That proposed rulemaking serves as the basis for today's action. DOE is amending its test procedures for GSFLs and GSILs established under the Energy Policy and Conservation Act (EPCA). DOE is not amending in this final rule the existing test procedure for IRLs established under EPCA. For GSFLs and GSILs, DOE is updating several references to the industry standards referenced in DOE's test procedures. DOE is also establishing a lamp lifetime test procedure for GSILs. These test procedures also provide the protocols upon which the Federal Trade Commission bases its energy guide label for these products. DOE's review of the GSFL, GSIL, and IRL test procedures fulfills the EPCA requirement that DOE review test procedures for all covered products at least once every seven years.

The US Food and Drug Administration (FDA) uses rulemaking as one of its primary tools to protect the public health and implement laws enacted by Congress and the president. Because of the many effects that these rules have on social welfare and the economy, the FDA and other executive agencies receive input from the executive branch, the public, and in some cases, the courts, during the process of rulemaking. In this article, we examine the life cycle of FDA regulations concerning medical products and review notable features of the rulemaking process. The current system grants substantial opportunities for diverse stakeholders to participate in and influence how rules are written and implemented. However, the duration, complexity, and adversarial qualities of the rulemaking process can hinder the FDA's ability to achieve its policy and public health goals. There is considerable variation in the level of transparency at different stages in the process, ranging from freely accessible public comments to undisclosed internal agency deliberations. In addition, significant medical product rules are associated with lengthy times to finalization, in some cases for unclear reasons. We conclude by identifying potential areas for reform on the basis of transparency and efficiency. Copyright © 2014 by Duke University Press.

This document supplements a 2005 notice of proposed rulemaking (NPRM) and a 2008 SNPRM previously published in this rulemaking (RIN 2127-AJ44) regarding this test dummy. In the 2005 NPRM, in response to Anton's Law, NHTSA proposed to adopt the 10-year-old child test dummy into FMVSS No. 213 to test child restraints for older children. Subsequently, to address variation that was found in dummy readings due to chin-to-chest contact, NHTSA published the 2008 SNPRM to propose a NHTSA-developed procedure for positioning the test dummy in belt-positioning seats. Comments on the SNPRM objected to the positioning procedure, and some suggested an alternative procedure developed by the University of Michigan Transportation Research Institute (UMTRI). Today's SNPRM proposes to use the UMTRI procedure to position the test dummy rather than the NHTSA-developed procedure. We note that the 10-year-old child dummy may sometimes experience stiff contact between its chin and upper sternal bib region which may result in an unrealistically high value of the head injury criterion (HIC) \\1\\ referenced in the standard. Accordingly, NHTSA proposes that the dummy's HIC measurement will not be used to assess the compliance of the tested child restraint. This SNPRM also proposes other amendments to FMVSS No. 213, including a proposal to permit NHTSA to use, at the manufacturer's option, the Hybrid II or Hybrid III versions of the 6-year-old test dummy, and a proposal to use the UMTRI procedure to position the Hybrid III 6-year- old and 10-year-old dummies when testing belt-positioning seats. ---------------------------------------------------------------------------

Strategic management of degrading coastal aquifers in eastern North Carolina (USA) became imperative after a severe imbalance occurred between withdrawal and recharge rates. To ameliorate this growing problem, an aggressive water policy was developed through public input by creating the Central Coastal Plain Capacity Use Area (CCPCUA) to maintain beneficial use of groundwater resources. Insights from social psychology, and socio-legal studies are used to evaluate how procedural justice and public participation played major roles to resolving groundwater resource management problems. A mixed methods approach uses archival data and interviews with various rule-making participants to assess the process of stakeholder involvement that led to creation of the policy. In addition, data analysis techniques are utilized to evaluate the effects of the policy on aquifer health (through water levels) over a ˜10 year period. Results suggest that not only did a stakeholder group participate in a process that was deemed fair, understandable, and relatively easy to administer for users and regulators, but public participation resulted in an effective plan that ensures the long-term sustainable use of groundwater. Declining groundwater withdrawals and recovering water levels suggest that the rule is achieving its intended goal of protecting the aquifers from depletion and degradation. This paper touches on global themes that are essential to water demand and consumption, water management techniques, and water resources protection.

The Food and Drug Administration (FDA) frequently uses its rulemaking process to establish or modify the way it regulates drugs, medical devices, and other medical products. The federal agency's rulemaking is controversial because of its perceived complexity, lack of transparency, and lengthy duration. To shed light on the FDA's rulemaking process, we examined the evolution of significant rules that the agency published during 2000-12 for drugs, devices, and other medical products. We found that the rules' median time to finalization was 7.3 years, with the pre-rule phase and postreview deliberation within the FDA accounting for the majority of that time. Rules that involved mandatory cost-benefit analyses were associated with an additional delay of approximately two years. We also found that longer review times were significantly associated with a reduction in the stringency of final rules, compared to the originally proposed versions. We recommend improving FDA's rulemaking by allocating additional resources to increase efficiency and by embarking on initiatives to promote transparency by the FDA and other parts of the executive branch.

SBA proposes to amend 13 CFR 108.503--4(c) to limit SBA participation with tax-exempt financing under the program authorized by section 503 of the Small Business Investment Act, 15 U.S.C. 697. Under the proposed rule, SBA would participate in the financing of a project which is also financed by tax-exempt obligations provided the repayment of the proceeds of SBA guaranteed financing is not subordinate to the repayment of the tax-exempt financing. This amendment would be in accordance with existing Federal policy which prohibits Federal agencies from directly or indirectly providing a guarantee to tax-exempt obligations.

Physical Protection of Spent Fuel Shipments: Resolution of Stakeholder Concerns Through Rulemaking - 12284

In 1999, the State of Nevada brought its concerns about physical protection of current spent nuclear fuel (SNF) shipments, and future SNF shipments to a federal repository, before the NRC in a 1999 petition for rulemaking (PRM-73-10). In October 2010, the NRC published a rulemaking decision which would significantly strengthen physical protection of SNF in transit. The newest articulation of the rule (10 CFR 73.37) incorporates regulatory clarifications and security enhancements requested in Nevada's 1999 petition for rulemaking, codifies the findings of the Nuclear NRC and DOE consequence analyses into policy guidance documents and brings forward into regulations the agencymore » and licensee experience gained since the terrorist attacks of September 11, 2001. Although at present DOE SNF shipments would continue to be exempt from these NRC regulations, Nevada considers the rule to constitute a largely satisfactory resolution to stakeholder concerns raised in the original petition and in subsequent comments submitted to the NRC. This paper reviews the process of regulatory changes, assesses the specific improvements contained in the new rules and briefly describes the significance of the new rule in the context of a future national nuclear waste management program. Nevada's petition for rulemaking led to a generally satisfactory resolution of the State's concerns. The decade plus timeframe from petition to rulemaking conclusion saw a sea change in many aspects of the relevant issues - perhaps most importantly the attacks on 9/11 led to the recognition by regulatory bodies that a new threat environment exists wherein shipments of SNF and HLW pose a viable target for human initiated events. The State of Nevada has always considered security a critical concern for the transport of these highly radioactive materials. This was one of the primary reasons for the original rulemaking petition and subsequent advocacy by Nevada on related issues. NRC decisions on the majority of the concerns expressed in the petition, additional developments by other regulatory bodies and the change in how the United States sees threats to the homeland - all of these produced a satisfactory resolution through the rulemaking process. While not all of the concerns expressed by Nevada were addressed in the proposed rule and significant challenges face any programmatic shipment campaign in the future, the lesson learned on this occasion is that stakeholder concerns can be resolved through rulemaking. If DOE would engage with stakeholders on its role in transport of SNF and HLW under the NWPA, these concerns would be better addressed. Specifically the attempts by DOE to resist transportation and security regulations now considered necessary by the NRC for the adequate protection of the shipments of highly radioactive materials, these DOE efforts seem ill advised. One clear lesson learned from this successful rulemaking petition process is that the system of stakeholder input can work to better the regulatory environment. (authors)« less

Increasing public confidence in the U.S. Nuclear Regulatory Commission (NRC) as an effective and independent regulator is an explicit goal of the Agency (1). Consistent with long-established mechanisms and procedures, NRC provides the public access to its decision-making process. Recently, during the course of a rulemaking required by statute, NRC examined its means for inviting public access as well as the NRC staff's effectiveness in furthering public confidence in it's actions as a regulator. When developing new, site-specific regulations for the proposed geologic repository at Yucca Mountain, Nevada, NRC's Division of Waste Management found it necessary to adapt and improvemore » its efforts to inform and involve the public in NRC's decision making process. Major changes were made to the way in which technical staff prepare for speaking to general audiences. The format used for public meetings was modified to encourage dialogue with participants. Handout and presentation materials that explain NRC's role and technical topics of concern in plain language were developed and are regularly updated. NRC successfully applied these and other institutional changes as it completed final regulations for Yucca Mountain and while developing and introducing a draft license review plan for public comment.« less

In 2011 and 2012, the Secretary, Department of Health and Human Services (HHS), promulgated regulations designed to govern the World Trade Center (WTC) Health Program (Program), including the processes by which eligible responders and survivors may apply for enrollment in the Program, obtain health monitoring and treatment for WTC-related health conditions, and appeal enrollment and treatment decisions, as well as a process to add new conditions to the List of WTC-Related Health Conditions (List). After using the regulations for a number of years, the Administrator of the WTC Health Program identified potential improvements to certain existing provisions, including, but not limited to, appeals of enrollment, certification, and treatment decisions, as well as the procedures for the addition of health conditions for WTC Health Program coverage. He also identified the need to add new regulatory provisions, including, but not limited to, standards for the disenrollment of a WTC Health Program member and decertification of a certified WTC-related health condition. A notice of proposed rulemaking was published on August 17, 2016; this action addresses public comments received on that proposed rulemaking, as well as three interim final rules promulgated since 2011, and finalizes the proposed rule and three interim final rules.

This staff report, prepared by the F.T.C.'s Bureau of Consumer Protection for Commission review, includes recommendations as to the final form of a trade regulation rule relating to the labeling and advertising of home insulation. Because of marketing abuses which accompanied the rising demand for home insulation, there has been broad support for a rule requiring information disclosures to help purchasers of home insulation to make an informed decision. The Commission, to provide such rule as quickly as possible, undertook its rulemaking proceeding under its new expedited rulemaking procedure. The rule was proposed on November 18, 1977, and, following amore » two-month period for written comments, four weeks of hearings were held in Washington, D.C. in February 1978. The record, contributed to by a variety of interests, shows that consumers do not know how to shop for home insulation. The staff-recommended rule, among other things, would require that insulation be tested and R-values (a measure of insulation's ability to retain heat) disclosed on labels and in advertising. To facilitate comparison shopping, the industry would also be required to furnish consumers with fact sheets describing, on a product-to-product basis, factors that can reduce the R-value of insulation.« less
