  20. Risk factors for injury among construction workers at Denver International Airport.

    The Denver International Airport construction project provided a rare opportunity to identify risk factors for injury on a large construction project for which 769 contractors were hired to complete 2,843 construction contracts. Workers' compensation claims and payroll data for individual contracts were recorded in an administrative database developed by the project's Owner-Controlled Insurance Program. From claims andy payroll data linked with employee demographic information, we calculated injury rates per 200,000 person-hours by contract and over contract characteristics of interest. We used Poisson regression models to examine contract-specific risk factors in relation to total injuries, lost-work-time (LWT), and non-LWT injuries. We included contract-specific expected loss rates (ELRs) in the model to control for prevailing risk of work and used logistic regression methods to determine the association between LWT and non-LWT injuries on contracts. Injury rates were highest during the first year of construction, at the beginning of contracts, and among older workers. Risk for total and non-LWT injuries was elevated for building construction contracts, contract for special trades companies (SIC 17), contracts with payrolls over $1 million, and those with overtime payrolls greater than 20%. Risk for LWT injuries only was increased for site development contracts and contract starting in the first year of construction. Contracts experiencing one or more minor injuries were four times as likely to have at least one major injury (OR = 4.0, 95% CI (2.9, 5.5)). Enhancement of DIA's safety infrastructure during the second year of construction appears to have been effective in reducing serious (LWT) injures. The absence of correlation between injury rates among contracts belonging to the same company suggest that targeting of safety resources at the level of the contract may be an effective approach to injury prevention. Interventions focused on high-risk contracts, including those with considerable overtime work, contracts held by special trades contractors (SIC 17), and contracts belonging to small and mid-sized companies, and on high-risk workers, such as those new to a construction site or new to a contract may reduce injury burden on large construction sites. The join occurrence of minor and major injuries on a contract level suggests that surveillance of minor injuries may be useful in identifying opportunities for prevention of major injures.

    The Canadian construction industry generates 30% of the total municipal solid waste deposited in landfills. Ample evidence can be found in the published literature about rework and waste generation due to ambiguity and errors in contract documents. Also, the literature quotes that disclaimer clauses in contract documents are included in the contractual agreements to prevent contractor claims, which often cause rework. Our professional practice has also noted that there are several disclaimer clauses in standard contract documents which have the potential to cause rework (and associated waste). This article illustrates a comparative study of standard contractual documents and their potential to create rework (and associated waste) in different regions of the world. The objectives of this study are (1) to analyse standard contractual documents in Canada, the USA and Australia in terms of their potential to generate rework and waste, and (2) to propose changes/amendments to the existing standard contract documents to minimise/avoid rework. In terms of construction waste management, all the reviewed standard contract documents have deficiencies. The parties that produce the contract documents include exculpatory clauses to avoid the other party's claims. This approach tends to result in rework and construction waste. The contractual agreements/contract documents should be free from errors, deficiencies, ambiguity and unfair risk transfers to minimise/avoid potential to generate rework and waste.

    The National Solar Observatory’s (NSO) Advanced Technology Solar Telescope (ATST) is the first large U.S. solar telescope accessible to the worldwide solar physics community to be constructed in more than 30 years. The 4-meter diameter facility will operate over a broad wavelength range (0.35 to 28 μm ), employing adaptive optics systems to achieve diffraction limited imaging and resolve features approximately 20 km on the Sun; the key observational parameters (collecting area, spatial resolution, spectral coverage, polarization accuracy, low scattered light) enable resolution of the theoretically-predicted, fine-scale magnetic features and their dynamics which modulate the radiative output of the sun and drive the release of magnetic energy from the Sun’s atmosphere in the form of flares and coronal mass ejections. In 2010, the ATST received a significant fraction of its funding for construction. In the subsequent two years, the project has hired staff and opened an office on Maui. A number of large industrial contracts have been placed throughout the world to complete the detailed designs and begin constructing the major telescope subsystems. These contracts have included the site development, AandE designs, mirrors, polishing, optic support assemblies, telescope mount and coudé rotator structures, enclosure, thermal and mechanical systems, and high-level software and controls. In addition, design development work on the instrument suite has undergone significant progress; this has included the completion of preliminary design reviews (PDR) for all five facility instruments. Permitting required for physically starting construction on the mountaintop of Haleakalā, Maui has also progressed. This paper will review the ATST goals and specifications, describe each of the major subsystems under construction, and review the contracts and lessons learned during the contracting and early construction phases. Schedules for site construction, key factory testing of major subsystems, and integration, test and commissioning activities will also be discussed.

    The article presents the results of studies whose aim was to analyse public procurement procedures in the context of environmental protection, especially wastewater infrastructure, performed in the selected Polish municipalities. The selection criterions were the time of public procurement procedure - from 2009 until 2015 and that the contract was cofinanced by the European Union funds. The contracting authorities responsible for awarding specific contracts, were asked series of detailed questions about the environmental criteria and requirements contained in the tender documents for the construction contracts related to the wastewater infrastructure. The aim of the detailed study was to determine whether the actions taken by the contracting authorities in a tender procedure for the construction or operation of wastewater infrastructure include environmental issues. Authors examine also the applicable public procurement law regulation in Poland and Europe in the context of sustainable development and environmental protection. The study of public procurement law was to check whether the law regulation fully takes into account the environmental aspects of the planned investments. On this basis, conclusions have been made that laws are consistent and do not constitute an obstacle to awarding a contract positively affecting the environment.

    The Port Granby Project is an integral part of the Port Hope Area Initiative (PHAI), and is located approximately 14 kilometres west of the Municipality of Port Hope in the adjacent Municipality of Clarington, Ontario. The principal objective of the project is the excavation and relocation of low-level radioactive waste (LLRW) and marginally contaminated soils, which were deposited at the Port Granby Waste Management Facility (PGWMF) by Eldorado Nuclear Limited during the period 1955 to 1988, to a new, highly engineered above-ground Long-term Waste Management Facility (LTWMF) to be constructed on a nearby site. The Environmental Assessment for the Projectmore » was approved in 2009 August and the required Waste Nuclear Substance License was received in 2011 November. Once the detailed engineering design was completed, in 2011 March, the Port Granby Project was divided into three major contracts for construction implementation purposes. The first of these contracts was completed in late 2012 and the second is planned to start in early 2013. The contracting process for the third major contract is also expected to be completed during 2013.   1. Mitigating delay and non-payment in the Malaysian construction industry

    Construction industry is one of the industries that have contributed towards the rapid growth of development and economics in Malaysia. However, the industry is inundated with delay and non-payment issues between the two parties in contract that is the clients and contractors Even though there are contractual and administrative provisions in the standard forms of contract in Malaysia regarding payments, delay and non-payment issues still occur between them. The aim of the study is to develop measures to mitigate delay and non-payment issues between contractors and clients in the Malaysian construction industry. Questionnaire survey was conducted with clients and contractors in Klang Valley. Results from data analysis identified significant measures to mitigate delay and non-payment issues between contractors and clients which include contractors should submit their progress work invoicing with adequate documents; contractors should follow up constantly with client regarding payment; proper understanding of requirements with regards to payment; mutual discussion of problems with client to address problems in a timely manner and proper use of payment provisions in the standard form of contract. This study is significant to contractors and clients and to other construction players in order to reduce and minimise delay and non-payment issues for the growth of economy in the Malaysian construction industry.

  2. Safety incentive and penalty provisions in Indian construction projects and their impact on safety performance.

    Safety incentive and penalty (I/P) provisions in construction contracts are one of the most common forms of I/P. Contradictory opinions on the effectiveness of these provisions have been expressed in the literature. Statistics on safety provisions were collected from 32 construction projects, which include both types of contracts - those with safety I/P provisions and those without them. Although inclusion of safety I/P provisions in contracts helps in improving the overall safety performance in construction projects, further scope for improvement still exists. Literature review and structured personal interviews, coupled with a survey based on preliminary questionnaire, revealed that successful formulation and implementation of such provisions are dependent on 25 attributes which need the attention of both clients and contractors. A questionnaire-based survey was conducted to evaluate these attributes. The six factors extracted by carrying out factor analysis are: incentive distribution method, proper labour training, special attention to risky situations, role of safety committee and sub-contractors, specialised works and safety equipments, and right form of I/P. If taken care of, these attributes have the potential to improve the safety performance in construction projects. The results would be useful to clients and contractors in implementing the safety I/P provisions and thereby improving safety performance.

Previous to the Washington River Protection Solutions, LLC contract, Construction work at the Hanford Tank Farms was contracted to large companies, while current Department of Energy (DOE) Contracts typically emphasize small business awards. As an integral part of Nuclear Project Management at Hanford Tank Farms, construction involves removal of old equipmentmore » and structures and installation of new infrastructure to support waste retrieval and waste feed delivery to the Waste Treatment Plant. Utilizing the optimum construction approach ensures that the contractors responsible for this work are successful in meeting safety, quality, cost and schedule objectives while working in a very hazardous environment. This paper describes the successful transition from a traditional project delivery method that utilized a large business general contractor and subcontractors to a new project construction management model that is more oriented to small businesses. Construction has selected the Agency Construction Management Method. This method was implemented in the first quarter of Fiscal Year (FY) 2009, where Construction Management is performed by substantially home office resources from the URS Northwest Office in Richland, Washington. The Agency Method has allowed WRPS to provide proven Construction Managers and Field Leads to mentor and direct small business contractors, thus providing expertise and assurance of a successful project. Construction execution contracts are subcontracted directly by WRPS to small or disadvantaged contractors that are mentored and supported by DRS personnel. Each small contractor is mentored and supported utilizing the principles of the Construction Industry Institute (CII) Partnering process. Some of the key mentoring and partnering areas that are explored in this paper are, internal and external safety professional support, subcontractor safety teams and the interface with project and site safety teams, quality assurance program support to facilitate compliance with NQA-1, construction, team roles and responsibilities, work definition for successful fixed price contracts, scheduling and interface with project schedules and cost projection/accruals. The practical application of the CII Partnering principles, with the Construction Management expertise of URS, has led to a highly successful construction model that also meets small business contracting goals.« less

    Standard form of contract is normally being used in Malaysia construction industry in establishing legal relation between contracting parties. Generally, most of Malaysia federal government construction project used PWD203A which is a standard form of contract to be used where Bills of Quantities Form Part of the Contract and it is issued by Public Works Department (PWD/JKR). On the other hand in Sarawak, the largest state in Malaysia, the state government has issued their own standard form of contract namely JKR Sarawak Form of Contract 2006. Even both forms have been used widely in construction industry; there is still lack of understanding on both forms. The aim of this paper is to identify significant provision on both forms of contract. Document analysis has been adopted in conducting an in-depth review on both forms.     There has recently been discussion of whether independent contract evaluation is possible. This article acknowledges the inherent tension in contract evaluation and in response suggests a range of constructive approaches to improving the independence of contract evaluation. In particular, a clear separation between the official evaluation report and a contractor's own publication of analysis from the underlying evaluation appears to be a promising approach. In this approach, the funder would retain almost unfettered rights to the official contract report (including the right never to publish but not the right to change the contractor's text while leaving the contractor's authorship) and the contractor would retain clearly defined rights to publish any findings from the evaluation (subject only to the limitations of human subjects and proprietary data and some minimal notice).

    An efficient algorithm for the rapid evaluation of electron repulsion integrals is proposed. The present method, denoted by accompanying coordinate expansion and transferred recurrence relation (ACE-TRR), is constructed using a transfer relation scheme based on the accompanying coordinate expansion and recurrence relation method. Furthermore, the ACE-TRR algorithm is extended for the general-contraction basis sets. Numerical assessments clarify the efficiency of the ACE-TRR method for the systems including heavy elements, whose orbitals have long contractions and high angular momenta, such as f- and g-orbitals.

    In view of the necessity for efficient implementation of public works projects, it is expected to utilize advanced technical skills of private firms, for the purpose of reducing project costs, improving performance and functions of construction objects, and reducing work periods, etc. The design-build system is a method to order design and construction as a single contract, including design of structural forms and main specifications of the construction object. This is a system in which high techniques of private firms can be utilized, as a means to ensure qualities of design and construction, rational design, and efficiency of the project. The objective of this study is to examine the use of a method to form a consortium of civil engineering consultants and construction companies, as it is an issue related to the implementation of the design-build method. Furthermore, by studying various forms of consortiums to be introduced in future, it proposes procedural items required to utilize this method, during the bid and after signing a contract, such as the estimate submission from the civil engineering consultants etc.

    Performance-based contracting for pavement in Japan started as performance warranties in construction phase, in 1999. Recently, road agencies have recognized the applicability of this type of contracting in outsourcing of maintenance activities. The objectives of this study are to clarify the issues of performance specifying in construction phase and maintenance phase of pavement, and to propose measures to be taken. This paper, with the recognition that the life of each pavement depends on performance standards for various attributes, reviews domestic and foreign examples of performance-based contracting. A performance standard based on the average of current practices can enhance product quality and service life with a warranty contract. Repair thresholds and response time for each deficiency should be considered as performance standards in maintenance phase.

    Multi-physics right and left ventricle (RV/LV) fluid-structure interaction (FSI) models were introduced to perform mechanical stress analysis and evaluate the effect of patch materials on RV function. The FSI models included three different patch materials (Dacron scaffold, treated pericardium, and contracting myocardium), two-layer construction, fiber orientation, and active anisotropic material properties. The models were constructed based on cardiac magnetic resonance (CMR) images acquired from a patient with severe RV dilatation and solved by ADINA. Our results indicate that the patch model with contracting myocardium leads to decreased stress level in the patch area, improved RV function and patch area contractility. PMID:21765559

    Major upgrades were made in 1999 to the 6- by 9-Foot (1.8- by 2.7-m) Icing Research Tunnel (IRT) at the NASA Glenn Research Center. These included replacement of the electronic controls for the variable-speed drive motor, replacement of the heat exchanger, complete replacement and enlargement of the leg of the tunnel containing the new heat-exchanger, the addition of flow-expanding and flow-contracting turning vanes upstream and downstream of the heat exchanger, respectively, and the addition of fan outlet guide vanes (OGV's). This paper presents an overview of the construction and reactivation testing phases of the project. Important lessons learned during the technical and contract management work are documented.

    NREL experienced a significant increase in employees and facilities on our 327-acre main campus in Golden, Colorado over the past five years. To support this growth, researchers developed and demonstrated a new building acquisition method that successfully integrates energy efficiency requirements into the design-build requests for proposals and contracts. We piloted this energy performance based design-build process with our first new construction project in 2008. We have since replicated and evolved the process for large office buildings, a smart grid research laboratory, a supercomputer, a parking structure, and a cafeteria. Each project incorporated aggressive efficiency strategies using contractual energy usemore » requirements in the design-build contracts, all on typical construction budgets. We have found that when energy efficiency is a core project requirement as defined at the beginning of a project, innovative design-build teams can integrate the most cost effective and high performance efficiency strategies on typical construction budgets. When the design-build contract includes measurable energy requirements and is set up to incentivize design-build teams to focus on achieving high performance in actual operations, owners can now expect their facilities to perform. As NREL completed the new construction in 2013, we have documented our best practices in training materials and a how-to guide so that other owners and owner's representatives can replicate our successes and learn from our experiences in attaining market viable, world-class energy performance in the built environment.« less

    Cells are often dispersed in extracellular matrix (ECM) gels like collagen and Matrigel as minimal tissue models. Generally, large-scale contraction of these constructs is observed, in which the degree of contraction of the entire system correlates with cell density and ECM concentration. The freedom to perform diverse mechanical experiments on these contracting constructs is limited by the challenges of handling and supporting these delicate samples. Here, we present a method to create simple cell-ECM constructs that can be manipulated with significantly reduced experimental limitations. We 3D print mixtures of MCF10A cells and ECM (collagen-I and Matrigel) into a 3D growth medium made from jammed microgels. With this approach, we are able to apply shear stresses to the cell constructs times after printing and observe the collective response. Preliminary results reveal that, following shear deformations that exceed 300% and dramatically smear cells and matrix in space, the cells actively re-contract the construct toward the un-sheared construct. These results suggest that new principles of collective recovery can be employed for tissue engineering applications using jammed microgels as a re-configurable support medium.

    The work described in this volume of ``S`` Projects History is an extension of the type of work described in Volume I. E.I. du Pont de flemours & Company had entered into Contract AT (07-2)-l with the United States Atomic Energy Commission to develop, design, construct, install, and operate facilities to produce heavy water, fissionable materials, and related products. Under this contract,, Du Pont constructed and operated the Savannah River Plant. The engineering, design, and construction for most of the larger ``S`` projects was performed by the Engineering DeDartment. For some of the large and many of the smaller projectsmore » the Engineering Department was responsible only for the construction because the Atomic Energy Division (AED) of the Explosives Department handled the other phases. The Engineering Department Costruction Division also performed the physical work for many of the plant work orders. This volume includes a general description of the Du Pont Engineering Department activities pertaining to the engineering, design, and construction of the ``S`` projects at the Savannah River Plant; brief summaries of the projects and principal work requests; and supplementary informaticn on a few subjects in Volume I for which final data was not available at the closing date.
