method of synthesizing a low-order optimal feedback control law for a high order system is presented. A nonlinear programming algorithm is employed to search for the control law design variables that minimize a performance index defined by a weighted sum of mean square steady state responses and control inputs. The controller is shown to be equivalent to a partial state estimator. The method is applied to the problem of active flutter suppression. Numerical results are presented for a 20th order system representing an aeroelastic wind-tunnel wing model. Low-order controllers (fourth and sixth order) are compared with a full order (20th order) optimal controller and found to provide near optimal performance with adequate stability margins.

The power-law formalism has been successfully used as a modeling tool in many applications. The resulting models, either as Generalized Mass Action or as S-systems models, allow one to characterize the target system and to simulate its dynamical behavior in response to external perturbations and parameter changes. The power-law formalism was first derived as a Taylor series approximation in logarithmic space for kinetic rate-laws. The especial characteristics of this approximation produce an extremely useful systemic representation that allows a complete system characterization. Furthermore, their parameters have a precise interpretation as local sensitivities of each of the individual processes and as rate-constants. This facilitates a qualitative discussion and a quantitative estimation of their possible values in relation to the kinetic properties. Following this interpretation, parameter estimation is also possible by relating the systemic behavior to the underlying processes. Without leaving the general formalism, in this paper we suggest deriving the power-law representation in an alternative way that uses least-squares minimization. The resulting power-law mimics the target rate-law in a wider range of concentration values than the classical power-law. Although the implications of this alternative approach remain to be established, our results show that the predicted steady-state using the least-squares power-law is closest to the actual steady-state of the target system.

Cybersecurity threats to satellite communications: Towards a typology of state actor responses

Cybersecurity threats to satellite communications are a relatively new phenomenon, yet have quickly come to the forefront of concern for the sustainability of satellite systems due to the vulnerabilities that such threats may exploit and negatively impact. These vulnerabilities are mission-critical: they include launch systems, communications, telemetry, tracking and command, and mission completion. They and other aspects of satellite communications depend heavily on secure and resilient cyber capabilities for all stages of the satellite's lifespan. Because of the inherently global nature of both satellite and cyberspace activities, these capabilities rely significantly on international cooperation for setting a baseline of agreed legal norms that protect satellites and satellite communications. This critical cooperation is relevant during all mission phases, from planning to final wrap-up. Under optimal circumstances, the norms and standards protecting satellites and satellite transmissions are developed and enforced by those nation-state actors that are committed to system operability and overall mission sustainability for those satellites launched under their aegis and responsibility. However, when breaches of international law do occur in the form of hostile cyber events that cause damage to satellite communications, a range of measures should be available to the victim state, provided by the appropriate legal regime or regimes. This article proposes that a comprehensive and integrative multi-stakeholder review be undertaken in the near future of the measures available under international law for responding to hostile acts directed at satellite systems and communications, in a manner that takes into account both existing regimes of international law reviewed herein, as well as considerations of cybersecurity. These measures will depend upon the characterization of hostile interference with satellite transmissions in accordance with a proposed typology of hostile events. At present, four key normative international law regimes influence the types of measures that may be undertaken by states: the UN Charter's collective security regime; space law (governing the launching of objects and their space activities, including liability for damages); global telecommunications law (governing data transmissions and protection of infrastructures); and the substantive law relating to transborder freedom of information. Moreover, the nascent normative framework that will eventually apply to state and non-state activities in cyberspace will also be relevant to satellite communications, although it has been largely excluded from analyses and studies. In summary, this article proposes a typology of hostile events, both kinetic and cyber-enabled, that are liable to disrupt satellite communications; and it reviews the four key relevant legal regimes and notes the challenges of nascent cybersecurity law on the international plane. The article concludes by advocating for the establishment of a framework for effective elucidation of appropriate legal remedies at the international level in responding to kinetic, virtual and hybrid threats and hostile disruptions to satellite communications. ASAT of various types, including hostile interference with satellite transmissions, has also been treated as a critical issue in the context of the increasing militarization of space, as addressed under the auspices of the United Nations' Office for Outer Space Affairs (UNOOSA) and Office for Disarmament Affairs (UNODA). For example, in the 2013 Report of the UN Group of Governmental Experts on Transparency and Confidence-Building Measures in Outer Space Activities (herein, "GGE") it was noted that the outer space environment is becoming "…increasingly congested, contested and competitive. In the context of international peace and security, there is growing concern that threats to vital space capabilities may increase during the next decade as a result of both natural and man-made hazards and the possible development of disruptive and destructive counterspace capabilities" [14].Ongoing work under the auspices of UN bodies and other intergovernmental organizations regarding the developing parameters of outer space governance has in recent years sharpened the understanding that a new, unified approach is needed [15]. The underlying assumption of this article is that international law has a key role to play in articulating these "rules of the road" for the activities of state actors relating to satellites, including the imposition of realistic and effective sanctions for those states that do not uphold and implement the applicable legal norms. Yet the additional and relatively unexplored issue of the application of international law to state activities in cyberspace is a relevant legal consideration that also needs to be weighed in evaluating the range of possible state responses to hostile disruption of satellite communications. This consideration is largely absent from existing intergovernmental initiatives regarding outer space governance [16]. Thus, the incorporation of cybersecurity considerations will be an important element of the analysis of harmful interference to satellite transmissions in light of the four regimes reviewed below. Thus, space law imposes upon states the responsibility for actions carried out by satellites under their jurisdiction and control, and duly attributable to them under international law. These actions may include physical damage caused by the creation of space debris that inflicts physical harm to other satellites.The full regime establishing responsibility and stipulating damages is set out in the Liability Convention, which elaborates on OST Article VII. The degree of liability incurred under particular circumstances is stipulated in the Liability Convention's Articles II through VI. For instance, Article II establishes absolute liability "for damage caused by [the launching state's] space object on the surface of the earth or to aircraft flight" [38]. This liability requires, for example, payment of compensation to the injured state when certain criteria have been met. In outer space, state liability must be established in accordance with the provisions of Liability Convention Articles II and IV. For these purposes, "damage" is defined as: "… [the] loss of life, personal injury or other impairment of health; or loss of or damage to property of States or of persons, natural or juridical, or property of international intergovernmental organizations" [39].There remains an open question of the applicability of the Liability Convention to satellite transmissions that are subject to hostile disruption through solely virtual means. A recent Draft Report of the Chair of the COPOUS Working Group on the Status and Application of the Five United Nations Treaties on Outer Space raised the question of expanding the scope of states' international responsibility and liability under this Convention [40]. The European Union's 2014 Draft Code of Conduct also formulates a broad approach, advocating "…the freedom for all States, in accordance with international law and obligations, to access, to explore, and to use outer space for peaceful purposes without harmful interference, fully respecting the security, safety and integrity of space objects…" [41]. It specifically endorses improving states' adherence to, and implementation of, ITU regulations addressing harmful radio-frequency interference [42].It is proposed here that a reasonable interpretation of Article VII might also include damage caused virtually by hostile disruption to satellite transmissions, whether by space debris or otherwise [43]. The Convention's concept of "loss or damage to property" would entail a determination that transmissions and the data they transmit constitute the "property" of a state or private entity the activity of which is attributable to a state. It is contended that this is not an unreasonable extension of the scope of the Convention, especially given the high commercial and financial value of many such transmissions. There is also precedent for such an approach, as in the application of the WIPO Convention to satellite transmissions, which it views as assets capable of bearing proprietary rights [44]. Moreover, commercial satellite operators and satellite consortia, such as International Maritime Satellite Organization (IMSO), are bound to provisions within their conventional regimes that require compensation when client transmissions are interrupted, distorted or otherwise damaged [45].In summary, the application of space law to the disruption of satellite transmissions may be characterized as follows. The determinative point of departure for space law is general international law, including the UN Charter and its regime of collective security. Although states may not claim sovereignty over particular territories in outer space, including the moon and other celestial bodies, satellites do remain under the sovereignty and the responsibility of the launching state or states. These legal principles are established in the OST, which also provides (together with the Liability Convention) for the liability of states for damage caused by satellites throughout the satellite's life span. In this author's view, the definition of "damage", crucial to the application of the Liability Convention, may be understood to include injuries caused by either kinetic or virtual means, including damage caused through and in cyberspace. More controversial is the question of whether satellite transmissions may be considered "property" under the Liability Convention, together with the applicable commercial satellite agreement, and are covered by its provisions. It is proposed that certain satellite transmissions are in fact subject to the Liability Convention as "property" and are protected by its provisions. Nonetheless, state practice regarding the issue is currently lacking, as it is, to a lesser degree, regarding liability for the clearer case of physical damage to satellites [46].

Judicial intervention in alcohol regulation: an empirical legal analysis.

While governments draft law and policy to promote public health, it is through cases put before the judiciary that the implementation of law can be challenged and where its practical implications are typically determined. In this paper, we examine the role of court judgements on efforts in Australia to regulate the harmful use of alcohol. Australian case law (2010 to June 2015) involving the judicial review of administrative decisions relating to development applications or liquor licences for retail liquor outlets (bottle shops), hotels, pubs and clubs was identified using a case law database (WestLaw AU). Data were extracted and analysed using standard systematic review techniques. A total of 44 cases were included in the analysis. Of these, 90% involved appeals brought by industry actors against local or state government stakeholders seeking to reject applications for development applications and liquor licences. The proportion of judicial decisions resulting in outcomes in favour of industry was 77%. Public health research evidence appeared to have little or no influence, as there is no requirement for legislation to consider public health benefit. Implications for public health: A requirement that the impact on public health is considered in legislation will help to offset its strong pro-competition emphasis, which in turn has strongly influenced judicial decision making in this area. © 2017 The Authors.

We have developed an analytical physics model from fundamental physics principles and used the reduced one-dimensional model to derive a thermonuclear ignition criterion and implosion energy scaling laws applicable to inertial confinement fusion capsules. The scaling laws relate the fuel pressure and the minimum implosion energy required for ignition to the peak implosion velocity and the equation of state of the pusher and the hot fuel. When a specific low-entropy adiabat path is used for the cold fuel, our scaling laws recover the ignition threshold factor dependence on the implosion velocity, but when a high-entropy adiabat path is chosen, the model agrees with recent measurements.

Biobanking Research and Privacy Laws in the United States.

Privacy is protected in biobank-based research in the US primarily by the Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule and the Federal Policy for Protection of Human Subjects (Common Rule). Neither rule, however, was created to function in the unique context of biobank research, and therefore neither applies to all biobank-based research. Not only is it challenging to determine when the HIPAA Privacy Rule or the Common Rule apply, but these laws apply different standards to protect privacy. In addition, many other federal and state laws may be applicable to a particular biobank, researcher, or project. US law also does not directly address international sharing of data or specimens outside of the EU-US Safe Harbor Agreement, which only applies to receipt of data by certain US entities from EU countries, and is in the process of revision. Although new rules would help clarify privacy protections in biobanking, any implemented changes should be studied to determine the sufficiency of the protections as well as its ability to facilitate or hinder international collaborations. © 2016 American Society of Law, Medicine & Ethics.

The present investigation is an application of the second law of thermodynamics to the spark ignition engine cycle. A comprehensive thermodynamic analysis of the air standard cycle is conducted using the first and second laws of thermodynamics, the ideal gas equation of state and the perfect gas properties for air. The study investigates the effect of the cycle parameters on the cycle performance reflected by the first and second law efficiencies, the heat added, the work done, the available energy added as well as the history of the internal, available and unavailable energies along the cycle. The study shows that the second law efficiency is a function of the compression ratio, the initial temperature, the maximum temperature as well as the dead state temperature. A non-dimensional comprehensive thermodynamic simulation model for the actual Otto cycle is developed to study the effects of the design and operating parameters of the cycle on the cycle performance. The analysis takes into account engine geometry, mixture strength, heat transfer, piston motion, engine speed, mechanical friction, spark advance and combustion duration.

Diffusion of Impaired Driving Laws Among US States.

We examined internal and external determinants of state's adoption of impaired driving laws. Data included 7 state-level, evidence-based public health laws collected from 1980 to 2010. We used event history analyses to identify predictors of first-time law adoption and subsequent adoption between state pairs. The independent variables were internal state factors, including the political environment, legislative professionalism, government capacity, state resources, legislative history, and policy-specific risk factors. The external factors were neighboring states' history of law adoption and changes in federal law. We found a strong secular trend toward an increased number of laws over time. The proportion of younger drivers and the presence of a neighboring state with similar laws were the strongest predictors of first-time law adoption. The predictors of subsequent law adoption included neighbor state adoption and previous legislative action. Alcohol laws were negatively associated with first-time adoption of impaired driving laws, suggesting substitution effects among policy choices. Organizations seeking to stimulate state policy changes may need to craft strategies that engage external actors, such as neighboring states, in addition to mobilizing within-state constituencies.

Youth motorcycle-related brain injury by state helmet law type: United States, 2005-2007.

Twenty-seven states have youth-specific helmet laws even though such laws have been shown to decrease helmet use and increase youth mortality compared with all-age (universal) laws. Our goal was to quantify the impact of age-specific helmet laws on youth under age 20 hospitalized with traumatic brain injury (TBI). Our cross-sectional ecological group analysis compared TBI proportions among US states with different helmet laws. We examined the following null hypothesis: If age-specific helmet laws are as effective as universal laws, there will be no difference in the proportion of hospitalized young motorcycle riders with TBI in the respective states. The data are derived from the 2005 to 2007 State Inpatient Databases of the Healthcare Cost and Utilization Project. We examined data for 17 states with universal laws, 6 states with laws for ages <21, and 12 states with laws for children younger than 18 (9287 motorcycle injury discharges). In states with a <21 law, serious TBI among youth was 38% higher than in universal-law states. Motorcycle riders aged 12 to 17 in 18 helmet-law states had a higher proportion of serious/severe TBI and higher average Abbreviated Injury Scores for head-region injuries than riders from universal-law states. States with youth-specific laws had an increased risk of TBI that required hospitalization, serious and severe TBI, TBI-related disability, and in-hospital death among the youth they are supposed to protect. The only method known to keep motorcycle-helmet use high among youth is to adopt or maintain universal helmet laws.

Feedback control laws for highly maneuverable aircraft

The results of a study of the application of H infinity and mu synthesis techniques to the design of feedback control laws for the longitudinal dynamics of the High Angle of Attack Research Vehicle (HARV) are presented. The objective of this study is to develop methods for the design of feedback control laws which cause the closed loop longitudinal dynamics of the HARV to meet handling quality specifications over the entire flight envelope. Control law designs are based on models of the HARV linearized at various flight conditions. The control laws are evaluated by both linear and nonlinear simulations of typical maneuvers. The fixed gain control laws resulting from both the H infinity and mu synthesis techniques result in excellent performance even when the aircraft performs maneuvers in which the system states vary significantly from their equilibrium design values. Both the H infinity and mu synthesis control laws result in performance which compares favorably with an existing baseline longitudinal control law.

Power law versus exponential state transition dynamics: application to sleep-wake architecture.

Despite the common experience that interrupted sleep has a negative impact on waking function, the features of human sleep-wake architecture that best distinguish sleep continuity versus fragmentation remain elusive. In this regard, there is growing interest in characterizing sleep architecture using models of the temporal dynamics of sleep-wake stage transitions. In humans and other mammals, the state transitions defining sleep and wake bout durations have been described with exponential and power law models, respectively. However, sleep-wake stage distributions are often complex, and distinguishing between exponential and power law processes is not always straightforward. Although mono-exponential distributions are distinct from power law distributions, multi-exponential distributions may in fact resemble power laws by appearing linear on a log-log plot. To characterize the parameters that may allow these distributions to mimic one another, we systematically fitted multi-exponential-generated distributions with a power law model, and power law-generated distributions with multi-exponential models. We used the Kolmogorov-Smirnov method to investigate goodness of fit for the "incorrect" model over a range of parameters. The "zone of mimicry" of parameters that increased the risk of mistakenly accepting power law fitting resembled empiric time constants obtained in human sleep and wake bout distributions. Recognizing this uncertainty in model distinction impacts interpretation of transition dynamics (self-organizing versus probabilistic), and the generation of predictive models for clinical classification of normal and pathological sleep architecture.

A review of the current litigation regarding Medicaid managed care reveals two basic types of lawsuits: (1) those that challenge the practices of managed care companies under various federal and state laws that safeguard consumer rights, protect health care quality, and prohibit discrimination; and (2) suits that assert claims arising directly under the Medicaid statute and implementing regulations, as well as claims related to Constitutional safeguards that undergird the program. Lawsuits asserting claims arising under Medicaid tend to raise two basic questions: (1) the extent to which enrollment in a Medicaid managed care plan alters existing Medicaid beneficiary rights and state agency duties under federal or state Medicaid law; and (2) the extent to which managed care companies, as agents of the state, act under "color of law" (i.e., undertaking to perform official duties or acting with the imprimatur of state authority). Additionally, states might see an increase in litigation brought by prospective and current contractors who assert that they have been wrongfully denied contracts or improperly penalized for poor performance. These assertions may involve claims that are grounded in federal and state law, the Medicaid statute, and the Constitution. Moreover, in light of the consumer protection elements of the managed care reforms contained in the Balanced Budget Act, future managed care litigation may focus on the manner in which companies carry out states' obligations toward managed care enrollees. Resolution of Medicaid managed care cases involves the application of general principles of administrative and regulatory law. Thus, Medicaid managed care cases have implications for other public purchasers of managed care arrangements, including state mental health and alcohol and substance abuse agencies.

Gun-Control Legislation and the Impact on Suicide.

Gun control is the prototypical example of controlling the environment for the means of suicide, an effective public health approach to suicide prevention. Canada's Criminal Law Amendment Act of 1977 (Bill C-51) provides an excellent opportunity to illustrate the effects of legislative gun-control laws and the impact on suicide. The research in Canada supports the significant effect of C-51 in reducing suicides and firearm suicides, even if one controls for socioeconomic factors, although not equally for all ages. The young, a high-risk group, show the most significant decrease, without significant substitution of other methods (displacement). Studies on gun-control laws from New Zealand, the United States, and Australia support the Canadian findings. It is concluded that, although not equally applicable in all countries, gun control may well have significant applications in reducing suicide worldwide.
