Since the Final Environmental Impact Statement (FEIS) and Record of Decision on the FEIS describing the potential impacts to human health and the environment associated with the program, three factors have caused NASA to initiate additional studies regarding these issues. These factors are: (1) The U.S. Army Corps of Engineers and the Environmental Protection Agency (EPA) agreed to use the same comprehensive procedures to identify and delineate wetlands; (2) EPA has given NASA further guidance on how best to simulate the exhaust plume from the Advanced Solid Rocket Motor (ASRM) testing through computer modeling, enabling more realistic analysis of emission impacts; and (3) public concerns have been raised concerning short and long term impacts on human health and the environment from ASRM testing.

The Western Australian Environmental Protection Authority (EPA) in 2002 released Position Statement, No. 3, Terrestrial Biological Surveys as an Element of Biodiversity Protection outlining how terrestrial fauna survey data are to be used and interpreted in the preparation of environmental impact assessments (EIA). In 2004, the EPA released its Guidance for the Assessment of Environmental Factors, Terrestrial Fauna Surveys for Environmental Impact Assessment in Western Australia, No. 56. This paper briefly assesses the adequacy of recent terrestrial fauna surveys undertaken to support publicly released EIAs and indicates that the EPA is not always adhering to its own position and guidancemore » statements. This paper argues that the current fauna survey guidelines are in need of improvement. The approach and requirements of some other Australian states are briefly assessed to identify similarities and where improvements can be made to the Western Australian (WA) guidelines. This paper concludes with suggestions on how the process and the guidelines in WA can be revised to more adequately assess the impact of developments on terrestrial vertebrate biodiversity and ecosystem function. This programmatic environmental impact statement (PElS) was prepared for the Uranium Mill Tailings Remedial Action (UMTRA) Ground Water Project to comply with the National Environmental Policy Act (NEPA). This PElS provides an analysis of the potential impacts of the alternatives and ground water compliance strategies as well as potential cumulative impacts. On November 8, 1978, Congress enacted the Uranium Mill Tailings Radiation Control Act (UMTRCA) of 1978, Public Law, codified at 42 USC §7901 et seq. Congress found that uranium mill tailings " ... may pose a potential and significant radiation health hazard to the public, and that every reasonablemore » effort should be made to provide for stabilization, disposal, and control in a safe, and environmentally sound manner of such tailings in order to prevent or minimize other environmental hazards from such tailings." Congress authorized the Secretary of Energy to designate inactive uranium processing sites for remedial action by the U.S. Department of Energy (DOE). Congress also directed the U.S. Environmental Protection Agency (EPA) to set the standards to be followed by the DOE for this process of stabilization, disposal, and control. On January 5, 1983, EPA published standards (40 CFR Part 192) for the disposal and cleanup of residual radioactive materials. On September 3, 1985, the U.S. Court of Appeals for the Tenth Circuit set aside and remanded to EPA the ground water provisions of the standards. The EPA proposed new standards to replace remanded sections and changed other sections of 40 CFR Part 192. These proposed standards were published in the Federal Register on September 24, 1987 (52 FR 36000). Section 108 of the UMTRCA requires that DOE comply with EPA's proposed standards in the absence of final standards. The Ground Water Project was planned under the proposed standards. On January 11, 1995, EPA published the final rule, with which the DOE must now comply. The PElS and the Ground Water Project are in accordance with the final standards. The EPA reserves the right to modify the ground water standards, if necessary, based on changes in EPA drinking water standards. Appendix A contains a copy of the 1983 EPA ground water compliance standards, the 1987 proposed changes to the standards, and the 1995 final rule. Under UMTRA, DOE is responsible for bringing the designated processing sites into compliance with the EPA ground water standards and complying with all other applicable standards and requirements. The U.S. Nuclear Regulatory Commission (NRC) must concur with DOE's actions. States are full participants in the process. The DOE also must consult with any affected Indian tribes and the Bureau of Indian Affairs. Uranium processing activities at most of the inactive mill sites resulted in the contamination of ground water beneath and, in some cases, downgradient of the sites. This contaminated ground water often has elevated levels of constituents such as but not limited to uranium and nitrates. The purpose of the UMTRA Ground Water Project is to eliminate or reduce to acceptable levels the potential health and environmental consequences of milling activities by meeting the EPA ground water standards.« less

This notice initiates the NEPA scoping process by inviting comments from Federal, State, and local agencies, Indian tribes, and the public to help identify the environmental issues and reasonable alternatives to be examined in the EIS. An evaluation paradigm for cumulative impact analysis

Cumulative impact analysis is examined from a conceptual decision-making perspective, focusing on its implicit and explicit purposes as suggested within the policy and procedures for environmental impact analysis of the National Environmental Policy Act of 1969 (NEPA) and its implementing regulations. In this article it is also linked to different evaluation and decision-making conventions, contrasting a regulatory context with a comprehensive planning framework. The specific problems that make the application of cumulative impact analysis a virtually intractable evaluation requirement are discussed in connection with the federal regulation of wetlands uses. The relatively familiar US Army Corps of Engineers' (the Corps) permit program, in conjunction with the Environmental Protection Agency's (EPA) responsibilities in managing its share of the Section 404 regulatory program requirements, is used throughout as the realistic context for highlighting certain pragmatic evaluation aspects of cumulative impact assessment. To understand the purposes of cumulative impact analysis (CIA), a key distinction must be made between the implied comprehensive and multiobjective evaluation purposes of CIA, promoted through the principles and policies contained in NEPA, and the more commonly conducted and limited assessment of cumulative effects (ACE), which focuses largely on the ecological effects of human actions. Based on current evaluation practices within the Corps' and EPA's permit programs, it is shown that the commonly used screening approach to regulating wetlands uses is not compatible with the purposes of CIA, nor is the environmental impact statement (EIS) an appropriate vehicle for evaluating the variety of objectives and trade-offs needed as part of CIA. A heuristic model that incorporates the basic elements of CIA is developed, including the idea of trade-offs among social, economic, and environmental protection goals carried out within the context of environmental carrying capacity.

In response to the Fuel Economy and Greenhouse Gas (GHG) emissions standards, automobile manufacturers will need to adopt new technologies to improve the fuel economy of their vehicles and to reduce the overall GHG emissions of their fleets. The U.S. Environmental Protection Agency (EPA) has developed the Optimization Model for reducing GHGs from Automobiles (OMEGA) to estimate the costs and benefits of meeting GHG emission standards through different technology packages. However, the model does not simulate the impact that increased technology costs will have on vehicle sales or on consumer surplus. As the model documentation states, “While OMEGA incorporates functionsmore » which generally minimize the cost of meeting a specified carbon dioxide (CO2) target, it is not an economic simulation model which adjusts vehicle sales in response to the cost of the technology added to each vehicle.” Changes in the mix of vehicles sold, caused by the costs and benefits of added fuel economy technologies, could make it easier or more difficult for manufacturers to meet fuel economy and emissions standards, and impacts on consumer surplus could raise the costs or augment the benefits of the standards. Because the OMEGA model does not presently estimate such impacts, the EPA is investigating the feasibility of developing an adjunct to the OMEGA model to make such estimates. This project is an effort to develop and test a candidate model. The project statement of work spells out the key functional requirements for the new model.« less

In 1979, six years after selecting the Delaware Basin as a potential disposal area, Congress authorized the US Department of Energy to build the Waste Isolation Pilot Plant (WIPP) near Carlsbad, New Mexico, as a research and development facility for the safe management, storage, and disposal of waste contaminated with transuranic radioisotopes. In 1998, 19 years after authorization and 25 years after site selection, the US Environmental Protection Agency (EPA) certified that the WIPP disposal system complied with its regulations. The EPA's decision was primarily based on the results from a performance assessment conducted in 1996. This performance assessment wasmore » the culmination of four preliminary performance assessments conducted between 1989 and 1992. This report provides a historical setting and context for how the performance of the deep geologic repository at the WIPP was analyzed. Also included is background on political forces acting on the project.
