Academic, state, and federal agencies collaborated over the last 9 years to improve disaster mental health services and evaluation. This process, which included literature reviews, a number of expert panels, and case studies, is described. The products resulting from this process have included the development of a systematic cross-site evaluation of the federally funded crisis counseling program and field guides for interventions aimed at providing services to distressed individuals in the immediate aftermath of disasters and to individuals needing resilience skills training weeks or months after the event. Future improvement of disaster mental health services calls for continued research, evaluation, training, and intervention development.

This dynamic policy context represents a substantial challenge for policy evaluation. Part I of this article provides a summary of state-level cannabis policy components across states and federal action regarding state-level policies. Part II presents a detailed history of cannabis policies in Washington State from 1998 to 2015 and analyzes the potential impacts of the policy changes on cannabis supply and demand. As an early adopter of both medical and nonmedical cannabis policies, Washington State provides an excellent example of the key elements to be considered in evaluating the relationship between policy changes and cannabis use. We highlight the importance of the interplay of federal enforcement priorities and previously adopted state-level cannabis regimes in interpreting the potential impacts of new cannabis policies.

We sought to evaluate the relationship between state-level implementation of the Patient Protection and Affordable Care Act (ACA) and resettlement patterns among refugees. We linked federal refugee resettlement data to ACA expansion data and found that refugee resettlement rates are not significantly different according to state-level insurance expansion or cost. Forty percent of refugees have resettled to states without Medicaid expansion. The wide state-level variability in implementation of the ACA should be considered by federal agencies seeking to optimize access to health insurance coverage among refugees who have resettled to the United States.

This article educates healthcare practitioners on the legal framework prohibiting abusive practices in urine drug testing (UDT) in medical settings, discusses several profit-driven UDT schemes that have resulted in enforcement actions, and provides recommendations for best practices in UDT to comply with state and federal fraud and anti-kickback statutes. The authors carefully reviewed and analyzed statutes, regulations, adivsory opinions, case law, court documents, articles from legal journals, and news articles. Certain facts-driven UDT arrangements tend to violate federal and state healthcare laws and regulations, including Stark law, the anti-kickback statute, the criminal health care fraud statute, and the False Claims Act. Healthcare practitioners who use UDT can help ensure that they are in compliance with applicable federal and state laws by evaluating whether their actions are motivated by providing proper care to their patients rather than by profits. They must avoid schemes that violate the spirit of the law while appearing to comply with the letter of the law. Such a simple self-evaluation of motive can reduce a practitioner's likelihood of civil fines and criminal liability.

The U.S. Geological Survey Federal-State Cooperative Water Resources Program is a partnership between the Geological Survey and State and local agencies for the collection of the hydrologic information needed for the continuing determination and evaluation of the quantity, quality, and use of the Nation 's water resources. The Cooperative Program has served the Nation for more than 80 years, and in 1981 more than 800 State and local agencies have cooperative programs with the Geological Survey with total funding over $80 million. The process of project selection in the Cooperative Water Resources Program is a mutual effort in which Geological Survey represents national interests, including the needs of other Federal agencies, and the cooperator represents State and local interests. The result is a balanced program that involves careful evaluation of needs, priorities, and resources. The cost sharing ratio of 50-50 is examined and determined to be the best ratio to effectively assess the Nation 's water resources. The Cooperative Program is and has been relevant to the problems of the day. Much of the current technology in ground-water management, ground-water quality, and flood-plain management--to name a few--was developed as part of the Cooperative Program. (USGS)

Furthermore, there are also special legal regulations for hospitals in almost every federal state which are governed by the principle of subsidiarity: special legal regulations are to be preferentially used, so that findings from one federal state are difficult to transfer to another federal state.Patient data may only be used and processed without legal regulations with informed consent of the patient. The use of patient data for purposes of quality assurance, research and further education of students and doctors is possible under the present laws according to a positive weighting of interests. Patient data can also be exchanged via online services for the purposes of patient care; however, informed consent of the patient for medical online services is almost always unavoidable.
Evaluating improvements in nursing staff at a state psychiatric hospital.

In response to federal intervention in 1990, Hawaii initiated a number of changes at the state's psychiatric hospital. The process of change that was undertaken by the hospital's department of nursing from 1990 through 1994 to meet federal mandates was described in an earlier article in this journal. The present study evaluated the degree to which court-ordered improvements in nursing staff at the hospital were actually achieved between 1995 and 1997. Seven quantitative measures of compliance with federal mandates were evaluated, based on the court orders. Significant improvements were found on six of the seven measures during the 30-month study period. These included increases in nursing staff as measured by (1) the number of staff and (2) full-time equivalents, as well as increases in (3) the hours of nursing care per patient, (4) the number of staff per patient on each shift, and (5) the percent of RNs per shift. Use of agency personnel decreased significantly, as ordered, but overtime use increased significantly, contrary to court orders.

Salem 98 was the largest nuclear power plant post-plume phase exercise since the 1993 FRMAC-93 exercise at the Fort Calhoun Nuclear Power Plant in Nebraska. Salem 98 was a 3 Day exercise, held on May 5--7, 1998, involving participation by the States of New Jersey and Delaware and associated State and county agencies. Public Service Electric and Gas was the host utility and Salem County the host county. Federal participation included the Nuclear Regulatory Commission, Federal Emergency Management Agency, Department of Energy, Environmental Protection Agency, US department of Agriculture and Department of Health and Human Services. In addition, the Americanmore » Nuclear Insurers participated, adding a dimension to the exercise not experienced often enough. Following the June 2012 Supreme Court ruling that states are no longer mandated to expand their Medicaid programs in 2014 as part of the Affordable Care Act, many states plan to opt out of the expansion, citing affordability as their primary concern. In response to this controversy, the present study evaluated the cost savings of expanding Medicaid coverage to include currently ineligible homeless adults with substance use disorders, a subset of the population that incurs some of the greatest societal costs and is disproportionately impacted by uninsurance. Using a time horizon of 7 years, separate analyses were conducted for state and federal governments, and then a final analysis evaluated the combined costs for the other two models. Results of the study demonstrate that, although the expansion will be associated with a net cost when combining state and federal expenses and savings, states will experience tremendous savings if they choose to participate.

We analyzed international, federal, and state policies—principally based on the policy documents themselves and media reports—to evaluate policy variability. We employed means-ends fit analysis to elucidate policy objectives. We found substantial variation in the specific approaches favored by WHO, CDC, and various American states. Several US states impose compulsory quarantine on a broader range of travelers or require more extensive monitoring than recommended by CDC or WHO. Observed differences likely partially resulted from different actors having different policy goals—particularly the federal government having to balance foreign policy objectives less salient to states. Further, some state-level variation appears to be motivated by short-term political goals. We propose recommendations to improve future policies, which include the following: (1) actors should explicitly clarify their objectives, (2) legal authority should be modernized and clarified, and (3) the federal government should consider preempting state approaches that imperil its goals. This study analyzes the sustainability of Brazil's National Policy for the Evaluation of Primary Health Care, based on the identification and categorization of representative critical events in the institutionalization process. This was an evaluative study of two analytical units: Federal Management of Primary Health Care and State Health Secretariats, using multiple case studies with data collected through interviews and institutional documents, using the critical incidents technique. Events that were temporally classified as specific to implementation, sustainability, and mixed were categorized analytically as pertaining to memory, adaptation, values, and rules. Federal management and one of the State Health Secretariats showed medium-level sustainability, while the other State Secretariat showed strong sustainability. The results indicate that the events were concurrent and suggest a weighting process, since the adaptation of activities, adequacy, and stabilization of resources displayed a strong influence on the others. Innovations and the development of technical capability are considered the most important results for sustainability.

The use of NASA high altitude aerial photography of south eastern Arizona to develop a natural resources information system for Federal lands is discussed. The data are to be used by local, State, and Federal agencies in connection with geologic mapping projects, water resources investigations, and land use studies to determine the alignment of a proposed major aqueduct. In addition, the data are used to confirm land ownership boundaries, detect changes in land use, and legislative reappointment mapping. Other applications include mapping vegetive cover, evaluation of changes in wildlife habitat, location of deer kills, and as a base for recording telemetry data from radio-collared big game animals.

Safe injection facilities (SIFs) have shown promise in reducing harms and social costs associated with injection drug use. Favorable evaluations elsewhere have raised the issue of their implementation in the United States. Recognizing that laws shape health interventions targeting drug users, we analyzed the legal environment for publicly authorized SIFs in the United States. Although states and some municipalities have the power to authorize SIFs under state law, federal authorities could still interfere with these facilities under the Controlled Substances Act. A state- or locally-authorized SIF could proceed free of legal uncertainty only if federal authorities explicitly authorized it or decided not to interfere. Given legal uncertainty, and the similar experience with syringe exchange programs, we recommend a process of sustained health research, strategic advocacy, and political deliberation.

Due to an increasing trend among states to cut higher education funds, many universities are relying more on private donations and federal funding to keep programs afloat. Scholarship productivity in general has become an integral factor in terms of universities granting tenure to faculty, allocating resources, and supporting program goals due to the fact that more research in a particular area tends to increase the likelihood that one will obtain funding from federal, state, and private sources. In the past, ranking systems have also been used to evaluate programs. However, most ranking systems use methodologies that do not quantify research productivity or evaluate factors that match current university trends. The purpose of this article is to explore current scholarship productivity trends among COAMFTE-accredited doctoral programs through the use of several evaluation methods. Specifically, productivity was examined in regard to the following areas: (a) family therapy journal publications; (b) family science journal publications; (c) historic journal publication trends; and (d) recent journal publication trends.

Also, we focus on the economic impact of implementing Colorado's existing Renewable Portfolio Standard, updated in 2013. This requires that 25% of state generation come from qualifying renewable sources by 2020. We evaluate the policy under a variety of assumptions regarding wind integration costs and assumptions on the persistence of federal subsidies for wind. Specifically, we estimate the implied price of carbon as the carbon price at which a state-levelmore » policy would pass a state-level cost-benefit analysis, taking account of estimated greenhouse gas emission reductions and ancillary benefits from corresponding reductions in criteria pollutants. Drug use remains a prominent aspect of the American environment. Consequently, this analysis was undertaken to examine the current as well as the projected role of the federal government in drug abuse. Based on an examination of federal expenditures between the years of 1976 and 1980, the intelligence, corrections, interdictions, federal prosecutions, and compliance categories have increased their proportions of the budget, but not enough to compensate for inflation. Based on the foregoing, there is a continuing desire for states to increase their operational responsibilities; however, a well-structured mechanism for evaluation in law enforcement efforts is lacking. The results of an evaluation of NASA's Applications Pilot Test (APT) and Applications System Verification and Transfer (AVST) Programs are presented. These programs sponsor cooperative projects between NASA and potential users of remote sensing (primarily LANDSAT) technology from federal and state government and the private sector. Fifteen specific projects, seven APT's and eight ASVT's, are examined as mechanisms for technology development, test, and transfer by comparing their results against stated objectives. Interviews with project managers from NASA field centers and user agency representatives provide the basis for project evaluation from NASA and user perspectives.

Higher prices, higher quality? Evidence from German nursing homes.

This study investigates the relationship between prices and quality of 7400 German nursing homes. We use a cross section of public quality reports for all German nursing homes, which had been evaluated between 2010 and 2013 by external institutions. Our analysis is based on multivariate regressions in a two stage least squares framework, where we instrument prices to explain their effect on quality controlling for income, nursing home density, demographics, labour market characteristics, and infrastructure at the regional level. Descriptive analysis shows that prices and quality do not only vary across nursing homes, but also across counties and federal states and that quality and prices correlate positively. Second, the econometric analysis, which accounts for the endogenous relation between negotiated price and reported quality, shows that quality indeed positively depends on prices. In addition, more places in nursing homes per people in need are correlated with both lower prices and higher quality. Finally, unobserved factors at the federal state level capture some of the variation of reported quality across nursing homes. Our results suggest that higher prices increase quality. Furthermore, since reported quality and prices vary substantially across federal states, we conclude that the quality and prices of long-term care facilities may well be compared within federal states but not across. Policy reform dilemmas in promoting employment of persons with severe mental illness.

Recent evaluations by the U.S. General Accounting Office and the National Alliance for the Mentally Ill of reemployment efforts of the federal-state vocational rehabilitation program found that services offered by state vocational rehabilitation agencies do not produce long-term earnings for clients with emotional or physical disabilities. This paper examines reasons for these poor outcomes and the implications of recent policy reform recommendations. Congress must decide whether to take action at the federal level to upgrade programs affecting persons with severe mental illnesses or to continue to rely on state decision making. The federal-state program largely wastes an estimated $490 million annually on time-limited services to consumers with mental illnesses. Rechanneled into a variety of innovative and more appropriate integrated services models, the money could buy stable annual vocational rehabilitation funding for 62,000 to 90,000 consumers with severe mental illnesses. Larger macrosystem problems involve the dynamics of the labor market that limit job opportunities and the powerful work disincentives for consumers with severe disabilities now inherent in Social Security Disability Insurance, Supplemental Security Income, Medicare, and Medicaid.

The objective of this study was to evaluate the efficiency of Brazilian States and the Federal District in the public kidney transplant system and their productivity trends from 2006 to 2011. The authors used Data Envelopment Analysis (DEA) with slack and the Malmquist index with slack. Inputs included spending on hospital services and health professionals in the system. The output was the number of kidney transplants performed in each State. The data showed a significant discrepancy between States in the number of kidney transplants. The transplant system's inefficiency may result from inadequate management, failure to comply with national guidelines, inactive hospital transplant committees, and overburdened hospital staff. Institutional changes promoted by the Brazilian Ministry of Health (procedures improvement and standardization) failed to increase productivity in most States during this period.

The Federal-State Cooperative Program is a part- nership between the U.S. Geological Survey and State and local agencies. It provides a balanced approach to the study and resolution of water- related problems and to acquiring hydrologic data. The principal program objectives are to: (1) collect, on a systematic basis, data needed for the continuing determination and evaluation of the quantity, quality, and use of the Nation's water resources, and (2) appraise the availa- bility and the physical, chemical, and biological characteristics of surface and ground water through analytical and interpretive investi- gations. During fiscal year 1993, hydrologic data collection, interpretive investigations, and research were conducted by Geological Survey personnel in offices in every State, Puerto Rico, and in several territories in cooperation with about 1,100 local, State, and regional agencies. In fiscal year 1993, Federal funding of $63.5 million was matched by cooperating agencies, which also provided almost $23 million unmatched for a total program of about $150 million. This amounted to nearly 40 percent of the total funds for Geological Survey water- resources activities. This report presents examples of current (1993) investigations. It also provides updated information on Cooperative Program investigations related to agricultural activities.

Despite the federal prohibition against marijuana, state-level recreational use appears to be moving forward. Public opinion is shifting. Following well-publicized state-legalization in Washington and Colorado, states across the US have begun considering similar measures. Since the 2016 election, over 21% of Americans now live in places where recreational marijuana is state-legal, and over 63% of the country permits medical or recreational use at the state level. This paper does not consider whether states should legalize marijuana nor does it weigh all regulatory options available to states. Instead, it considers how states can create a practical framework to regulate recreational marijuana, particularly in a climate of federal uncertainty where marijuana remains illegal. We draw lessons from Colorado and Washington-assuming that other states will adopt similar models and employ commercial, for-profit systems. Considering both the variety of goals that states could adopt and how they interact, we offer recommendations in five areas: cultivation, production, and processing; sale, consumption, and possession; taxes and finance; public health and safety; and governance. We recommend that states implement a relatively restrictive regulatory approach, with a single market for recreational and medical marijuana, if appropriate. This should make marijuana laws easier to enforce, help reduce diversion, and satisfy federal guidance. Moreover, drawing from Colorado and Washington's experience, we suggest a flexible system with robust data collection and performance monitoring that supports a thorough evaluation. This should allow states to "learn as they go"-a must, given the uncertainty surrounding such policy shifts. Of course, a tightly regulated approach will have drawbacks-including a significant illegal market. But political experience teaches that states will be better off loosening a tight market than attempting to tighten a loose one. The Economic and Environmental Evaluations of Extractable Coal Resources (E4CR) project integrates economic analyses of extractable coal resources with environmental and coal quality considerations in order to better understand the contribution that coal resources can make to help meet the Nation’s future energy needs. The project utilizes coal resource information derived from the recent National Coal Resource Assessment (NCRA), National Oil and Gas Assessment (NOGA), and Coal Availability and Recoverability Studies (CARS) conducted by the U.S. Geological Survey and other State and Federal cooperating agencies. The E4CR evaluations are designed to augment economic models created by the U.S. Geological Survey CARS and NCRA projects and by the Department of Energy/Energy Information Administration (DOE/EIA). E4CR evaluations are conducted on potentially minable coal beds within selected coalfields in the United States. Emphasis is placed on coalfields containing Federally owned coal and within or adjacent to Federal lands, as shown in U.S. Geological Survey Fact Sheets 012-98, 145-99, and 011-00 (U.S. Geological Survey, 1998, 1999, 2000). Other considerations for the selection of study areas include coal quality, potential environmental impact of coal production activities and coal utilization, the potential for coalbed methane development from the coal, and projected potential for future mining. Completion dates for the E4CR studies loosely follow the schedule for analogous NOGA studies to allow for a comparison of different energy resources in similar geographic areas.

In this 2017 analysis, we examined the funding history of key federal programs critical to public health preparedness by reviewing program budget data collected for our annual examination of federal funding for biodefense and health security programs since fiscal year (FY) 2001. State and local preparedness at the Centers for Disease Control and Prevention initially received $940 million in FY2002 and resulted in significant preparedness gains, but funding levels have since decreased by 31%. Similarly, the Hospital Preparedness Program within the Office of the Assistant Secretary for Preparedness and Response was funded at a high of $515 million in FY2003, but funding was reduced by 50%. Investments in medical countermeasure development and stockpiling remained relatively stable. The United States has made significant progress in preparing for disasters and advancing public health infrastructure. To enable continued advancement, federal funding commitments must be sustained.

The thesis explores policy-making processes in the Federal Republic from 1979-1987 in three areas: INF arms control policy, East-West economic relations, and inter-German policy. Each case study assesses the degree of complexity and domestic accountability in policy-making processes and evaluates the relative influence of domestic and external factors on policy choices. It argues that the trends in West German foreign policy toward greater assertiveness reflected the evolution of the FRG as a state, society, and polity. The maturation' of the Federal Republic has introduced greater complexity into foreign policy-making processes, and more frequent societal intervention into what heretofore were elitemore » deliberations. Domestic actors have begun to demand greater accountability, while West German leaders, in turn, have become more assertive and confident in defending German national interests. The state-based and federally facilitated health insurance Marketplaces, or exchanges, enrolled more than eight million people during the first open enrollment period, which ended March 31, 2014. There is significant variation in how states have designed and implemented their Marketplaces. We examined how premiums varied with states' involvement in the Marketplaces through governance, plan management authority, and strategy during the first year that the exchanges have been open. State-based Marketplaces using "clearinghouse" plan management models had significantly lower adjusted average premiums for all plans within each metal level compared to state-based Marketplaces using "active purchaser" models and the federally facilitated and partnership Marketplaces. Clearinghouse management models are those in which all health plans that meet published criteria are accepted. Active purchaser models are those in which states negotiate premiums, provider networks, number of plans, and benefits. Our baseline estimates provide valuable benchmarks for evaluating future performance of states' involvement in governance, plan management, and regulatory authority of the insurance Marketplaces. Regional Jurassic geologic framework of Alabama coastal waters area and adjacent Federal waters area

To date, numerous Jurassic hydrocarbon fields and pools have been discovered in the Cotton Valley Group, Haynesville Formation, Smackover Formation and Norphlet Formation in the tri-state area of Mississippi, Alabama and Florida, and in Alabama State coastal waters and adjacent Federal waters area. Petroleum traps are basement highs, salt anticlines, faulted salt anticlines and extensional faults associated with salt movement. Reservoirs include continental and marine sandstones, limestones and dolostones. Hydrocarbon types are oil, condensate and natural gas. The onshore stratigraphic and structural information can be used to establish a regional geologic framework for the Jurassic for the State coastal waters and adjacent Federal waters areas. Evaluation of the geologic information along with the hydrocarbon data from the tri-state area indicates that at least three Jurassic hydrocarbon trends (oil, oil and gas condensate, and deep natural gas) can be identified onshore. These onshore hydrocarbon trends can be projected into the Mobile area in the Central Gulf of Mexico and into the Pensacola, Destin Dome and Apalachicola areas in the Eastern Gulf of Mexico. Substantial reserves of natural gas are expected to be present in Alabama State waters and the northern portion of the Mobile area. Significant accumulations of oil and gas condensate may be encountered in the Pensacola, Destin Dome, and Apalachicola areas. ?? 1989.

The Federal-State Cooperative Program is a partnership between the U.S. Geological Survey and State and local agencies. It provides a balanced approach to the study and resolution of water-related problems and to acquiring hydrologic data. The principal program objectives are to: (1) collect, on a systematic basis, data needed for the continuing determination and evaluation of the quantity, quality, and use of the Nation's water resources, and (2) appraise the availability and the physical, chemical, and biological characteristics of surface and ground water through analytical and interpretive investigations. During fiscal year 1988, hydrologic data collection, interpretive investigations, and research were conducted by Geological Survey personnel in offices in every State, Puerto Rico, and several territories in cooperation with more than 1,000 local, State, and regional agencies. In fiscal year 1988, Federal funding of almost $60 million was matched by cooperating agencies, who also provided approximately $6 million unmatched for a total program of about $126 million. This amounted to more than 40 percent of the total funds for Geological Survey water-resources activities. This report presents examples of current (1988) investigations. It also lists about 250 water-resources investigations related to agricultural activities that the Geological Survey conducted from 1970 to 1988.

Altered states: state health privacy laws and the impact of the Federal Health Privacy Rule.

Although the Federal Health Privacy Rule has evened out some of the inconsistencies between states' health privacy laws, gaps in protection still remain. Furthermore, the Federal Rule contains some lax standards for the disclosure of health information. State laws can play a vital role in filling these gaps and strengthening the protections afforded health information. By enacting legislation that has higher privacy-protective standards than the Federal Health Privacy Rule, states can play three important roles. First, because they can directly regulate entities that are beyond HHS's mandate, states can afford their citizens a broader degree of privacy protection than the Federal Health Privacy Rule. Second, by having state health privacy laws, states can enforce privacy protections at the local level. Finally, action by the states can positively influence health privacy policies at the federal level by raising the standard as to what constitutes sufficient privacy protection. High privacy protections imposed by states may serve as the standard for comprehensive federal legislation, if and when Congress reconsiders the issue. So far, states' reactions to the Federal Privacy Rule have been mixed. Only time will tell whether states will assume the mantle of leadership on health privacy or relinquish their role as the primary protectors of health information.

Wetland mitigation banks are already in existence in the United States, and the number is increasing. To date, most of these banks have been created and operated for mitigation of impacts arising from highway or commercial development and have not been associated with the oil and gas industry. Argonne National Laboratory evaluated the positive and negative aspects of wetland mitigation banking for the oil and gas industry by examining banks already created for other uses by federal, state, and private entities. Forty-three ongoing technology transfer programs in Federal agencies other than NASA were selected from over 200 current Federal technology transfer activities. Selection was made and specific technology transfer mechanisms utilized. Detailed information was obtained on the selected programs by reviewing published literature, and conducting telephone interviews with each program manager. Specific information collected on each program includes technology areas; user groups, mechanisms employed, duration of program, and level of effort. Twenty-four distinct mechanisms are currently employed in Federal technology transfer activities totaling $260 million per year. Typical applications of each mechanism were reviewed, and caveats on evaluating program effectiveness were discussed. A review of recent federally funded research in technology transfer to state and local governments was made utilizing the Smithsonian Science Information Exchange, and abstracts of interest to NASA were selected for further reference.

Section 1011 of the Alaska National Interest Lands Conservation Act (ANILCA) of 1980, as amended, requires that "On or before October 1, 1982, and annually thereafter, the President shall transmit to the Congress all pertinent public information relating to minerals in Alaska gathered by the United States Geological Surveys, United States Bureau of Mines, and any other Federal agency." This report has been prepared in response to that requirement. This circular is the fourteenth in the series of annual mineral reports mandated by the ANILCA. The report provides information about current Alaskan mineral projects and events during 1994; the emphasis is on Federal activity. The report addresses both onshore and offshore areas of Alaska.The U.S. Geological Survey (USGS), U.S. Bureau of Mines (USBM), and Minerals Management Service (MMS) are the principal Federal agencies that publish information about energy and mineral resources in Alaska. Their reports and data form the basis for decisions by other Federal agencies regarding land use, access, environmental impacts, and mining claim evaluation. The time required for sample analysis, data synthesis, and publication is lengthy; as a result, scientific reports are generally issued a year or more after initial sample and data collection. This article evaluates compliance issues the United States could face in ratifying the education provisions of the United Nations Convention on the Rights of the Child (CRC). These final regulations require that a State agency refund to the Federal Government the Federal share of Medicaid checks issued by the State or its fiscal agent that remain uncashed 180 days after the date of issuance. In addition, we are requiring that the Federal share of cancelled (voided) Medicaid checks be refunded quarterly since there has been no expenditure by the State. These regulations implement, in part, a 1981 General Accounting Office recommendation that procedures be established for States to credit the Federal Government for the Federal portion of uncashed Medicaid checks issued by the State or its fiscal agent.

Federal lands across the conterminous United States (CONUS) account for 23.5% of the CONUS terrestrial area but have received no systematic studies on their ecosystem carbon (C) dynamics and contribution to the national C budgets. The methodology for US Congress-mandated national biological C sequestration potential assessment was used to evaluate ecosystem C dynamics in CONUS federal lands at present and in the future under three Intergovernmental Panel on Climate Change Special Report on Emission Scenarios (IPCC SRES) A1B, A2, and B1. The total ecosystem C stock was estimated as 11,613 Tg C in 2005 and projected to be 13,965 Tg C in 2050, an average increase of 19.4% from the baseline. The projected annual C sequestration rate (in kilograms of carbon per hectare per year) from 2006 to 2050 would be sinks of 620 and 228 for forests and grasslands, respectively, and C sources of 13 for shrublands. The federal lands’ contribution to the national ecosystem C budget could decrease from 23.3% in 2005 to 20.8% in 2050. The C sequestration potential in the future depends not only on the footprint of individual ecosystems but also on each federal agency’s land use and management. The results presented here update our current knowledge about the baseline ecosystem C stock and sequestration potential of federal lands, which would be useful for federal agencies to decide management practices to achieve the national greenhouse gas (GHG) mitigation goal.

The federal sector is the largest consumer of products in the United States and annually purchases almost 1.5 quads of energy measured at the building site at a cost of almost $10 billion (U.S. Department of Energy 1991). A review of design, construction, and procurement practices in the federal sector, as well as discussions with manufacturers and vendors, indicated that new technologies are not utilized in as timely a manner as possible. As a consequence of this technology transfer lag, the federal sector loses valuable energy and environmental benefits that can be derived through the application of new technologies. Inmore » addition, opportunities are lost to reduce federal energy expenditures and spur U.S. economic growth through the procurement of such technologies. In 1990, under the direction of the U.S. Department of Energy (DOE) Federal Energy Management Program, the Pacific Northwest Laboratory began the design of a program to accelerate the introduction of new U.S. technologies into the federal sector. Designated first as the Test Bed Demonstration Program and more recently the New Technology Demonstration Program, it sought to shorten the acceptance period of new technologies within the federal sector. By installing and evaluating various new technologies at federal facilities, the Program attempts to increase the acceptance of those new technologies through the results of {open_quotes}real-world{close_quotes} federal installations. Since that time, the Program has conducted new technology demonstrations and evaluations, evolved to address the need for more timely information transfer, and explored collaborative opportunities with other DOE offices and laboratories. Federal and state policies identify schools as a setting to prevent childhood obesity, but schools need better health-promoting strategies. The objective of this study was to evaluate interim progress in schools receiving hands-on training from the Healthy Schools Program, the nation's largest school-based program aimed at preventing childhood obesity. The 4-year program targets schools with predominantly low-income, African American, or Hispanic students. In 2010 we assessed schools that enrolled in the 2007-2008 and 2008-2009 school years. School representatives completed an inventory of 8 content areas: policy and systems, school meals, competitive foods and beverages, health education, physical education, physical activity outside of physical education, before- and after-school programs, and school employee wellness. Schools' baseline inventory was compared by t test with the most recent inventory available. Schools made significant changes in all content areas, and effect sizes were moderate to large. Participating schools improved environmental policies and practices to prevent childhood obesity. The program is a resource to implement recent federal and state policies.

State legislatures and state utility commissions trying to attract renewable energy projects are considering feed-in tariffs, which obligate retail utilities to purchase electricity from renewable producers under standard arrangements specifying prices, terms, and conditions. The use of feed-in tariffs simplifies the purchase process, provides revenue certainty to generators, and reduces the cost of financing generating projects. However, some argue that federal law--including the Public Utility Regulatory Policies Act of 1978 (PURPA) and the Federal Power Act of 1935 (FPA)--constrain state-level feed-in tariffs. This report seeks to reduce the legal uncertainties for states contemplating feed-in tariffs by explaining the constraints imposedmore » by federal statutes. It describes the federal constraints, identifies transaction categories that are free of those constraints, and offers ways for state and federal policymakers to interpret or modify existing law to remove or reduce these constraints. This report proposes ways to revise these federal statutes. It creates a broad working definition of a state-level feed-in tariff. Given this definition, this report concludes there are paths to non-preempted, state-level feed-in tariffs under current federal law.« less

Twenty-five funded projects were conducted by the Water Resources Division of the U.S. Geological Survey, Idaho District, during fiscal years 1989-90. These projects were done in cooperation with 13 State and local agencies, 11 other Federal agencies, and 1 International Commission. State and local cooperative funding amounted to about $1.1 million in fiscal year 1989 and $1 million in fiscal year 1990; Federal funding amounted to about $3.6 million in fiscal year 1989 and about $4.4 million in fiscal year 1990. The Kansas applied remote sensing (KARS) program conducts demonstration projects and applied research on remote sensing techniques which enable local, regional, state and federal agency personnel to better utilize available satellite and airborne remote sensing systems. As liason with Kansas agencies for the Earth Resources Laboratory (ERL), Kansas demonstration project, KARS coordinated interagency communication, field data collection, hands-on training, and follow-on technical assistance and worked with Kansas agency personnel in evaluating land cover maps provided by ERL. Short courses are being conducted to provide training in state-of-the-art remote sensing technology for university faculty, state personnel, and persons from private industry and federal government. Concerns about the quality, safety, and cost of healthcare have driven the nation to increase its focus on this issue. A number of states are moving forward-in parallel with federal efforts-to develop and adopt policies for improving health and healthcare through health information technology and electronic health information exchange. Based on the eHealth Initiative's experience providing technical assistance to more than 20 states, and its work related to its coalition of more than 250 state, regional and community-based health information exchange initiatives and organizations, the most difficult challenges facing these initiatives and organizations today is that related to assessing the value of services that emerge from the health information exchange to various stakeholders groups such as providers, payers, and employers, and converting those value assessments to business plans that promote and assure sustainability for these initiatives. The combination of increased federal and state focus and funding and the pace at which regional and community-based health information networks are developing, along with the identification of value and sustainability as some of the most difficult challenges experienced by these efforts, all point to the significant need for evaluation. The most critical evaluation questions focus on the impact of health information technology and health information exchange on quality, safety, efficiency, the value of such efforts for various stakeholders, and assessment of how grant programs can be designed to support positive impact, value, and a sustainable business model, so that efforts continue when the grant funds are fully expended.

In light of the steady rise in the prevalence of students with autism, this study examined the definition of autism published by state education agencies (SEAs), as well as SEA-indicated evaluation procedures for determining student qualification for autism. We compared components of each SEA definition to aspects of autism from two authoritative sources: Diagnostic and Statistical Manual of Mental Disorders (DSM-IV-TR) and Individuals with Disabilities Education Improvement Act (IDEA-2004). We also compared SEA-indicated evaluation procedures across SEAs to evaluation procedures noted in IDEA-2004. Results indicated that many more SEA definitions incorporate IDEA-2004 features than DSM-IV-TR features. However, despite similar foundations, SEA definitions of autism displayed considerable variability. Evaluation procedures were found to vary even more across SEAs. Moreover, within any particular SEA there often was little concordance between the definition (what autism is) and evaluation procedures (how autism is recognized). OBJECTIVE: To analyze the public expenditures of states on health care and the participation of states and the Federal District in financing the Unified Health System, better known by the acronym SUS. To develop the research, two targets were used: “to rescue expenses per government source (federal, state and municipal) during the period from 2002 to 2013” and “to rescue resource transfers from the federal SUS to the states and also to municipalities”. METHODS: This research is bibliographic, documentary and descriptive and used a quantitative approach. Data were extracted from the Information System Public Health Budget, and additional data were collected from the public managers of states, municipalities and the Federal District during the period from 2002 to 2013. Federal data from the Undersecretary of Planning and Budget (originally extracted from the Integrated System of Financial Administration of the Federal Government and available on the Budget Public Health System webpage) were also collected. RESULTS: The data revealed that during the same researched period, the Federal District has maintained the health care system budget, whereas states and municipalities have increased their budgets for the same spending. CONCLUSIONS: By analyzing the results, there is clearly a disparity regarding the investment expended by the entities of the Federation. Although municipalities and states have gradually increased their application of resources to health care, the federal state has maintained the same budget. These results reveal a bit of concern about public health funding. PMID:26017788

Limited school drinking water access for youth

PURPOSE Providing children and youth with safe, adequate drinking water access during school is essential for health. This study utilized objectively measured data to investigate the extent to which schools provide drinking water access that meets state and federal policies. METHODS We visited 59 middle and high schools in Massachusetts during spring 2012. Trained research assistants documented the type, location, and working condition of all water access points throughout each school building using a standard protocol. School food service directors (FSDs) completed surveys reporting water access in cafeterias. We evaluated school compliance with state plumbing codes and federal regulations and compared FSD self-reports of water access with direct observation; data were analyzed in 2014. RESULTS On average, each school had 1.5 (SD: 0.6) water sources per 75 students; 82% (SD: 20) were functioning, and fewer (70%) were both clean and functioning. Less than half of the schools met the federal Healthy Hunger Free Kids Act requirement for free water access during lunch; 18 schools (31%) provided bottled water for purchase but no free water. Slightly over half (59%) met the Massachusetts state plumbing code. FSDs overestimated free drinking water access compared to direct observation (96% FSD-reported versus 48% observed, kappa=0.07, p=0.17). CONCLUSIONS School drinking water access may be limited. In this study, many schools did not meet state or federal policies for minimum student drinking water access. School administrative staff may not accurately report water access. Public health action is needed to increase school drinking water access. IMPLICATIONS AND CONTRIBUTIONS Adolescents’ water consumption is lower than recommended. In a sample of Massachusetts middle and high schools, about half did not meet federal and state minimum drinking water access policies. Direct observation may improve assessments of drinking water access and could be integrated into routine school food service monitoring protocols. PMID:27235376

The impact of Wyeth v. Levine on FDA regulation of prescription drugs.

In Wyeth v. Levine, decided in March, 2009, the United States Supreme Court concluded that the plaintiff's failure to warn claim against the makers of the drug Phenergan was not impliedly preempted by the Food, Drug and Cosmetic Act. In doing so, the Court rejected the argument of the U.S. Food and Drug Administration (FDA) that tort claims of this nature stand as an obstacle to federal regulatory objectives. This Article evaluates the Court's opinion in Wyeth and examines that decision's impact on subsequent litigation in the area of prescription drug labeling. The Article first discusses the preemption doctrine and its application to state law tort claims against product manufacturers. It then reviews the history of implied preemption of tort claims against manufacturers of FDA-approved prescription drugs prior to Wyeth and then discusses the Wyeth decisions in the Vermont Supreme Court and the United States Supreme Court. Finally, the Article evaluates some of the prescription drug preemption cases that have been decided in the lower federal courts since Wyeth and suggests that these courts are now reluctant to preempt failure to warn claims unless a manufacturer affirmatively seeks permission from FDA to change a drug's labeling.

These proposed regulations require a State agency to refund to the Federal government the Federal share of Medicaid checks issued by the State or its fiscal agent that remain uncashed 180 days after the date of issuance. In addition, we would require that the Federal share of cancelled (voided) Medicaid checks be refunded quarterly since there has been no expenditure by the State. This proposal is intended to implement in part a 1981 General Accounting Office recommendation that procedures be established for States to credit the Federal government for its portion of uncashed Medicaid checks issues by the State or its fiscal agent.

Objective Critically review estimates of health insurance coverage available from different sources, including the federal government, state survey initiatives, and foundation-sponsored surveys for use in state policy research. Study Setting and Design We review the surveys in an attempt to flesh out the current weaknesses of survey data for state policy uses. The main data sources assessed in this analysis are federal government surveys (such as the Current Population Survey's Annual Social and Economic Supplement, and the National Health Interview Survey), foundation-supported surveys (National Survey of America's Families, and the Community Tracking Survey), and state-sponsored surveys. Principal Findings Despite information on estimates of health insurance coverage from six federal surveys, states find the data lacking for state policy purposes. We document the need for state representative data on the uninsured and the recent history of state data collection efforts spurred in part by the Health Resources Services Administration State Planning Grant program. We assess the state estimates of uninsurance from the Current Population Survey and make recommendations for a new consolidated federal survey with better state representative data. Conclusions We think there are several options to consider for coordinating a federal and state data collection strategy to inform state and national policy on coverage and access. PMID:16704521

This article evaluates how an observational epidemiologic study of federal agencies in uranium miners became an experiment of opportunity for radiation effects. Navajo miners and communities suffered environmental exposures caused by the practices of uranium mining and milling in the Navajo reservation during the 1947 to 1966 period. A historical review of the state-of-the-art knowledge of the health effects of uranium mining and milling during the years prior to 1947 was conducted. Contemporary prevention and remediation practices also were assessed. An appraisal of the summary of findings of a comprehensive evaluation of radiation human experimentation conducted by the U.S. federal government in 1995-96 (ACHRE) demonstrates that uranium miners, including Navajo miners, were the single group that was put more seriously at risk of harm from radiation exposures, with inadequate disclosure and often with fatal consequences. Uranium miners were unwilling and unaware victims of human experimentation to evaluate the health effects of radiation. The failure of the State and U.S. Governments to issue regulations or demand installation of known mine-dust exposure control measures caused widespread environmental damage in the Navajo Nation.
