Patient's rights charter in Iran.
Parsapoor, Alireza; Bagheri, Alireza; Larijani, Bagher
2014-01-01
Given the importance of patient's rights in healthcare, special attention has been given to the concept of patient's rights by the Ministry of Health and Medical Education in Iran. Iranian patient's rights charter has been compiled with a novel and comprehensive approach. This charter aims to elucidate rights of recipients of health services as well as observing ethical standards in medicine. This paper presents the Iranian patient's rights charter. Based on a study done from 2007 to 2009, the charter has been finalized through an extensive consultation involving all stakeholders, patients, physicians, nurses, lawyers, patient associations and health policy makers. The developed charter was adopted by the Ministry of Health in December 2009. Iranian patient's rights charter has been formulated in the framework of 5 chapters and 37 articles including vision and an explanatory note. The five chapters concern right to receiving appropriate services, right to access desired and enough information, right to choose and decide freely about receiving healthcare, right to privacy and confidentiality, and finally right to access an efficient system of dealing with complaints which have been explained in 14, 9, 7, 4 and 3 articles, respectively. The paper concludes that, adopting the patient's rights charter is a valuable measure to meet patient's rights; however, a serious challenge is how to implement and acculturate observing patient's rights in practice in our healthcare system in Iran.

Human rights advances in women's reproductive health in Africa.
Ngwena, Charles G; Brookman-Amissah, Eunice; Skuster, Patty
2015-05-01
The African Commission on Human and Peoples' Rights recently adopted General Comment No 2 to interpret provisions of Article 14 of the Protocol to the African Charter on the Rights Women. The provisions relate to women's rights to fertility control, contraception, family planning, information and education, and abortion. The present article highlights the General Comment's potential to promote women's sexual and reproductive rights in multiple ways. The General Comment's human rights value goes beyond providing states with guidance for framing their domestic laws, practices, and policies to comply with treaty obligations. General Comment No 2 is invaluable in educating all stakeholders-including healthcare providers, lawyers, policymakers, and judicial officers at the domestic level-about pertinent jurisprudence. Civil society and human rights advocates can use the General Comment to render the state accountable for failure to implement its treaty obligations. Though prevalent in practice, team charters have only recently received scholarly attention. However, most of this work has been relatively devoid of theory, and consequently, key questions about why and under what conditions team charter quality affects team performance remain unanswered. To address these gaps, we draw on macro organizational control theory to propose that team charter quality serves as a team-level "behavior" control mechanism that builds task cohesion through a structured exercise. We then juxtapose team charter quality with an "input" team control mechanism that influences the emergence of task cohesion more organically: team conscientiousness. Given their redundant effects on task cohesion, we propose that the effects of team charter quality and team conscientiousness on team performance (through task cohesion) are substitutive such that team charter quality primarily impacts team performance for teams that are low (vs. high) on conscientiousness. We test and find support for our hypotheses in a sample of 239 undergraduate self-managing project teams. Our study contributes to the groups and teams literature in the following ways: first, relative to previous studies, we take a more theory-driven approach toward understanding team charters, and in doing so, uncover when and why team charter quality impacts team performance; second, we integrate two normally disparate perspectives on team effectiveness (team development and team selection) to offer a broader perspective on how teams are "built"; and third, we introduce team charter quality as a performance-enhancing mechanism for teams lower on conscientiousness. Historic day for Malaysian consumers.
Kaur, S R
1993-04-01
The Malaysian Medical Association, the Malaysian Dental Association, the Malaysian Pharmaceutical Society, and the Federation of Malaysian Consumer Associations have introduced and endorsed the Charter for Patient Rights. The Charter recognized that health care is a basic human right, regardless of race, religion, social status, and ability to pay. Further, consumers have the right to seek medical care in both the public and private sectors. The Charter also includes the right to a second opinion, one's own medical records, and explanation before receiving any medical treatment and concerning the risks of treatment, compensation for negligence, and adequate information. Malaysia is the second Asian country to have such a charter, South Korea being the first. The UK also has a Patients Charter. The rest of Europe is also moving to adopt such a charter. The private sector, which serves only those who can afford them, provides most health care services in developing countries. Thus, a large private sector threatens the elderly, unemployed, rural poor, and the mentally ill in these countries. The supply of these services is a marketable commodity which physicians and health care professionals own and sell. The medical community has planned, formulated, implemented, and monitored health services in most of these countries. Therefore, the private sector is a major obstacle to health for all. The Charter helps to break down the barrier by informing both physicians and their patients of their rights and responsibilities.

Enhancing accountability in health systems is increasingly emphasised as crucial for improving the nature and quality of health service delivery worldwide and particularly in developing countries. Accountability mechanisms include, among others, health facilities committees, suggestion boxes, facility and patient charters. However, there is a dearth of information regarding the nature of and factors that influence the performance of accountability mechanisms, especially in developing countries. We examine community members' experiences of one such accountability mechanism, the health facility charter in Kericho District, Kenya. A household survey was conducted in 2011 among 1,024 respondents (36% male, 64% female) aged 17 years and above stratified by health facility catchment area, situated in a division in Kericho District. In addition, sixteen focus group discussions were conducted with health facility users in the four health facility catchment areas. Quantitative data were analysed through frequency distributions and cross-tabulations. Qualitative data were transcribed and analysed using a thematic approach. The majority (65%) of household survey respondents had seen their local facility service charter, 84% of whom had read the information on the charter. Of these, 83% found the charter to be useful or very useful. According to the respondents, the charters provided useful information about the services offered and their costs, gave users a voice to curb potential overcharging and helped users plan their medical expenses before receiving the service. However, community members cited several challenges with using the charters: non-adherence to charter provisions by health workers; illegibility and language issues; lack of expenditure records; lack of time to read and understand them, often due to pressures around queuing; and socio-cultural limitations. Findings from this study suggest that improving the compliance of health facilities in districts across Kenya with regard to the implementation of the facility service charter is critical for accountability and community satisfaction with service delivery. To improve the compliance of health facilities, attention needs to be focused on mechanisms that help enforce official guidelines, address capacity gaps, and enhance public awareness of the charters and their use.

Move for Change is an online pan-European patient survey based on the European Parkinson's Disease Association (EPDA) Charter for People with Parkinson's Disease (PD), which states that all PD patients have the right to: be referred to a doctor with a specialist interest in PD; receive an accurate diagnosis; have access to support services; receive continuous care; and take part in managing their illness. This part of the survey focuses on the final two elements of the Charter. It was administered online through the EPDA website and through affiliated patient associations' websites. A total of 1591 questionnaires were received and 1546 were analysed (97.2%). Approximately half of the patients (53.0%) consulted a neurologist regularly (every 4-6 months). Consultations were usually arranged as part of a follow-up process (65.5%) and lasted for 15-30 min (63.2%), with 16.1% lasting <10 min and 17.9% lasting >30 min. Patients were largely satisfied with the attention they received (63.2%) but just 11.6% of patients were involved in treatment decisions, and 39.1% prepared a list of symptom changes for discussion. Two hundred caregivers also took part in the survey, and 71.4% felt included in the treatment plan by the doctor. These results highlight that PD disease-management is driven by the clinician; he/she arranges consultations and makes the majority of management decisions, rather than patients being included in the process. This survey can be used to raise awareness for PD patients, encouraging greater involvement in the management of PD. © 2014 The Author(s). While in the United Kingdom, Ireland, and Australia, higher education and research institutions are widely engaged with the Athena SWAN Charter for Women in Science to advance gender equality, empirical research on this process and its impact is rare. This study combined two data sets (free- text comments from a survey and qualitative interviews) to explore the range of experiences and perceptions of participation in Athena SWAN in medical science departments of a research-intensive university in Oxford, United Kingdom. The study is based on the secondary analysis of data from two projects: 59 respondents to an anonymous online survey (42 women, 17 men) provided relevant free-text comments and, separately, 37 women participated in face-to-face narrative interviews. Free-text survey comments and narrative interviews were analysed thematically using constant comparison. Both women and men said that participation in Athena SWAN had brought about important structural and cultural changes, including increased support for women's careers, greater appreciation of caring responsibilities, and efforts to challenge discrimination and bias. Many said that these positive changes would not have happened without linkage of Athena SWAN to government research funding, while others thought there were unintended consequences. Concerns about the programme design and implementation included a perception that Athena SWAN has limited ability to address longstanding and entrenched power and pay imbalances, persisting lack of work-life balance in academic medicine, questions about the sustainability of positive changes, belief that achieving the award could become an end in itself, resentment about perceived positive discrimination, and perceptions that further structural and cultural changes were needed in the university and wider society. The findings from this study suggest that Athena SWAN has a positive impact in advancing gender equality, but there may be limits to how much it can improve gender equality without wider institutional and societal changes. To address the fundamental causes of gender inequality would require cultural change and welfare state policies incentivising men to increase their participation in unpaid work in the family, which is beyond the scope of higher education and research policy.

The present article examines the contents and importance of the General Comments adopted by the African Commission on Human and Peoples' Rights on Article 14 (1) (d) and (e) of the Protocol to the African Charter on the Rights of Women in Africa as a tool for advancing women's rights in the context of HIV. Given that discriminatory practices in all facets of life have continued to limit African women's enjoyment of their sexual and reproductive rights and render them susceptible to HIV infection, it becomes vital that African governments adopt appropriate measures to address this challenge. The provisions of the Protocol on the Rights of Women in Africa present great opportunities for this to be realized. The radical and progressive provisions of the Protocol will be of no use to women unless policymakers and other stakeholders have a clear understanding of them and are able to implement them effectively. The adoption of the General Comments is a welcome development, and states and civil society groups must maximize it to advance women's rights. Weight comments by family and significant others in young adulthood.
Eisenberg, Marla E; Berge, Jerica M; Fulkerson, Jayne A; Neumark-Sztainer, Dianne
2011-01-01
Weight teasing is common among adolescents, but less is known about the continuation of this experience during young adulthood. The present study uses survey data from a diverse sample of 2287 young adults, who participated in a 10-year longitudinal study of weight-related issues to examine hurtful weight comments by family members or a significant other. Among young adults, 35.9% of females and 22.8% of males reported receiving hurtful weight-related comments by family members, and 21.2% of females and 23.8% of males with a significant other had received hurtful weight-related comments from this source. Hispanic and Asian young adults and overweight/obese young adults were more likely to report receiving comments than those in other groups. Weight teasing during adolescence predicted hurtful weight-related comments in young adulthood, with some differences by gender. Findings suggest that hurtful weight talk continues into young adulthood and is predicted by earlier weight teasing experiences. Copyright © 2010 Elsevier Ltd. All rights reserved.

ESO PR Photo 47/06 ESO PR Photo 47a/06 Janez Potočnik, European Commissioner for Science and Research receives the statement of support from Bill Stirling, Director General of ESRF and present Chairman of EIROforum. The European Charter for Researchers addresses the roles, responsibilities and entitlements of researchers and their employers or funding organisations. It aims at ensuring that the relationship between these parties contributes to successful performance in the generation, transfer and sharing of knowledge, and to the career development of researchers. The Code of Conduct for the Recruitment of Researchers aims to improve recruitment, to make selection procedures fairer and more transparent and proposes different means of judging merit. Merit should not just be measured on the number of publications but on a wider range of evaluation criteria, such as teaching, supervision, teamwork, knowledge transfer, management and public awareness activities. ESO PR Photo 47/06 ESO PR Photo 47b/06 The signature of the statement of support last November. From left to right: Richard Wagner, Director of the ILL, David Southwood, Scientific Director of ESA, Robert Aymar, Director General of CERN, Bill Stirling, Director General of ESRF, Catherine Cesarsky, Director General of ESO, Francesco Romanelli, EFDA-JET leader and Silke Schumacher, Coordinator International Relations and Communication of the EMBL. In their statement, signed at the EIROforum Assembly on 15 November 2006, the seven EIROforum organisations support the general principles contained in the Charter and the Code, and will endeavour individually, where appropriate, to implement recommendations that have not yet been undertaken, or which could be improved within their own organisations. The two documents were carefully studied by the organisations' human resources experts, who noted the high level of compliance with the guidelines of the Charter and the Code in the EIROforum organisations, where most of the recommendations are implemented and part of internal practice. The implementation of the recommendations of the Charter and the Code of Conduct will be done in full compliance with the relevant intergovernmental conventions and agreements, staff rules and regulations, applicable to each of the EIROforum organisations.

Despite some empirical findings on the usefulness of citizen's charters on awareness of rights and services, there is a dearth of literature about charter implementation and impact on health service delivery in low-income settings. To gauge the level of awareness of the Charter within Nepal's primary health-care (PHC) system, perceived impact and factors affecting Charter implementation. Using a case study design, a quantitative survey was administered to 400 participants from 22 of 39 PHC facilities in the Dang District to gauge awareness of the Charter. Additionally, qualitative interviews with 39 key informants were conducted to explore the perceived impact of the Charter and factors affecting its implementation. Few service users (15%) were aware of the existence of the Charter. Among these, a greater proportion were literate, and there were also differences according to ethnicity and occupational group. The Charter was usually not properly displayed and had been implemented with no prior public consultation. It contained information that provided awareness of health facility services, particularly the more educated public, but had limited potential for increasing transparency and holding service providers accountable to citizens. Proper display, consultation with stakeholders, orientation or training and educational factors, follow-up and monitoring, and provision of sanctions were all lacking, negatively influencing the implementation of the Charter. Poor implementation and low public awareness of the Charter limit its usefulness. Provision of sanctions and consultation with citizens in Charter development are needed to expand the scope of Charters from information brochures to tools for accountability. © 2017 The Authors Health Expectations Published by John Wiley & Sons Ltd.

...NMFS issues regulations creating a limited access system for charter vessels in the guided sport fishery for Pacific halibut in waters of International Pacific Halibut Commission Regulatory Areas 2C (Southeast Alaska) and 3A (Central Gulf of Alaska). This limited access system limits the number of charter vessels that may participate in the guided sport fishery for halibut in these areas. NMFS will issue a charter halibut permit to a licensed charter fishing business owner based on his or her past participation in the charter halibut fishery and to a Community Quota Entity representing specific rural communities. All charter halibut permit holders are subject to limits on the number of permits they may hold and on the number of charter vessel anglers who may catch and retain halibut on permitted charter vessels. This action is necessary to achieve the approved halibut fishery management goals of the North Pacific Fishery Management Council. The intended effect is to curtail growth of fishing capacity in the guided sport fishery for halibut.

We examined the population reach, acceptability, and perceived potential of an initiative that developed a promotional tool for a healthy body image, the Québec Charter for a Healthy and Diverse Body Image. The Charter, developed through consensus building by a multisectoral, government-led task force, outlined actions to be undertaken by organizations or citizens to reduce media pressures favoring thinness. Six months after the Charter's launch, we surveyed 1003 Québec residents aged 18 years or older about their knowledge of the Charter, their willingness to adhere to it, and their perceptions of its potential. After minimal prompting, more than 35% of respondents recognized the Charter. About 33.7% were very favorable toward personally adhering to the Charter and 32.7% perceived the Charter as having high potential to sensitize people to negative consequences of disordered eating. Women showed greater likelihood and people with lesser education showed lower likelihood of spontaneous recognition. An initiative involving the creation of a body image Charter reaches a substantial portion of adults and is viewed as acceptable and potentially influential.

In 2002, the Physician Charter on Medical Professionalism was published to provide physicians with guidance for decision making in a rapidly changing environment. Feedback from physicians indicated that they were unable to fully live up to the principles in the 2002 charter partly because of their employing or affiliated health care organizations. A multistakeholder group has developed a Charter on Professionalism for Health Care Organizations, which may provide more guidance than charters for individual disciplines, given the current structure of health care delivery systems. This article contains the Charter on Professionalism for Health Care Organizations, as well as the process and rationale for its development. For hospitals and hospital systems to effectively care for patients, maintain a healthy workforce, and improve the health of populations, they must attend to the four domains addressed by the Charter: patient partnerships, organizational culture, community partnerships, and operations and business practices. Impacting the social determinants of health will require collaboration among health care organizations, government, and communities. Transitioning to the model hospital described by the Charter will challenge historical roles and assumptions of both its leadership and staff. While the Charter is aspirational, it also outlines specific institutional behaviors that will benefit both patients and workers. Lastly, this article considers obstacles to implementing the Charter and explores avenues to facilitate its dissemination. PMID:28079726

This paper uses Jürgen Habermas's Theory of Communicative Action as a lens through which to examine the development of a local mental health charter. To assess whether the Charter represents the product of a communicatively rational process. RESEARCH DESIGN AND SETTING: The paper is based on an analysis of the text of the Charter, and on documentation relating to its development, including notes of discussion groups used to identify its themes. An analysis of the notes of the discussion groups against the text of the Charter shows that the Charter's themes are based broadly on the views generated in the discussion groups. However, they also draw on norms derived from wider discourses not reflected in the discussion groups, and exclude other specific local issues. The strength of feeling expressed in the discussion groups is also toned down in the language of the Charter. The development of the Charter was based on a participatory process that can be said to have contained elements of both communicative and strategic rationality. The strategic rationality involved in translating service users' views into language that would be acceptable to those working in the system can be seen as necessary for the Charter to succeed in bringing about change. In drawing also on communicatively generated norms from the wider public sphere the Charter can be seen as reflecting a form of generalized communicative rationality. The Charter represents a 'sluice' by which communicative rationality is drawn into the mental health system.

The approach taken in this paper, namely synthesising a wealth of previous information with new data and a genetic model, in combination with integrated numerical analyses, led to new insights into the geological controls on the localisation of auriferous veins and residual prospectivity of the Charters Towers goldfield, NE Australia. The method also has implications for the assessment of other "mature" goldfields worldwide. Despite a number of different ore controls having operated within the Charters Towers goldfield, the controlling factors can be linked to a single genetic model for orogenic, granitoid-hosted lode-gold mineralisation in a brittle deformation regime (D4) of NE-SW to NNE-SSW shortening, under conditions of supralithostatic fluid pressure and low stress difference. Spatial autocorrelation results suggest district-scale alignment of the auriferous veins parallel to and overlapping with the ESE-WNW- to E-W-striking Charters Towers-Ravenswood lineament, a major crustal boundary in the basement to the Ravenswood batholith. At the camp-scale, auriferous veins have abundance and proximity relationships with NW-SE-, NNW-SSE-, NE-SW- and ENE-WSW-oriented lineaments, suggesting that structures that controlled gold deposition in one camp did not necessarily control mineralisation in other camps. Fractal dimensions obtained with the box-counting method range from 1.02 to 1.10, whereas veins in the Charters Towers City camp are characterised by a significantly higher fractal dimension of 1.28. This discrepancy may be taken to imply that most or all outcropping and near-surface deposits within the Charters Towers City camp have been found and that new discoveries are more likely to occur at greater levels of depth, or outside the boundaries of this camp. The new understanding has implications for the assessment of the residual prospectivity of the Charters Towers goldfield, where large areas of prospective rock types and structures (e.g., approximately 40% of the Charters Towers-Ravenswood lineament) are hidden under cover. This parameter space was inaccessible to the historic prospectors and has received relatively little attention from recent explorers. The following steps are suggested for the development of a targeting strategy for lode-gold exploration in areas of the goldfield under cover: (1) identify from geological and geophysical data the ENE-WSW (?? 15??) and NNW-SSE (?? 15??) striking structures and geological boundaries within a 20-km-wide corridor parallel to and centred upon the Charters Towers-Ravenswood lineament, the potential control on gold deposit distribution at the regional- to district-scale, (2) interpret from geological and geophysical data the distribution of pre-Middle Devonian granitoids within these areas that are the preferred host rocks of the payable gold deposits, (3) deduce from geophysical data the ENE-WSW (?? 15??) and NNW-SSE (?? 15??) striking structures that cut or bound the intrusions identified in step 2, (4) locate segments along the structures identified in step 3 that deviate most from the geometry of a straight line (e.g., potential bends or splays) and/or intersect other structures or geological contacts, or both, and (5) define and rank potential targets within the prospective areas identified in step 4 and systematically test the best ones. ?? 2006 Elsevier B.V. International Charter Space and Major Disasters: Evaluation after Two Years
NASA Astrophysics Data System (ADS)
Chevrel, M.; Briggs, S.; Parashar, S.; Venkatachary, K. V.; Wood, H.
The purpose of the Charter is to provide assistance in situations of emergencies caused by natural or technological disasters, through the combination of the space and associated ground resources of the Charter participants. The Charter was signed on June 20, 2000 by CNES and ESA, followed by the Canadian Space Agency in October 2000. The Indian Space Research Organisation (ISRO) and the National Oceanic and Atmospheric Administration (NOAA) joined the Charter in September 2001. Under the terms of the Charter immediate, free access to data provided through partners is available to authorised civil protection agencies. All Partner agencies undertake to co- operate on a voluntary basis with no exchange of funds between them. A key objective of the Charter is to establish a long-term working relationship between the civil protection community and space agencies, essential to achieve an efficient use of space technology in disaster management. Since the Charter was formally declared operational on November 1, 2000, it has been activated on average once a month for various kinds of events such as landslide, earthquake, oil spill, flood and volcanic eruption. Each operation was analysed with the relevant end-users in order to improve the efficiency of the service provided to the civil protection community, particularly in terms of response time and of delivered products. After a brief description of the Charter organisation and of its implementation procedures, this paper will focus on the evaluation of the contribution of the Charter to crisis management two years after its inception, based on an analysis of the Charter activation cases.

Applying the Ottawa Charter to inform health promotion programme design.
Fry, Denise; Zask, Avigdor
2017-10-01
There is evidence of a correlation between adoption of the Ottawa Charter's framework of five action areas and health promotion programme effectiveness, but the Charter's framework has not been as fully implemented as hoped, nor is generally used by formal programme design models. In response, we aimed to translate the Charter's framework into a method to inform programme design. Our resulting design process uses detailed definitions of the Charter's action areas and evidence of predicted effectiveness to prompt greater consideration and use of the Charter's framework. We piloted the process by applying it to the design of four programmes of the Healthy Children's Initiative in New South Wales, Australia; refined the criteria via consensus; and made consensus decisions on the extent to which programme designs reflected the Charter's framework. The design process has broad potential applicability to health promotion programmes; facilitating greater use of the Ottawa Charter framework, which evidence indicates can increase programme effectiveness. © The Author 2016. School Segregation, Charter Schools, and Access to Quality Education*
Logan, John R.; Burdick-Will, Julia
2015-01-01
Race, class, neighborhood, and school quality are all highly inter-related in the American educational system. In the last decade a new factor has come into play, the option of attending a charter school. We offer a comprehensive analysis of the disparities among public schools attended by white, black, Hispanic, Asian, and Native American children in 2010–2011, including all districts in which charter schools existed. We compare schools in terms of poverty concentration, racial composition, and standardized test scores, and we also examine how attending a charter or non-charter school affects these differences. Black and Hispanic (and to a lesser extent Native American and Asian) students attend elementary and high schools with higher rates of poverty than white students. Especially for whites and Asians, attending a charter school means lower exposure to poverty. Children’s own race and the poverty and charter status of their schools affect the test scores and racial isolation of schools that children attend in complex combinations. Most intriguing, attending a charter school means attending a better performing school in high-poverty areas but a lower performing school in low-poverty areas. Yet even in the best case the positive effect of attending a charter school only slightly offsets the disadvantages of black and Hispanic students. PMID:27616813

These revisions approve specific provisions of a 2011 Consent Decree between MDE and GenOn to reduce particulate matter (PM), sulfur oxides (SOX), and nitrogen oxides (NOX) from the GenOn Chalk Point generating station (Chalk Point). These revisions also remove the 1978 and 1979 Consent Orders for the Chalk Point generating station from the Maryland SIP as those Consent Orders have been superseded by the 2011 Consent Decree. In the Final Rules section of this Federal Register, EPA is approving the State's SIP submittal as a direct final rule without prior proposal because the Agency views this as a noncontroversial submittal and anticipates no adverse comments. A detailed rationale for the approval is set forth in the direct final rule. If no adverse comments are received in response to this action, no further activity is contemplated. If EPA receives adverse comments, the direct final rule will be withdrawn and all public comments received will be addressed in a subsequent final rule based on this proposed rule. EPA will not institute a second comment period. Any parties interested in commenting on this action should do so at this time.
