    In 1994, Michigan's Court of Appeals was asked to rule on three circuit court decisions involving Michigan's statute criminalizing assisted suicide and violations of the statute by Jack Kevorkian, M.D. The cases, consolidated on appeal, were Hobbins v. Attorney General, wherein the assisted suicide statute was declared unconstitutional; People v. Kevorkian (Docket No. 171056), wherein charges that Kevorkian had violated the statute by assisting in a suicide were dismissed; and People v. Kevorkian (Docket No. 172399), wherein additional charges that Kevorkian had violated the statute by assisting in another suicide were dismissed. In declaring the Michigan statute unconstitutional, two of the three circuit court judges held that individuals had a constitutional right to commit suicide. The Court of Appeals affirmed that the statute was unconstitutional because, by creating a commission to study end-of-life issues as well as specifically criminalizing assisted suicide, it violated the one-object provision of the Michigan Constitution. The court held, however, that there is no constitutional right to suicide, reversing the two circuit court orders in this respect.

    In this final rule, the Office of Inspector General (OIG) amends the safe harbor regulation concerning electronic health records items and services, which defines certain conduct that is protected from liability under the Federal anti-kickback statute, section 1128B(b) of the Social Security Act (the Act). Amendments include updating the provision under which electronic health records software is deemed interoperable; removing the electronic prescribing capability requirement; extending the sunset provision until December 31, 2021; limiting the scope of protected donors to exclude laboratory companies; and clarifying the condition that prohibits a donor from taking any action to limit or restrict the use, compatibility, or interoperability of the donated items or services.

    Pursuant to Section 78 German Criminal Code, criminal offences under Section 220a (genocide) and Section 211 (murder) are not subject to a statute of limitations. To the extent that prosecution is subject to a statute of limitations, the period of limitation is thirty years in the case of acts punishable by imprisonment for life. After the expiration of the period of limitation, evidence and investigation records relevant for the offence may no longer be available. Once a homicide is statute-barred, main proceedings may be opened only, if the elements of murder are present. The problems arising from the statute of limitations are discussed on the basis of a case on which the author had to give an export opinion. The homicide was committed in Amsterdam in 1967. In 2004, after the period of limitation had expired in The Netherlands and--as far as manslaughter is concerned, also in the Federal Republic of Germany--a meanwhile 60-year-old man accused himself of having committed the offence (manual strangulation of a tied male). After the expiration of the statute of limitations the results of the police investigations and the autopsy report were no longer available. How the offence might have been committed and whether the elements of murder were present therefore had to be discussed on the basis of still available photographs of the crime scene and the victim. After studying these pieces of evidence, the criminal court decided that the accused had actually committed a voluntary homicide, but that it was no longer ascertainable, if the elements of murder were fulfilled. The issues relevant to legal medicine are presented against the background of the problems associated with the statute of limitations.

In general the standards are designed to ensure that the applicable volumes of renewable fuel specified in the statute are used. However, the statute specifies that EPA is to project the volume of cellulosic biofuel production for the upcoming year and must base the cellulosic biofuel standard on that projected volume if it is less than the applicable volume set forth in the Act. EPA is today proposing a projected cellulosic biofuel volume for 2013 that is below the applicable volume specified in the Act. EPA is proposing that the applicable volumes of advanced biofuel and total renewable fuel would remain at the statutory levels for 2013. Finally, today's action also proposes annual percentage standards for cellulosic biofuel, biomass-based diesel, advanced biofuel, and renewable fuels that would apply to all gasoline and diesel produced or imported in year 2013.

    In 1991, the South Dakota Legislature enacted a living will statute. Included is a pregnancy provision that prevents pregnant women from obtaining the full benefit of the statute. A South Dakota Attorney General's opinion was released discussing the conflict of laws problems posed by the statute. That opinion, however, did not address the more important question of the constitutionality of the pregnancy provision. This comment analyzes the pregnancy provision under the Due Process, Equal Protection, and the Establishment Clauses and concludes that South Dakota's pregnancy provision is unconstitutional under all three doctrines.

Today's school nurse is in a pivotal position for the avoidance and resolution of disputes not only by increasing awareness of student health conditions but also by having a working knowledge of legal developments under Section 504 and its sister statute-the Americans with Disabilities Act (ADA). The ADA amendments of 2008 have extended the standards for eligibility and expanded questions about school districts' obligations under Section 504 and the ADA. This article provides a comprehensive synthesis of recent case law and related legal developments under this pair of federal statutes, culminating in practical implications and professional recommendations for school nurses.

    BACKGROUND Despite vigorous national debate between 1999–2001 the federal patients’ bill of rights (PBOR) was not enacted. However, states have enacted legislation and the Joint Commission defined an accreditation standard to present patients with their rights. Because such initiatives can be undermined by overly complex language, we surveyed the readability of hospital PBOR documents as well as texts mandated by state law. METHODS State Web sites and codes were searched to identify PBOR statutes for general patient populations. The rights addressed were compared with the 12 themes presented in the American Hospital Association’s (AHA) PBOR text of 2002. In addition, we obtained PBOR texts from a sample of hospitals in each state. Readability was evaluated using Prose, a software program which reports an average of eight readability formulas. RESULTS Of 23 states with a PBOR statute for the general public, all establish a grievance policy, four protect a private right of action, and one stipulates fines for violations. These laws address an average of 7.4 of the 12 AHA themes. Nine states’ statutes specify PBOR text for distribution to patients. These documents have an average readability of 15th grade (range, 11.6, New York, to 17.0, Minnesota). PBOR documents from 240 US hospitals have an average readability of 14th grade (range, 8.2 to 17.0). CONCLUSIONS While the average U.S. adult reads at an 8th grade reading level, an advanced college reading level is routinely required to read PBOR documents. Patients are not likely to learn about their rights from documents they cannot read. PMID:19189192

    Practitioners must understand their legal responsibilities in fitting minors with contact lenses, which include informed consent, contractual obligations, and the Statute of Limitations. Minors are children and teenagers who have not yet reached voting age in their state--generally 18 years of age. Informed consent requires permission from the patient before a practitioner performs any treatment. For these young people, this consent generally can only be given by a parent or legal guardian. Minors can repudiate contracts made with them; therefore, the contractual obligation to pay for a contact lens fitting should be established with a parent or legal guardian. In most states, minors have additional time beyond the usual Statute of Limitations to bring a lawsuit. If practitioners recognize their legal responsibilities in caring for these special patients, fitting youngsters with contact lenses can be a rewarding part of practice.
