The Supreme Court of Michigan upheld a statute which prohibited the use of Medicaid funds to pay for abortions unless the abortion is necessary to save the mother's life. Medicaid funding in Michigan covers expenses related to childbirth. The 15-year-old plaintiff sought a first-trimester abortion through the Medicaid program after she was raped. Despite her history of seizures, doctors did not believe that her life was threatened by the pregnancy. The court held that the equal protection clause of the Michigan constitution provides the same amount of protection as the federal constitution. The court noted that similar statutes in other states, as well as the federal Hyde Amendment, had withstood equal protection challenges. The court found that the Michigan statute was rationally related to the legitimate governmental purpose of allocating state benefits in a way that reflects the state's determination of public policy of protecting potential life and promoting childbirth.

Are black Americans entitled to equal health care? a new research paradigm.

This paper analyzes the health, economic and legal implications of most major health systems' reform initiatives in the 20th century and, briefly, the 19th century. The paper suggests that models of analysis grounded in science deter the development of claims for racial equality in health care. Because race is a legal construct, the paper suggests that the 14th Amendment's Equal Protection Clause is an analytical framework that better accommodates the complexity of the health system, is at the heart of our national laws and ethos, and has political rhetorical power to further the political and policy debate. Major components of the health care system, including professional training, hospital construction, and health care financing, are analyzed for racially discriminatory purpose or impact and the extent of government participation. The paper gives particular attention to: the Flexner Report and the limited number of black physicians; the Hill-Burton program and the disproportionate assistance it gave to white controlled hospitals; and, efforts to expand health insurance coverage that also disproportionately favored the needs of the white community. Given the compounding effects of numerous policy decisions made over many years, there should not be any great wonder that such gross disparities in morbidity and mortality exist between black and white Americans. Further research and analysis of the policy decisions that have constructed the current health care system as well as framing those analyses as claims for racial fairness will better develop the policy debate than more narrowly focused analytical models from biomedical science or epidemiology. The law produced slavery and segregation, which usually determined where you lived, where you went, what work you could do, and what you learned. That legally constructed system significantly determined what you earned and what health you had. The biomedical models of analysis of our health system are too narrowly focused and temporally limited to identify the broad systemic barriers to equal health and health care. An analytical framework from law more easily accommodates the complex dynamics of our health care system. The equal protection clause of the 14th amendment has been used to analyze complex social and economic models, such as housing and education and has moved those systems to greater racial equality. The equal protection clause is at the heart of our national laws and ethos and, as a claim for fair treatment from government, has considerable rhetorical power. Menefee presents an analysis of major health policies dealing with training of physicians, construction of hospitals, and financing of personal health care. He suggests it demonstrates a health system rooted in racial discrimination and perpetuating racial discrimination in education, employment and housing. The history of successes using this analytical framework in other areas of social policy validates its consideration by health policy analysts for further research.

In 1991, the South Dakota Legislature enacted a living will statute. Included is a pregnancy provision that prevents pregnant women from obtaining the full benefit of the statute. A South Dakota Attorney General's opinion was released discussing the conflict of laws problems posed by the statute. That opinion, however, did not address the more important question of the constitutionality of the pregnancy provision. This comment analyzes the pregnancy provision under the Due Process, Equal Protection, and the Establishment Clauses and concludes that South Dakota's pregnancy provision is unconstitutional under all three doctrines.

The Equal Employment Opportunity Commission (EEOC) issued a policy statement condemning a prevalent practice among U.S. employers--new hires are asked to sign an agreement obligating them to submit Americans with Disabilities Act (ADA) claims to binding arbitration. By signing the clause, an employee virtually forfeits his or her rights to bring an ADA claim to court. The EEOC compares these employment clauses to conditions of employment rather than voluntary agreements between worker and employer. Employers argue that the binding arbitration process is fast and equitable. Opponents argue that the process is unfair. The EEOC instructed its investigators to proceed with administrative charges regardless of whether or not the complainant signed a binding arbitration agreement. The EEOC policy statement argues against mandatory arbitration clauses, noting that the arbitration process limits the rights of employees and weighs heavily in favor of employers.

Michigan's Court of Appeals affirmed in part and reversed in part a lower court decision in an action brought by infertile couples and prospective surrogate mothers. The plaintiffs asserted that if Michigan's Surrogate Parenting Act were interpreted as banning outright surrogacy contracts for pay, the statute would deny them their constitutionally protected privacy rights and would offend the due process and equal protection clauses of the state and federal constitutions. They argued that in order to be constitutional, the Act must be read as permitting surrogacy contracts as long as payment to the birth mother is not contingent upon her relinquishing her parental rights. The Court of Appeals affirmed that the state had sufficient interests to warrant its intrusion into the protected area of privacy in the matter of reproduction. The court held that in order to be found void, unenforceable, unlawful, and prohibited in the language of the Surrogate Parenting Act, a surrogate parenting contract must contain two elements: (1) conception by a surrogate, and (2) her voluntary relinquishment of her parental rights.

Freedom of conscience and religion, also called conscience clause legislation is part of the inherent and inalienable rights of every human being and freedoms protected by the constitution as a fundamental principle of democratic countries working in the law. At international level, the most common piece of legislation on this issue is the European Convention on Human Rights of 4 November 1950, which Poland is a party. Pursuant to Art. 9 of the European Convention Poland is committed to the protection of freedom of thought, conscience and religion to every person under its jurisdiction, including the medical professions. In a special way to be protected by the freedom of conscience of physicians, dentists, nurses and midwives, as the conscience clause is written in the law governing the exercise of such professions in Poland.

Previous work on Relative Clause attachment has overlooked a crucial grammatical distinction across both the languages and structures tested: the selective availability of Pseudo Relatives. We reconsider the literature in light of this observation and argue that, all else being equal, local attachment is found with genuine Relative Clauses and that non-local attachment emerges when their surface identical imposters, Pseudo Relatives, are available. Hence, apparent cross-linguistic variation in parsing preferences is reducible to grammatical factors. The results from two novel experiments in Italian are presented in support of these conclusions. In the current work, we test the hypothesis that ‘at-issue’ and 'not-at-issue' content (Potts, 2005) are processed semi-independently. In a written rating study comparing restrictive relative clauses and parentheticals in interrogatives and declaratives, we observe a significantly larger length penalty for restrictive relative clauses than for parentheticals. This difference cannot be attributed to differences in how listeners allocate attention across a sentence: a second study confirms that readers are equally sensitive to agreement violations in at-issue and not-at-issue content. A third rating experiment showed that the results do not depend on the restrictive relative clause intervening on the subject-verb dependency. A final experiment showed that the observed effects obtain with definite determiners and demonstratives alike. Taken jointly the results suggest that the parenthetical structures are processed independently of their embedding utterance, which in turn suggests that syntactic memory may be more differentiated than is typically assumed. In today's healthcare industry, many hospitals utilize outside agencies for both business and clinical functions. This Article acknowledges the prevalence of outsourcing contract labor in the healthcare arena and focuses on the restrictive provisions included in these employment contracts, particularly "no-hire" clauses. No-hire clauses are often included in contracts between healthcare providers and professional groups that provide clinical service employees to the provider, such as a medical practice group providing physicians to a hospital or an agency providing nurses to a nursing home. These clauses usually provide that the healthcare provider may not directly hire an employee provided by the professional group, nor may it contract with another professional group that later hires the employee. The purpose of a no-hire clause is two-fold: to protect the professional group's investment of time and moneyfor recruiting, training, and establishing the employee's clinical practice, and to give the professional group leverage to retain its employees. While noncompete clauses in employment contracts have traditionally been the subject of litigation, no-hire clauses raise distinct legal issues. Case law provides conflicting views as to the enforceability of these provisions. Some courts find no-hire clauses to be per se illegal restrictions on trade, while others will permit them when they are reasonable within a specific context. The author proposes that a multifactor test be applied on a case-by-case basis to determine the reasonableness of the no-hire provision in a given employment contract and suggests drafting improvements to facilitate enforcement.

This approach can reduce the concentration of tobacco retailers in poorer communities, limit youth exposure to tobacco advertising, and prevent misleading associations between tobacco and health messaging. Methods: Communities can reduce the density and number of tobacco retailers by imposing minimum distance requirements between existing retailers, capping the number of retailers in a given geographic area, establishing a maximum number of retailers proportional to population size, and prohibiting sales at certain types of establishments, such as pharmacies, or within a certain distance of locations serving youth. Local governments use direct regulation, licensing, or zoning laws to enact these changes. We analyze each approach under U.S. constitutional law to assist communities in selecting and implementing one or more of these methods. There are few published legal opinions that address these strategies in the context of tobacco control. But potential constitutional challenges include violations of the Takings Clause of the Fifth Amendment, which protects property owners from onerous government regulations, and under the Fourteenth Amendment’s Equal Protection and Due Process Clauses, which protect business owners from arbitrary or unreasonable regulations that do not further a legitimate government interest. Conclusion: Because there is an evidentiary basis linking the density of tobacco retailers to smoking rates in a community, courts are likely to reject constitutional challenges to carefully crafted laws that reduce the number of tobacco retailers. Implications: Our review of the relevant constitutional issues confirms that local governments have the authority to utilize laws and policies to reduce the density and number of tobacco retailers in their communities, given existing public health data. The analysis guides policy makers in crafting laws that comply with constitutional requirements by outlining the most important procedures and evidentiary justifications to use in development, implementation, and enforcement. This perspective also highlights the importance of reviewing state constitutions, statutes, and municipal codes and getting local input from attorneys and community stakeholders to assess the likely success of some methods over others. Abortion 1980: the debate continues.

Although recent Supreme Court rulings clarified the constitutional issues concerning induced abortion in the U.S., the abortion debate is not over. The debate has simply moved out of the courtroom and into the country's state and federal legislative bodies. The 1973 Supreme Court rulings recognized that women have the constitutional right to decide whether to abort or continue a pregnancy while the 1980 Supreme Court ruling declared that state and federal governments are not obligated by the constitution to provide funds to insure that women can exercise their abortion rights. The court ruled that neither the due process nor the equal protection clauses applied to abortion funding. The court did, nowever, leave the way open for the battle to continue in legislative bodies. The legislative bodies were clearly assigned the task of deciding for themselves whether or not to fund abortions. Since the public has a variety of views on the subject, debate on the issue in legislatures throughout the country will be intense.

The planned reform of the Clinical Trials Directive has re-opened the debate over how to implement and interpret research-related injuries regulation. In the European Union (EU), clinical trials are currently regulated by Directive 2001/20/EC, which establishes the provision of mandatory insurance before clinical trials commence but is silent on the system of liability. The proposed new Regulation will impact biomedical research assurance in all EU Member States because it points to insurance costs as being one of the causes of the fall in the number of clinical trials carried out in the EU. Despite the adoption of a risk-balance approach, the proposed new Regulation does not include a no-fault compensation system to protect subjects participating in clinical trials. An adequate protection of the rights and wellbeing of trial subjects would require not only mandatory insurance for clinical trials but also a no-fault compensation system. The new regulation should include a general clause requiring mandatory insurance and establishing liability insurance based on no-fault compensation; an exception clause, enabling the performance of clinical trials without insurance in the case of low-risk interventions or non-commercial clinical trials; and an exclusion clause, excluding compensation when there is no causal connection between injuries and clinical trial.

Whose Choice? Developing a Unifying Ethical Framework for Conscience Laws in Health Care.

Since abortion became legal nationwide, federal and state "conscience clauses" have been established to define the context in which health professionals may decline to participate in contested services. Patients and health care providers may act according to conscience in making health care decisions and in deciding whether to abstain from or to participate in contested services. Historically, however, conscience clauses largely have equated conscience in health care with provider abstinence from such services. We propose a framework to analyze the ethical implications of conscience laws. There is a rich literature on the exercise of conscience in the clinical encounter. This essay addresses the need to ensure that policy, too, is grounded in an ethical framework. We argue that the ideal law meets three standards: it protects patients' exercise of conscience, it safeguards health care providers' rights of conscience, and it does not contradict standards of ethical conduct established by professional societies. We have chosen Illinois as a test of our framework because it has one of the nation's broadest conscience clauses and because an amendment to ensure that women receive consistent access to contested services has just passed in the state legislature. Without such an amendment, Illinois law fails all three standards of our framework. If signed by the governor, the amended law will provide protections for patients' positive claims of conscience. We recommend further protections for providers' positive claims as well. Enacting such changes would offer a model for how ethics-based analysis could be applied to similar policies nationwide.

The Origination Clause, the Affordable Care Act, and Indirect Constitutional Violations.

"All bills for raising revenue shall originate in the House of Representatives; but the Senate may propose or concur with amendments as on other Bills." U.S. Const. art. I, § 7, cl. 1 (Origination Clause). "As we have often noted, '[c]onstitutional rights would be of little value if they could be . . . indirectly denied.'" United States Term Limits, Inc. v. Thornton, 514 U.S. 779, 829 (1995) The Supreme Court's opinion in National Federation of Independent Business v. Sebelius, upholding the constitutionality of the Patient Protection and Affordable Care Act (ACA) as a permissible exercise of Congress's taxing power rekindled an old question about the constitutionality of the Act: Was the Act unconstitutional under the Origination Clause? The bill that became the ACA, H.R. 3590, originated in the House as the Service Members Home Ownership Tax Act of 2009. It was gutted by the Senate and replaced with the ACA before being passed and sent back to the House for final passage. The Supreme Court has heard very few cases on the Origination Clause, and Origination Clause challenges have met with little success. Most of these cases have developed over the questions of whether the bill is actually a revenue-raising bill that is constitutionally required to be originate in the House, and, if so, whether the Senate amendments were appropriate. But United States Term Limits v. Thornton provides another angle under which to examine the constitutionality of the ACA: an indirect violation of a constitutional prohibition. In this Article, I will provide an overview of the ACA's passage and analyze it through the lenses of traditional Origination Clause arguments and the Term Limits approach.

The planned reform of the regulation of clinical trials in Spain has reopened the debate over how to regulate research-related injuries. Act 29/2006 and Royal Decree 223/2004 regulate the insurance of research-related injuries, and they include a general clause requiring mandatory insurance and imposing a no-fault compensation system; they also contain an exception clause enabling clinical trials to be carried out without insurance under some conditions, and an exclusion clause excluding compensation when there is no causal connection between injuries and a clinical trial. National legislation is under review, affecting the requirement of mandatory insurance and paving the road to a liability system based on negligence, which will affect the level of protection of the persons enrolled in clinical trials because it would not ensure compensation. Regulatory texts on individuals' participation as research subjects should include not only mandatory insurance, but also a no-fault compensation system for cases when voluntary research subjects are injured, irrespective of negligence.

Court Decision: 379 Federal Reporter, 3d Series 531; 2004 Jun 18 (date of decision). The U.S. Court of Appeals for the Ninth Circuit reversed in part a lower court decision and held that an Arizona law requiring licensing and regulation of any medical facility performing five or more first trimester abortions per month, or any second or third trimester abortions, did not violate the equal protection clause, and that it violated the Fourth Amendment and the plaintiff's right to informational privacy and was, in part, unconstitutionally vague. The appellate court held that the Arizona law did not violate the equal protection right of doctors who perform abortions because the law was related to health and safety issues, and there was no evidence of a stigmatizing or animus-based purpose to the law. Similarly, the law did not violate the equal protection right of doctors who provide more, rather than fewer, abortions because the state's rationale for the law (that the requirements would unduly burden smaller practices) was legitimate and was not absurd or irrational. The law did not violate the equal protection right of women seeking abortions because the state interest justifying the regulation was maternal health and the plaintiffs failed to show an invidious purpose behind the law. The court held that the law's provision allowing warrantless searches of regulated clinics violated the Fourth Amendment because abortion clinics are not a closely regulated industry. The court also held that two of the law's provisions violated the right of informational privacy. First, the law allowed health department employees access to patient records even though there was tremendous potential for harm, there were inadequate safeguards to prevent unauthorized disclosure, the goals of the information release could be met without releasing identifying patient information, and the public interest was not promoted. The law also allowed release of ultrasound prints containing patient information and did not provide safeguards to protect private patient information despite the potential for harm. The court did not find a provision requiring incident reports to the medical licensing board following death or serious injury to violate the right of informational privacy because the type of information requested was narrowly tailored, the information was only required in limited circumstances, the potential for harm was minimized by existing statutory safeguards, and there was a strong state interest in having professional physician licensing boards monitor serious incidences. The court held that the law's provision requiring patients "be treated with consideration, respect and full recognition of the patient's dignity and individuality" was unconstitutionally vague because the meanings of "consideration," "respect," "dignity," and "individuality" were widely variable and the words were not medical terms. As such, the provision was too vague and subjective for providers to know how they should act and did not limit arbitrary enforcement. Finally, the court held that a provision requiring a hospital-admitted physician be on-site was constitutional because it did not violate procedural or substantive due process. The court remanded the case for determination of whether the law unduly burdened a woman's right to an abortion.

Proposals to reduce national expenditures for health care under Medicare and other programs raise questions about the limits on legislative power to distribute health care benefits. Recent decisions of the United States Supreme Court suggest that the Justices seek a newer, more flexible approach to reviewing claims of unequal protection. This Article examines the application of the equal protection guarantee to health-related claims. It argues that traditional equal protection analysis is too rigid and newer rationality review too imprecise to provide just eligibility determinations. The Article concludes that courts should subject claims of unequal protection in the health care context to heightened scrutiny, as health care plays a special role in assuring equality of opportunity.

This topical report consists of the two titled projects. Surface Acoustic Wave/Gas Chromatography (SAW/GC) provides a cost-effective system for collecting real-time field screening data for characterization of vapor streams contaminated with volatile organic compounds (VOCs). The Model 4100 can be used in a field screening mode to produce chromatograms in 10 seconds. This capability will allow a project manager to make immediate decisions and to avoid the long delays and high costs associated with analysis by off-site analytical laboratories. The Model 4100 is currently under evaluation by the California Environmental Protection Agency Technology Certification Program. Unconstitutionality of abortion laws affirmed.

A federal appeals court has affirmed lower court rulings that substantial portions of the Illinois' 1975 Abortion Act and 1977 Abortion Parental Consent Act are unconstitutional. The 7th Court adopted an April 12, 1978 district court opinion that invalidated several sections of the Illinois 1975 abortion statute, including parental and spousal consent requirements and provisions requiring that a woman be informed of the "physical competency" of the fetus at the time the abortion was to be performed. The appeals court specifically addressed the statute's provision making a liveborn fetus resulting from an abortion a ward of the state, unless the abortion was performed to save the woman's life. Regarding the 1977 Parental Consent Act, the 7th Circuit reaffirmed its August 1978 ruling that it is unconstitutional to require an unmarried minor to have the consent of both parents or, if they refused consent, a circuit court judge before undergoing an abortion. The appeals court also agreed with the lower court's November 2nd ruling that the Act's requirement of a 48-hour delay between the time the minor gives her consent and the performance of an abortion violated the equal protection clause of the 14th amendment.

The Supreme Court's recent decisions in United States v. Lopez and United States v. Morrison articulate a vision of federalism under which Congress's regulatory authority under the Commerce Clause is severely limited in favor of returning traditional areas of state concern, particularly criminal law enforcement, to local or state control. The Court's decisions in these cases coincide with ballot initiatives legalizing the medical use of marijuana garnering a majority of the vote in California, Arizona, Alaska, Colorado, Nevada, Oregon, Washington, Maine, and Washington D.C. Those who use marijuana for medical purposes under sanction of state law, however, still face the threat of federal prosecution under the Controlled Substances Act. Medical marijuana proponents have traditionally, and unsuccessfully, contested federal prosecution using individual rights arguments under theories of equal protection or substantive due process. This Comment argues that after Lopez and Morrison, the federal government's authority to regulate intrastate use of marijuana for medicinal purposes is not the foregone conclusion it once was. The author suggests that proponents of medical marijuana use should invoke the federalism arguments of Lopez and Morrison and argue for state legislative independence from the federal government on this issue.

The relationship between government and the not-for-profit (NFP) sector has important implications for society, especially in relation to the delivery of public health measures and the protection of the environment. In key health-related areas such as provision of medical services, welfare, foreign aid and education, governments have traditionally preferred for the NFP sector to act as service partners, with the relationship mediated through grants or funding agreements. This service delivery arrangement is intended to provide a diversity of voices, and encourage volunteerism and altruism, in conjunction with the purposes and objectives of the relevant NGO. Under the pretence of "accountability", however, governments increasingly are seeking to impose intrusive conditions on grantees, which limit their ability to fulfil their mission and advocate on behalf of their constituents. This column examines the United States Supreme Court decision, Agency for International Development v Alliance for Open Society International Inc 570 US_(2013), and compares it to the removal of gag clauses in Australian federal funding rules. Recent national changes to the health-related NFP sector in Australia are then discussed, such as those found in the Charities Act 2013 (Cth) and the Not-for-Profit Sector Freedom to Advocate Act 2013 (Cth). These respectively include the establishment of the Australian Charities and Not-For-Profit Commission, the modernising of the definition of "charity" and statutory blocks on "gag" clauses. This analysis concludes with a survey of recent moves by Australian States to impose new restrictions on the ability of health-related NFPs to lobby against harmful government policy Among the responses considered is the protection afforded by s 51l(xxiiiA) of the Australian Constitution. This constitutional guarantee appears to have been focused historically on preventing medical and dental practitioners and related small businesses being practically coerced into government or large-scale private corporate operations. As such, it may prohibit civil conscription arising not only from "gag clauses" in managed care contracts, but also from "gag clauses" in governmental ideological controls over taxpayer-funded, health-related NFPs.

Since 1976, the United States has seen over 1,400 judicial executions, and these have been highly concentrated in only a few states and counties. The number of executions across counties appears to fit a stretched distribution. These distributions are typically reflective of self-reinforcing processes where the probability of observing an event increases for each previous event. To examine these processes, we employ two-pronged empirical strategy. First, we utilize bootstrapped Kolmogorov-Smirnov tests to determine whether the pattern of executions reflect a stretched distribution, and confirm that they do. Second, we test for event-dependence using the Conditional Frailty Model. Our tests estimate the monthly hazard of an execution in a given county, accounting for the number of previous executions, homicides, poverty, and population demographics. Controlling for other factors, we find that the number of prior executions in a county increases the probability of the next execution and accelerates its timing. Once a jurisdiction goes down a given path, the path becomes self-reinforcing, causing the counties to separate out into those never executing (the vast majority of counties) and those which use the punishment frequently. This finding is of great legal and normative concern, and ultimately, may not be consistent with the equal protection clause of the U.S. Constitution. PMID:29293583

Regardless of the corrosivity of the environment, all metals require periodic maintenance activity to guard against the insidious effects of corrosion and thus ensure that alloys meet or exceed design or performance life. The standard practice for protecting metallic substrates is the application of a coating system. Applied coating systems work via a variety of methods (barrier, galvanic, and/or inhibitor) and adhere to the substrate through a combination of chemical and physical bonds. For years hexavalent chromium has been a widely used element within applied coating systems because of its self healing and corrosion resistant properties. Occupational Safety and Health Administration (OSHA) studies have concluded that hexavalent chromium (hex chrome) is carcinogenic and poses significant risk to human health. On May 5, 2011 amendments to the Defense Federal Acquisition Regulation Supplement (DFARS) were issued in the Federal Register. Subpart 223.73 prohibits contracts from requiring hexavalent chromium in deliverables unless certain exceptions apply. These exceptions include authorization from a general or flag officer and members of the Senior Executive Service from a Program Executive Office, and unmodified legacy systems. Otherwise, Subpart 252.223-7008 provides the contract clause prohibiting contractors from using or delivering hexavalent chromium in a concentration greater than 0.1 percent by weight for all new contracts and to be included down to subcontractors for supplies, maintenance and repair services, and construction materials. National Aeronautics and Space Administration (NASA), Department of Defense (DoD), and industry stakeholders continue to search for alternatives to hex chrome in coatings applications that meet their performance requirements in corrosion protection, cost, operability, and health and safety, while typically specifying that performance must be equal to or greater than existing systems.

Integral to the commercialization process for nanotechnology enabled products is the methodology for protecting workers potentially exposed to nanomaterials during product development. Occupational health surveillance is a key aspect of protecting employees and involves both hazard identification and surveillance of known medical data. However, when the health effects and exposure pathways of both new and existing "nano-scale" chemical substances are not yet well understood, conservative hazard controls and baseline data collection can facilitate both immediate and long-term worker protection. Luna Innovations uses a conservative approach based on risk assessment and the OSHA General Duty Clause. To date, Luna's approach has been effective for our business model. Understanding and managing potential hazards to our nanotechnology workers is key to the success and acceptance of nanotechnology enabled products.
