On June 15, the FERC dismissed a motion by the Puerto Rico Electric Power Authority (PREPA) to intervene to challenge the filing of Merck, Sharp and Dohme Quimica De Puerto Rico, Inc. (Merck), for qualifying status under PURPA. (Docket QF 84-188). The FERC's reason for dismissing the motion for intervention was that the Merck submission was not a true application for certification, but rather, merely a notice that the proposed facility would in fact be a qualifying facility. The Commission is revising certain aspects of its current market-based rate regulations, ancillary services requirements under the pro forma open-access transmission tariff (OATT), and accounting and reporting requirements. Specifically, the Commission is revising its regulations to reflect reforms to its Avista policy governing the sale of ancillary services at market-based rates to public utility transmission providers. The Commission is also requiring each public utility transmission provider to add to its OATT Schedule 3 a statement that it will take into account the speed and accuracy of regulation resources in its determination of reserve requirements for Regulation and Frequency Response service, including as it reviews whether a self-supplying customer has made ``alternative comparable arrangements'' as required by the Schedule. The final rule also requires each public utility transmission provider to post certain Area Control Error data as described in the final rule. Finally, the Commission is revising the accounting and reporting requirements under its Uniform System of Accounts for public utilities and licensees and its forms, statements, and reports, contained in FERC Form No. 1, Annual Report of Major Electric Utilities, Licensees and Others, FERC Form No. 1-F, Annual Report for Nonmajor Public Utilities and Licensees, and FERC Form No. 3-Q, Quarterly Financial Report of Electric Utilities, Licensees, and Natural Gas Companies, to better account for and report transactions associated with the use of energy storage devices in public utility operations.

The rationale underlying the merchant affiliate rules, their continued relevance, and, most importantly, their practical effect on both the utilities bound by such rules and the marketplace has not been seriously re-examined in the wake of the bulk power market`s rapid evolution. The regulatory, legislative and judicial branches of government all have played a role in twisting and changing FERC`s authority over hydropower. At times authority over hydropower is kept at FERC; at other times it is granted to state or federal agencies. At present, decisions are driven by competing uses of water that require differing flows or quantities of water. It is the highest and best use of the f lows and the quantities that will dictate whether water quantities are used for hydropower or fish habitat. However, that is not where it all started. In First Iowa, the Federal Powermore » Commission ({open_quotes}FPC{close_quotes}) (predecessor to FERC) dismissed a license application solely on the ground of the failure of the license applicant to comply with Iowa statutes. Iowa law provided that no dam could be constructed or operated unless a permit had been issued by a state agency. The U.S. Supreme Court reversed the Commission deciding that the Iowa statute would vest in an Iowa agency a veto power over a federal project and thereby subordinate the FPC`s comprehensive planning obligation to state control. The Court ruled that there is a separation of those subjects that are under the jurisdiction of the states from those subjects that the Constitution delegates to the United States and over which Congress vests the FPC with authority to act. The Court stated that this {open_quotes}duality does not require two agencies to share in the final decision of the same issue.{close_quotes} Although the Supreme Court ruled that federal jurisdiction is preeminent, it should be underscored that it was the FPC`s decision to defer to state authority in the first place. Scientists at the Mid-Continent Ecological Science Center of the National Biological Service conducted a series of case studies of FERC license consultations. The goal of these studies was to test hypotheses about factors that contribute to success in interagency negotiations. Based on their analysis of six case studies, the researchers constructed a list of ten rules for success. Since UI has no wholesale customers, it is a matter best left to state regulators, FERC said. UI`s stranded investment recovery plan was part of the company`s transmission access tariff, which provides for open access transmission service at cost-based rates. Ancillary services are those functions performed by electrical generating, transmission, system-control, and distribution-system equipment and people to support the basic services of generating capacity, energy supply, and power delivery. The Federal Energy Regulatory Commission defined ancillary services as ``those services necessary to support the transmission of electric power from seller to purchaser given the obligations of control areas and transmitting utilities within those control areas to maintain reliable operations of the interconnected transmission system.`` FERC divided these services into three categories: ``actions taken to effect the transaction (such as scheduling and dispatching services) , services that are necessary to maintainmore » the integrity of the transmission system [and] services needed to correct for the effects associated with undertaking a transaction.`` In March 1995, FERC published a proposed rule to ensure open and comparable access to transmission networks throughout the country. The Federal Energy Regulatory Commission (FERC) has approved two orders dealing with transmission pricing issues that evolved from its March 1992 Pennsylvania Electric Co. (Penelec) decision dealing with cost recovery of transmission plant expansion. Commissioner Betsy Moler said the cases represented the first time the FERC has used incremental rates for wheeling transactions. In the first new order, Public Service Electric Gas Co. proposed charging for third-party transmission services to recover the sum of its standard embedded cost rate and the net incremental cost of making upgrades to its integrated transmission system. Public Service sought to provide service to EEAmore » I Limited, which proposed building and operating a cogeneration facility at a United States Gypsum Co. plant in New Jersey. Consolidated Edison Company of New York Inc. had agreed to purchase the project's output. In rejecting Public Service's proposal, the FERC ruled the utility must charge a transmission rate that is the higher of either its embedded cost rate or its incremental cost rate of accelerated expansion. (In this instance, the incremental rate was higher). In the second new order, Public Service Co. of Colorado (PSCC) filed a proposed open access transmission service tariff related to its acquisition of facilities from Colorado-Ute Electric Association Inc. The FERC rejected PSCC's tariff request that would have required a new transmission customer (in the event PSCC modified its integrated transmission grid) to pay the sum of PSCC's standard transmission rate (reflecting the average cost of the grid facilities) plus the expansion cost (reflecting the incremental facility cost).« less

An analysis of electricity price behavior when the market in California was dysfunctional

The electricity market in California worked well for the first two years after restructuring, but in the summer of 2000 there were frequent high price spikes and then persistently high prices during the winter and the spring of 2001. This research develops econometric models to explain the behavior of the spot and forward prices for electricity and the relationship between them when the market in California was dysfunctional. The first results demonstrate that the high spot prices in the day-ahead market during the summer of 2000 were caused by changes in the bid behavior of buyers as well as by the offer behavior of sellers. After the Federal Energy Regulatory Commission (FERC) declared that these high spot prices were "unjust and unreasonable", the FERC approved the payment of refunds to customers in California but not in other areas within the Western Inter-Connection (WECC). However, the results of a Vector Auto-Regressive model (VAR) show that the high spot prices in California were transferred immediately to other states in the WECC and the spot prices at different trading hubs belong to a single market. After the intervention by FERC in December 2000, spot prices and forward prices of electricity were unusually high. Estimated distributed lag models, using both monthly and daily data, show that there were strong positive relationships between the price shocks for electricity and natural gas in the spot markets and the forward prices for electricity. Risk premiums in the forward prices for electricity were estimated and the results show that the price shocks for electricity after FERC's intervention were the primary cause of the high forward prices. The main conclusions for regulatory policy are (1) it is virtually impossible to contain the effects of a dysfunctional electricity market to a single region because other regions are linked through the electrical grid, and (2) it is essential to intervene immediately and effectively when the spot prices have been ruled by regulators to be unjust and unreasonable. The intervention by the FERC did not prevent persistently high spot and forward prices for customers throughout the WECC.

An analysis is made of the rules implementing Sections 201 and 210 of the Public Utility Regulatory Policies Act of 1978 (PURPA). The act provides that utilities must purchase power from qualifying producers of electricity at nondiscriminatory rates, and it exempts private generators from virtually all state and Federal utility regulations. Most of the analysis presented is taken from the perspective of photovoltaics (PV) and solar thermal electric point-focusing distributed receivers (pfdr). In 1996, the Federal Energy Regulatory Commission (FERC) issued Order 888, which required transmission-owning utilities under FERC jurisdiction to provide open access transmission service to eligible wholesale power customers. Among other things, the elements of electric service are unbundled, meaning that wind project developers must not only find a taker for the energy but also potentially make interconnection, ancillary service, and transmission arrangements for their wind projects. In 1999, the FERC issued Order 2000, which required transmission-owning utilities to file an intent with FERC on whether they have joined or plan to join a regional transmission organization (RTO). Order 2000more » also required RTOs to meet certain criteria and be approved by FERC in order to begin operations as an RTO. More recently, FERC said it would issue a Notice of Proposed Rulemaking in 2002 on certain requirements and services, often termed''standard market design'' (SMD), that must be included in all transmission tariffs filed at FERC. The Securities and Exchange Commission (SEC) is under fire. For the past year, Congress has criticized its administration of the Public Utility Holding Company Act of 1935 (PUHCA). The criticism might persuade Congress to transfer the administration of PUHCA from the SEC to the Federal Energy Regulatory Commission (FERC). Section I of this article briefly describes the events of the past year and the implications of transfer of PUHCA from the SEC to the FERC. Section II of this article discusses the background relationship of PUHCA, under which the SEC regulates the securities transactions of public utilities, to the Federalmore » Power Act, under which the FERC regulates the rates of public utilities. Section III discusses the case involving the Ohio Power Company, which resulted in a November 1990 decision of the Supreme Court, that recently has highlighted the conflict in jurisdiction between the SEC and the FERC relative to the regulation of public utilities. Section IV discusses the immediate responses to that conflict--a proposed amendment to a FERC regulation and S. 544--and the reasons that neither response is an ideal solution. Section V proposes an alternative to those immediate responses--the Memorandum of Understanding. This report documents today`s hydropower licensing and development status based on published data as follows: (a) Federal Energy Regulatory Commission (FERC) databases, maintained by FERC`s Office of Hydropower Licensing, of: (1) operating FERC-regulated projects, federal projects, and known unlicensed projects; (2) surrendered licenses; and, (3) recent licensing and relicensing actions; (b) Energy Information Administration (EIA) data on installed capacity and generation from 1949 through 1995 for the various resources used to produce electricity in the U.S.; and, (c) FERC licensing orders, and environmental assessments or environmental impact statements for each individual project relicensed since 1980. The analysis conducted to preparemore » this paper includes the effects of all FERC hydropower licensing actions since 1980, and applies those findings to estimate the costs of hydropower licensing and development activity for the next 15 years. It also quantifies the national cost of hydropower regulation. The future estimates are quite conservative. The are presented in 1996 dollars without speculating on the effects of future inflation, license surrenders, conditions imposed through open-ended license articles, license terms greater than 30 years, or low water years. Instead, they show the most directly predictable influences on licensing outcomes using actual experiences since ECPA (after 1986).« less

In 1996, the Court of Appeals for the District of Columbia Circuit issued an opinion striking down a mandatory license condition imposed by the U.S. Department of the Interior in a FERC relicensing. The case, Bangor Hydro-Electric Company v.Federal Energy Regulatory Commission, is instructive for agencies regarding the procedures to be followed in imposing mandatory FERC licensing conditions in the future. After Bangor Hydro, agencies should: (1) support their decisions by substantial evidence in the FERC record, (2) request applicant studies to support agency decisions and allow public comment on the decisions as a means to test the facts and analysis, and (3) consider intervening in a case to defend the condition on appeal. Bangor Hydro also raises, but does not decide, the issue of whether the agency imposing the mandatory condition should engage in balancing the economics of the hydropower project with the public resources affected by the project.

The Public Utility Regulatory Policies Act of 1978 (PURPA) is designed to promote energy conservation, the efficient use of utility resources, and equitable rates. PURPA specifically directs the Federal Energy Regulatory Commission (FERC) to encourage small power production from renewable resources (and also cogeneration of electric energy as well as heat) by setting standards under which facilities qualify for interconnection, and guidelines for sales between utilities and independent facilities. The way FERC carries out this mandate may critically affect the development of solar alternatives to electric power production from fossil and nuclear resources. The process for obtaining, transferring, or surrendering a Federal Energy Regulatory Commission (FERC) hydropower license or exemption from licensing can be a series of complex negotiations. In many instances, the process may include stakeholders with different and/or competing perspectives or objectives related to the original license, new license (i.e., relicense), transfer of a license, or surrender of a license. Divergent perspectives and objectives can lead to disputes among project participants, which may impact the development of FERC license terms and conditions. One mechanism to resolve disputes between project participants involving a FERC authorization is informal and formal settlement agreement conferences,more » which often result in settlement agreements addressing the disputed issues. This report provides hydropower stakeholders with a better understanding of the FERC settlement agreement process, including information on: How to initiate a settlement agreement. The procedural steps associated with the settlement agreement process. This paper is an account of the process that evolved during acquisition of the license to operate the Terror Lake hydroelectric power project under the auspices of the Federal Energy Regulatory Commission (FERC). The Commission is responsible for granting these licenses under the Federal Power Act (16 U.S.C. 792 et seq.). This act provides, in part, that FERC may condition a license to protect the public interest. The public interest in these cases has come to include both instream and terrestrial values. The Terror River is located on Kodiak Island in Alaska. The river is within the Kodiak National Wildlifemore » Refuge; it supports excellent runs of several species of Pacific Salmon which are both commercially important and a prime source of nutrition for the Kodiak brown bear. The river is also a prime resource for generating electric power. One major concern in the negotiations was the impact of land disturbance and management practices on brown bear habitat - i.e., protection of the brown bear. Maintenance of the bears' habitat is the main purpose of the Kodiak National Wildlife Refuge. But, like many other projects, resolving the instream flow issue was of major importance in the issuance of the FERC license. This rule adopts as final, with some modifications, the National School Lunch Program and School Breakfast Program regulations set forth in the interim final rule published in the Federal Register on June 28, 2013. The requirements addressed in this rule conform to the provisions in the Healthy, Hunger-Free Kids Act of 2010 regarding nutrition standards for all foods sold in schools, other than food sold under the lunch and breakfast programs. Most provisions of this final rule were implemented on July 1, 2014, a full year subsequent to publication of the interim final rule. This was in compliance with section 208 of the Healthy, Hunger-Free Kids Act of 2010, which required that State and local educational agencies have at least one full school year from the date of publication of the interim final rule to implement the competitive food provisions. Based on comments received on the interim final rule and implementation experience, this final rule makes a few modifications to the nutrition standards for all foods sold in schools implemented on July 1, 2014. In addition, this final rule codifies specific policy guidance issued after publication of the interim rule. Finally, this rule retains the provision related to the standard for total fat as interim and requests further comment on this single standard.

...The Federal Deposit Insurance Corporation (FDIC) is adopting an interim final rule that revises its risk-based and leverage capital requirements for FDIC-supervised institutions. This interim final rule is substantially identical to a joint final rule issued by the Office of the Comptroller of the Currency (OCC) and the Board of Governors of the Federal Reserve System (Federal Reserve) (together, with the FDIC, the agencies). The interim final rule consolidates three separate notices of proposed rulemaking that the agencies jointly published in the Federal Register on August 30, 2012, with selected changes. The interim final rule implements a revised definition of regulatory capital, a new common equity tier 1 minimum capital requirement, a higher minimum tier 1 capital requirement, and, for FDIC-supervised institutions subject to the advanced approaches risk-based capital rules, a supplementary leverage ratio that incorporates a broader set of exposures in the denominator. The interim final rule incorporates these new requirements into the FDIC's prompt corrective action (PCA) framework. In addition, the interim final rule establishes limits on FDIC-supervised institutions' capital distributions and certain discretionary bonus payments if the FDIC-supervised institution does not hold a specified amount of common equity tier 1 capital in addition to the amount necessary to meet its minimum risk-based capital requirements. The interim final rule amends the methodologies for determining risk-weighted assets for all FDIC-supervised institutions. The interim final rule also adopts changes to the FDIC's regulatory capital requirements that meet the requirements of section 171 and section 939A of the Dodd-Frank Wall Street Reform and Consumer Protection Act. The interim final rule also codifies the FDIC's regulatory capital rules, which have previously resided in various appendices to their respective regulations, into a harmonized integrated regulatory framework. In addition, the FDIC is amending the market risk capital rule (market risk rule) to apply to state savings associations. The FDIC is issuing these revisions to its capital regulations as an interim final rule. The FDIC invites comments on the interaction of this rule with other proposed leverage ratio requirements applicable to large, systemically important banking organizations. This interim final rule otherwise contains regulatory text that is identical to the common rule text adopted as a final rule by the Federal Reserve and the OCC. This interim final rule enables the FDIC to proceed on a unified, expedited basis with the other federal banking agencies pending consideration of other issues. Specifically, the FDIC intends to evaluate this interim final rule in the context of the proposed well- capitalized and buffer levels of the supplementary leverage ratio applicable to large, systemically important banking organizations, as described in a separate Notice of Proposed Rulemaking (NPR) published in the Federal Register August 20, 2013. The FDIC is seeking commenters' views on the interaction of this interim final rule with the proposed rule regarding the supplementary leverage ratio for large, systemically important banking organizations.

This study is an analysis of 2006 and 2007 electric load data, wind speed and solar irradiance data, and existing hydroelectric, geothermal, and other power plant data to quantify benefits of aggregating clean electric power from various Federal Energy Regulatory Commission (FERC) regions in the contiguous United States. First, various time series, statistics, and probability methods are applied to the electric load data to determine if there are any desirable demand-side results—specifically reducing variability and/or coincidence of peak events, which could reduce the amount of required carbon-based generators—in combining the electricity demands from geographically and temporally diverse areas. Second, an optimization algorithm is applied to determine the least-cost portfolio of energy resources to meet the electric load for a range of renewable portfolio standards (RPS’s) for each FERC region and for various aggregation scenarios. Finally, the installed capacities, ramp rates, standard deviation, and corresponding generator requirements from these optimization test runs are compared against the transmission requirements to determine the most economical organizational structure of the contiguous U.S. electric grid. Ideally, results from this study will help to justify and identify a possible structure of a federal RPS and offer insight into how to best organize regions for transmission planning.

The Integrated Licensing Process (ILP) of the US Federal Energy Regulatory Commission (FERC) is an example of an existing regulatory process that has the capacity to bridge the gap between science and decision making by clearly delineating existing science, the climate-regulatory nexus, and additional scientific work needed to inform licensing or relicensing of non-federal hydropower projects. In a parallel, but interacting set of legal and regulatory processes, NOAA's National Marine Fisheries Service (NMFS) must conduct analyses based on the best available science in order to implement the requirements of the Endangered Species Act (ESA), the Magnuson-Stevens Act, and NEPA, and to develop terms and conditions to protect fisheries for the 30-50 year term of the license and the longer life of the project itself. Therefore, NMFS must understand the combined effects of hydropower projects and climate change to fulfill its own mandates to protect anadromous fish, protected species and habitat. Federal Executive Order (EO) #13693 on climate change sustainability require use of climate risks in planning, also recommended in NOAA's own guidance on implementing ESA, and the Council on Environmental Quality (CEQ) guidance on implementing NEPA; however, as an independent agency FERC is not subject to that EO. In the past, FERC has consistently rejected NMFS' climate study requests, stating, among other reasons, that climate science is `too uncertain,' and therefore not actionable. Thus, in order for NMFS to get the information needed for its own decision process, NOAA must first persuade FERC that the science is actionable. This presentation will describe our experiences in a multi-year effort by an interdisciplinary team of climate and fishery scientists to develop acceptable climate study requests that address FERC's concerns about uncertainty, for the Susitna-Watana project on Alaska's Susitna River, the LaGrange Project on the Tuolumne R. in California, and the Hiram Project on the Saco R. in Maine. Furthermore, we document that climate studies are needed to meet FERC's own standard that study methodologies be "generally accepted practice" in the community, i.e., that water infrastructure planning and management has evolved to include use of climate risk assessments as best practices.

The Federal Energy Regulatory Commission`s transmission pricing policy signals acceptance of what previously had been taboo: any departure from the embedded cost, postage-stamp rates that have characterized transmission pricing for decades but are becoming increasingly difficult to deal with as the power industry develops a more competitive profile. The transmission pricing policy gives the electric utility industry the flexibility it wants but, the utilities must provide comparability of pricing - an extension of the golden rule of transmission access to transmission pricing. The proposed revisions were made, in part, in response to a petition for reconsideration received by the Administrator following the promulgation of the October 29, 2009, final rule (``2009 final rule''). In this action, the EPA is finalizing those amendments, lifting the stay of the title V permit requirement issued on March 14, 2011, and lifting the stay of the final rule issued on October 25, 2012. In addition, this final action includes revisions to the EPA's approach for addressing malfunctions and standards applicable during startup and shutdown periods. This final action also includes amendments and technical corrections to the final rule to clarify applicability and compliance issues raised by stakeholders subject to the 2009 final rule. This final rule adopts the substance of the April 15, 2004 tentative interim amendment (TIA) 00-1 (101), Alcohol Based Hand Rub Solutions, an amendment to the 2000 edition of the Life Safety Code, published by the National Fire Protection Association (NFPA). This amendment allows certain health care facilities to place alcohol-based hand rub dispensers in egress corridors under specified conditions. This final rule also requires that nursing facilities at least install battery-operated single station smoke alarms in resident rooms and common areas if they are not fully sprinklered or they do not have system-based smoke detectors in those areas. Niagara Mohawk Power Corp. owns and operates the 3.3 MW South Edwards Hydro Plant in Northern New York. The FERC license for this plant requires a minimum flow release in the bypass region of the river. NMPC submitted a license amendment to the FERC to permit the addition of a minimum flow unit to take advantage of this flow. The amendment was accepted, permitting the installation of the 236 kw, 60 cfs unit to proceed. The unit was installed and commissioned in 1994.

The OCC, Board, FDIC, OTS, and NCUA (Agencies) are publishing final rules to implement section 411 of the Fair and Accurate Credit Transactions Act of 2003 (FACT Act). The final rules create exceptions to the statute's general prohibition on creditors obtaining or using medical information pertaining to a consumer in connection with any determination of the consumer's eligibility, or continued eligibility, for credit for all creditors. The exceptions permit creditors to obtain or use medical information in connection with credit eligibility determinations where necessary and appropriate for legitimate purposes, consistent with the Congressional intent to restrict the use of medical information for inappropriate purposes. The final rules also create limited exceptions to permit affiliates to share medical information with each other without becoming consumer reporting agencies. The final rules are substantially similar to the rules adopted by the Agencies on an interim final basis in June 2005.

The Health Resources and Services Administration (HRSA) administers section 340B of the Public Health Service Act (PHSA), referred to as the "340B Drug Pricing Program" or the "340B Program." HRSA published a final rule on January 5, 2017, that set forth the calculation of the ceiling price and application of civil monetary penalties. The final rule applied to all drug manufacturers that are required to make their drugs available to covered entities under the 340B Program. In accordance with a January 20, 2017, memorandum from the Assistant to the President and Chief of Staff, entitled "Regulatory Freeze Pending Review," HRSA issued an interim final rule that delayed the effective date of the final rule published in the Federal Register (82 FR 1210, (January 5, 2017)) to May 22, 2017. HHS invited commenters to provide their views on whether a longer delay of the effective date to October 1, 2017, would be more appropriate. After consideration of the comments received on the interim final rule, HHS is delaying the effective date of the January 5, 2017 final rule, to October 1, 2017.

...The Office of the Comptroller of the Currency (OCC) and Board of Governors of the Federal Reserve System (Board), are adopting a final rule that revises their risk-based and leverage capital requirements for banking organizations. The final rule consolidates three separate notices of proposed rulemaking that the OCC, Board, and FDIC published in the Federal Register on August 30, 2012, with selected changes. The final rule implements a revised definition of regulatory capital, a new common equity tier 1 minimum capital requirement, a higher minimum tier 1 capital requirement, and, for banking organizations subject to the advanced approaches risk-based capital rules, a supplementary leverage ratio that incorporates a broader set of exposures in the denominator. The final rule incorporates these new requirements into the agencies' prompt corrective action (PCA) framework. In addition, the final rule establishes limits on a banking organization's capital distributions and certain discretionary bonus payments if the banking organization does not hold a specified amount of common equity tier 1 capital in addition to the amount necessary to meet its minimum risk-based capital requirements. Further, the final rule amends the methodologies for determining risk-weighted assets for all banking organizations, and introduces disclosure requirements that would apply to top-tier banking organizations domiciled in the United States with $50 billion or more in total assets. The final rule also adopts changes to the agencies' regulatory capital requirements that meet the requirements of section 171 and section 939A of the Dodd-Frank Wall Street Reform and Consumer Protection Act. The final rule also codifies the agencies' regulatory capital rules, which have previously resided in various appendices to their respective regulations, into a harmonized integrated regulatory framework. In addition, the OCC is amending the market risk capital rule (market risk rule) to apply to Federal savings associations, and the Board is amending the advanced approaches and market risk rules to apply to top-tier savings and loan holding companies domiciled in the United States, except for certain savings and loan holding companies that are substantially engaged in insurance underwriting or commercial activities, as described in this preamble.

The Sarbanes-Oxley Act (Act) significantly changed the expected corporate behavior of public companies. The Act governs the relationship between corporate organizations and their in-house or outside counsel. Under Section 307 of the Act, the Securities and Exchange Commission initially proposed expansive rules regarding counsel's duties. After comments and criticism from much of the bar, a final, narrower, version of rules under Section 307 (Final Rule) was adopted. The Final Rule contains alternative reporting procedures, attorney responsibilities, and sanctions for violations. In addition to the Act, the American Bar Association's (ABA) Task Force on Corporate Responsibility(Task Force), which was itself a reaction to Enron, reported on the importance of counsel's role in a corporate setting (Cheek Report). The ABA adopted amendments to its Model Rules of Professional Conduct (Model Rules) 1.6 and 1.13 as proposed in the Cheek Report. The Final Rule and amended Model Rules together suggest that attorneys may owe duties beyond those owed to their clients.

He doesn`t think we`ve seen the last of this phenomenon. As the industry begins to understand the shape of market developments to come in the future, increasingly creative M and A activities will be seen. But there`s also many other contractual arrangements among utilities and between utilities, pipelines, and gas distribution companies that reflect the more dynamic market of today. The Drug Enforcement Administration (DEA) is finalizing, without change, the Interim Rule with Request for Comment published in the Federal Register on July 25, 2007 (72 FR 40738). The Interim Rule removed the Controlled Substances Act (CSA) exemptions for chemical mixtures containing ephedrine and/or pseudoephedrine with concentration limits at or below five percent. Upon the effective date of the Interim Rule, all ephedrine and pseudoephedrine chemical mixtures, regardless of concentration and form, became subject to the regulatory provisions of the CSA. DEA regulated the importation, exportation, manufacture, and distribution of these chemical mixtures by requiring persons who handle these chemical mixtures to register with DEA, maintain certain records common to business practice, and file certain reports, regarding these chemical mixtures. No comments to the Interim Rule were received. This Final Rule finalizes the Interim Rule without change.

The Energy Policy Act of 1992 introduced the concept of open-access into the electric utility industry which allows privately-owned utilities to transmit power produced by non-utility generators and independent power producers (IPPs). In April 1996, the Federal Energy Regulatory Commission (FERC) laid down the final rules (Orders No. 888 & No. 889), which required utilities to open their transmission lines to any power producer and charge them no more than what they pay for the use of their own lines. These rules set the stage for the retail sale of electricity to industrial, commercial and residential utility customers; non-utility generators (Nugs); and power marketers. These statutory, regulatory and administrative changes create for the electric utility industry two different forces that contradict each other. The first is the concept of competition among utility companies; this places a greater emphasis on electric power generation cost control and affects generation/fuel mix selection and demand side management (DSM) activities. The second force, which is converse to the first, is that utilities are major contributors to the air pollution burden in the United States and environmental concerns are forcing them to reduce emissions of air pollutants by using more environmentally friendly fuels and implementing energy saving programs. This study evaluates the impact of deregulation within the investor owned electric utilities and how this deregulation effects air quality by investigating the trend in demand side management programs and generation/fuel mix. A survey was conducted of investor owned utilities and independent power producers. The results of the survey were analyzed by analysis of variance and regression analysis to determine the impact to Air Pollution. An air Quality Impact model was also developed in this study. This model consists of six modules: (1) demand side management and (2) consumption of coal, (3) gas, (4) renewable, (5) oil and (6) nuclear sources until the year 2005. Each module was analyzed separately and the result from each module was transferred into the Air Quality Impact model. The model assesses the changes in electricity generation within each module due to deregulation and these changes can then be correlated to the emission of air pollutants in the United States.

The Food and Drug Administration (FDA) is issuing a final rule amending the final monograph (FM) for over-the-counter (OTC) dandruff, seborrheic dermatitis, and psoriasis drug products to include the combination of 1.8 percent coal tar solution and 1.5 percent menthol in a shampoo drug product to control dandruff. FDA did not receive any comments or data in response to its previously proposed rule to include this combination. This final rule is part of FDA's ongoing review of OTC drug products.

Improve Tracking of Workplace Injuries and Illnesses. Final rule.

OSHA is issuing a final rule to revise its Recording and Reporting Occupational Injuries and Illnesses regulation. The final rule requires employers in certain industries to electronically submit to OSHA injury and illness data that employers are already required to keep under existing OSHA regulations. The frequency and content of these establishment-specific submissions is set out in the final rule and is dependent on the size and industry of the employer. OSHA intends to post the data from these submissions on a publicly accessible Web site. OSHA does not intend to post any information on the Web site that could be used to identify individual employees. The final rule also amends OSHA's recordkeeping regulation to update requirements on how employers inform employees to report work-related injuries and illnesses to their employer. The final rule requires employers to inform employees of their right to report work-related injuries and illnesses free from retaliation; clarifies the existing implicit requirement that an employer's procedure for reporting work-related injuries and illnesses must be reasonable and not deter or discourage employees from reporting; and incorporates the existing statutory prohibition on retaliating against employees for reporting work-related injuries or illnesses. The final rule also amends OSHA's existing recordkeeping regulation to clarify the rights of employees and their representatives to access the injury and illness records.

In this Final Rule, EPA is amending both the Asbestos Worker Protection Rule (WPR) and the Asbestos-in-Schools Rule. The WPR amendment protects State and local government employees from the health risks of exposure to asbestos to the same extent as private sector workers by adopting for these employees the Asbestos Standards of the Occupational Safety and Health Administration (OSHA). The WPR's coverage is extended to State and local government employees who are performing construction work, custodial work, and automotive brake and clutch repair work. This final rule cross-references the OSHA Asbestos Standards for Construction and for General Industry, so that future amendments to these OSHA standards are directly and equally effective for employees covered by the WPR. EPA also amends the Asbestos-in-Schools Rule to provide coverage under the WPR for employees of public local education agencies who perform operations, maintenance, and repair activities. EPA is issuing this final rule under section 6 of the Toxic Substances Control Act (TSCA).

This final rule updates the hospice payment rates and the wage index for fiscal year (FY) 2014, and continues the phase out of the wage index budget neutrality adjustment factor (BNAF). Including the FY 2014 15 percent BNAF reduction, the total 5 year cumulative BNAF reduction in FY 2014 will be 70 percent. The BNAF phase-out will continue with successive 15 percent reductions in FY 2015 and FY 2016. This final rule also clarifies how hospices are to report diagnoses on hospice claims, and provides updates to the public on hospice payment reform. Additionally, this final rule changes the requirements for the hospice quality reporting program by discontinuing currently reported measures and implementing a Hospice Item Set with seven National Quality Forum (NFQ) endorsed measures beginning July 1, 2014, as proposed. Finally, this final rule will implement the hospice Experience of Care Survey on January 1, 2015, as proposed.

This final rule updates the payment rates used under the prospective payment system (PPS) for skilled nursing facilities (SNFs) for fiscal year (FY) 2015. In addition, it adopts the most recent Office of Management and Budget (OMB) statistical area delineations to identify a facility's urban or rural status for the purpose of determining which set of rate tables will apply to the facility, and to determine the SNF PPS wage index including a 1-year transition with a blended wage index for all providers for FY 2015. This final rule also contains a revision to policies related to the Change of Therapy (COT) Other Medicare Required Assessment (OMRA). This final rule includes a discussion of a provision related to the Affordable Care Act involving Civil Money Penalties. Finally, this final rule discusses the SNF therapy payment research currently underway within CMS, observed trends related to therapy utilization among SNF providers, and the agency's commitment to accelerating health information exchange in SNFs.

OSHA is confirming the effective date of its direct final rule that revises a number of standards for general industry that refer to national consensus standards. The direct final rule states that it would become effective on March 13, 2008 unless OSHA receives significant adverse comment on these revisions by January 14, 2008. OSHA received no adverse comments by that date and, therefore, is confirming that the rule will become effective on March 13, 2008.

This final rule updates the payment rates used under the prospective payment system for skilled nursing facilities (SNFs) for fiscal year 2012. In addition, it recalibrates the case-mix indexes so that they more accurately reflect parity in expenditures between RUG-IV and the previous case-mix classification system. It also includes a discussion of a Non-Therapy Ancillary component currently under development within CMS. In addition, this final rule discusses the impact of certain provisions of the Affordable Care Act, and reduces the SNF market basket percentage by the multi-factor productivity adjustment. This rule also implements certain changes relating to the payment of group therapy services and implements new resident assessment policies. Finally, this rule announces that the proposed provisions regarding the ownership disclosure requirements set forth in section 6101 of the Affordable Care Act will be finalized at a later date.

This final rule updates the payment rates used under the prospective payment system (PPS) for skilled nursing facilities (SNFs) for fiscal year (FY) 2018. It also revises and rebases the market basket index by updating the base year from 2010 to 2014, and by adding a new cost category for Installation, Maintenance, and Repair Services. The rule also finalizes revisions to the SNF Quality Reporting Program (QRP), including measure and standardized resident assessment data policies and policies related to public display. In addition, it finalizes policies for the Skilled Nursing Facility Value-Based Purchasing Program that will affect Medicare payment to SNFs beginning in FY 2019. The final rule also clarifies the regulatory requirements for team composition for surveys conducted for investigating a complaint and aligns regulatory provisions for investigation of complaints with the statutory requirements. The final rule also finalizes the performance period for the National Healthcare Safety Network (NHSN) Healthcare Personnel (HCP) Influenza Vaccination Reporting Measure included in the End-Stage Renal Disease (ESRD) Quality Incentive Program (QIP) for Payment Year 2020.

The Food and Drug Administration (FDA) is amending its current good manufacturing practice (CGMP) regulations for human drugs, including biological products, to exempt most investigational "Phase 1" drugs from complying with the requirements in FDA's regulations. FDA will instead exercise oversight of production of these drugs under the agency's general statutory CGMP authority and investigational new drug application (IND) authority. In addition, FDA is making available simultaneously with the publication of this direct final rule, a guidance document setting forth recommendations on approaches to CGMP compliance for the exempted Phase 1 drugs. Elsewhere in this issue of the Federal Register, FDA is publishing a companion proposed rule, under FDA's usual procedure for notice-and-comment rulemaking, to provide a procedural framework to finalize the rule in the event the agency receives any significant adverse comments and withdraws this direct final rule. The companion proposed rule and direct final rule are substantively identical. Elsewhere in this issue of the Federal Register, FDA is announcing the availability of a draft guidance for industry entitled "INDs--Approaches to Complying With CGMP During Phase 1" to provide further guidance on the subject.

This final rule implements provisions of the Patient Protection and Affordable Care Act and the Health Care and Education Reconciliation Act of 2010 (collectively referred to as the Affordable Care Act). Specifically, this final rule outlines financial integrity and oversight standards with respect to Affordable Insurance Exchanges, qualified health plan (QHP) issuers in Federally-facilitated Exchanges (FFEs), and States with regard to the operation of risk adjustment and reinsurance programs. It also establishes additional standards for special enrollment periods, survey vendors that may conduct enrollee satisfaction surveys on behalf of QHP issuers, and issuer participation in an FFE, and makes certain amendments to definitions and standards related to the market reform rules. These standards, which include financial integrity provisions and protections against fraud and abuse, are consistent with Title I of the Affordable Care Act. This final rule also amends and adopts as final interim provisions set forth in the Amendments to the HHS Notice of Benefit and Payment Parameters for 2014 interim final rule, published in the Federal Register on March 11, 2013, related to risk corridors and cost-sharing reduction reconciliation.

We investigated the “need to negotiate” in a comparative case study of multi-agency negotiations in the FERC licensing process. Researchers interviewed participants in two cases involving environmental consultations and asked about parties' level of need to negotiate throughout the process. Participants identified a need to negotiate, and when this need was strongly felt, there was an increased opportunity for an agreement to be reached. An intense need to negotiate by all parties is not a prerequisite to successful agreements. When key participants have a strong need to negotiate, they can instigate negotiations and encourage the involvement of other parties.
