Reported municipal costs from outdoor smoke-free by-laws-experience from Ontario, Canada

Background In 2006, enclosed public and workplaces in Ontario were made smoke-free by the Smoke-free Ontario Act (SFOA). Numerous area municipalities across the province have since developed local by-laws that are more restrictive than the SFOA and ban smoking in outdoor environments including parks, beaches, and patios. The current study measured reported costs associated with the implementation and enforcement of smoke-free outdoor municipal by-laws including materials and staffing costs. The study also assessed the number of warnings or tickets issued to smokers. Ontario communities with a by-law in force for at least 2 years were included in the sample (n = 42). The study was completed by 88% of area municipalities (n = 37). Municipal staff and managers completed a survey by telephone between June-September 2012. Findings No area municipality surveyed reported that they hired additional enforcement staff as a result of their community’s smoke-free by-law. Most municipalities (95%) posted signage to support awareness of their by-law; signs costs ranged from $40-$150/sign with most municipalities reporting signs were made in-house. Most communities reported actively enforcing the by-law; six communities reported they had issued tickets to people not in compliance with outdoor smoking restrictions. Conclusions The implementation, promotion, and enforcement of outdoor smoke-free by-laws have required municipal staff time and in most cases have promotional costs, but these have come from existing budgets and using existing staff. Outdoor smoke-free by-laws have not created significant burdens on municipal enforcement staff or on municipal budgets. PMID:24581326

Municipal bylaw to reduce cosmetic/non-essential pesticide use on household lawns - a policy implementation evaluation

Background Pesticide use on urban lawns and gardens contributes to environmental contamination and human exposure. Municipal policies to restrict use and educate households on viable alternatives deserve study. We describe the development and implementation of a cosmetic/non-essential pesticide bylaw by a municipal health department in Toronto, Ontario, Canada and assess changes in resident practices associated with bylaw implementation. Methods Implementation indicators built on a logic model and were elaborated through key informant interviews. Bylaw impacts on awareness and practice changes were documented through telephone surveys administered seasonally pre, during and post implementation (2003-2008). Multivariable logistic regression models assessed associations of demographic variables and gardening season with respondent awareness and practices. Results Implementation indicators documented multiple municipal health department activities and public involvement in complaints from commencement of the educational phase. During the enforcement phases only 40 warning letters and 7 convictions were needed. The number of lawn care companies increased. Among survey respondents, awareness of the bylaw and the Natural Lawn campaign reached 69% and 76% respectively by 2008. Substantial decreases in the proportion of households applying pesticides (25 to 11%) or hiring lawn care companies for application (15 to 5%) occurred. Parallel absolute increases in use of natural lawn care methods occurred among households themselves (21%) and companies they contracted (7%). Conclusions Bylaws or ordinances implemented through education and enforcement are a viable policy option for reducing urban cosmetic pesticide use. PMID:21867501

Each of the sections of AGU has been requested by Council to adopt a set of bylaws. The Union has provided a set of model bylaws that each section can adapt to its own particular needs. At t h e request of Bob Helliwell, I have taken the model bylaws and attempted to alter them to better reflect the needs of the SPR Section. I n doing so, I have made several proposed changes in t h e operation of the SPR Section. The first one to note is that the draft bylaws call for only three sections and not four. This is to create three more equal subdivisions in SPR. Even with the SC and SS section programs combined, as SS and SC have been at recent meetings, they have not sustained a full program during the meeting. The other important change is a limitation on the term of the secretaries. This is not any reflection on the past or present performance of our secretaries but rather an acknowledgment of the strong influence that they wield on t h e intellectual directions of the section and the feeling that this influence should be shared among many individuals over the course of time. The section does not lack talented individuals who would be good secretaries.

The economic impact of a smoke-free bylaw on restaurant and bar sales in Ottawa, Canada.

On 1 August 2001, the City of Ottawa (Canada's Capital) implemented a smoke-free bylaw that completely prohibited smoking in work-places and public places, including restaurants and bars, with no exemption for separately ventilated smoking rooms. This paper evaluates the effects of this bylaw on restaurant and bar sales. DATA AND MEASURES: We used retail sales tax data from March 1998 to June 2002 to construct two outcome measures: the ratio of licensed restaurant and bar sales to total retail sales and the ratio of unlicensed restaurant sales to total retail sales. Restaurant and bar sales were subtracted from total retail sales in the denominator of these measures. We employed an interrupted time-series design. Autoregressive integrated moving average (ARIMA) intervention analysis was used to test for three possible impacts that the bylaw might have on the sales of restaurants and bars. We repeated the analysis using regression with autoregressive moving average (ARMA) errors method to triangulate our results. Outcome measures showed declining trends at baseline before the bylaw went into effect. Results from ARIMA intervention and regression analyses did not support the hypotheses that the smoke-free bylaw had an impact that resulted in (1) abrupt permanent, (2) gradual permanent or (3) abrupt temporary changes in restaurant and bar sales. While a large body of research has found no significant adverse impact of smoke-free legislation on restaurant and bar sales in the United States, Australia and elsewhere, our study confirms these results in a northern region with a bilingual population, which has important implications for impending policy in Europe and other areas.

Teenage sexuality and rights in Chile: from denial to punishment.

While Chile sees itself as a country that has fully restored human rights since its return to democratic rule in 1990, the rights of teenagers to comprehensive sexuality education are still not being met. This paper reviews the recent history of sexuality education in Chile and related legislation, policies and programmes. It also reports a 2008 review of the bylaws of 189 randomly selected Chilean schools, which found that although such bylaws are mandatory, the absence of bylaws to prevent discrimination on grounds of pregnancy, HIV and sexuality was common. In relation to how sexual behaviour and discipline were addressed, bylaws that were non-compliant with the law were very common. Opposition to sexuality education in schools in Chile is predicated on the denial of teenage sexuality, and many schools punish sexual behaviour where transgression is perceived to have taken place. While the wider Chilean society has been moving towards greater recognition of individual autonomy and sexual diversity, this cultural shift has yet to be reflected in the government's political agenda, in spite of good intentions. Given this state of affairs, the Chilean polity needs to recognise its youth as having human rights, or will continue to fail in its commitment to them.

Codes and by-laws concerning air well design (for buildings and lavatories) in Malaysia has been established in the Malaysian Uniform Building By-Laws UBBL number 40 (1) and (2) since the 1980s. Wells are there to fulfill the ventilation and daylighting requirements. The minimum well area according to building storey height are compared between UBBL and the Singapore's well requirements from the Building Construction Authority BCA. A visual and graphical representation (with schematics building and well diagrams drawn to scale) of the minimum well sizes and dimensions is given. It can be seen that if the minimum requirement of well size is used for buildings above 8 storeys high, a thin well resulted which is not proportionate to the building height. A proposed dimension is graphed and given to be used in the UBBL which translated to graphics (3 dimensional buildings drawn to scale) created a much better well proportion.

The International Organization for Crystal Growth (IOCG) Executive Committee, Council and General Assembly met in the week 7-12 August 2016. Participation quorum was achieved at all the meetings. The following changes in the Constitution, already approved at ICCGE-17 for the second time, were moved to be presented to the IOCG General Assembly for the third and final approval. 7.a The International Conference on Crystal Growth, ICCG is renamed to the International Conference on Crystal Growth and Epitaxy (ICCGE) and all references to ICCG in the constitution and By-laws are changed to ICCGE. 7.b The IOCG Constitution is amended such that Article III Section 1 will read as "The Executive Committee shall consist of the five Officers, the Past President, the Chairman or Chairmen of the past ICCGE the Chairman or Chairmen of the next ICCGE and up to ten additional members elected by the Council." 7.c The IOCG Constitution is amended such that Article IV Section 1 includes the sentence: "The Council may also include ex-officio members as described in the Bylaws" There was no change to the Bylaws. All provisional amendments are included in the IOCG Constitution and Bylaws with different text colors. Public place restrictions on smoking in Canada: assessing the role of the state, media, science and public health advocacy.

While much is known about the impact of law and public policy, we know considerably less about their antecedents. Theories of policy adoption suggest that a variety of policy inputs help to shape legislative change. This research considers the enactment of municipal smoking bylaws in Canada between 1970 and 1995. The emergence of second-hand smoke (SHS) has been offered as a viable explanation for the increased enactment of local smoking restrictions. A number of indicators confirm the rising public health concern around SHS. Using Health Canada data on municipal smoking bylaw enactment in Canada, this paper employs an event history analysis to trace the role of four indicators of the increased recognition of SHS as a public health concern-scientific research, parliamentary debate, print media, and health advocacy. Findings indicate that the print media and health advocacy play the strongest role in explaining the increase in the adoption of municipal smoking bylaws in Canada. Results lend support to the quantitative study of the policy adoption process and to theories of policy making that consider multiple influences on policy adoption.

In Chile, high cost treatments required by selected medical conditions are financed by the State, according to Law 20.850. A bylaw under discussion by the Senate regulates clinical trials, posing complex issues that will endanger local interest in front-line research: 1) The exclusive and mandatory control bestowed to the Institute of Public Health during all stages of the trials and also the surveillance of institutions performing clinical trials, overriding their Clinical Research Review Boards; 2) The 10 year period during which any adverse event is assumed to have been caused by the medication or devise evaluated by the trial, unless the contrary is proven in a judicial process; 3) Individuals submitted to the trials are entitled to free post trial access to the treatment received during the study, financed by the trial supporting entities and as long as the drug or devise is considered to be useful. While agreeing with the need to have a National Registry of Clinical Trials, we predict that the mentioned critical issues in the bylaw will lead to difficulties and unnecessary judicial processes, thus limiting clinicians' interest in performing research. We propose to modify the bylaw, excluding responsibilities on events associated with the natural evolution of the medical condition, with patients' ageing or with comorbidities and clinical events considered unpredictable when the protocol was accepted. We recommend that the free post trial access should be a joint decision involving the patient and the attending physician, taking in consideration that the volunteer has been exposed to risks and burdens, or when discontinuation of treatment entails a vital risk until the treatment under study has been approved and becomes available in the national market.

The purpose of the Laboratory Astrophysics Division (LAD) is to advance our understanding of the Universe through the promotion of fundamental theoretical and experimental research into the underlying processes that drive the Cosmos. LAD represents all areas of astrophysics and planetary sciences. The first new AAS Division in more than 30 years, the LAD traces its history back to the recommendation from the scientific community via the White Paper from the 2006 NASA-sponsored Laboratory Astrophysics Workshop. This recommendation was endorsed by the Astronomy and Astrophysics Advisory Committee (AAAC), which advises the National Science Foundation (NSF), the National Aeronautics and Space Administration (NASA), and the U.S. Department of Energy (DOE) on selected issues within the fields of astronomy and astrophysics that are of mutual interest and concern to the agencies. In January 2007, at the 209th AAS meeting, the AAS Council set up a Steering Committee to formulate Bylaws for a Working Group on Laboratory Astrophysics (WGLA). The AAS Council formally established the WGLA with a five-year mandate in May 2007, at the 210th AAS meeting. From 2008 through 2012, the WGLA annually sponsored Meetings in-a-Meeting at the AAS Summer Meetings. Eat Smart! Ontario's Healthy Restaurant Program is a standard provincial health promotion program. Public health units give an award of excellence to restaurants that meet nutrition, food safety, and non-smoking seating standards. The purpose of this study was to determine why some restaurant operators have not applied to participate in the program, and how to get them to apply. Four focus group interviews were conducted with 35 operators who didn't apply to participate. The analysis of responses yielded various themes. The participants' perceived barriers to participation were misunderstandings about how to qualify for the program, lack of time, concern about different non-smoking bylaw requirements, and potential loss of revenue. Their perceived facilitators to participation were convenience of applying to participate, franchise executives' approval to participate, a 100% non-smoking bylaw, flexibility in the assessment of restaurants, the opportunity for positive advertising, alternative payment for food handler training, and customer demand. Program staff can use the findings to develop and use strategies to encourage participation.

This study aimed to identify and prioritize factors affecting the development of military hospital beds and provide a model using fuzzy analytical hierarchy process (Fuzzy AHP). This applied study was conducted in 2016 in Iran using a mixed method. The sample included experts in the field of military health care system. The MAXQDA 10.0 and Expert Choice 10.0 software were used for analyzing the collected data. Geographic situation, demographic status, economic status, health status, health care centers and organizations, financial and human resources, laws and regulations and by-laws, and the military nature of service recipients had effects on the development of military hospital beds. The military nature of service recipients (S=0.249) and economic status (S=0.040) received the highest and lowest priorities, respectively. Providing direct health care services to the military forces in order to maintain their dignity, and according to its effects in the crisis, as well as the necessity for maintaining the security of the armed forces, and the hospital beds per capita based on the existing laws, regulations and bylaws are of utmost importance.

Background: This study aimed to identify and prioritize factors affecting the development of military hospital beds and provide a model using fuzzy analytical hierarchy process (Fuzzy AHP). Methods: This applied study was conducted in 2016 in Iran using a mixed method. The sample included experts in the field of military health care system. The MAXQDA 10.0 and Expert Choice 10.0 software were used for analyzing the collected data. Results: Geographic situation, demographic status, economic status, health status, health care centers and organizations, financial and human resources, laws and regulations and by-laws, and the military nature of service recipients had effects on the development of military hospital beds. The military nature of service recipients (S=0.249) and economic status (S=0.040) received the highest and lowest priorities, respectively. Conclusion: Providing direct health care services to the military forces in order to maintain their dignity, and according to its effects in the crisis, as well as the necessity for maintaining the security of the armed forces, and the hospital beds per capita based on the existing laws, regulations and bylaws are of utmost importance. The master indenture enables members of multiinstitutional health care systems to finance capital programs and expansions by borrowing on the basis of systemwide revenues and assets. Participation in a master indenture financing may be structured in two ways. In a restricted group, only the parent organization issues notes, and only the parent is directly liable for the debt. To ensure that each member's revenues flow to the parent, the latter must have sole member status and be permitted to approve subsidiaries' debts, budgets, amendments to articles and bylaws of incorporation, and selection of trustees. Each entity's articles and bylaws must permit it to support the system members' common charitable purpose. In contrast, members of an obligated group have direct joint and several liability for master indenture notes. If one subsidiary misses a payment, the parent can call for payment from other obligated group members. Limitations on a member's obligation to support system debt in case of insolvency or bankruptcy may be included in the master indenture provisions. Whichever structure is selected, the amount of debt that can be incurred is based on the institutions' combined financial statements. The master indenture thus allows financially weak institutions to benefit from the credit strengths of stranger system members and permits the parent organization to control members' access to capital markets.

Within the field of medical ethics, discussions related to public health have mainly concentrated on issues that are closely tied to research and practice involving technologies and professional services, including vaccination, screening, and insurance coverage. Broader determinants of population health have received less attention, although this situation is rapidly changing. Against this backdrop, our specific contribution to the literature on ethics and law vis-à-vis promoting population health is to open up the ubiquitous presence of pets within cities and towns for further discussion. An expanding body of research suggests that pet animals are deeply relevant to people's health (negatively and positively). Pet bylaws adopted by town and city councils have largely escaped notice, yet they are meaningful to consider in relation to everyday practices, social norms, and cultural values, and thus in relation to population health. Nevertheless, not least because they pivot on defining pets as private property belonging to individual people, pet bylaws raise emotionally charged ethical issues that have yet to be tackled in any of the health research on pet ownership. The literature in moral philosophy on animals is vast, and we do not claim to advance this field here. Rather, we pragmatically seek to reconcile philosophical objections to pet ownership with both animal welfare and public health. In doing so, we foreground theorizations of personhood and property from sociocultural anthropology.

In 1980, Congress passed the Low-Level Radioactive Waste Policy Act. This Act provided for a new approach to the disposal of low-level radioactive waste. It assigned each state responsibility for the disposal of low-level radioactive waste generated within its borders, and it authorized states to enter into compacts for the purpose of operating regional disposal facilities. It also authorized compacts to restrict the use of regional disposal facilities to only member states. To meet their obligations under the Act, Indiana, Iowa, Michigan, Minnesota, Missouri, Ohio and Wisconsin formed the Midwest Interstate Low-Level Radioactive Waste Compact. The Compact was ratified bymore » each of the state legislatures and by Congress. The Compact established the Midwest Interstate Low-Level Radioactive Waste Commission, composed on one representative appointed by the Governor or Legislature of each member state. Article 3 of the compact requires that the Commission prepare an annual report regarding the activities and actions of the Commission. It also requires that the annual report be distributed to the Governors and legislative leaders in the member states. The Commission's Bylaw Article 12 requires the annual report to cover the preceding fiscal year, and to be distributed in August of each year. In this viewpoint we highlight and discuss some recent local and regional level advances in tobacco control in Aotearoa/New Zealand. In this country a wide range of local actors are helping drive smokefree and tobacco-free policies, with an increasing presence of businesses in this field. There has been progress in the areas of smokefree dining, large outdoor worksites and ski fields, and parts of downtown areas such as squares and streets. In 2015 and 2016, three councils (Palmerston North, Napier and Hastings) have used pavement lease policies and bylaws to start introducing an element of requirement into smokefree outdoor dining. Elsewhere (eg, Rotorua, Ashburton, Westland and Christchurch) significant smokefree outdoor dining moves have been made by, or in conjunction with, local councils. Tobacco-free retailing continues to expand, particularly in Northland. In the absence of meaningful central government action on smokefree places in the last decade (despite the Smokefree 2025 goal), local activity is leading the way. It is particularly important in providing models for smokefree outdoor hospitality areas, where smoking normalisation and relapse are significant health risks. Nevertheless, there is a need for the local smokefree and tobacco-free activity to be nationally evaluated, particularly for assessing the prevalence of smoking in areas covered by 'smokefree' policies. Action by central government could help local actors by providing a more definite legislative basis for bylaws, by minimum outdoor smokefree laws and by the funding of effective tobacco control mass media.

Air quality, mortality, and economic benefits of a smoke - free workplace law for non-smoking Ontario bar workers.

We estimated the impact of a smoke-free workplace bylaw on non-smoking bar workers' health in Ontario, Canada. We measured bar workers' urine cotinine before (n = 99) and after (n = 91) a 2004 smoke-free workplace bylaw. Using pharmacokinetic and epidemiological models, we estimated workers' fine-particle (PM2.5 ) air pollution exposure and mortality risks from workplace secondhand smoke (SHS). workers' pre-law geometric mean cotinine was 10.3 ng/ml; post-law dose declined 70% to 3.10 ng/ml and reported work hours of exposure by 90%. Pre-law, 97% of workers' doses exceeded the 90th percentile for Canadians of working age. Pre-law-estimated 8-h average workplace PM2.5 exposure from SHS was 419 μg/m(3) or 'Very Poor' air quality, while outdoor PM2.5 levels averaged 7 μg/m(3) , 'Very Good' air quality by Canadian Air Quality Standards. We estimated that the bar workers' annual mortality rate from workplace SHS exposure was 102 deaths per 100000 persons. This was 2.4 times the occupational disease fatality rate for all Ontario workers. We estimated that half to two-thirds of the 10620 Ontario bar workers were non-smokers. Accordingly, Ontario's smoke-free law saved an estimated 5-7 non-smoking bar workers' lives annually, valued at CA $50 million to $68 million (US $49 million to $66 million). © 2012 John Wiley & Sons A/S. Analysis of pharmacy student motivators and deterrents for professional organization involvement.

The purpose of this study was to determine motivators and deterrents impacting a student pharmacist's decision to join professional organizations. The goal was to create a list of meaningful factors that organizations can use for membership recruitment. This descriptive study utilized a blinded electronic survey sent to eight accredited pharmacy schools in Ohio, Michigan, Wisconsin, Indiana, Illinois, and Kentucky. The survey assessed motivating and hindering factors, as well as demographic data. Eight-hundred fifty-six students completed the survey, a 15.05% participation rate. Professional development and networking were the top two endorsed motivational factors, selected as significant by 88.0% and 87.5% respectively. Upon chi-square analysis, networking (p<0.001), involvement opportunities (p=0.01), and scholarships (p=0.02) were motivating factors with which membership was found to be significantly influenced. Networking and involvement opportunities were more significant for members while scholarships were a greater motivator among nonmembers. Time required for involvement and cost were the most commonly selected hindrances with 78% and 76% respectively identifying these as significant barriers. The hindering factor found to be significantly different between active members and nonmembers was bylaws/rules of the organization (p=0.032), with non-members rating this as a greater consideration than current members. Multiple factors contribute to a student's decision to join a professional organization. Those active members find greater significance in networking involvement opportunities. Non-member students found scholarships more motivating and recognize bylaws as a consideration for membership more than current members. These results emphasize the multifactorial nature of membership and may direct future membership initiatives. Copyright © 2017 Elsevier Inc. All rights reserved.

This paper illustrates a sustained conceptual service quality improvement process for the management of software development within a healthcare enterprise. Our proposed process is revised from Niland's healthcare quality information system (HQIS). This process includes functions to survey the satisfaction of system functions, describe the operation bylaws on-line, and provide on-demand training. To achieve these goals, we integrate five information systems in National Taiwan University Hospital, including healthcare information systems, health quality information system, requirement management system, executive information system, and digital learning system, to form a full Deming cycle. A preliminary user satisfaction survey showed that our outpatient information system scored an average of 71.31 in 2006.

There are presented sanitary and hygienic requirements to the enterprises of the brewing industry. There are designated measures of occupational hygiene of brewing production: a sink, cleaning--removal of various pollutions, and also disinfection--process of the decline in quantity of microorganisms to safe level. There are considered some characteristics of pollutions which are subject to removal at various stages ofproduction of beer and stages of sanitary processing of brewing systems according to chemical properties of substances.

This communication presents a functional prototype, named PTAH, implementing a linguistic model focused on regulations in Spanish. Its global architecture, the reasoning model and short statistics are provided for the prototype. It is mainly a conversational robot linked to an Expert System by a module with many intelligent linguistic filters, implementing the reasoning model of an expert. It is focused on bylaws, regulations, jurisprudence and customized background representing entity mission, vision and profile. This Structure and model are generic enough to self-adapt to any regulatory environment, but as a first step, it was limited to an academic field. This way it is possible to limit the slang and data numbers. The foundations of the linguistic model are also outlined and the way the architecture implements the key features of the behavior.

Conduction of thesis by the students is one of their major academic activities. Thesis quality and acquired experiences are highly dependent on the supervision. Our study is aimed at identifing the challenges in thesis supervision from both students and faculty members point of view. This study was conducted using individual in-depth interviews and Focus Group Discussions (FGD). The participants were 43 students and faculty members selected by purposive sampling. It was carried out in Tehran University of Medical Sciences in 2012. Data analysis was done concurrently with data gathering using content analysis method. Our data analysis resulted in 162 codes, 17 subcategories and 4 major categories, "supervisory knowledge and skills", "atmosphere", "bylaws and regulations relating to supervision" and "monitoring and evaluation". This study showed that more attention and planning in needed for modifying related rules and regulations, qualitative and quantitative improvement in mentorship training, research atmosphere improvement and effective monitoring and evaluation in supervisory area.

A gower maneuver: the American Society for Bioethics and Humanities' resolution of the "Taking Stands" debate.

The American Society for Bioethics and Humanities debated for several years about whether it should adopt positions and, if so, on what range of issues. The membership recently approved an amendment to its bylaws permitting the Society to adopt positions on matters related to academic freedom and professionalism but not on substantive moral and policy issues. This resolution is problematic for a number of reasons, including the lack of a categorical difference between these types of claims and the Society's inability to speak on behalf of patients and research subjects. The implementation of the amendment also raises several issues. The Society will need to refrain from speaking too specifically and to articulate the responsibilities of its members. If the Society fails to address these concerns, it runs the risk of denigrating its public image and that of the profession.

Each year, the apportionment ballot is used to determine how many representatives each division and state, provincial, and territorial association will have on the Council of Representatives. The system is described in Article V, Sections 6 and 7, of the American Psychological Association (APA) Bylaws. Briefly, all APA fellows, members, and voting associates are sent an apportionment ballot on or before November 1. Voting members indicate the division( s) and/or state, provincial, or territorial association(s) through which they desire to have their interests represented on Council in the following year by allocating a total of 10 votes to one or more of these groups. [The legitimacy of representation in forums with social participation: the case of the Bahia State Health Council, Brazil].

The electoral representation model is insufficient and inadequate for new participatory roles such as those played by members of health councils. This article analyzes representation and representativeness in the Bahia State Health Council, Brazil. The study included interviews with 20 current or former members of the State Health Council, analysis of the council minutes and bylaws, and observation of plenary meetings. Discourse analysis technique was used to analyze interventions by members. The article discusses the results in four analytical lines: the process by which various organizations name representatives to the Council; the relationship between Council members and their constituencies; interest representation in the Council; and criteria used by the plenary to take positions. The study reveals various problems with the representativeness of the Bahia State Health Council and discusses the peculiarities of representation in social participation forums and the characteristics that give legitimacy to representatives.

Hospital emergency on-call coverage: is there a doctor in the house?

The nation's community hospitals face increasing problems obtaining emergency on-call coverage from specialist physicians, according to findings from the Center for Studying Health System Change's (HSC) 2007 site visits to 12 nationally representative metropolitan communities. The diminished willingness of specialist physicians to provide on-call coverage is occurring as hospital emergency departments confront an ever-increasing demand for services. Factors influencing physician reluctance to provide on-call coverage include decreased dependence on hospital admitting privileges as more services shift to non-hospital settings; payment for emergency care, especially for uninsured patients; and medical liability concerns. Hospital strategies to secure on-call coverage include enforcing hospital medical staff bylaws that require physicians to take call, contracting with physicians to provide coverage, paying physicians stipends, and employing physicians. Nonetheless, many hospitals continue to struggle with inadequate on-call coverage, which threatens patients' timely access to high-quality emergency care and may raise health care costs.

Before a hospital medical staff can realistically accept responsibility for the professional practices of its members, a principle initially fostered by the American College of Surgeons and adopted by both the Canadian and American accreditation programs, it must have an effectively functioning medical staff organization. The medical advisory committee is the most important committee of the medical staff organization. A representative composition, adherence to sound administrative principles, and recognition of its prime functions of co-ordination, supervision and jurisdiction will permit this committee—and the total medical staff organization—to discharge adequately the very important responsibilities delegated to them by the governing board of the hospital. Properly structured medical staff bylaws with clearly defined terms of reference assist the smooth functioning of the “cabinet” of the medical staff and safeguard the prerogatives of the individual members of the staff. As many as 53.5 million American workers have experienced workplace bullying, which can cost organizations an estimated $200 billion annually in lost productivity, increased sick d ays, increased med ical claims, legal costs, and staff turnover. Bullying can occur in any profession, but for many reasons it is most prevalent in healthcare. Bullying behavior in healthcare has been reported and documented in literature for over 35 years. Although physicians are often considered to be the primary culprit of bullying, healthcare bullies can be one any one of the professionals who work in the organization including nurses, radiology technologists, pharmacists, ancillary staff personnel, administrators, or other non-physician staff members. The first installment of the series focused on defining bullying and its impact on the organization. Part 2 discussed three legal protections for the bully to include at-will laws, unions, and bylaws related to physician privileging. The final installment in this series will evaluate specific bully types and implementing processes to address inappropriate behavior.

Consultation for Simple Laceration Repair When On-Call in the Emergency Department: Potential Quagmire.

What are the forces obligating a plastic surgeon who is on-call for the emergency department to respond to a consultation request for repair of a simple laceration? Although the duties are clear in cases of obvious surgical emergency, ambiguity and subsequent conflict may arise when the true nature of the emergency is less clear. Does the consultant's clinical discretion dictate the obligation in the case of a simple laceration; or is it subservient to either the discretion of the requesting health-care provider or even the patient? Do federal statutes such as the Emergency Medical Treatment and Labor Act, or perhaps more local rules apply, such as the by-laws of the hospital? It would behoove all medical practitioners to familiarize themselves with both the legal and moral implications of these issues. Having legitimate policies in place which actively address those situations where the consultative obligation is unclear is critical to resolve potential conflict.

In Defence of Reason: Religion, Science, and the Prince Edward Island Anti-Abortion Movement, 1969-1988.

Throughout the 1970s and 1980s, the Prince Edward Island Right to Life Association (RTLA) lobbied medical professionals, hospital boards, politicians, and neighbours to prevent the Charlottetown and Summerside hospital corporations, the only abortion providers on the Island, to eliminate their Therapeutic Abortion Committees. Because abortion committees were not mandatory and only hospital boards were responsible for establishing committees at accredited hospitals, the RTLA elected pro-life members to the boards and voted against abortion committee bylaws to establish barriers to abortion access. By holding key positions within the hospital corporations, pro-life activists ensured that abortion provisions were no longer legally or medically permissible in Island hospitals. This article draws on RTLA and government records, newspaper articles, as well as interviews with pro-life activists, to highlight the avenues through which the organization created a prominent social movement. By contesting the scientific reasoning for abortion, the RTLA quickly became a countermovement not only to the pro-choice movement, but also to the mainstream medical community.

Physician retirement: a case for concern in Canadian hospitals.

Mandatory retirement is being challenged on the basis of age discrimination, and physicians are not divorced from this social trend. In January 1982 legal precedent was set by the Manitoba Court of Appeal concerning the retirement policy for physicians in Canada. Currently, Canadian hospital bylaws include clauses that require a change in membership status once a physician reaches 65 years of age. The main arguments in favour of this change include easier physician manpower management, ensured public safety and, in some instances, greater productivity. The main arguments against this change include loss of income to physicians, loss of skilled manpower to the profession and adverse effects on the mental and physical health of retiring physicians. In an effort to resolve this conflict some Canadian hospitals are developing strategies for reviewing the specific privileges and responsibilities physicians will retain once they reach age 65. Using Third-Party Inspectors in Building Energy Codes Enforcement in India

India is experiencing fast income growth and urbanization, and this leads to unprecedented increases in demand for building energy services and resulting energy consumption. In response to rapid growth in building energy use, the Government of India issued the Energy Conservation Building Code (ECBC) in 2007, which is consistent with and based on the 2001 Energy Conservation Act. ECBC implementation has been voluntary since its enactment and a few states have started to make progress towards mandatory implementation. Rajasthan is the first state in India to adopt ECBC as a mandatory code. The State adopted ECBC with minor additions onmore » March 28, 2011 through a stakeholder process; it became mandatory in Rajasthan on September 28, 2011. Tamil Nadu, Gujarat, and Andhra Pradesh have started to draft an implementation roadmap and build capacity for its implementation. The Bureau of Energy Efficiency (BEE) plans to encourage more states to adopt ECBC in the near future, including Haryana, Uttar Pradesh, Karnataka, Maharashtra, West Bengal, and Delhi. Since its inception, India has applied the code on a voluntary basis, but the Government of India is developing a strategy to mandate compliance. Implementing ECBC requires coordination between the Ministry of Power and the Ministry of Urban Development at the national level as well as interdepartmental coordination at the state level. One challenge is that the Urban Local Bodies (ULBs), the enforcement entities of building by-laws, lack capacity to implement ECBC effectively. For example, ULBs in some states might find the building permitting procedures to be too complex; in other cases, lack of awareness and technical knowledge on ECBC slows down the amendment of local building by-laws as well as ECBC implementation. The intent of this white paper is to share with Indian decision-makers code enforcement approaches: through code officials, third-party inspectors, or a hybrid approach. Given the limited capacity and human resources available in the state and local governments, involving third-party inspectors could rapidly expand the capacity for plan reviews and broad implementation. However, the procedures of involving third-parties need to be carefully designed in order to guarantee a fair process. For example, there should be multiple checks and certification requirements for third-party inspectors, and the government should have the final approval when third-party inspectors are used in a project. This paper discusses different approaches of involving third-parties in ECBC enforcement; the Indian states may choose the approaches that work best in their given circumstances.« less

[History Of forensic medicine and the coroner system in the town of Bjelovar].

This review analyses historical sources on the development of forensic medicine and the coroner system in the town of Bjelovar over the past two centuries. The development of these two professional fields in the context of public health was regulated through a number of bylaws, such as Normativum Sanitatum from the time of the Habsburg Monarchy. Coroner examinations were performed by physicians, surgeons, and laymen using special instructions such as the famous booklet by nobleman and county medical officer Vilim Peičić from 1914. Forensic autopsy was performed by surgeons, primary or secondary hospital physicians in case of sudden or suspicious in-hospital deaths, whereas outpatient forensic autopsies were performed by county or town medical officers and district physicians at the request of investigating authorities (police, court, or general attorney's office). This historical review should serve as the basis for further historical research into this field in Croatia so as to obtain deeper insight into the development of forensic medicine and the coroner system, two professions that have always been a vital factor in public health.

Neighbourhood Built Environment Influences on Physical Activity among Adults: A Systematized Review of Qualitative Evidence

Qualitative studies can provide important information about how and why the built environment impacts physical activity decision-making—information that is important for informing local urban policies. We undertook a systematized literature review to synthesize findings from qualitative studies exploring how the built environment influences physical activity in adults. Our review included 36 peer-reviewed qualitative studies published from 1998 onwards. Our findings complemented existing quantitative evidence and provided additional insight into how functional, aesthetic, destination, and safety built characteristics influence physical activity decision-making. Sociodemographic characteristics (age, sex, ethnicity, and socioeconomic status) also impacted the BE’s influence on physical activity. Our review findings reinforce the need for synergy between transportation planning, urban design, landscape architecture, road engineering, parks and recreation, bylaw enforcement, and public health to be involved in creating neighbourhood environments that support physical activity. Serving on Organizational Boards: What Nurses Need to Know

If you have ever thought about serving on a board or being actively involved in meetings aimed at making policy decisions, but are not sure you have the knowledge, skills or abilities to serve competently, this article is for you! In this article, the authors describe six competencies needed by nurses who are serving on boards and/or policy committees so as to contribute in a productive manner. These competencies include a professional commitment to serving on a governing board; knowledge about board types, bylaws, and job descriptions; an understanding of standard business protocols, board member roles, and voting processes; a willingness to use principles for managing and leading effective and efficient board meetings; an appreciation for the ethical and legal processes for conducting meetings; and the ability to employ strategies for maintaining control during intense/uncivil situations. They also discuss strategies for demonstrating these competencies and describe personal responsibilities of board members. The authors conclude that a knowledge of these rules and standards is essential in order for nurses to assume leadership roles that will enhance the health of today’s and tomorrow’s societies.
