The selection of the most feasible strategy for implementation of landfills is a challenging step. Potential implementation options of landfills cover a wide range, from conventional construction contracts to the concessions. Montenegro, seeking to improve the efficiency of the public services while maintaining affordability, was considering privatisation as a way to reduce public spending on service provision. In this study, to determine the most feasible model for construction and operation of a regional landfill, a quantitative risk analysis was implemented with four steps: (i) development of a global risk matrix; (ii) assignment of qualitative probabilities of occurrences and magnitude of impacts; (iii) determination of the risks to be mitigated, monitored, controlled or ignored; (iv) reduction of the main risk elements; and (v) incorporation of quantitative estimates of probability of occurrence and expected impact for each risk element in the reduced risk matrix. The evaluated scenarios were: (i) construction and operation of the regional landfill by the public sector; (ii) construction and operation of the landfill by private sector and transfer of the ownership to the public sector after a pre-defined period; and (iii) operation of the landfill by the private sector, without ownership. The quantitative risk assessment concluded that introduction of a public private partnership is not the most feasible option, unlike the common belief in several public institutions in developing countries. A management contract for the first years of operation was advised to be implemented, after which, a long term operating contract may follow. © The Author(s) 2016.

Integrating social client relationship management (CRM 2.0) in the built environment can enhance the relationship between construction organizations and client towards sustaining a long and lasting collaboration. The data exploration analyzed the e-readiness of contracting and consulting construction firms in the uptake of CRM 2.0 and the barriers encountered in the adoption of the modern business tool. The targeted organizations consist of seventy five (75) construction businesses operating in Lagos State which were selected from a pool of registered contracting and consulting construction firms using random sampling technique. Descriptive statistics of the e-readiness of contracting and consulting construction firms for CRM 2.0 adoption and barriers limiting its uptake were analyzed. Also, inferential analysis using Mann-Whitney U statistical and independent sample t-test was performed on the dataset obtained. The data generated will support construction firms on the necessity to engage in client social relationship management in ensuring sustainable client relationship management in the built environment.

Previous to the Washington River Protection Solutions, LLC contract, Construction work at the Hanford Tank Farms was contracted to large companies, while current Department of Energy (DOE) Contracts typically emphasize small business awards. As an integral part of Nuclear Project Management at Hanford Tank Farms, construction involves removal of old equipmentmore » and structures and installation of new infrastructure to support waste retrieval and waste feed delivery to the Waste Treatment Plant. Utilizing the optimum construction approach ensures that the contractors responsible for this work are successful in meeting safety, quality, cost and schedule objectives while working in a very hazardous environment. This paper describes the successful transition from a traditional project delivery method that utilized a large business general contractor and subcontractors to a new project construction management model that is more oriented to small businesses. Construction has selected the Agency Construction Management Method. This method was implemented in the first quarter of Fiscal Year (FY) 2009, where Construction Management is performed by substantially home office resources from the URS Northwest Office in Richland, Washington. The Agency Method has allowed WRPS to provide proven Construction Managers and Field Leads to mentor and direct small business contractors, thus providing expertise and assurance of a successful project. Construction execution contracts are subcontracted directly by WRPS to small or disadvantaged contractors that are mentored and supported by DRS personnel. Each small contractor is mentored and supported utilizing the principles of the Construction Industry Institute (CII) Partnering process. Some of the key mentoring and partnering areas that are explored in this paper are, internal and external safety professional support, subcontractor safety teams and the interface with project and site safety teams, quality assurance program support to facilitate compliance with NQA-1, construction, team roles and responsibilities, work definition for successful fixed price contracts, scheduling and interface with project schedules and cost projection/accruals. Implementing a Rule-Based Contract Compliance Checker

The paper describes the design and implementation of an independent, third party contract monitoring service called Contract Compliance Checker (CCC). The CCC is provided with the specification of the contract in force, and is capable of observing and logging the relevant business-to-business (B2B) interaction events, in order to determine whether the actions of the business partners are consistent with the contract. A contract specification language called EROP (for Events, Rights, Obligations and Prohibitions) for the CCC has been developed based on business rules, that provides constructs to specify what rights, obligation and prohibitions become active and inactive after the occurrence of events related to the execution of business operations. The system has been designed to work with B2B industry standards such as ebXML and RosettaNet.

Protecting the Environment Through Public Procurement Law - The Case of Poland

The article presents the results of studies whose aim was to analyse public procurement procedures in the context of environmental protection, especially wastewater infrastructure, performed in the selected Polish municipalities. The selection criterions were the time of public procurement procedure - from 2009 until 2015 and that the contract was cofinanced by the European Union funds. The contracting authorities responsible for awarding specific contracts, were asked series of detailed questions about the environmental criteria and requirements contained in the tender documents for the construction contracts related to the wastewater infrastructure. The aim of the detailed study was to determine whether the actions taken by the contracting authorities in a tender procedure for the construction or operation of wastewater infrastructure include environmental issues. Authors examine also the applicable public procurement law regulation in Poland and Europe in the context of sustainable development and environmental protection. The study of public procurement law was to check whether the law regulation fully takes into account the environmental aspects of the planned investments. On this basis, conclusions have been made that laws are consistent and do not constitute an obstacle to awarding a contract positively affecting the environment.

The Denver International Airport construction project provided a rare opportunity to identify risk factors for injury on a large construction project for which 769 contractors were hired to complete 2,843 construction contracts. Workers' compensation claims and payroll data for individual contracts were recorded in an administrative database developed by the project's Owner-Controlled Insurance Program. From claims andy payroll data linked with employee demographic information, we calculated injury rates per 200,000 person-hours by contract and over contract characteristics of interest. We used Poisson regression models to examine contract-specific risk factors in relation to total injuries, lost-work-time (LWT), and non-LWT injuries. We included contract-specific expected loss rates (ELRs) in the model to control for prevailing risk of work and used logistic regression methods to determine the association between LWT and non-LWT injuries on contracts. Injury rates were highest during the first year of construction, at the beginning of contracts, and among older workers. Risk for total and non-LWT injuries was elevated for building construction contracts, contract for special trades companies (SIC 17), contracts with payrolls over $1 million, and those with overtime payrolls greater than 20%. Risk for LWT injuries only was increased for site development contracts and contract starting in the first year of construction. Contracts experiencing one or more minor injuries were four times as likely to have at least one major injury (OR = 4.0, 95% CI (2.9, 5.5)). Enhancement of DIA's safety infrastructure during the second year of construction appears to have been effective in reducing serious (LWT) injures. The absence of correlation between injury rates among contracts belonging to the same company suggest that targeting of safety resources at the level of the contract may be an effective approach to injury prevention. Interventions focused on high-risk contracts, including those with considerable overtime work, contracts held by special trades contractors (SIC 17), and contracts belonging to small and mid-sized companies, and on high-risk workers, such as those new to a construction site or new to a contract may reduce injury burden on large construction sites. The join occurrence of minor and major injuries on a contract level suggests that surveillance of minor injuries may be useful in identifying opportunities for prevention of major injures.

The work described in this volume of ``S`` Projects History is an extension of the type of work described in Volume I. E.I. du Pont de flemours & Company had entered into Contract AT (07-2)-l with the United States Atomic Energy Commission to develop, design, construct, install, and operate facilities to produce heavy water, fissionable materials, and related products. Under this contract,, Du Pont constructed and operated the Savannah River Plant. The engineering, design, and construction for most of the larger ``S`` projects was performed by the Engineering DeDartment. For some of the large and many of the smaller projectsmore » the Engineering Department was responsible only for the construction because the Atomic Energy Division (AED) of the Explosives Department handled the other phases. The Engineering Department Costruction Division also performed the physical work for many of the plant work orders. A course syllabus provides a roadmap for pharmacy students to achieve course learning objectives and develop lifelong learning skills. For several decades the literature has referred to syllabi as legal documents and/or contracts between students and professors. A review of the legal precedents reveals that syllabi are not considered contracts because the courts refuse thus far to recognize educational malpractice or breach of contract as a cause of action. Syllabi do, however, represent a triggering agent for instructional dissent and grade appeals, may be binding in student appeal proceedings, and are used in judicial hearings. Pharmacy faculty members should review their syllabi and follow process improvement strategies to construct legally sound syllabi that can both enhance learning and minimize risks of student grievances and appeals.

The National Solar Observatory’s (NSO) Advanced Technology Solar Telescope (ATST) is the first large U.S. solar telescope accessible to the worldwide solar physics community to be constructed in more than 30 years. The 4-meter diameter facility will operate over a broad wavelength range (0.35 to 28 μm ), employing adaptive optics systems to achieve diffraction limited imaging and resolve features approximately 20 km on the Sun; the key observational parameters (collecting area, spatial resolution, spectral coverage, polarization accuracy, low scattered light) enable resolution of the theoretically-predicted, fine-scale magnetic features and their dynamics which modulate the radiative output of the sun and drive the release of magnetic energy from the Sun’s atmosphere in the form of flares and coronal mass ejections. In 2010, the ATST received a significant fraction of its funding for construction. In the subsequent two years, the project has hired staff and opened an office on Maui. A number of large industrial contracts have been placed throughout the world to complete the detailed designs and begin constructing the major telescope subsystems. These contracts have included the site development, AandE designs, mirrors, polishing, optic support assemblies, telescope mount and coudé rotator structures, enclosure, thermal and mechanical systems, and high-level software and controls. In addition, design development work on the instrument suite has undergone significant progress; this has included the completion of preliminary design reviews (PDR) for all five facility instruments. Permitting required for physically starting construction on the mountaintop of Haleakalā, Maui has also progressed. This paper will review the ATST goals and specifications, describe each of the major subsystems under construction, and review the contracts and lessons learned during the contracting and early construction phases. Schedules for site construction, key factory testing of major subsystems, and integration, test and commissioning activities will also be discussed.

NREL experienced a significant increase in employees and facilities on our 327-acre main campus in Golden, Colorado over the past five years. To support this growth, researchers developed and demonstrated a new building acquisition method that successfully integrates energy efficiency requirements into the design-build requests for proposals and contracts. We piloted this energy performance based design-build process with our first new construction project in 2008. We have since replicated and evolved the process for large office buildings, a smart grid research laboratory, a supercomputer, a parking structure, and a cafeteria. Each project incorporated aggressive efficiency strategies using contractual energy usemore » requirements in the design-build contracts, all on typical construction budgets. We have found that when energy efficiency is a core project requirement as defined at the beginning of a project, innovative design-build teams can integrate the most cost effective and high performance efficiency strategies on typical construction budgets. High speed, high power density current collection systems have been identified as an enabling technology required to construct homopolar power supplies to meet SDI missions. This work is part of a three-year effort directed towards the analysis, experimental verification, and prototype construction of a current collection system designed to operate continuously at 2 kA/sq cm, at a rubbing speed of 200 m/s, and with acceptable losses in a space environment. To date, no system has achieved these conditions simultaneously. This is the final report covering the three year period of performance on DOE contract AC03-86SF-16518. Major areas covered include design, construction and operation of a cryogenically cooled brush test rig, design and construction of a high speed brush test rig, optimization study for homopolar machines, loss analysis of the current collection system, and an application study which defines the air-core homopolar construction necessary to achieve the goal of 80 kW/kg generator power density.

Two distinct yet closely related waste remediation projects are finally underway in Canada under the Port Hope Area Initiative (PHAI) which aims to clean up 1.7 million cubic metres (m{sup 3}) of low-level radioactive waste (LLRW) arising from 60 years of uranium and radium operations. Under the PHAI, the Port Hope Project and the smaller Port Granby Project will result in the consolidation of the LLRW within two highly engineered, above-ground mounds, to be constructed within the municipalities of Port Hope and Clarington. These projects will fulfill the federal government commitment to the safe, long-term management of the LLRW, asmore » set out in the legal agreement signed by the government and the host municipalities in 2001. The federal authorization to commence PHAI Remediation and Construction Phase 2 was received in late 2011 and several enabling infrastructure construction and radiological survey contracts were awarded in 2012. The contracts to remediate the waste sites and construct the new engineered mounds will be tendered in 2013. BPA proposes to fund IDFG to plan and complete construction of fish passage improvements and water conservation activities that are contained within IDFG’s Statement of Work (SOW) for the period 7/1/04 to 6/30/05. The funding request contained in their SOW is part of an ongoing IDFG effort to fund anadromous fish passage projects that fall outside the scope of the Mitchell Act. The proposed SOW activities fall within the following four categories: Phase I-Planning and Design (gather data, perform investigations, and exchange information; perform surveys and assessments to be compliant; survey project sites and perform engineering designs; perform contract andmore » project management); Phase II-Construction and Implementation (procure materials and supplies, prepare contracts and solicit bids, plant native seedlings, complete capital improvements); Phase III-Operation and Maintenance (maintain office operations); and Phase IV- Monitoring and Evaluation (monitor and evaluate post-project effects, reporting). The SOW culminates with proposed construction of 18 capital improvement projects (Table 1 attached). The types of capital improvements include: screening gravity water diversions; consolidating and/or eliminating ditches; evaluating and screening pump diversions; evaluating and implementing water conservation activities; constructing screens along migration routes and rearing areas for hatchery and wild salmon; improving upstream and downstream passage for anadromous fish; and maximize benefits to aquatic habitat. Reduction of construction wastes by improving construction contract management: a multinational evaluation.

The Canadian construction industry generates 30% of the total municipal solid waste deposited in landfills. Ample evidence can be found in the published literature about rework and waste generation due to ambiguity and errors in contract documents. Also, the literature quotes that disclaimer clauses in contract documents are included in the contractual agreements to prevent contractor claims, which often cause rework. Our professional practice has also noted that there are several disclaimer clauses in standard contract documents which have the potential to cause rework (and associated waste). This article illustrates a comparative study of standard contractual documents and their potential to create rework (and associated waste) in different regions of the world. The objectives of this study are (1) to analyse standard contractual documents in Canada, the USA and Australia in terms of their potential to generate rework and waste, and (2) to propose changes/amendments to the existing standard contract documents to minimise/avoid rework. In terms of construction waste management, all the reviewed standard contract documents have deficiencies. The parties that produce the contract documents include exculpatory clauses to avoid the other party's claims. This approach tends to result in rework and construction waste. The contractual agreements/contract documents should be free from errors, deficiencies, ambiguity and unfair risk transfers to minimise/avoid potential to generate rework and waste.

Standard form of contract is normally being used in Malaysia construction industry in establishing legal relation between contracting parties. Generally, most of Malaysia federal government construction project used PWD203A which is a standard form of contract to be used where Bills of Quantities Form Part of the Contract and it is issued by Public Works Department (PWD/JKR). On the other hand in Sarawak, the largest state in Malaysia, the state government has issued their own standard form of contract namely JKR Sarawak Form of Contract 2006. Even both forms have been used widely in construction industry; there is still lack of understanding on both forms. The aim of this paper is to identify significant provision on both forms of contract. Document analysis has been adopted in conducting an in-depth review on both forms. It is found that, both forms of contracts have differences and similarities on several provisions specifically matters to definitions and general; execution of the works; payments, completion and final account; and delay, dispute resolution and determination.

Pneumatic Artificial Muscles (PAMs) have been known for its wide application in various aspects of industrial automation and robotic equipments. Many advantages in terms of high power-to-volume ratio, high power-to-weight ratio, stick-slip-free operation and high degree of safety offer by PAM compare to traditional actuators. However, behind this benefits lie a limitation of significant compatibility of PAM mechanism which have to be considered so as to fully understand how the PAM works during load-lifting. In this study, the mesh suitability experiment and the effect of force load on PAM contraction experiment have been carried out. PAM is constructed and compatibility of bladder and the braided mesh to produce uniform expansion is investigated. Moreover, the first experimental result of finding compatibility is used to verify the contraction value under various loads.

The E-ELT program status

ESO is now fully engaged in building the European Extremely Large Telescope (E-ELT), a 40-m class optical nearinfrared telescope to be installed on top of Cerro Armazones, Chile and become operational around 2025. The Programme was formally approved by ESO Council back in 2012. However the required funding level for starting construction was actually reached in 2014, leading to a Green Light to start large construction contracts in December of that year. Since then, the programme has entered a very busy phase leading to the signature of the first major industrial contracts as well as the agreements with scientific institutes in ESO Member States to design and built the first suite of science instruments. This paper summarizes the current status of the E-ELT Programme and presents some aspects related to scientific objectives, managerial organization, programmatic aspects and system engineering approach. It also outlines the procurement strategies put in place to achieve the goal of the Programme: building the 'world's biggest eye on the sky' within the next decade.

On successful completion of a conceptual design review by a funding agency or customer, there is a transition phase before construction contracts can be placed. The nature of this transition phase depends on the Project's approach to construction and the particular subsystem being considered. There are generically two approaches; project retention of design authority and issuance of build to print contracts, or issuance of subsystem performance specifications with controlled interfaces. This paper relates to the latter where a proof of concept (conceptual or reference design) is translated into performance based sub-system specifications for competitive tender. This translation is not a straightforward process and there are a number of different issues to consider in the process. This paper deals with primarily the Telescope mount and Enclosure subsystems. The main subjects considered in this paper are: • Typical status of design at Conceptual Design Review compared with the desired status of Specifications and Interface Control Documents at Request for Quotation. • Options for capture and tracking of system requirements flow down from science / operating requirements and sub-system requirements, and functional requirements derived from reference design. • Requirements that may come specifically from the contracting approach. • Methods for effective use of reference design work without compromising a performance based specification. • Management of project team's expectation relating to design. • Effects on cost estimates from reference design to actual. This paper is based on experience and lessons learned through this process on both the VISTA and the ATST projects.

Even though the executive branch has proposed terminating the Advanced Solid Rocket Motor (ASRM) program, NASA is proceeding with all construction activity planned for FY 1992 to avoid schedule slippage if the program is reinstated by Congress. However, NASA could delay some construction activities for at least a few months without affecting the current launch data schedule. For example, NASA could delay Yellow Creek's motor storage and dock projects, Stennis' dock project, and Kennedy's rotation processing and surge facility and dock projects. Starting all construction activities as originally planned could result in unnecessarily incurring additional costs and termination liability if the funding for FY 1993 is not provided. If Congress decides to continue the program, construction could still be completed in time to avoid schedule slippage.

Performance-based contracting for pavement in Japan started as performance warranties in construction phase, in 1999. Recently, road agencies have recognized the applicability of this type of contracting in outsourcing of maintenance activities. The objectives of this study are to clarify the issues of performance specifying in construction phase and maintenance phase of pavement, and to propose measures to be taken. This paper, with the recognition that the life of each pavement depends on performance standards for various attributes, reviews domestic and foreign examples of performance-based contracting. A performance standard based on the average of current practices can enhance product quality and service life with a warranty contract. Repair thresholds and response time for each deficiency should be considered as performance standards in maintenance phase.

The National Carbon Capture Center (NCCC) at the Power Systems Development Facility supports the Department of Energy (DOE) goal of promoting the United States’ energy security through reliable, clean, and affordable energy produced from coal. Work at the NCCC supports the development of new power technologies and the continued operation of conventional power plants under CO 2 emission constraints. The NCCC includes adaptable slipstreams that allow technology development of CO 2 capture concepts using coal-derived syngas and flue gas in industrial settings. Because of the ability to operate under a wide range of flow rates and process conditions, research atmore » the NCCC can effectively evaluate technologies at various levels of maturity and accelerate their development path to commercialization. During its first contract period, from October 1, 2008, through December 30, 2014, the NCCC designed, constructed, and began operation of the Post-Combustion Carbon Capture Center (PC4). Testing of CO 2 capture technologies commenced in 2011, and through the end of the contract period, more than 25,000 hours of testing had been achieved, supporting a variety of technology developers. Technologies tested included advanced solvents, enzymes, membranes, sorbents, and associated systems. The NCCC continued operation of the existing gasification facilities, which have been in operation since 1996, to support the advancement of technologies for next-generation gasification processes and pre-combustion CO 2 capture. The gasification process operated for 13 test runs, supporting over 30,000 hours combined of both gasification and pre-combustion technology developer testing. Throughout the contract period, the NCCC incorporated numerous modifications to the facilities to accommodate technology developers and increase test capabilities. Preparations for further testing were ongoing to continue advancement of the most promising technologies for future power generation processes.« less

Contractile recovery of microtissues after giant shear events

Cells are often dispersed in extracellular matrix (ECM) gels like collagen and Matrigel as minimal tissue models. Generally, large-scale contraction of these constructs is observed, in which the degree of contraction of the entire system correlates with cell density and ECM concentration. The freedom to perform diverse mechanical experiments on these contracting constructs is limited by the challenges of handling and supporting these delicate samples. Here, we present a method to create simple cell-ECM constructs that can be manipulated with significantly reduced experimental limitations. We 3D print mixtures of MCF10A cells and ECM (collagen-I and Matrigel) into a 3D growth medium made from jammed microgels. With this approach, we are able to apply shear stresses to the cell constructs times after printing and observe the collective response. Preliminary results reveal that, following shear deformations that exceed 300% and dramatically smear cells and matrix in space, the cells actively re-contract the construct toward the un-sheared construct. These results suggest that new principles of collective recovery can be employed for tissue engineering applications using jammed microgels as a re-configurable support medium.
