Yet, international law provides for rights-limiting principles, which would justify enforcing compulsory measures against TB patients who refuse to have diagnostic procedures or who refuse to be monitored and treated once disease is confirmed. This article analyzes under what circumstances compulsory measures for TB patients may be enforced under international law. Compulsory measures for TB patients may, in fact, be justified on legal grounds provided that these measures are foreseen in the law, that they are used as a last resort, and that safeguards are in place to protect affected individuals. The deadly nature of the disease, its epidemiology, the high case fatality rate, and the speed at which the disease leads to death when associated with HIV are proven.

The upcoming HIPAA security regulations are forcing a change in business and operating procedures that many, if not most, healthcare organizations are ill-prepared to tackle. Of all healthcare organizational structures, membership organizations will most likely face the greatest number of obstacles in preparing for and implementing the HIPAA security regulations. This is because the membership organization as a whole must find a way to accommodate the disparate technologies, business and operating methodologies and processes, and available, limited resources of its individual member organizations, and integrate these into a uniform implementation plan. Compounding these obvious difficulties is the unique challenge of enforcement authority. The individual member organizations are autonomous business entities, whereas the membership organization as a whole merely acts as an advisor or consultant, and has only limited enforcement authority over any individual member organization. This article explores this unique situation in depth. We focus on PROMINA Health System, a nonprofit healthcare membership organization that consists of five disparate member healthcare organizations. We examine the challenges PROMINA has encountered in its quest to institute an organization-wide HIPAA security program and its methodology for accomplishing program implementation.

Significant reductions in motor vehicle emissions are possible through the implementation of inspection and maintenance (I/M) programs. However, the potential benefits of I/M are obviously not achieved when specific inspection requirements are ignored or improperly performed. In addition, I/M benefits may be substantially reduced when improper repair procedures are used on vehicles which fail the test. In order for the ''theoretical'' benefits of I/M to be achieved, certain program design and enforcement procedures are necessary. The use of instrumentation and data analysis methods capable of identifying individuals who are improperly performing inspections and repairs is critical.

Eyewitness identification evidence is an important aspect of our legal system. Society relies on witnesses to identify suspects whom they have observed during the commission of a crime. Because a witness has only a mental representation of the individual he or she observed, law enforcement must rely on verbal descriptions and identification procedures to document eyewitness evidence. The present article introduces and details a computer program, referred to as PC_Eyewitness (PCE), which can be used in laboratories to conduct research on eyewitness memory. PCE is a modular program written in Visual Basic 6.0 that allows a researcher to present stimuli to a participant, to conduct distractor tasks, to elicit verbal descriptors regarding a target individual, and to present a lineup for the participant to provide an identification response. To illustrate the versatility of the program, several classic studies in the eyewitness literature are recreated in the context of PCE. The program is also shown to have applications in the conduct of field research and for use by law enforcement to administer lineups in everyday practice. PCE is distributed at no cost.

All states in the U.S. prohibit alcohol-impaired driving but active law enforcement is necessary for effectively reducing this behavior. Sobriety checkpoints, saturation patrols, open container laws, and media campaigns related to enforcement efforts are all enforcement-related strategies for reducing alcohol-impaired driving. We conducted surveys of all state patrol agencies and a representative sample of local law enforcement agencies to assess their use of alcohol-impaired driving enforcement-related strategies and to determine the relationship between these enforcement-related strategies and self-reported alcohol-impaired driving behavior obtained from the Behavioral Risk Factor Surveillance System. We found that sobriety checkpoints, saturation patrols, and enforcement of open container laws were associated with a lower prevalence of alcohol-impaired driving but, more importantly, a combination of enforcement-related strategies was associated with a greater decrease in alcohol-impaired driving than any individual enforcement-related activity. In addition, alcohol-impaired driving enforcement-related strategies were associated with decreased alcohol-impaired driving above and beyond their association with decreased binge drinking. Results suggest law enforcement agencies should give greater priority to using a combination of strategies rather than relying on any one individual enforcement activity. Eyewitness-identification tests often culminate in witnesses not picking the culprit or identifying innocent suspects. We tested a radical alternative to the traditional lineup procedure used in such tests. Rather than making a positive identification, witnesses made confidence judgments under a short deadline about whether each lineup member was the culprit. We compared this deadline procedure with the traditional sequential-lineup procedure in three experiments with retention intervals ranging from 5 min to 1 week. A classification algorithm that identified confidence criteria that optimally discriminated accurate from inaccurate decisions revealed that decision accuracy was 24% to 66% higher under the deadline procedure than under the traditional procedure. Confidence profiles across lineup stimuli were more informative than were identification decisions about the likelihood that an individual witness recognized the culprit or correctly recognized that the culprit was not present. Large differences between the maximum and the next-highest confidence value signaled very high accuracy. Future support for this procedure across varied conditions would highlight a viable alternative to the problematic lineup procedures that have traditionally been used by law enforcement.

Resource systems with enforced rules and strong monitoring systems typically have more predictable resource abundance, which can confer economic and social benefits to local communities. Co-management regimes demonstrate better social and ecological outcomes, but require an active role by community members in management activities, such as monitoring and enforcement. Previous work has emphasized understanding what makes fishermen comply with rules. This research takes a different approach to understand what influences an individual to enforce rules, particularly sea tenure. We conducted interviews and used multiple regression and Akaike's Information Criteria model selection to evaluate the effect of social networks, food security, recent catch success, fisherman's age and personal gear investment on individual's enforcement of sea tenure. We found that fishermen's enforcement of sea tenure declined between the two time periods measured and that social networks, age, food security, and changes in gear investment explained enforcement behavior across three different communities on Nicaragua's Atlantic Coast, an area undergoing rapid globalization.

Background In response to the rise of distracted driving, many countries and most US states have adopted laws to restrict the use of handheld phones for drivers. Specific provisions of each law and the overall social mores of distracted driving influence enforceability and impact. Objectives Identify multilevel interdependent factors that influence distracted driving enforcement through the perspective of police officers. Design/methods We conducted focus group discussions with active duty law enforcement officers from three large Washington State counties. Our thematic analysis used descriptive and pattern coding that placed our findings within a social ecological framework to facilitate targeted intervention development. Results Participants reported that the distracted driving law posed challenges for consistent and effective enforcement. They emphasised the need to change social norms around distracted driving, similar to the shifts seen around impaired driving. Many participants were themselves distracted drivers, and their individual knowledge, attitude and beliefs influenced enforcement. Participants suggested that law enforcement leaders and policymakers should develop and implement policies and strategies to prioritise and motivate increased distracted driving enforcement. Conclusions Individual, interpersonal, organisational and societal factors influence enforcement of distracted driving laws. Targeted interventions should be developed to address distracted driving and sustain effective enforcement. PMID:27634839

The need for drugged driving per se laws: a commentary.

Triggered by the new federal commitment announced by the Office of National Drug Control Policy (ONCDP) to encourage states to enact drugged driving per se laws, this article reviews the reasons to establish such laws and the issues that may arise when trying to enforce them. A review of the state of drunk driving per se laws and their implications for drugged driving is presented, with a review of impaired driving enforcement procedures and drug testing technology. Currently, enforcement of drugged driving laws is an adjunct to the enforcement of laws regarding alcohol impairment. Drivers are apprehended when showing signs of alcohol intoxication and only in the relatively few cases where the blood alcohol concentration of the arrested driver does not account for the observed behavior is the possibility of drug impairment pursued. In most states, the term impaired driving covers both alcohol and drug impairment; thus, driver conviction records may not distinguish between the two different sources of impairment. As a result, enforcement statistics do not reflect the prevalence of drugged driving. Based on the analysis presented, this article recommends a number of steps that can be taken to evaluate current drugged driving enforcement procedures and to move toward the enactment of drug per se laws.

The forensic toxicology (TF) is a science of analytical basis, aiming to clarify legal issues related to poisoning, whether or not fatal, within the various areas of law (criminal, civil, labor, etc.). The analysis that are more often requested (with a tendency to increase and gaining rising attention) are those concerning the procedures involving supervision of driving under the influence of alcohol and psychotropic substances, in the living individual and in the cadaver. The key players in this process, are: (a) the police agents carrying out the screening and quantification of alcohol on the exhaled breath and the screening of psychotropic and stupefacient substances in saliva; (b) the public health services that perform qualitative analysis of these substances in urine (if the test was not previously performed in saliva); (c) the doctor that collects blood samples from the living, or the dead victim; (d) the forensic toxicologist who conducts toxicological analysis in blood (or, eventually in another biological sample) and (e) the magistrate prosecutors that ultimately will receive the toxicological report to apply the law. Therefore it is important to understand and be acquainted with the road law enforcement of driving under the influence of alcohol and psychotropic substances, particularly in what concerns to the role of the medical doctor. Consequently, this paper aimed to review these topics, namely highlighting the necessary information to clarify the interested parties about the technical, ethical and legal procedures to consider.

Large-scale human cooperation among unrelated individuals requires the enforcement of social norms. However, such enforcement poses a problem because non-enforcers can free ride on others' costly and risky enforcement. One solution is that enforcers receive benefits relative to non-enforcers. Here we show that this solution becomes functional during the preschool years: 5-year-old (but not 4-year-old) children judged enforcers of norms more positively, preferred enforcers, and distributed more resources to enforcers than to non-enforcers. The ability to sustain not only first-order but also second-order cooperation thus emerges quite early in human ontogeny, providing a viable solution to the problem of higher-order cooperation. Bioethical Biobanks: Three Concerns in Designing and Using Law Enforcement DNA Identification Databases

Federal and state law enforcement authorities have amassed large collections of DNA samples and the identifying profiles derived from them. These databases help to identify the guilty and to exonerate the innocent, but as the databanks grow, so do fears about civil liberties. The research reported here discusses three legal and social policy issues that have been raised in regard to these biobanks—the choice of loci to type for identifying individuals, the indefinite retention of DNA samples, and the use of the DNA samples or the identifying profiles for research purposes. It also considers the possible value of the databasesmore » for research into the genetics of human behavior and the ethics of using them for this purpose. It rejects the broad claim that such research is inherently unethical but proposes procedures for ensuring that the value of the proposed research justifies any psychosocial or other risks to the subjects of the research.« less

In response to the rise of distracted driving, many countries and most US states have adopted laws to restrict the use of handheld phones for drivers. Specific provisions of each law and the overall social mores of distracted driving influence enforceability and impact. Identify multilevel interdependent factors that influence distracted driving enforcement through the perspective of police officers. We conducted focus group discussions with active duty law enforcement officers from three large Washington State counties. Our thematic analysis used descriptive and pattern coding that placed our findings within a social ecological framework to facilitate targeted intervention development. Participants reported that the distracted driving law posed challenges for consistent and effective enforcement. They emphasised the need to change social norms around distracted driving, similar to the shifts seen around impaired driving. Many participants were themselves distracted drivers, and their individual knowledge, attitude and beliefs influenced enforcement. Participants suggested that law enforcement leaders and policymakers should develop and implement policies and strategies to prioritise and motivate increased distracted driving enforcement. Individual, interpersonal, organisational and societal factors influence enforcement of distracted driving laws. The expansion of U.S. immigration enforcement from the borders into the interior of the country and the fivefold increase in immigration detentions and deportations since 1995 raise important questions about how the enforcement of immigration law is spatially patterned across American communities. Focusing on the practice of immigration detention, the present study analyzes the records of all 717,160 noncitizens detained by Immigration and Customs Enforcement (ICE) in 2008 and 2009-a period when interior enforcement was at its peak-to estimate states' detention rates and examine geographic variation in detention outcomes, net of individual characteristics. Findings reveal substantial state heterogeneity in immigration detention rates, which range from approximately 350 detentions per 100,000 noncitizens in Connecticut to more than 6,700 detentions per 100,000 noncitizens in Wyoming. After detainment, individuals' detention outcomes are geographically stratified, especially for detainees eligible for pretrial release. These disparities indicate the important role that geography plays in shaping individuals' chances of experiencing immigration detention and deportation.

To handle firearms safely, an individual needs to be in sound psychological conditions. This point is especially relevant in law enforcement, given that this group is likely to experience situations where there is a reasonably severe risk to life, physical integrity and that of third parties. These conditions cause high levels of stress and become a significant source of psychological strain. The assessment of these psychological conditions in law enforcement must stay ahead of this strain and should act preventively, establishing surveillance that is the product of a consensus between the needs of professionals and organizations. This evaluation should be conducted by technical specialists who understand and know the occupational reality of these professionals. A good assessment methodology starts with the need to discover the basic areas that need exploring, the ideal procedure for assessing these issues and the criteria that determine the aptitude (or lack thereof) for handling firearms. Once these goals have been established, we can be assured that the assessment will follow a set of principles that will give it homogeneity, effectiveness and efficiency. This type of assessment will help accomplish the mission that these security professionals are entrusted to by law, which is to protect the free exercise of rights and freedoms and ensure citizen safety. Religious prosociality and morality across cultures: how social enforcement of religion shapes the effects of personal religiosity on prosocial and moral attitudes and behaviors.

The question of whether religiosity is linked to prosocial behavior is currently hotly debated in psychology. This research contributes to this debate by showing that the nature of individuals' religious orientations and their relationships to prosociality depend on their country's social enforcement of religiosity. Our analyses of data from more than 70 countries indicate that in countries with no social pressure to follow a religion, religious individuals are more likely to endorse an intrinsic religious orientation (Study 1), engage in charity work (Study 2), disapprove of lying in their own interests (Study 3), and are less likely to engage in fraudulent behaviors (Study 4) compared with non-religious individuals. Ironically, in secular contexts, religious individuals are also more likely to condemn certain moral choices than non-religious individuals (Study 2). These effects of religiosity substantially weaken (and ultimately disappear) with increasing national levels of social enforcement of religiosity.

In order to ensure that digital evidence is collected, preserved, examined, or transferred in a manner safeguarding the accuracy and reliability of the evidence, law enforcement and digital forensic units must establish and maintain an effective quality assurance system. The very first part of this system is standard operating procedures (SOP's) and/or models, conforming chain of custody requirements, those rely on digital forensics "process-phase-procedure-task-subtask" sequence. An acceptable and thorough Digital Forensics (DF) process depends on the sequential DF phases, and each phase depends on sequential DF procedures, respectively each procedure depends on tasks and subtasks. There are numerous amounts of DF Process Models that define DF phases in the literature, but no DF model that defines the phase-based sequential procedures for crime scene identified. An analytical crime scene procedure model (ACSPM) that we suggest in this paper is supposed to fill in this gap. The proposed analytical procedure model for digital investigations at a crime scene is developed and defined for crime scene practitioners; with main focus on crime scene digital forensic procedures, other than that of whole digital investigation process and phases that ends up in a court. When reviewing the relevant literature and interrogating with the law enforcement agencies, only device based charts specific to a particular device and/or more general perspective approaches to digital evidence management models from crime scene to courts are found. After analyzing the needs of law enforcement organizations and realizing the absence of crime scene digital investigation procedure model for crime scene activities we decided to inspect the relevant literature in an analytical way. The outcome of this inspection is our suggested model explained here, which is supposed to provide guidance for thorough and secure implementation of digital forensic procedures at a crime scene. In digital forensic investigations each case is unique and needs special examination, it is not possible to cover every aspect of crime scene digital forensics, but the proposed procedure model is supposed to be a general guideline for practitioners. The study involved: (a) three annual telephone surveys, (b) two annual purchase surveys in 2000 tobacco outlets and (c) interviews with key informants from local law enforcement agencies. Analyses were multi-level models (city, individual, time). A sample of 50 mid-sized non-contiguous cities in California, USA. A total of 1478 youths (aged 13-16 at wave 1, 52.2% male); 1061 participated in all waves. Measures at the individual level included life-time cigarette smoking, perceived availability and perceived enforcement. City-level measures included tobacco outlet density, cigarette sales without ID checks and compliance checks. Outlet density was associated positively with life-time smoking [OR = 1.12, P < 0.01]. An interaction between outlet density and wave (OR = 0.96, P < 0.05) suggested that higher density was associated more closely with life-time smoking at the earlier waves when respondents were younger. Greater density was associated positively with perceived availability (β = 0.02, P < 0.05) and negatively with perceived enforcement (β = -0.02, P < 0.01). Sales rate without checking IDs was related to greater perceived availability (β = 0.01, P < 0.01) and less perceived enforcement (β = -0.01, P < 0.01). Enforcement of underage tobacco laws was related positively to perceived enforcement (β = 0.06, P < 0.05). Higher tobacco outlet density may contribute to life-time smoking among youths. Density, sales without ID checks and enforcement levels may influence beliefs about access to cigarettes and enforcement of underage tobacco sales laws. © 2015 Society for the Study of Addiction.

A cloth simulation represents the behavior of cloth objects such as flag, tablecloth, or even garments has application in clothing animation for games and virtual shops. Elastically deformable models have widely used to provide realistic and efficient simulation, however problem of overstretching is encountered. We introduce a new cloth simulation algorithm that replaces iterative distance constraint enforcement steps with non-iterative ones for preventing over stretching in a spring-mass system for cloth modeling. Our method is based on a simple position correction procedure applied at one end of a spring. In our experiments, we developed a rectangle cloth model which is initially at a horizontal position with one point is fixed, and it is allowed to drape by its own weight. Our simulation is able to achieve a plausible cloth drapes as in reality. This paper aims to demonstrate the reliability of our approach to overcome overstretches while decreasing the computational cost of the constraint enforcement process due to an iterative procedure that is eliminated.

EPA Facility Registry Service (FRS): ICIS

EPA Pesticide Factsheets

This web feature service contains location and facility identification information from EPA's Facility Registry Service (FRS) for the subset of facilities that link to the Integrated Compliance Information System (ICIS). When complete, ICIS will provide a database that will contain integrated enforcement and compliance information across most of EPA's programs. The vision for ICIS is to replace EPA's independent databases that contain enforcement data with a single repository for that information. Currently, ICIS contains all Federal Administrative and Judicial enforcement actions and a subset of the Permit Compliance System (PCS), which supports the National Pollutant Discharge Elimination System (NPDES). ICIS exchanges non-sensitive enforcement/compliance activities, non-sensitive formal enforcement actions and NPDES information with FRS. This web feature service contains the enforcement/compliance activities and formal enforcement action related facilities; the NPDES facilities are contained in the PCS_NPDES web feature service. FRS identifies and geospatially locates facilities, sites or places subject to environmental regulations or of environmental interest. Using vigorous verification and data management procedures, FRS integrates facility data from EPA's national program systems, other federal agencies, and State and tribal master facility records and provides EPA with a centrally managed, single source of comprehensive and authoritative information on f
