The Mental Health (Care and Treatment) (Scotland) Act 2003 introduced the right for patients in high-security psychiatric care to appeal against detention in conditions of excessive security. A previous study examined the first 100 patients to appeal under this provision. In this study we compare them with the next cohort of 110 patients to lodge an appeal, finding, contrary to expectations, no change in patient characteristics or the outcome of their appeals. The clinical, legal and demographic features of successful and unsuccessful appellants, who made up 38% and 27% of the 110 patients, respectively, were also compared. Those patients with the support of their responsible medical officer and those already included on a transfer list had a significantly better chance of success (p = 0.00). It was also found that a history of excessive alcohol consumption was associated with successful appeals (p = 0.002). A diagnosis of learning disability was associated with unsuccessful appeals (p = 0.018), though the sub-sample was very small. These findings are important given the forthcoming extension of this right of appeal to other levels of security. © The Author(s) 2015.

Empirical Analysis and Automated Classification of Security Bug Reports

With the ever expanding amount of sensitive data being placed into computer systems, the need for effective cybersecurity is of utmost importance. However, there is a shortage of detailed empirical studies of security vulnerabilities from which cybersecurity metrics and best practices could be determined. This thesis has two main research goals: (1) to explore the distribution and characteristics of security vulnerabilities based on the information provided in bug tracking systems and (2) to develop data analytics approaches for automatic classification of bug reports as security or non-security related. This work is based on using three NASA datasets as case studies. The empirical analysis showed that the majority of software vulnerabilities belong only to a small number of types. Addressing these types of vulnerabilities will consequently lead to cost efficient improvement of software security. Since this analysis requires labeling of each bug report in the bug tracking system, we explored using machine learning to automate the classification of each bug report as a security or non-security related (two-class classification), as well as each security related bug report as specific security type (multiclass classification). In addition to using supervised machine learning algorithms, a novel unsupervised machine learning approach is proposed. An ac- curacy of 92%, recall of 96%, precision of 92%, probability of false alarm of 4%, F-Score of 81% and G-Score of 90% were the best results achieved during two-class classification. Furthermore, an accuracy of 80%, recall of 80%, precision of 94%, and F-score of 85% were the best results achieved during multiclass classification.

Environmental campaigns often promote energy conservation by appealing to economic (for example, lower electricity bills) rather than biospheric concerns (for example, reduced carbon emissions), assuming that people are primarily motivated by economic self-interest. However, people also care about maintaining a favourable view of themselves (they want to maintain a `positive self-concept'), and may prefer to see themselves as `green' rather than `greedy'. Consequently, people may find economic appeals less attractive than biospheric appeals. Across two studies, participants indicated feeling better about biospheric (`Want to protect the environment? Check your car's tire pressure') than economic (`Want to save money? Check your car's tire pressure') tyre-check appeals. In a field experiment, we found that an economic tyre-check appeal (`Do you care about your finances? Get a free tire check') elicited significantly less compliance than parallel biospheric and neutral appeals. Together, these studies discredit the conventional wisdom that appealing to economic self-interest is the best way to secure behaviour change. At least in some cases, our studies suggest, this strategy is not effective.

A federal appeals court recently ruled that a member of a Catholic religious institute assigned by her superiors to serve with a county hospital was subject to Social Security withholding on earnings from that service. Consequently, Catholic institute members will have Social Security taxes withheld whenever they serve with an entity not associated with the Church, that is, any entity not listed in the Official Catholic Directory. The ruling hinges on the contention that the sister could not have been "required" by her superiors to serve with the county hospital, since the hospital had final authority to determine who its employees would be, and that she thereby failed to qualify for the exception to Social Security withholding in Internal Revenue Code section 3121(b)(8)(A) for members of religious institutes performing service "'required" by their superiors. Because virtually all employers have this final authority, however, the appeals court's ruling leaves in doubt the perimeters of the exception to Social Security withholding in section 3121(b)(8)(A).

The distinction between vertical (emphasizing hierarchy) and horizontal (valuing equality) cultures yields novel predictions regarding the prevalence of advertising appeals. A content analysis of 1211 magazine advertisements in five countries (Denmark, Korea, Poland, Russia, U.S.) revealed differences in ad content that underscore the value of this distinction. Patterns in the degree to which ads emphasized status benefits and uniqueness benefits corresponded to the countries' vertical/horizontal cultural classification. These and other patterns of ad benefits are analyzed and the predictions afforded by the vertical/horizontal distinction versus the broader individualism-collectivism distinction are compared and tested. This final rule implements provisions of the Patient Protection and Affordable Care Act and the Health Care and Education Reconciliation Act of 2010 (collectively referred to as the Affordable Care Act). Specifically, this final rule outlines Exchange standards with respect to eligibility appeals, agents and brokers, privacy and security, issuer direct enrollment, and the handling of consumer cases. It also sets forth standards with respect to a State's operation of the Exchange and Small Business Health Options Program (SHOP). It generally is finalizing previously proposed policies without change.

[Name removed] applied for and received Social Security benefits after losing his job at The Disney Stores, Inc. [Name removed], who has AIDS, alleges he was fired in violation of the Americans with Disabilities Act (ADA). The 3rd U.S. Circuit Court of Appeals said [name removed] could not sue [name removed] because of a discrepancy between his statements on the disability application and in the lawsuit. The Court said he had to choose between suing and accepting disability benefits. The court would not accept [name removed]'s argument that the definitions of disability under the Social Security Act and the ADA differed significantly. The U.S. Supreme Court has been asked to overturn this ruling. In a related case, the Michigan Court of Appeals invoked judicial estoppel to bar a worker from suing his employer under the State Handicappers' Civil Rights Act.
