Community Water Systems (CWSs) are required to remove uranium from drinking water to meet EPA standards. Similarly, mining operations are required to remove uranium from their dewatering discharges to meet permitted surface water discharge limits. Ion exchange (IX) is the primary treatment strategy used by these operations, which loads uranium onto resin beads. Presently, uranium-loaded resin from CWSs and mining operations can be disposed as a waste product or processed by NRC- or Agreement State-licensed uranium recovery facilities if that licensed facility has applied for and received permission to process 'alternate feed'. The disposal of uranium-loaded resin is costly andmore » the cost to amend a uranium recovery license to accept alternate feed can be a strong disincentive to commercial uranium recovery facilities. In response to this issue, the NRC issued a Regulatory Issue Summary (RIS) to clarify the agency's policy that uranium-loaded resin from CWSs and mining operations can be processed by NRC- or Agreement State-licensed uranium recovery facilities without the need for an alternate feed license amendment when these resins are essentially the same, chemically and physically, to resins that licensed uranium recovery facilities currently use (i.e., equivalent feed). NRC staff is clarifying its current alternate feed policy to declare IX resins as equivalent feed. This clarification is necessary to alleviate a regulatory and financial burden on facilities that filter uranium using IX resin, such as CWSs and mine dewatering operations. Disposing of those resins in a licensed facility could be 40 to 50 percent of the total operations and maintenance (O and M) cost for a CWS. Allowing uranium recovery facilities to treat these resins without requiring a license amendment lowers O and M costs and captures a valuable natural resource. (authors)« less

The FERC license for this plant requires a minimum flow release in the bypass region of the river. NMPC submitted a license amendment to the FERC to permit the addition of a minimum flow unit to take advantage of this flow. The amendment was accepted, permitting the installation of the 236 kw, 60 cfs unit to proceed. The unit was installed and commissioned in 1994.

After nearly three decades of medical product sterilization, 3M launched a major new project to build and license an irradiator facility. 3M Corporate Health Physics was responsible for the licensing aspect of this project. The licensing process consisted of six amendments, over 30 submissions to the U.S. Nuclear Regulatory Commission (U.S. NRC) and four U.S. NRC site visits. It took approximately 22 months to complete. The six license amendments are reviewed and several of the submissions are discussed. These include 3M's response to the U.S. NRC's interest in the shielding calculations used for the bioshield, the development of a protocol of radiation safety system test methods, and an analysis to show that a dropped cask during loading operations would not fall on sealed sources. A number of lessons were learned during the course of licensing the new irradiator. Among these were the importance of understanding the U.S. NRC license reviewer's perspective, the need to thoroughly review the irradiator manufacturer's licensing package during project negotiations, the benefits of leaving the Health Physics Office and meeting with the non-health physicists involved in the project, and the necessity of maintaining the solid relationships that already existed with the site Radiation Safety Officer and Sterilization Engineer.

Summer Nuclear Station (VCSNS), Units 2 and 3 located in Fairfield County, South Carolina. The amendment changes requested revise the design of the bracing used to support the Turbine Building structure. This request requires changing Tier 1 information found in the Design Description portion of Updated Final Safety Analysis Report (UFSAR) section 3.3, ``Buildings.'' The granting of the exemption allows the changes to Tier 1 information asked for in the amendment. Because the acceptability of the exemption was determined in part by the acceptability of the amendment, the exemption and amendment are being issued concurrently.

According to the accepted current understanding under the nuclear fuel we will consider the assembled active zone unit (Fuel assembly) with its structural elements, fuel rods, pellet column, structural materials of fuel rods and fuel assemblies. The licensing process includes justification of safe application of the proposed modifications, including design-basis and experimental justification of the modified items under normal operating conditions and in violation of normal conditions, including accidents as well. Besides the justification of modified units itself, it is required to show the influence of modifications on the performance and safety of the other Reactor Unit’ and Nuclear Plant’ elements (e.g. burst can detection system, transportation and processing operations during fuel handling), as well as to justify the new standards of fuel storage etc. Finally, the modified fuel should comply with the applicable regulations, which often becomes a very difficult task, if only because those regulations, such as the NP-082-07, are not covered modification issues. Making amendments into regulations can be considered as the only solution, but the process is complicated and requires deep grounds for amendments. Some aspects of licensing new nuclear fuel are considered the example of mixed nitride uranium -plutonium fuel application for the BREST reactor unit.

This paper will focus on the unique characterization, packaging, and transportation issues associated with the disposition of the two CP-5 Converter Tube assemblies from Argonne National Laboratory. The converter tubes were constructed of combinations of HEU and alloys of zirconium, and were part of the original research facilities attached to the CP-5 reactor during operating evolutions. These assemblies were heavily irradiated during their operational lifetime, and were segregated from the balance of irradiated test specimens when the reactor was deactivated and slated for Decontamination and Demolition (D&D). In addition, the substantial contribution of fissile material to the assemblies’ inventory mademore » the potential disposition pathways extremely challenging. As a result, these items became part of Argonne’s legacy “nuclear footprint”, and were added to the Nuclear Footprint Reduction Project scope for disposition. The Project was responsible for the size reduction and characterization of these items, as well as the ultimate disposition. After negotiating a disposal pathway for these tubes, there were significant transportation issues that required a small team to overcome, in order to successfully ship these items to the Nevada National Security Site (NNSS). The Project team at Argonne, technical support from transportation specialists, licensing support from the 10-160B license owner, the Savanah River National Lab (SRNL) Packaging Certification Team (PCT, and the DOE EM-33 staff contributed to license and safety analysis report amendments that eventually authorized the shipment of the material. The paper will identify the organizations, and the specific actions, required to successfully make three “one of a kind” shipments of irradiated test specimen material. This will include the unique packaging configurations, contents modification for the cask license (via the Amendment process), criticality evaluations, and associated review and approval processes.« less

This research project is part of the U.S. Nuclear Regulatory Commission’s (NRC’s) Probabilistic Flood Hazard Assessment (PFHA) Research plan in support of developing a risk-informed licensing framework for flood hazards and design standards at proposed new facilities and significance determination tools for evaluating potential deficiencies related to flood protection at operating facilities. The PFHA plan aims to build upon recent advances in deterministic, probabilistic, and statistical modeling of extreme precipitation events to develop regulatory tools and guidance for NRC staff with regard to PFHA for nuclear facilities. The Low-Level Radioactive Waste Policy Amendments Act of 1985 (LLRWPAA) assigned States the responsibility to provide for disposal of commercial low-level radioactive waste (LLRW) by 1993. The LLRWPAA also required the US Nuclear Regulatory Commission (NRC) to establish procedures and develop the technical review capability to process license applications for new LLRW disposal facilities. Under the LLRWPAA, NRC is required, to the extent practicable, to complete its review of an LLRW disposal facility license application within 15 months of its submittal by a State. This provision of the LLRWPAA helps ensure that NRC, in addition to protecting public health andmore » safety and the environment, facilitates States` achievement of LLRWPAA milestones for new facility development. A timely NRC review is needed for States to accomplish their objective of having new disposal facilities in operation on the dates prescribed in the LLRWPAA. To help assure NRC and States` compliance with the provisions of the LLRWPAA, NRC has developed a licensing review strategy that includes: (1) the further development of regulatory guidance, (2) enhancement of licensing review capability, and (3) prelicensing regulatory consultation with potential applicants.« less

That section prescribes conditions under which cable systems may obtain a compulsory license to retransmit copyrighted works, including the filing of Notices of Identity and Signal Carriage Complement and Statements of Account, and the submission of statutory royalty fees. The effect of the amendments is to modify the filing requirements and royalty fee calculations necessitated by changes in the rules and regulations of the Federal Communications Commission. The amendments are issued on an interim basis in order to permit their immediate application while allowing full public comment.

The European Union plans to harmonize the aviation requirements, in particular the flight crew licensing requirements. On 23 May 2007, the German Federal Ministry of Transport, Building and Urban Affairs published the Flight Crew Licensing Requirements, which are based on the Joint Aviation Requirements, Flight Crew Licensing 3, Amendment 5. These guidelines also list the examination methods to be used for testing the medical fitness of pilots. In this Amendment some examinations which were part of the routine tests before JAR-FCL3 became effective have been deleted, e.g. the exercise ECG. This article presents two cases from the autopsy material of the Institute of Legal Medicine in Hanover and discusses the problems associated with the new examination guidelines.

The purpose of our inspection was to review the Department of Energy`s (Energy) export licensing process for dual-use and military (munitions) commodities subject to nuclear nonproliferation controls. Specifically, we reviewed Energy`s authorities, procedures, and policies pertaining to the export licensing process and examined procedures for safeguarding data transmitted between Energy and other agencies involved in the export licensing process. We also reviewed Energy`s role as a member of the Subgroup on Nuclear Export Coordination. Our review of the sample of 60 export cases did not find evidence to lead us to believe that Energy`s recommendations for these cases were inappropriatemore » or incorrect. We identified, however, problems regarding management systems associated with the export license review process. We found that without documentation supporting export licensing decisions by the Export Control Operations Division (ECOD), we could not determine whether ECOD analysts considered all required criteria in their review of export cases referred to Energy. For example, we found that the ECOD did not retain records documenting the bases for its advice, recommendations, or decisions regarding its reviews of export license cases or revisions to lists of controlled commodities and, therefore, was not in compliance with certain provisions of the Export Administration Act, as amended, and Energy records management directives. Additionally, we found that the degree of compliance by Energy with the export licensing review criteria contained in the Export Administration Regulations and the Nuclear Non-Proliferation Act of 1978 could not be determined because ECOD did not retain records documenting the bases for its advice and recommendations on export cases.« less

The 'Nuclear Materials and Radioactive Waste Management Act' (NMRWMA) in Taiwan has been in use since 2002. To promote further administrative efficiency and improve regulatory capacity, an amendment of the act has been initiated by the Atomic Energy Council (AEC). It is now being reviewed by outside experts and related communities so as to include the best understanding of risk management factors. For the future decommissioning challenges of nuclear facilities, the act is also being amended to comply with the regulatory requirements of the decommissioning mandates. Currently the Taiwan government is conducting government reorganization, and AEC will be reformed butmore » will remain as an independent regulatory body. AEC will then be capable of improving the regulatory capacity for facilitating licensing and inspection, ensuring operational safety, environmental protection and public involvement, and giving a more flexible administrative discretion, such as expending the margin of penalty. The amendment is also required to provide a formal legal basis for the Nuclear Backend Fund, and to mandate the waste producers to take responsibility for any final debt repayment. ...The U.S. Nuclear Regulatory Commission (NRC) is proposing to amend the licensing, inspection, and annual fees charged to its applicants and licensees. The proposed amendments are necessary to implement the Omnibus Budget Reconciliation Act of 1990 (OBRA-90), as amended, which requires the NRC to recover through fees approximately 90 percent of its budget authority in Fiscal Year (FY) 2013, not including amounts appropriated for Waste Incidental to Reprocessing (WIR) and amounts appropriated for generic homeland security activities. The NRC is currently operating under a Continuing Resolution (CR) which is set to expire on March 27, 2013. Based on the FY 2013 budget submitted to the Congress, the NRC is proposing fees in this rulemaking based on the FY 2013 budget which is estimated to be $1,053.2 million. After accounting for billing adjustments, the total amount to be billed as fees is approximately $924.8 million. These fees are subject to change pending congressional action which may include sequestration, full-year CR or issuance of an FY 2013 appropriation which differs from the FY 2013 budget submitted to Congress which could result in higher or lower fees than those proposed in this rulemaking.
