Community Water Systems (CWSs) are required to remove uranium from drinking water to meet EPA standards. Similarly, mining operations are required to remove uranium from their dewatering discharges to meet permitted surface water discharge limits. Ion exchange (IX) is the primary treatment strategy used by these operations, which loads uranium onto resin beads. Presently, uranium-loaded resin from CWSs and mining operations can be disposed as a waste product or processed by NRC- or Agreement State-licensed uranium recovery facilities if that licensed facility has applied for and received permission to process 'alternate feed'. The disposal of uranium-loaded resin is costly andmore » the cost to amend a uranium recovery license to accept alternate feed can be a strong disincentive to commercial uranium recovery facilities. In response to this issue, the NRC issued a Regulatory Issue Summary (RIS) to clarify the agency's policy that uranium-loaded resin from CWSs and mining operations can be processed by NRC- or Agreement State-licensed uranium recovery facilities without the need for an alternate feed license amendment when these resins are essentially the same, chemically and physically, to resins that licensed uranium recovery facilities currently use (i.e., equivalent feed). NRC staff is clarifying its current alternate feed policy to declare IX resins as equivalent feed. This clarification is necessary to alleviate a regulatory and financial burden on facilities that filter uranium using IX resin, such as CWSs and mine dewatering operations. Disposing of those resins in a licensed facility could be 40 to 50 percent of the total operations and maintenance (O and M) cost for a CWS. Allowing uranium recovery facilities to treat these resins without requiring a license amendment lowers O and M costs and captures a valuable natural resource. (authors)« less

To evaluate the effects of physician ownership of freestanding physical therapy and rehabilitation facilities on utilization, charges, profits, and three measures of service characteristics for physical therapy treatments. Statistical comparison by physician joint venture ownership status of freestanding physical therapy and comprehensive rehabilitation facilities providing physical therapy treatments in Florida. A total of 118 outpatient physical therapy facilities and 63 outpatient comprehensive rehabilitation facilities providing services in Florida during 1989. The data from the facilities were collected under a legislative mandate. Visits per patient, average revenue per patient, percent operating income, percent markup, profits per patient, licensed therapist time per visit, and licensed and nonlicensed medical worker time per visit. Visits per patient were 39% to 45% higher in joint venture facilities. Both gross and net revenue per patient were 30% to 40% higher in facilities owned by referring physicians. Percent operating income and percent markup were significantly higher in joint venture physical therapy and rehabilitation facilities. Licensed physical therapists and licensed therapist assistants employed in non-joint venture facilities spend about 60% more time per visit treating physical therapy patients than licensed therapists and licensed therapist assistants working in joint venture facilities. Joint ventures also generate more of their revenues from patients with well-paying insurance. Our results indicate that utilization, charges per patient, and profits are higher when physical therapy and rehabilitation facilities are owned by referring physicians. With respect to service characteristics, joint venture firms employ proportionately fewer licensed therapists and licensed therapist assistants to perform physical therapy, so that licensed professionals employed in joint venture businesses spend significantly less time per visit treating patients. These results should be of interest to the medical profession, third-party payers, and policymakers, all of whom are concerned about the consequences of physician self-referral arrangements.

Health and Safety Management for Small-scale Methane Fermentation Facilities

In this study, we considered health and safety management for small-scale methane fermentation facilities that treat 2-5 ton of biomass daily based on several years operation experience with an approximate capacity of 5 t·d-1. We also took account of existing knowledge, related laws and regulations. There are no qualifications or licenses required for management and operation of small-scale methane fermentation facilities, even though rural sewerage facilities with a relative similar function are required to obtain a legitimate license. Therefore, there are wide variations in health and safety consciousness of the operators of small-scale methane fermentation facilities. The industrial safety and health laws are not applied to the operation of small-scale methane fermentation facilities. However, in order to safely operate a small-scale methane fermentation facility, the occupational safety and health management system that the law recommends should be applied. The aims of this paper are to clarify the risk factors in small-scale methane fermentation facilities and encourage planning, design and operation of facilities based on health and safety management.

For usage of radioactive substances, any facility has to register and take license from relevant authority of the country in which such facility is operating. In the Kingdom of Saudi Arabia (KSA), the authority for managing radioactive sources and providing licenses to organizations for its usage is the National Center of Radiation Protection (NCRP). This paper describes the system that automates registration and licensing process of the National Center of Radiation Protection. To provide 24×7 accesses to all the customers of NCRP, system is developed as web-based application that provide facility to online register, request license, renew license, check request status, view historical data and reports etc. and other features are provided as Electronic Services that would be accessible to users via internet. The system also was designed to streamline and optimize internal operations of NCRP besides providing ease of access to its customers by implementing a defined workflow through which every registration and license request will be routed. In addition to manual payment option, the system would also be integrated with SADAD (online payment system) that will avoid lengthy and cumbersome procedures associated with manual payment mechanism. Using SADAD payment option license fee could be paid through internet/ATM machine or branch of any designated bank, Payment will be instantly notified to NCRP hence delay in funds transfer and verification of invoice could be avoided, SADAD integration is discussed later in the document.

The Low-Level Radioactive Waste Policy Amendments Act of 1985 (LLRWPAA) assigned States the responsibility to provide for disposal of commercial low-level radioactive waste (LLRW) by 1993. The LLRWPAA also required the US Nuclear Regulatory Commission (NRC) to establish procedures and develop the technical review capability to process license applications for new LLRW disposal facilities. Under the LLRWPAA, NRC is required, to the extent practicable, to complete its review of an LLRW disposal facility license application within 15 months of its submittal by a State. This provision of the LLRWPAA helps ensure that NRC, in addition to protecting public health andmore » safety and the environment, facilitates States` achievement of LLRWPAA milestones for new facility development. A timely NRC review is needed for States to accomplish their objective of having new disposal facilities in operation on the dates prescribed in the LLRWPAA. To help assure NRC and States` compliance with the provisions of the LLRWPAA, NRC has developed a licensing review strategy that includes: (1) the further development of regulatory guidance, (2) enhancement of licensing review capability, and (3) prelicensing regulatory consultation with potential applicants.« less

Volume 1 contains the assessment of the potential environmental impacts for licensing the construction and operation of a proposed gaseous centrifuge enrichment facility to be built in Claiborne Parish, Louisiana, by Louisiana Energy Services, LP. Most women in Ghana obtain oral contraceptives and condoms from shops run by licensed chemical sellers, but such shops are not legally permitted to sell the country's most widely used method, the injectable. Allowing shops to sell the injectable could increase access to and use of the method. In 2012-2013, semistructured telephone interviews were conducted among convenience samples of 94 licensed chemical seller shop operators in two districts who were trained to sell the injectable and of 298 women who purchased the method from these shops. Follow-up interviews were conducted with 92 clients approximately three months after their initial injectable purchase. Ninety-seven percent of shop operators reported selling the injectable, and 94% felt sufficiently trained to provide family planning methods and services. Virtually all sellers (99%) referred clients to a hospital or health facility for injection; none provided injections themselves. Fifty-six percent of injectable clients were new family planning users. Of those who completed a follow-up interview, 79% had purchased the injectable again from a shop. Virtually all clients (97%) reported getting their injection at the health facility to which they were referred by the seller. Women cited trust, convenience and commodities being in stock as key reasons for purchasing from a shop. Licensed chemical seller shop operators can safely sell the injectable and refer clients to health facilities for screening, counseling and injection.

Faced with the prospect of being unable to permanently dispose of low-level radioactive wastes (LLRW) generated from teaching, research, and patient care activities, component institutions of the University of Texas System worked collaboratively to create a dedicated interim storage facility to be used until a permanent disposal facility became available. Located in a remote section of West Texas, the University of Texas System Interim Storage Facility (UTSISF) was licensed and put into operation in 1993, and since then has provided safe and secure interim storage for up to 350 drums of dry solid LLRW at any given time. Interim storage capability provided needed relief to component institutions, whose on-site waste facilities could have possibly become overburdened. Experiences gained from the licensing and operation of the site are described, and as a new permanent LLRW disposal facility emerges in Texas, a potential new role for the storage facility as a surge capacity storage site in times of natural disasters and emergencies is also discussed.

The 60-megawatt test reactor, NASA’s only reactor, was the eighth largest test reactor in the world. The facility was built by the Lewis Research Center in the late 1950s to study the effects of radiation on different materials that could be used to construct nuclear propulsion systems for aircraft or rockets. The reactor went critical for the first time in 1961. For the next two years, two operators were on duty 24 hours per day working on the fission process until the reactor reached its full-power level in 1963. Reactor Operators were responsible for monitoring and controlling the reactor systems. Once the reactor was running under normal operating conditions, the work was relatively uneventful. Normally the reactor was kept at a designated power level within certain limits. Occasionally the operators had to increase the power for a certain test. The shift supervisor and several different people would get together and discuss the change before boosting the power. All operators were required to maintain a Reactor Operator License from the Atomic Energy Commission. The license included six months of training, an eight-hour written exam, a four-hour walkaround, and testing on the reactor controls.

The fuel cycle facility (FCF) at the Idaho National Laboratory is a nuclear facility which must be licensed in order to operate. A safety analysis is required for a license. This paper describes the analysis of the Design Basis Accident for this facility. This analysis involves a model of the transient behavior of the FCF inert atmosphere hot cell following an earthquake initiated breach of pipes passing through the cell boundary. The hot cell is used to process spent metallic nuclear fuel. Such breaches allow the introduction of air and subsequent burning of pyrophoric metals. The model predicts the pressure,more » temperature, volumetric releases, cell heat transfer, metal fuel combustion, heat generation rates, radiological releases and other quantities. The results show that releases from the cell are minimal and satisfactory for safety. The US Nuclear Regulatory Commission (NRC) has prepared this Environmental Assessment (EA) to evaluate environmental issues associated with the renewal of licenses issued by NRC for facilities operated by Nuclear Metals, Inc. (NMI) in Concord, Massachusetts. By renewing the licenses, NRC proposes to allow the continuation of ongoing operations involving radioactive materials at NMI`s facilities. This EA focuses on the potential impacts related to air emissions at NMI during normal (incident-free) operations and accidental releases. Findings indicate that there are only two areas of potential concern. First, modeling results for sulfur dioxide (SO{sub 2}) emissions from the boilers during normalmore » operations indicate that the potential exists for exceeding the short-term National Ambient Air Quality Standards (NAAQS). NMI is prepared to undertake mitigative action to prevent potential exceedances of the short-term SO{sub 2} NAAQS, and the Massachusetts Department of Environmental Protection is prepared to resolve the issue via a permit/approval change or through a Consent Order. Second, in the unlikely event of a severe fire, predicted sulfuric acid (H{sub 2}SO{sub 4}) concentrations based on conservative (upper bound) modeling exceed the Emergency Response Planning Guideline (ERPG) levels. TERN is Australia's Terrestrial Ecosystem Research Network (www.tern.org.au) is one of several environmental data collection, storage and sharing projects developed through the government's research infrastructure programs 2008-2014. This includes terrestrial and coastal ecosystem data collection infrastructure across multiple disciplines, hardware, software and processes used to store, analyse and integrate data sets. TERN's overall objective is to build the collaborations, infrastructure and programs to meet the needs of ecosystem science communities in Australia in the long term, through institutional frameworks necessary to establish a national terrestrial ecosystem site and observational network, coordinated networks enabling cooperation and operational experience; public access to quality assured and appropriately licensed data; and allowing the terrestrial ecosystem research community to define and sustain the terrestrial observing paradigm into the longer term. This paper explains how TERN was originally established, and now operates, along with plans to sustain itself in the future. TERN is implemented through discipline/technical groups referred to as "TERN Facilities". Combined, the facilities provide observations of surface mass and energy fluxes over key ecosystems, biophysical remote sensing data, ecological survey plots, soils information, and coastal ecosystems and associated water quality variables across Australia. Additional integrative facilities cover elements of ecoinformatics, data-scaling and modelling, and linking science to management. A central coordination and portal facility provides meta-data storage, data identification, legal and licensing support. Data access, uploading, meta-data generation, DOI attachment and licensing is completed at each facility's own portal level. TERN also acts as the open-data repository of choice for Australian scientists required to publish their data. Several key lessons we have learnt, will be presented during the talk.

The US Department of Energy (DOE) has proposed the construction and operation of the Advanced Neutron Source (ANS), a 330-MW(f) reactor, at Oak Ridge National Laboratory (ORNL) to support neutron scattering and nuclear physics experiments. ANS would provide a steady-state source of neutrons that are thermalized to produce sources of hot, cold, and very coal neutrons. The use of these neutrons in ANS experiment facilities would be an essential component of national research efforts in basic materials science. Additionally, ANS capabilities would include production of transplutonium isotopes, irradiation of potential fusion and fission reactor materials, activation analysis, and production ofmore » medical and industrial isotopes such as {sup 252}Cf. Although ANS would not require licensing by the US Nuclear Regulatory Commission (NRC), DOE regards the design, construction, and operation of ANS as activities that would produce a licensable facility; that is, DOE is following the regulatory guidelines that NRC would apply if NRC were licensing the facility. Those guidelines include instructions for the preparation of an environmental report (ER), a compilation of available data and preliminary analyses regarding the environmental impacts of nuclear facility construction and operation. The ER, described and outlined in NRC Regulatory Guide 4.2, serves as a background document to facilitate the preparation of environmental impact statements (EISs). Accordingly, the regulatory considerations that are set forth in the AdvSMR RTDP will not be limited to any one particular type or subset of advanced reactor technology(s) but rather broadly consider potential regulatory approaches and the licensing implications that accompany all DOE-sponsored research and technology development activity that deal with commercial non-light water reactors. However,more » it is also important to remember that certain “minimum” levels of design and safety approach knowledge concerning these technology(s) must be defined and available to an extent that supports appropriate pre-licensing regulatory analysis within the RTDP. Final resolution to advanced reactor licensing issues is most often predicated on the detailed design information and specific safety approach as documented in a facility license application and submitted for licensing review. Because the AdvSMR RTDP is focused on identifying and assessing the potential regulatory implications of DOE-sponsored reactor technology research very early in the pre-license application development phase, the information necessary to support a comprehensive regulatory analysis of a new reactor technology, and the resolution of resulting issues, will generally not be available. As such, the regulatory considerations documented in the RTDP should be considered an initial “first step” in the licensing process which will continue until a license is issued to build and operate the said nuclear facility. Because a facility license application relies heavily on the data and information generated by technology development studies, the anticipated regulatory importance of key DOE reactor research initiatives should be assessed early in the technology development process. Quality assurance requirements supportive of later licensing activities must also be attached to important research activities to ensure resulting data is usable in that context. Early regulatory analysis and licensing approach planning thus provides a significant benefit to the formulation of research plans and also enables the planning and development of a compatible AdvSMR licensing framework, should significant modification be required.« less

The complexity of space fission systems and rigidity of requirement on minimization of weight and dimension characteristics along with the wish to decrease expenditures on their development demand implementation of experimental works which results shall be used in designing, safety substantiation, and licensing procedures. Experimental facilities are intended to solve the following tasks: obtainment of benchmark data for computer code validations, substantiation of design solutions when computational efforts are too expensive, quality control in a production process, and ``iron'' substantiation of criticality safety design solutions for licensing and public relations. The NARCISS and ISKRA critical facilities and unique ORM facility on shielding investigations at the operating OR nuclear research reactor were created in the Kurchatov Institute to solve the mentioned tasks. The range of activities performed at these facilities within the implementation of the previous Russian nuclear power system programs is briefly described in the paper. This experience shall be analyzed in terms of methodological approach to development of future space nuclear systems (this analysis is beyond this paper). Because of the availability of these facilities for experiments, the brief description of their critical assemblies and characteristics is given in this paper.

This report documents the US Nuclear Regulatory Commission (NRC) staff review and safety evaluation of the Louisiana Energy Services, L.P. (LES, the applicant) application for a license to possess and use byproduct, source, and special nuclear material and to enrich natural uranium to a maximum of 5 percent U-235 by the gas centrifuge process. The plant, to be known as the Claiborne Enrichment Center (CEC), would be constructed near the town of Homer in Claiborne Parish, Louisiana. At full production in a given year, the plant will receive approximately 4,700 tonnes of feed UF{sub 6} and produce 870 tonnes ofmore » low-enriched UF{sub 6}, and 3,830 tonnes of depleted UF{sub 6} tails. Facility construction, operation, and decommissioning are expected to last 5, 30, and 7 years, respectively. The objective of the review is to evaluate the potential adverse impacts of operation of the facility on worker and public health and safety under both normal operating and accident conditions. The review also considers the management organization, administrative programs, and financial qualifications provided to assure safe design and operation of the facility. The NRC staff concludes that the applicant`s descriptions, specifications, and analyses provide an adequate basis for safety review of facility operations and that construction and operation of the facility does not pose an undue risk to public health and safety.« less

Four utilities were using operational canister-based dry storage facilities at year-end, and seven more have contracts to establish similar facilities. Consumers Power`s Palisades Nuclear Power Plant has successfully completed loading its eighth dry storage canister with the Ventilated Storage Cask (VSC) system, under license to Sierra Nuclear Corporation. The VSC has a Multi-Assembly Sealed Basket (MSB) containing 24 specially-selected and aged spent fuel assemblies. MSB closure occurs when two independent lids are welded at the utility. After nearly three decades of medical product sterilization, 3M launched a major new project to build and license an irradiator facility. 3M Corporate Health Physics was responsible for the licensing aspect of this project. The licensing process consisted of six amendments, over 30 submissions to the U.S. Nuclear Regulatory Commission (U.S. NRC) and four U.S. NRC site visits. It took approximately 22 months to complete. The six license amendments are reviewed and several of the submissions are discussed. These include 3M's response to the U.S. NRC's interest in the shielding calculations used for the bioshield, the development of a protocol of radiation safety system test methods, and an analysis to show that a dropped cask during loading operations would not fall on sealed sources. A number of lessons were learned during the course of licensing the new irradiator. Among these were the importance of understanding the U.S. NRC license reviewer's perspective, the need to thoroughly review the irradiator manufacturer's licensing package during project negotiations, the benefits of leaving the Health Physics Office and meeting with the non-health physicists involved in the project, and the necessity of maintaining the solid relationships that already existed with the site Radiation Safety Officer and Sterilization Engineer.

The objective of the ''Waste Handling Building Conceptual Study'' is to develop proposed design requirements for the repository Waste Handling System in sufficient detail to allow the surface facility design to proceed to the License Application effort if the proposed requirements are approved by DOE. Plum Brook Reactor Facility Control Room during Facility Startup

Operators test the National Aeronautics and Space Administration’s (NASA) Plum Brook Reactor Facility systems in the months leading up to its actual operation. The “Reactor On” signs are illuminated but the reactor core was not yet ready for chain reactions. Just a couple weeks after this photograph, Plum Brook Station held a media open house to unveil the 60-megawatt test reactor near Sandusky, Ohio. More than 60 members of the print media and radio and television news services met at the site to talk with community leaders and representatives from NASA and Atomic Energy Commission. The Plum Brook reactor went critical for the first time on the evening of June 14, 1961. It was not until April 1963 that the reactor reached its full potential of 60 megawatts. The reactor control room, located on the second floor of the facility, was run by licensed operators. The operators manually operated the shim rods which adjusted the chain reaction in the reactor core. The regulating rods could partially or completely shut down the reactor. The control room also housed remote area monitoring panels and other monitoring equipment that allowed operators to monitor radiation sensors located throughout the facility and to scram the reactor instantly if necessary. The color of the indicator lights corresponded with the elevation of the detectors in the various buildings. The reactor could also shut itself down automatically if the monitors detected any sudden irregularities.

The Next Generation Nuclear Plant (NGNP) Project, initiated at Idaho National Laboratory (INL) by the U.S. Department of Energy (DOE) pursuant to provisions of the Energy Policy Act of 2005, is based on research and development activities supported by the Department of Energy Generation IV Nuclear Energy Systems Initiative. The principal objective of the NGNP Project is to support commercialization of high temperature gas-cooled reactor (HTGR) technology. The HTGR is a helium-cooled and graphite moderated reactor that can operate at temperatures much higher than those of conventional light water reactor (LWR) technologies. This paper puts in place a risk-cost-benefit analysis for waste management facilities that explicitly recognizes the adversarial relationship that exists in a regulated market economy between the owner/operator of a waste management facility and the government regulatory agency under whose terms the facility must be licensed. The risk-cost-benefit analysis is set up from the perspective of the owner/operator. It can be used directly by the owner/operator to assess alternative design strategies. It can also be used by the regulatory agency to assess alternative regulatory policy, but only in an indirect manner, by examining the response of an owner/operator to the stimuli of various policies. The objective function is couched in terms of a discounted stream of benefits, costs, and risks over an engineering time horizon. Benefits are in the form of revenues for services provided; costs are those of construction and operation of the facility. Risk is defined as the cost associated with the probability of failure, with failure defined as the occurrence of a groundwater contamination event that violates the licensing requirements established for the facility. Failure requires a breach of the containment structure and contaminant migration through the hydrogeological environment to a compliance surface. The probability of failure can be estimated on the basis of reliability theory for the breach of containment and with a Monte-Carlo finite-element simulation for the advective contaminant transport. In the hydrogeological environment the hydraulic conductivity values are defined stochastically. The probability of failure is reduced by the presence of a monitoring network operated by the owner/operator and located between the source and the regulatory compliance surface. The level of reduction in the probability of failure depends on the probability of detection of the monitoring network, which can be calculated from the stochastic contaminant transport simulations. While the framework is quite general, the development in this paper is specifically suited for a landfill in which the primary design feature is one or more synthetic liners in parallel. Contamination is brought about by the release of a single, inorganic nonradioactive species into a saturated, high-permeability, advective, steady state horizontal flow system which can be analyzed with a two-dimensional analysis. It is possible to carry out sensitivity analyses for a wide variety of influences on this system, including landfill size, liner design, hydrogeological parameters, amount of exploration, extent of monitoring network, nature of remedial schemes, economic factors, and regulatory policy.

This presentation focuses on linking climate knowledge to the complicated decision process for hydropower dam licensing, and the affected parties involved in that process. The U.S. Federal Energy Regulatory Commission issues of licenses for nonfederal hydroelectric operations, typically 30-50 year licenses, and longer infrastructure lifespan, a similar time frame as the anticipated risks of changing climate and hydrology. Resources managed by other federal and state agencies such as the NOAA National Marine Fisheries Service may be affected by new or re-licensed projects. The federal Integrated Licensing Process gives the opportunity for affected parties to recommend issues for consultative investigation and possible mitigation, such as impacts to downstream fisheries. New or re-licensed projects have the potential to "pre-adapt" by considering and incorporating risks of climate change into their planned operations as license terms and conditions. Hundreds of hydropower facilities will be up for relicensing in the coming years (over 100 in the western Sierra Nevada alone, and large-scale water projects such as the proposed Lake Powell Pipeline), as well as proposed new dams such as the Susitna project in Alaska. Therefore, there is a need for comprehensive guidance on delivering climate analysis to support understanding of risks of hydropower projects to other affected resources, and decisions on licensing. While each project will have a specific context, many of the questions will be similar. We also will discuss best practices for the use of climate science in water project planning and management, and how creating the best and most appropriate science is also still a developing art. We will discuss the potential reliability of that science for consideration in long term planning, licensing, and mitigation planning for those projects. For science to be "actionable," that science must be understood and accepted by the potential users. This process is a negotiation, with climate scientists needing to understand the concerns of users and respond, and users developing a better understanding of the state of climate science in order to make an informed choice. We will also discuss what is needed to streamline providing that analysis for the many re-licensing decisions expected in the upcoming years.

The State of South Carolina was delegated the authority by the US Nuclear Regulatory Commission to regulate the receipt, possession, use and disposal of radioactive material as an Agreement State. Since 1970, the state has been the principal regulatory authority for the Barnwell Low-Level Waste Disposal Facility operated by Chem-Nuclear Systems, Inc. The radioactive material license issued authorizing the receipt and disposal of low-level waste contains numerous restrictions to ensure environmental protection and compliance with shallow land disposal performance criteria. Low-level waste has evolved from minimally contaminated items to complex waste streams containing high concentrations of radionuclides and processing chemicalsmore » which necessitated these restrictions. Additionally, some waste with their specific radionuclides and concentration levels, many classified as low-level radioactive waste, are not appropriate for shallow land disposal unless additional precautions are taken. The California Department of Health Services will soon reach a licensing decision on the proposed Ward Valley low-level radioactive waste disposal facility. As the first regulatory agency in the country to address the 10 CFR Part 61 requirements for a new disposal facility, California`s program has broken new ground in its approach. Throughout the review process, the Department has relied on contractor support to augment its technical and administrative staff. A team consisting of Roy F. Weston, Inc., supported by ERM-Program Management Corp., Environmental Issues Management, Inc., and Rogers and Associates Engineering Corporation, has worked closely with the Department inmore » a staff extension role. The authors have been involved with the project in contractor project management roles since 1987, and continue to support the Department`s program as it proceeds to finalize its licensing process. This paper describes the selection process used to identify a contractor team with the needed skills and experience, and the makeup of team capabilities. It outlines the management, communication, and technical approaches used to assure a smooth agency-contractor function and relationship. It describes the techniques used to ensure that decisions and documents represented the Department credibly in its role as the regulatory and licensing agency under the Nuclear Regulatory Commission (NRC) Agreement State program. The paper outlines the license application review process and activities, through preparation of licensing documentation and responses to public comments. The plaintiffs, physicians and women seeking abortions, challenged licensing regulations imposed by the state of Illinois on abortion clinics. The Court found the following requirements to place unconstitutional burdens on a woman's right to obtain an abortion: 1) that separate licenses be obtained for facilities devoted primarily to performing first trimester abortions; 2) that a physician who was to perform an abortion also perform a pregnancy test, even if such a test had already been performed by another physician; 3) that persons undergoing abortions be given counseling which includes a discussion of alternatives, a description of procedures, and an explanation of risks and possible complications; 4) that physicians providing preabortion counseling not be involved financially in the woman's decision; 5) that facilities performing abortions comply with the physical plant and staffing provisions of the Illinois Ambulatory Surgery Treatment Center Act; and 6) "certificate of need" proceeding requirements of the Health Facilities Planning Act. In 1988, other US Courts reached the following decisions with respect to the licensing of abortion clinics: 1) a building inspector had violated the right of privacy of women to obtain abortions by classing an outpatient abortion clinic as a hospital, thereby forcing it to obtain a special-use permit to operate in the zone where it was to be sited (P.L.S. The NRC regulates the civilian use of radioactive materials and facilities in an open and transparent manner. The NRC regulatory criteria are designed to protect human health and safety, and the environment by regulating nuclear facilities. During review of new reactor licensing applications, NRC staff reviews and independently verifies hydrogeologic information submitted by the applicant in several topical areas such as development and testing of Conceptual Site Models (CSM) which may involve perched aquifers; engineered water level fluctuations of surface-water reservoirs; ground-water collector wells and local ground-water uses; design-basis ground-water levels for structural analysis; analysis of scenarios for potential release of radionuclides to the subsurface; deep well injection of effluents; and monitoring to detect radionuclide releases. This information is reviewed in a systematic manner in accordance with NRC requirements and guidance to evaluate safety and environmental impacts and reduce the uncertainties for these impacts. NRC licensing staff is reviewing 14 applications for siting new reactors. Experience gained through these licensing activities has shown the value of using site-specific data to evaluate the CSM and its use to assess design and operational issues. Optimizing the information flow process through a systemically and thorough review process creates efficiencies. Through an iterative process of evaluating various geographical settings and associated ground-water conditions, NRC staff has developed methods to minimize prediction uncertainty through the use of confirmatory analyses performed under conservative, hierarchal approaches.

Residential care facilities operating without a state license are known to house vulnerable adults. Such unlicensed care homes (UCHs) commonly operate illegally, making them difficult to investigate. We conducted an exploratory, multimethod qualitative study of UCHs, including 18 subject matter expert interviews and site visits to three states, including a total of 30 stakeholder interviews, to understand UCH operations, services provided, and residents served. Findings indicate that various vulnerable groups reside in UCHs; some UCHs offer unsafe living environments; and some residents are reportedly abused, neglected, and financially exploited. Regulations, policies and practices that might influence UCH prevalence are discussed.
