Many factors are known to influence the inference of the discourse coherence relationship between two sentences. Here, we examine the relationship between two conjoined embedded clauses in sentences like The professor noted that the student teacher did not look confident and (that) the students were poorly behaved. In two studies, we find that the presence of that before the second embedded clause in such sentences reduces the possibility of a forward causal relationship between the clauses, i.e., the inference that the student teacher’s confidence was what affected student behavior. Three further studies tested the possibility of a backward causal relationship between clauses in the same structure, and found that the complementizer’s presence aids that relationship, especially in a forced-choice paradigm. The empirical finding that a complementizer, a linguistic element associated primarily with structure rather than event-level semantics, can affect discourse coherence is novel and illustrates an interdependence between syntactic parsing and discourse parsing. Previous studies have suggested sentential complementation is the crucial ingredient of language that relates to false-belief (FB) reasoning, while the role of relative clauses (RCs) is less clear. Nevertheless, under the hypothesis that clausal embedding has a meta-representational effect, arguably implied in FB, one expects a link between FB and not only complementation but also relativization. Seventeen children with ASD (6 to 16 years, mean age 9;2) were assessed for RCs and FB. Comprehension of RCs significantly predicted FB performance, while none of the controlled factors played a predictive role (comprehension of simple sentences, vocabulary, morpho-syntax and working memory). A growing body of work indicates a close relation between complement clause sentences and Theory of Mind (ToM) in children with autism (e.g., Tager-Flusberg, & Joseph (2005). In Astington, & Baird (Eds.), Why language matters for theory of mind (pp. 298-318). New York, NY, US: Oxford University Press, Lind, & Bowler (2009). Journal of Autism and Developmental Disorders, 39(6), 929). However, this link is based primarily on success at a specific complement clause task and a verbal false-belief (FB) task. One cannot exclude that the link found between these tasks may be a by-product of their both presupposing similar levels of language skills. It is also an open question if the role of complementation in ToM success is a privileged one as compared to that of other abilities which have been claimed to be an important factor for ToM understanding in autism, namely executive functioning (EF) (Pellicano (2007). Developmental Psychology 43, 974). Indeed the role played by complementation may be conceived of as an indirect one, mediated by some more general cognitive function related to EF. This study is the first to examine the relation between theory of mind assessed both verbally and non-verbally and various types of complement clause sentences as well as executive functions in children with autism spectrum disorder (ASD). Our participants included 17 children and adolescents with ASD (aged 6 to 16) and a younger TD control group matched on non-verbal IQ (aged 4 to 9 years). Three tasks assessing complements of verbs of cognition, verbs of communication and verbs of perception were conducted. ToM tasks involved a verbal ToM task (Sally-Anne, Baron-Cohen et al. (1985). Cognition, 21(1), 37) as well as a non-verbal one (Colle et al. (2007). Journal of Autism and Developmental Disorders, 37(4), 716). Indexes of executive functions were collected via a computerized version of the Dimensional Change Card-Sorting task (Frye et al., 1995). Standardized measures of vocabulary, morphosyntax and non-verbal IQ were also administered. Results show similar performance by children with ASD and TD controls for the understanding of complement sentences, for non-verbal ToM and for executive functions. However, children with ASD were significantly impaired for false belief when this was measured verbally. For both ASD and TD, correlations controlling for IQ were found between the verbal FB task and complement sentences of verbs of communication and cognition, but not with verbs of perception. EF indexes did not significantly correlate with either of the ToM tasks, nor did any of the general language scores. These findings provide support for the view that knowledge of certain specific types of complement clause may serve as a privileged means of 'hacking out' solutions to verbal false belief tasks for individuals on the autistic spectrum. More specifically, complements with a truth-value that is independent of that of the matrix clause (i.e. those occurring with verbs of cognition and of communication, but not of perception) may describe a false event while the whole sentence remains true, making these linguistic structures particularly well suited for representing the minds of others (de Villiers, 2007). Readers will be able to (1) describe and evaluate the hypothesis that complement sentences play a privileged role in false belief task success in autism; (2) describe performance on complement sentences, executive functioning and false belief tasks by children with autism as compared to IQ-matched peers; (3) explain which types of complements specifically relate to false belief task performance and why; and (4) understand that differences in performance by children with autism at different types of false-belief tasks may be related to the nature of the task conducted and the underlying mechanisms involved. The role of the input in the acquisition of third person singular verbs in English.

During the early stages of language acquisition, children pass through a stage of development when they produce both finite and nonfinite verb forms in finite contexts (e.g., "it go there," "it goes there"). Theorists who assume that children operate with an abstract understanding of tense and agreement marking from the beginnings of language use tend to explain this phenomenon in terms of either performance limitations in production (e.g., V. Valian, 1991) or the optional use of finite forms in finite contexts due to a lack of knowledge that tense and agreement marking is obligatory (the optional infinitive hypothesis; K. Wexler, 1994, 1996). An alternative explanation, however, is that children's use of nonfinite forms is based on the presence of questions in the input ("Where does it go?") where the grammatical subject is immediately followed by a nonfinite verb form. To compare these explanations, 2 groups of 24 children aged between 2 years 6 months and 3 years were exposed to 6 known and 3 novel verbs produced in either declaratives or questions or in both declaratives and questions. The children were then questioned to elicit use of the verbs in either finite or nonfinite contexts. The results show that for novel verbs, the children's patterns of verb use were closely related to the patterns of verb use modeled in the language to which they were exposed. For known verbs, there were no differences in the children's use of individual verbs, regardless of the specific patterns of verb use modeled in the language they heard. The implications of these findings for theories of early verb use are discussed.

Disenfranchised grief and nonfinite loss as experienced by the families of death row inmates.

The families of death row inmates experience grief and loss issues that have been neglected by scholars and clinicians alike. The issues found in this population are unique and require our understanding. The present study uses the concepts of disenfranchised grief and nonfinite loss to uncover the pain experienced by the children and other family members who have a loved one on death row. Kenneth Doka's (1989) concept of disenfranchised grief is utilized to bring attention to the ways in which the circumstances surrounding an execution leave the family members of those condemned to death outside of the "grieving rules" that exist in the United States. Family members are disenfranchised from their grief, as society does not socially validate their pain. The loss that they feel is also nonfinite (Bruce & Schultz, 2001) in that it is continuous and denies the families all of the hopes, dreams, and expectations that they had for their loved one who now sits on death row. The qualitative interview method was utilized by the authors of this study to gather data from 26 family members of death row inmates who are incarcerated along the East Coast of the United States. The reactions of this group of family members are varied and complex, yet they include the following common responses: social isolation due to stigma and their own feelings of criminalization, intensified family conflict between family members who grieve differently from one another, diminished self-esteem, shame, diffused and specific feelings of guilt, and a chronic state of despair. This study explores virtually untapped terrain. An examination of the microlevel effects of the death penalty on families provides insight in to the area of death and dying, especially as it is related to disenfranchised loss and nonfinite grief. In addition, this study provides insight into the death penalty and its effects.

Embedded syntax could be useful either for the development of Theory of Mind (ToM) (Emergence account) or more generally over the lifespan (Reasoning account). Two hypotheses have been explored, one suggesting that embedding itself (Relatives and Complement sentences and Metarepresentation account) is important for ToM and another one considering that the embedding of a false proposition into a true one (Complement sentences and Misrepresentation account) is important. The goals of this study were to evaluate (1) the role of syntax in ToM (Emergence vs. Reasoning account), (2) the type of syntax implied in ToM (Metarepresentation vs. Misrepresentation account), and (3) the verbally mediated strategies which compensate for ToM deficits in adults with Asperger Syndrome (AS). Fifty NeuroTypical (NT) adults and 22 adults with AS were involved in a forced-choice task including ±ToM tasks (BA and a control task, physical causation, PC) under four Interference conditions (silence, syllable repetition, relative sentences repetition, and complement sentences repetition). The non-significant ±ToM × Interference interaction effect in the NT group did not support the Reasoning account and thus suggests that syntax is useful only for ToM development (i.e., Emergence account). Results also indicated that repeating complement clauses put NT participants in a dual task whereas repeating relative clauses did not, suggesting that repeating relatives is easier for NT than repeating complements. This could be an argument in favor of the Misrepresentation account. However, this result should be interpreted with caution because our results did not support the Reasoning account. Moreover, AS participants (but not NT participants) were more disrupted by ±ToM tasks when asked to repeat complement sentences compared to relative clause sentences. This result is in favor of the Misrepresentation account and indirectly suggests verbally mediated strategies for ToM in AS. To summarize, our results are in favor of the Emergence account in NT and of Reasoning and Misrepresentation accounts in adults with AS. We tested four predictions based on the assumption that optional infinitives can be attributed to properties of the input whereby children inappropriately extract nonfinite subject-verb sequences (e.g. the girl run) from larger input utterances (e.g. Does the girl run? Let’s watch the girl run). Thirty children with specific language impairment (SLI) and 30 typically developing children heard novel and familiar verbs that appeared exclusively either in utterances containing nonfinite subject-verb sequences or in simple sentences with the verb inflected for third person singular –s. Subsequent testing showed strong input effects, especially for the SLI group. The results provide support for input-based factors as significant contributors not only to the optional infinitive period in typical development, but also to the especially protracted optional infinitive period seen in SLI. Identifying the null subject: evidence from event-related brain potentials.

Event-related brain potentials (ERPs) were recorded during spoken language comprehension to study the on-line effects of gender agreement violations in controlled infinitival complements. Spanish sentences were constructed in which the complement clause contained a predicate adjective marked for syntactic gender. By manipulating the gender of the antecedent (i.e., the controller) of the implicit subject while holding constant the gender of the adjective, pairs of grammatical and ungrammatical sentences were created. The detection of such a gender agreement violation would indicate that the parser had established the coreference relation between the null subject and its antecedent. The results showed a complex biphasic ERP (i.e., an early negativity with prominence at anterior and central sites, followed by a centroparietal positivity) in the violating condition as compared to the non-violating conditions. The brain reacts to NP-adjective gender agreement violations within a few hundred milliseconds of their occurrence. The data imply that the parser has properly coindexed the null subject of an infinitive clause with its antecedent.

This paper presents three experiments on the parsing of Italian wh-questions that manipulate the wh-type (who vs. which-N) and the wh extraction site (main clause, dependent clause with or without complementizer). The aim of these manipulations is to see whether the parser is sensitive to the type of dependencies being processed and whether the processing effects can be explained by a unique processing principle, the minimal chain principle (MCP; De Vincenzi, 1991). The results show that the parser, following the MCP, prefers structures with fewer and less complex chains. In particular: (1) There is a processing advantage for the wh-subject extractions, the structures with less complex chains; (2) there is a processing dissociation between the who and which questions; (3) the parser respects the principle that governs the well-formedness of the empty categories (ECP).

The processing and comprehension of wh-questions among L2 German speakers

Using the self-paced-reading paradigm, the present study examines whether highly proficient second language (L2) speakers of German (English L1) use case-marking information during the on-line comprehension of unambiguous wh-extractions, even when task demands do not draw explicit attention to this morphosyntactic feature in German. Results support previous findings, in that both the native and the L2 German speakers exhibited an immediate subject-preference in the matrix clause, suggesting they were sensitive to case-marking information. However, only among the native speakers did this subject-preference carry over to reading times in the complement clause. The results from the present study are discussed in light of current debates regarding the ability of L2 speakers to attain native-like processing strategies in their L2. PMID:20161006

Language and False-Belief Task Performance in Children With Autism Spectrum Disorder.

Language is related to false-belief (FB) understanding in both typically developing children and children with autism spectrum disorder (ASD). The current study examined the role of complementation and general language in FB understanding. Of interest was whether language plays similar or different roles in the groups' FB performance. Participants were 16 typically developing children (mean age = 5.0 years; mental age = 6.7) and 18 with ASD (mean age = 7.3 years; mental age = 8.3). Children were administered FB and language tasks (say- and think-complements), receptive and expressive vocabulary tests, and relative clauses. When mental age and receptive and expressive vocabulary were used as separate covariates, the typical control group outperformed the children with ASD in FB task performance. Chi-square analyses indicated that passing both complementation tasks was linked to the FB understanding of children with ASD. Children with ASD who passed FB tasks all passed say- and think-complement tasks. However, some children in the control group were able to pass the FB tasks, even if they failed the say- and think-complement tasks. The results indicate that children with ASD relied more on complement understanding to pass FB than typically developing children. Results are discussed regarding the developmental pathways for FB understanding.

Prior studies on online sentence processing have shown that the parser can resolve non-local dependencies rapidly and accurately. This study investigates the interaction between the processing of two such non-local dependencies: wh-filler-gap dependencies (WhFGD) and reflexive-antecedent dependencies. We show that reflexive-antecedent dependency resolution is sensitive to the presence of a WhFGD, and argue that the filler-gap dependency established by WhFGD resolution is selected online as the antecedent of a reflexive dependency. We investigate the processing of constructions like (1), where two NPs might be possible antecedents for the reflexive, namely which cowgirl and Mary. Even though Mary is linearly closer to the reflexive, the only grammatically licit antecedent for the reflexive is the more distant wh-NP, which cowgirl. (1). Which cowgirl did Mary expect to have injured herself due to negligence? Four eye-tracking text-reading experiments were conducted on examples like (1), differing in whether the embedded clause was non-finite (1 and 3) or finite (2 and 4), and in whether the tail of the wh-dependency intervened between the reflexive and its closest overt antecedent (1 and 2) or the wh-dependency was associated with a position earlier in the sentence (3 and 4). The results of Experiments 1 and 2 indicate the parser accesses the result of WhFGD formation during reflexive antecedent search. The resolution of a wh-dependency alters the representation that reflexive antecedent search operates over, allowing the grammatical but linearly distant antecedent to be accessed rapidly. In the absence of a long-distance WhFGD (Experiments 3 and 4), wh-NPs were not found to impact reading times of the reflexive, indicating that the parser's ability to select distant wh-NPs as reflexive antecedents crucially involves syntactic structure. Last interglacial sediments in unglaciated Alaska and Yukon (eastern Beringia) are commonly identified by palaeoecological indicators and stratigraphic position ~2-5m above the regionally prominent Old Crow tephra (124 + or - 10ka). We demonstrate that this approach can yield erroneous age assignments using data from a new exposure at the Palisades, a site in interior Alaska with numerous exposures of last interglacial sediments. Tephrochronology, stratigraphy, plant macrofossils, pollen and fossil insects from a prominent wood-rich organic silt unit are all consistent with a last interglacial age assignment. However, six 14C dates on plant and insect macrofossils from the organic silt range from non-finite to 4.0 14C ka BP, indicating that the organic silt instead represents a Holocene deposit with a mixed-age assemblage of organic material. In contrast, wood samples from presumed last interglacial organic-rich sediments elsewhere at the Palisades, in a similar stratigraphic position with respect to Old Crow tephra, yield non-finite 14C ages. Given that local permafrost thaw since the last interglaciation may facilitate reworking of older sediments into new stratigraphic positions, minimum constraining ages based on 14C dating or other methods should supplement age assignments for last interglacial sediments in eastern Beringia that are based on palaeoecology and stratigraphic association with Old Crow tephra.

A General Symbolic Method with Physical Applications

A solution to the problem of unifying the General Relativistic and Quantum Theoretical formalisms is given which introduces a new non-axiomatic symbolic method and an algebraic generalization of the Calculus to non-finite symbolisms without reference to the concept of a limit. An essential feature of the non-axiomatic method is the inadequacy of any (finite) statements: Identifying this aspect of the theory with the "existence of an external physical reality" both allows for the consistency of the method with the results of experiments and avoids the so-called "measurement problem" of quantum theory.

The emergence of complexity in prosody and syntax

The relation between prosody and syntax is investigated here by tracing the emergence of each in a new language, Al-Sayyid Bedouin Sign Language. We analyze the structure of narratives of four signers of this language: two older second generation signers, and two about 15 years younger. We find that younger signers produce prosodic cues to dependency between semantically related constituents, e.g., the two clauses of conditionals, revealing a type and degree of complexity in their language that is not frequent in that of the older pair. In these younger signers, several rhythmic and (facial) intonational cues are aligned at constituent boundaries, indicating the emergence of a grammatical system. There are no overt syntactic markers (such as complementizers) to relate clauses; prosody is the only clue. But this prosodic complexity is matched by syntactic complexity inside propositions in the younger signers, who are more likely to use pronouns as abstract grammatical markers of arguments, and to combine predicates with their arguments within in a constituent. As the prosodic means emerge for identifying constituent types and signaling dependency relations between them, the constituents themselves become increasingly complex. Effect of ambiguities on SAR picture quality

The degradation of picture quality in a high-resolution, large-swath SAR mapping system caused by speckle, additive white Gaussian noise and range and azimuthal ambiguities occurring because of the nonfinite antenna pattern produced by a square aperture antenna was studied and simulated. The effect of the azimuth antenna pattern was accounted for by calculating the azimuth ambiguity function. Range ambiguities were accounted for by adding, to each pixel of interest, appropriate pixels at a range separation corresponding to one pulse repetition period, but attenuated by the antenna pattern. It is concluded that azimuth ambiguities do not cause any noticeable degradation (for large time bandwidth product systems, at least) but range ambiguities might.

PySCeSToolbox is an extension to the Python Simulator for Cellular Systems (PySCeS) that includes tools for performing generalized supply-demand analysis, symbolic metabolic control analysis, and a framework for investigating the kinetic and thermodynamic aspects of enzyme-catalyzed reactions. Each tool addresses a different aspect of metabolic behaviour, control, and regulation; the tools complement each other and can be used in conjunction to better understand higher level system behaviour. PySCeSToolbox is available on Linux, Mac OS X and Windows. It is licensed under the BSD 3-clause licence. Nonlinear mechanics of composite materials with periodic microstructure

This report summarizes the result of research done under NASA NAG3-882 Nonlinear Mechanics of Composites with Periodic Microstructure. The effort involved the development of non-finite element methods to calculate local stresses around fibers in composite materials. The theory was developed and some promising numerical results were obtained. It is expected that when this approach is fully developed, it will provide an important tool for calculating local stresses and averaged constitutive behavior in composites. NASA currently has a major contractual effort (NAS3-24691) to bring the approach developed under this grant to application readiness. The report has three sections. One, the general theory that appeared as a NASA TM, a second section that gives greater details about the theory connecting Greens functions and Fourier series approaches, and a final section shows numerical results.

Effect of ambiguities on SAR picture quality

The degradation of picture quality is studied for a high-resolution, large-swath SAR mapping system subjected to speckle, additive white Gaussian noise, and range and azimuthal ambiguities occurring because of the non-finite antenna pattern produced by a square aperture antenna. The effect of the azimuth antenna pattern was accounted for by calculating the aximuth ambiguity function. Range ambiguities were accounted for by adding appropriate pixels at a range separation corresponding to one pulse repetition period, but attenuated by the antenna pattern. A method of estimating the range defocussing effect which arises from the azimuth matched filter being a function of range is shown. The resulting simulated picture was compared with one degraded by speckle and noise but no ambiguities. It is concluded that azimuth ambiguities don't cause any noticeable degradation but range ambiguities might.

How MFN clauses used in the health care industry unreasonably restrain trade under the Sherman Act.

When used in the health care industry, an MFN clause is a contractual agreement that guarantees a health insurer the same best price as their market competitors. MFN clauses have the effect of unnecessarily raising consumer costs, reducing choice among providers, constraining access to care and preventing the development of alternative health care delivery models. The purpose of this paper is four-fold. First, to design a four-quadrant matrix to evaluate the pro-competitive and anticompetitive purposes and effects of MFN clauses under Section 1 of the Sherman Act. Second, to defeat the jurisprudential presumption that MFN clauses are pro-competitive in the health care industry and to recommend that this presumption be abolished. Third, to examine the U.S. Department of Justice's paradigmatic shift over the last decade toward prosecuting large insurers who employ MFN clauses resulting in U.S. Consent Decrees. Fourth, to outline the indicia of a meritorious claim against an insurer who employs an MFN clause.

Several studies have indicated that the population in general perceives doctors as reliable. In the present study perceptions of reliability and kindness attributed to another socially significant archetype, Santa Claus, have been comparatively examined in relation to the doctor. In all, 52 randomly chosen participants were shown a film, where a narrator dressed either as Santa Claus or as a doctor tells an identical story. Structured interviews were then used to assess the subjects' perceptions of reliability and kindness in relation to the narrator's appearance. We found a strong inclination for Santa Claus being perceived as friendlier than the doctor (p = 0.053). However, there was no significant difference in the perception of reliability between Santa Claus and the doctor (p = 0.524). The positive associations attributed to Santa Claus probably cause that he is perceived friendlier than the doctor who may be associated with more serious and unpleasant memories of illness and suffering. Surprisingly, and despite him being an imaginary person, Santa Claus was assessed as being as reliable as the doctor.

Infinite index extensions of local nets and defects

The subfactor theory provides a tool to analyze and construct extensions of Quantum Field Theories, once the latter are formulated as local nets of von Neumann algebras. We generalize some of the results of [62] to the case of extensions with infinite Jones index. This case naturally arises in physics, the canonical examples are given by global gauge theories with respect to a compact (non-finite) group of internal symmetries. Building on the works of Izumi-Longo-Popa [44] and Fidaleo-Isola [30], we consider generalized Q-systems (of intertwiners) for a semidiscrete inclusion of properly infinite von Neumann algebras, which generalize ordinary Q-systems introduced by Longo [58] to the infinite index case. We characterize inclusions which admit generalized Q-systems of intertwiners and define a braided product among the latter, hence we construct examples of QFTs with defects (phase boundaries) of infinite index, extending the family of boundaries in the grasp of [7].

A characterization of verb use in Turkish agrammatic narrative speech.

This study investigates the characteristics of narrative-speech production and the use of verbs in Turkish agrammatic speakers (n = 10) compared to non-brain-damaged controls (n = 10). To elicit narrative-speech samples, personal interviews and storytelling tasks were conducted. Turkish has a large and regular verb inflection paradigm where verbs are inflected for evidentiality (i.e. direct versus indirect evidence available to the speaker). Particularly, we explored the general characteristics of the speech samples (e.g. utterance length) and the uses of lexical, finite and non-finite verbs and direct and indirect evidentials. The results show that speech rate is slow, verbs per utterance are lower than normal and the verb diversity is reduced in the agrammatic speakers. Verb inflection is relatively intact; however, a trade-off pattern between inflection for direct evidentials and verb diversity is found. The implications of the data are discussed in connection with narrative-speech production studies on other languages.

Thematic orders and the comprehension of subject-extracted relative clauses in Mandarin Chinese

This study investigates the comprehension of three kinds of subject-extracted relative clauses (SRs) in Mandarin Chinese: standard SRs, relative clauses involving the disposal ba construction (“disposal SRs”), and relative clauses involving the long passive bei constructions (“passive SRs”). In a self-paced reading experiment, the regions before the relativizer (where the sentential fragments are temporarily ambiguous) showed reading patterns consistent with expectation-based incremental processing: standard SRs, with the highest constructional frequency and the least complex syntactic structure, were processed faster than the other two variants. However, in the regions after the relativizer and the head noun where the existence of a relative clause is unambiguously indicated, a top-down global effect of thematic ordering was observed: passive SRs, whose thematic role order conforms to the canonical thematic order of Chinese, were read faster than both the standard SRs and the disposal SRs. Taken together, these results suggest that two expectation-based processing factors are involved in the comprehension of Chinese relative clauses, including both the structural probabilities of pre-relativizer constituents and the overall surface thematic orders in the relative clauses. The present study examined Japanese university students' processing time for English subject and object relative clauses in relation to their English listening proficiency. In Analysis 1, the relation between English listening proficiency and reading span test scores was analyzed. The results showed that the high and low listening comprehension groups' reading span test scores do not differ. Analysis 2 investigated English listening proficiency and processing time for sentences with subject and object relative clauses. The results showed that reading the relative clause ending and the main verb section of a sentence with an object relative clause (such as "attacked" and "admitted" in the sentence "The reporter that the senator attacked admitted the error") takes less time for learners with high English listening scores than for learners with low English listening scores. In Analysis 3, English listening proficiency and comprehension accuracy for sentences with subject and object relative clauses were examined. The results showed no significant difference in comprehension accuracy between the high and low listening-comprehension groups. These results indicate that processing time for English relative clauses is related to the cognitive processes involved in listening comprehension, which requires immediate processing of syntactically complex audio information.

An audit questionnaire that examines specifically the management of technical activities clauses in ISO 15189.

The aim of this study was to design an audit questionnaire that focuses on the management of the technical activities in a Diagnostic Pathology Laboratory. The ISO 15189 Standard is written in such a way that it continually moves back and forth from topics where the auditor needs to question bench level staff, to topics where the auditor needs to question Technical Management Staff. This makes for a disjointed audit process - both Bench Staff and Technical Managers are repeatedly interrupted. The solution was to do a clause by clause analysis of the Standard and assign the major responsibility for the compliance to each clause to either Technical Managers or Bench Staff. The Clauses were then grouped under four topic headings regardless of whether they were a Section 4 or Section 5 Clause. Two questionnaires have emerged - the one described in this work and one directed primarily towards the activities of bench staff. There are 95 questions and it takes approximately two hours to complete.

"No-hire" clauses in healthcare sector contracts: their use and enforceability.

In today's healthcare industry, many hospitals utilize outside agencies for both business and clinical functions. This Article acknowledges the prevalence of outsourcing contract labor in the healthcare arena and focuses on the restrictive provisions included in these employment contracts, particularly "no-hire" clauses. No-hire clauses are often included in contracts between healthcare providers and professional groups that provide clinical service employees to the provider, such as a medical practice group providing physicians to a hospital or an agency providing nurses to a nursing home. These clauses usually provide that the healthcare provider may not directly hire an employee provided by the professional group, nor may it contract with another professional group that later hires the employee. The purpose of a no-hire clause is two-fold: to protect the professional group's investment of time and moneyfor recruiting, training, and establishing the employee's clinical practice, and to give the professional group leverage to retain its employees. While noncompete clauses in employment contracts have traditionally been the subject of litigation, no-hire clauses raise distinct legal issues. Case law provides conflicting views as to the enforceability of these provisions. Some courts find no-hire clauses to be per se illegal restrictions on trade, while others will permit them when they are reasonable within a specific context. The author proposes that a multifactor test be applied on a case-by-case basis to determine the reasonableness of the no-hire provision in a given employment contract and suggests drafting improvements to facilitate enforcement.
