The Bureau is in the process of republishing the regulations implementing those laws with technical and conforming changes to reflect the transfer of authority and certain other changes made by the Dodd-Frank Act. In light of the transfer of the Department of Housing and Urban Development's (HUD's) rulemaking authority for the Real Estate Settlement Procedures Act (RESPA) to the Bureau, the Bureau is publishing for public comment an interim final rule establishing a new Regulation X (Real Estate Settlement Procedures Act). This interim final rule does not impose any new substantive obligations on persons subject to the existing Regulation X, previously published by HUD.

The Human Settlements Authority Act, 1988 (No. 2 of 1988), 4 June 1986.

This Act establishes in Swaziland the Human Settlements Authority, whose members are appointed by the Minister responsible for human settlements. The Authority shall "1) assist the Government in formulating policy relating to human settlements and uphold and give effect to such policy; 2) ensure the orderly development of existing and future urban and rural settlements; 3) establish a finance mechanism for ensuring the supply and maintenance of improved shelter and infrastructure throughout Swaziland, which shall include a system of revenue recovery; 4) prepare appropriate standards for the provision of land, shelter and infrastructure by both private and public developers; 5) regulate real estate transactions including the standardization of lease agreements, rent control and sale of land and buildings; 6) encourage and support research in appropriate methods of providing affordable shelter and infrastructure; and 7) perform all other acts or things as are required by this Act." Under the Act, no person shall establish a human settlement, housing scheme, or private housing scheme without the written permission of the Authority. Further provisions of the Act deal with the membership and meetings of the Authority, the granting of permission for human settlements, and human settlement development plans, among other things. On 4 June 1986, the Government of Swaziland also enacted the National Housing Board Act, 1988 (No. 3 of 1988). This Act establishes a National Housing Board, subject to the provisions of the Human Settlements Act, 1988, to "provide affordable housing generally in Swaziland and take over such housing schemes as the Government may determine." Further provisions of the Act deal with the functions, membership, finances, staffing, assets, and administration of the Board. FMLA will substantially influence the administration of employee benefits. The plan sponsor, trustees, plan administrator and collective bargaining parties must make a number of policy decisions. These include employer reporting and contribution procedures, settlement of eligibility questions, delinquency procedures, coordination with COBRA, substitution of vacation and sick leave rights and procedures, restrictions on participants working during leave, procedures for the non-forfeiture of accrued benefits and restoration of benefits. After the policy decisions are made and the procedures are established, the proper notices and caveats must be communicated to plan participants, and the plan must update the SPD. Each of the policy decisions, administrative procedures and participant communications must be carefully thought out before implementation. Plan sponsors, trustees and plan administrators should seek the help, advice and assistance of the plan's professional advisers.

In the American southwest, over-allocated water supplies, groundwater depletion, and potential climate change impacts are major water management concerns. It may therefore seem counterintuitive that the resolution of outstanding senior tribal water claims, essentially reallocating finite water supplies to tribes, could support improved water supply reliability for many water users as is the case with the 2004 Arizona Water Settlements Act. The large size of the settlement and its multiple components translate to significant impacts on water policy in Arizona. Key water management solutions incorporated into the settlement and associated legislation have expanded the water manager's "toolbox" and are expected to enhance water supply reliability both within and outside Arizona's active management areas. Many of these new tools are transferable to water management applications in other states.

Conservation and restoration of traditional settlements are amongst the actions that international directives proclaim in order to protect our cultural heritage. Towards this end, a mandatory base step in all archaeological and historical practices includes the surveying and mapping of the study area. Often, new, unexplored or abandoned settlements are considered, where dense vegetation, damaged structures and ruins, incorporation of newer structures and renovation characteristics make the precise surveying procedure a labor intensive and time consuming procedure. Unmanned airborne vehicles (UAVs) have been effectively incorporated into several cultural heritage projects mainly for mapping archeological sites. However, the majority of relevant publications lack of quantitative evaluation of their results and when such a validation is provided it is rather a procedural error estimation readily available from the software used, without independent ground truth verification. In this study, a low-cost custom-built hexacopter prototype was employed to deliver accurate mapping of the traditional settlement of Kamariotis in east Crete, Greece. The case of Kamariotis settlement included highly dense urban structures with continuous building forms, curved walls and missing terraces, while wild vegetation made classic geodetic surveying unfeasible. The resulting maps were qualitatively compared against the ones derived using Google Earth and the Greek Cadastral Orthophoto Viewing platforms to evaluate their applicability for architectural mapping. Moreover, the overall precision of the photogrammetric procedure was compared against geodetic surveying.

Settlements around pumping wells: Analysis of influential factors and a simple calculation procedure

Estimated and measured settlements caused by pumping rarely agree. Several reasons could explain this mismatch, including the influence of layering, the mechanical parameters used in the predictions, or the relationship between settlements and drawdown. We analyze the influence of the above issues by investigating the mechanical response of pumped elastic porous media under different conditions. A radially symmetric conceptual model is considered and several hydro-mechanical simulations are performed varying the boundary conditions, the size of the modeled domain and the presence or not of an overlying layer. The simplicity of the considered problem allows us to compare our results with existing analytical solutions, to identify the role of each variable on pumping settlements and to generalize the results. The most relevant results are as follows: (1) settlements are proportional to drawdown only outside a circle of radius equal to 0.7 times the thickness of the pumped porous medium; inside, they are virtually constant, which leads to two simple procedures for computing pumping settlements. (2) Poorly conductive layers located above (or below) a pumped porous medium (with higher hydraulic conductivity) reduce and smooth settlements. (3) Boundary constraints affect the local specific storage coefficient and the displacements occurred. (4) The specific storage coefficient evaluated by interpreting pumping tests with the Cooper and Jacob method (1946) leads to overestimation of the actual Young's Modulus of the soil. The main conclusion is that settlements are less differential than expected near pumping wells. Still, they must always be evaluated acknowledging the nature of layering, the boundary constraints and carefully selecting the mechanical parameters of the soil.

An iterative procedure for numerical prediction of long-term degradation of railway track geometry (longitudinal level) due to accumulated differential settlement of ballast/subgrade is presented. The procedure is based on a time-domain model of dynamic vehicle-track interaction to calculate the contact loads between sleepers and ballast in the short-term, which are then used in an empirical model to determine the settlement of ballast/subgrade below each sleeper in the long-term. The number of load cycles (wheel passages) accounted for in each iteration step is determined by an adaptive step length given by a maximum settlement increment. To reduce the computational effort for the simulations of dynamic vehicle-track interaction, complex-valued modal synthesis with a truncated modal set is applied for the linear subset of the discretely supported track model with non-proportional spatial distribution of viscous damping. Gravity loads and state-dependent vehicle, track and wheel-rail contact conditions are accounted for as external loads on the modal model, including situations involving loss of (and recovered) wheel-rail contact, impact between hanging sleeper and ballast, and/or a prescribed variation of non-linear track support stiffness properties along the track model. The procedure is demonstrated by calculating the degradation of longitudinal level over time as initiated by a prescribed initial local rail irregularity (dipped welded rail joint).

The understanding of long-term landfill settlement is important for landfill design and rehabilitation. However, suitable models that can consider both the mechanical and biodecomposition mechanisms in predicting the long-term landfill settlement are generally not available. In this paper, a model based on unsaturated consolidation theory and considering the biodegradation process is introduced to simulate the landfill settlement behaviour. The details of problem formulations and the derivation of the solution for the formulated differential equation of gas pressure are presented. A step-by-step analytical procedure employing this approach for estimating settlement is proposed. The proposed model can generally model the typical features of short-term and long-term behaviour. The proposed model also yields results that are comparable with the field measurements.

Recent studies of recruitment dynamics in demersal fishes have placed major emphasis on presettlement mortality, and little on events bridging late larval and early juvenile periods. Observations on 68 taxa of Caribbean coral reef fishes before and during settlement revealed the existence of a distinct post-settlement life phase called the transition juvenile, associated with the act of recruitment. Transition juveniles were found as solitary individuals, in conspecific groups, or in heterospecific groups. The groups were either uniform or heterogenous in appearance. The complexity of the transition phase and its apparently widespread occurrence in coral reef fishes suggests that important aspects of population structure may be determined between settlement and first appearance as a full-fledged juvenile.

The process for obtaining, transferring, or surrendering a Federal Energy Regulatory Commission (FERC) hydropower license or exemption from licensing can be a series of complex negotiations. In many instances, the process may include stakeholders with different and/or competing perspectives or objectives related to the original license, new license (i.e., relicense), transfer of a license, or surrender of a license. Divergent perspectives and objectives can lead to disputes among project participants, which may impact the development of FERC license terms and conditions. One mechanism to resolve disputes between project participants involving a FERC authorization is informal and formal settlement agreement conferences,more » which often result in settlement agreements addressing the disputed issues. This report provides hydropower stakeholders with a better understanding of the FERC settlement agreement process, including information on: How to initiate a settlement agreement. Like the majority of benthic invertebrates, the blue mussel Mytilus edulis has a bentho-pelagic cycle with its larval settlement being a complex phenomenon involving numerous factors. Among these factors, underwater noise and pelagic trophic conditions have been weakly studied in previous researches. Under laboratory conditions, we tested the hypothesis that picoplankton assimilation by the pediveliger blue mussel larvae acts as a food cue that interacts with anthropic underwater sound to stimulate settlement. We used 13C-labeling microalgae to validate the assimilation of different picoplankton species in the tissues of pediveliger larvae. Our results clearly confirm our hypothesis with a significant synergic effect of these two factors. However, only the picoeukaryotes strains assimilated by larvae stimulated the settlement, whereas the non-ingested picocyanobacteria did not. Similar positive responses were observed with underwater sound characterized by low frequency vessel noises. The combination of both factors (trophic and vessel noise) drastically increased the mussel settlement by an order of 4 compared to the control (without picoplankton and noise). Settlement levels ranged from 16.5 to 67% in 67 h.

Malodorous consequences: what comprises negligence in anosmia litigation?

Our objectives were to evaluate factors raised in malpractice litigation in which plaintiffs alleged that physician negligence led to olfactory dysfunction. We analyzed publically available federal and court records using Westlaw, a widely used computerized legal database. Pertinent jury verdicts and settlements were comprehensively examined for alleged causes of malpractice (including procedures for iatrogenic causes), defendant specialty, patient demographics, and other factors raised in legal proceedings. Of 25 malpractice proceedings meeting inclusion criteria, 60.0% were resolved for the defendant, 12.0% were settled, and 28.0% had jury-awarded damages. Median payments were significant ($300,000 and $412,500 for settlements and awards, respectively). Otolaryngologists were the most frequently named defendants (68.0%), with the majority of iatrogenic cases (55.0%) related to rhinologic procedures. Associated medical events accompanying anosmia included dysgeusia, cerebrospinal fluid leaks, and meningitis. Other alleged factors included requiring additional surgery (80.0%), unnecessary procedures (47.4% of iatrogenic procedural cases), untimely diagnosis leading to anosmia (44.0%), inadequate informed consent (35.0%), dysgeusia (56.0%), and psychological sequelae (24.0%). Olfactory dysfunction can adversely affect quality of life and thus is a potential area for malpractice litigation. This is particularly true for iatrogenic causes of anosmia, especially following rhinologic procedures. Settlements and damages awarded were considerable, making an understanding of factors detailed in this analysis of paramount importance for the practicing otolaryngologist. This analysis reinforces the importance of explicitly including anosmia in a comprehensive informed consent process for any rhinologic procedure. © 2013 ARS-AAOA, LLC.

Homonymous entity matching is an important part of multi-source spatial data integration, automatic updating and change detection. Considering the low accuracy of existing matching methods in dealing with matching multi-scale settlement data, an algorithm based on Attributed Relational Graph (ARG) is proposed. The algorithm firstly divides two settlement scenes at different scales into blocks by small-scale road network and constructs local ARGs in each block. Then, ascertains candidate sets by merging procedures and obtains the optimal matching pairs by comparing the similarity of ARGs iteratively. Finally, the corresponding relations between settlements at large and small scales are identified. At the end of this article, a demonstration is presented and the results indicate that the proposed algorithm is capable of handling sophisticated cases.

Over the last decades 3D modelling has been a fast growing field in Geographic Information Science, extensively applied in various domains including reconstruction and visualization of cultural heritage, especially monuments and traditional settlements. Technological advances in computer graphics, allow for modelling of complex 3D objects achieving high precision and accuracy. Procedural modelling is an effective tool and a relatively novel method, based on algorithmic modelling concept. It is utilized for the generation of accurate 3D models and composite facade textures from sets of rules which are called Computer Generated Architecture grammars (CGA grammars), defining the objects' detailed geometry, rather than altering or editing the model manually. In this paper, procedural modelling tools have been exploited to generate the 3D model of a traditional settlement in the region of Central Zagori in Greece. The detailed geometries of 3D models derived from the application of shape grammars on selected footprints, and the process resulted in a final 3D model, optimally describing the built environment of Central Zagori, in three levels of Detail (LoD). The final 3D scene was exported and published as 3D web-scene which can be viewed with 3D CityEngine viewer, giving a walkthrough the whole model, same as in virtual reality or game environments. This research work addresses issues regarding textures' precision, LoD for 3D objects and interactive visualization within one 3D scene, as well as the effectiveness of large scale modelling, along with the benefits and drawbacks that derive from procedural modelling techniques in the field of cultural heritage and more specifically on 3D modelling of traditional settlements.

The objective was to describe characteristics of civil monetary penalty settlements levied by the Office of the Inspector General (OIG) against individual physicians related to violation of the Emergency Medical Treatment and Labor Act (EMTALA). Descriptions of all civil monetary penalty settlements between 2002 and 2015 were obtained from the OIG. Characteristics of settlements against individual physicians related to EMTALA violations were described including settlement date, location, amount, whether there was an associated hospital settlement, the medical specialty of the physician involved, and the nature of the allegation. Of 196 OIG civil monetary penalty settlements related to EMTALA, eight (4%) were levied against individual physicians, and 188 (96%) against facilities. Seven of the eight penalties against individual physicians were imposed upon on-call specialists, including six who failed to respond to evaluate and treat a patient in the emergency department (ED), and one who failed to accept appropriate transfer of a patient requiring higher level of care. The only penalty imposed on an emergency physician involved a case where a provider repeatedly failed to provide a medical screening examination to a pregnant teen based on the erroneous belief that a minor could not be evaluated or treated absent parental consent. Four of eight penalties against individual physicians were levied within the first 3 years of the 14-year study period. Half of all physician settlements were associated with a separate hospital civil monetary penalty settlement. For emergency physicians, a civil monetary penalty is a feared consequence of EMTALA enforcement, as a physician can be held individually liable for fine of up to $50,000 not covered by malpractice insurance. Although EMTALA is an actively enforced law, and violation of the EMTALA statute often results in hospital citations and fines, and occasionally facility closure, we found that individual physicians are rarely penalized by the OIG following EMTALA violation. Individual physician penalties are far less common than hospital citations or fines related to EMTALA or malpractice claims or payments. The majority of penalties against individual physicians were levied upon on-call specialists who refused to evaluate and treat ED patients. Only one emergency physician was fined during the study period for a clear violation of the EMTALA statute. Physicians should be diligent to ensure appropriate patient care and that facilities are compliant with the EMTALA statute, but should be aware that settlements against individual physicians are a rare consequence of EMTALA enforcement. © 2017 by the Society for Academic Emergency Medicine.

The majority of marine invertebrates produce dispersive larvae which, in order to complete their life cycles, must attach and metamorphose into benthic forms. This process, collectively referred to as settlement, is often guided by habitat-specific cues. While the sources of such cues are well known, the links between their biological activity, chemical identity, presence and quantification in situ are largely missing. Previous work on coral larval settlement in vitro has shown widespread induction by crustose coralline algae (CCA) and in particular their associated bacteria. However, we found that bacterial biofilms on CCA did not initiate ecologically realistic settlement responses in larvae of 11 hard coral species from Australia, Guam, Singapore and Japan. We instead found that algal chemical cues induce identical behavioral responses of larvae as per live CCA. We identified two classes of CCA cell wall-associated compounds – glycoglycerolipids and polysaccharides – as the main constituents of settlement inducing fractions. These algae-derived fractions induce settlement and metamorphosis at equivalent concentrations as present in CCA, both in small scale laboratory assays and under flow-through conditions, suggesting their ability to act in an ecologically relevant fashion to steer larval settlement of corals. The World Trade Organization (WTO) dispute settlement procedure is a key arena for establishing global legal norms for what counts as relevant knowledge. As a high-profile case, the WTO trade dispute on GMOs mobilized scientific expertise in somewhat novel ways. Early on, the Panel put the dispute under the Sanitary and Phytosanitary (SPS) Agreement through a new legal ontology; it classified transgenes as potential pests and limited all environmental issues to the 'plant and animal health' category. The selection of scientific experts sought a multi-party consensus through a fast adversarial process, reflecting a specific legal epistemology. For the SPS framing, focusing on the defendant's regulatory procedures, the Panel staged scientific expertise in specific ways that set up how experts were questioned, the answers they would give, their specific role in the legal arena, and the way their statements would complement the Panel's findings. In these ways, the dispute settlement procedure co-produced legal and scientific expertise within the Panel's SPS framework. Moreover, the Panel operated a procedural turn in WTO jurisprudence by representing its findings as a purely legal-administrative judgement on whether the EC's regulatory procedures violated the SPS Agreement, while keeping implicit its own judgements on substantive risk issues. As this case illustrates, the WTO settlement procedure mobilizes scientific expertise for sophisticated, multiple aims: it recruits a source of credibility from the scientific arena, thus reinforcing the standard narrative of 'science-based trade discipline', while also constructing new scientific expertise for the main task--namely, challenging trade restrictions for being unduly cautious.

Water resource management requires collaborative solutions that cross institutional and political boundaries. This work describes the development and use of a computer-based tool for assessing the impact of additional water allocation from the Gila River and the San Francisco River prescribed in the 2004 Arizona Water Settlements Act. Between 2005 and 2010, Sandia National Laboratories engaged concerned citizens, local water stakeholders, and key federal and state agencies to collaboratively create the Gila-San Francisco Decision Support Tool. Meningitis is a potential complication in otolaryngologic procedures and conditions. Severe sequelae make understanding factors involved in relevant malpractice litigation critical. We analyze pertinent litigation for awards, outcomes, patient demographic factors, and other alleged causes of malpractice. Pertinent jury verdict and settlement reports were examined using the Westlaw legal database (Thomson Reuters, New York, NY). Twenty-three cases (60.5%) involved non-iatrogenic injuries, including inadequate treatment or failure to diagnose sinusitis or otitis media, while 15 (39.5%) involved iatrogenic cases, mostly rhinologic procedures. 36.8% of cases were resolved for the defendant, 28.9% with juries awarding damages, and 34.2% with settlements. Although not statistically significant, mean damages awarded were higher than settlements ($2.1 vs. 1.5M, p=0.056), and cases involving pediatric patients were more likely to be resolved with payment than those with adult litigants (80.0% vs. 52.2%, p=0.08 respectively). Other frequent alleged factors included permanent deficits (63.2%), requiring additional surgery (41.1%), death (34.2%), cognitive deficits (21.2%), deafness (15.8%), and inadequate informed consent (33.0% of iatrogenic cases). Practitioners facing litigation related to meningitis may wish to consider these findings, notably for cases involving death or permanent functional deficits, as cases with out of court settlements tended to be resolved with lower payments. Cases involving misdiagnosis may be more likely to be resolved with payment compared with iatrogenic cases. By understanding the issues detailed in this analysis and including them in the informed consent process for patients undergoing rhinologic and otologic procedures, otolaryngologists may potentially improve patient safety and decrease liability. © 2014.

The Emergency Medical Treatment and Labor Act (EMTALA) of 1986 was enacted to prevent hospitals from "dumping" or refusing service to patients for financial reasons. The statute prohibits discrimination of emergency department (ED) patients for any reason. The Office of the Inspector General (OIG) of the Department of Health and Human Services enforces the statute. The objective of this study is to determine the scope, cost, frequency and most common allegations leading to monetary settlement against hospitals and physicians for patient dumping. Review of OIG investigation archives in May 2015, including cases settled from 2002-2015 ( https://oig.hhs.gov/fraud/enforcement/cmp/patient_dumping.asp ). There were 192 settlements (14 per year average for 4000+ hospitals in the USA). Fines against hospitals and physicians totaled $6,357,000 (averages $33,435 and $25,625 respectively); 184/192 (95.8%, $6,152,000) settlements were against hospitals and eight against physicians ($205,000). Most common settlements were for failing to screen 144/192 (75%) and stabilize 82/192 (42.7%) for emergency medical conditions (EMC). There were 22 (11.5%) cases of inappropriate transfer and 22 (11.5%) more where the hospital failed to transfer. Hospitals failed to accept an appropriate transfer in 25 (13.0%) cases. Patients were turned away from hospitals for insurance/financial status in 30 (15.6%) cases. There were 13 (6.8%) violations for patients in active labor. In 12 (6.3%) cases, the on-call physician refused to see the patient, and in 28 (14.6%) cases the patient was inappropriately discharged. Although loss of Medicare/Medicaid funding is an additional possible penalty, there were no disclosures of exclusion of hospitals from federal funding. There were 6,035 CMS investigations during this time period, with 2,436 found to have merit as EMTALA violations (40.4%). However, only 192/6,035 (3.2%) actually resulted in OIG settlements. The proportion of CMS-certified EMTALA violations that resulted in OIG settlements was 7.9% (192/2,436). Of 192 hospital and physician settlements with the OIG from 2002-15, most were for failing to provide screening (75%) and stabilization (42%) to patients with EMCs. The reason for patient "dumping" was due to insurance or financial status in 15.6% of settlements. The vast majority of penalties were to hospitals (95% of cases and 97% of payments). Forty percent of investigations found EMTALA violations, but only 3% of investigations triggered fines.

The presence of the Unified Family Court, with procedures emphasizing judicial case management and settlement in custody disputes, provided an opportunity to combine these practices with those of a university hospital-based family court clinic experienced in the provision of custody assessments. Specifically, a process integrating the clinical custody assessment with the work of counsel and court procedures was developed. This format, incorporating the preparation of a clinical settlement conference brief, was then evaluated with emphasis on time management, outcome in relation to settlement or trial, and the effect of clinical assessment at critical points in the combined endeavour. Seventy-two judicial referrals conducted using this format were reviewed. To assess efficiency, we determined time intervals to various points in the process and compared them to previous local practice. Settlement rates, recorded incrementally to mark each component's contribution, were compared with rates noted in the literature. Assessment functions were identified according to the point of resolution of the dispute and in a manner to facilitate comparison with previously published work. The format resulted in 50% of cases settling without trial in under 5 months, a minimum settlement rate of 50%, and confirmed the ability of clinical assessment to contribute flexibly to dispute resolution in several conciliation venues and at trial. Combining legal and mental health efforts can results in more efficient use of resources and a substantial diversion of cases from continuing litigation. While altering the process of clinical assessments enhances such findings, further work is required to assure appropriate selection criteria for various intervention formats.

The bacterial component of marine biofilms plays an important role in the induction of larval settlement in the polychaete Hydroides elegans. In this study, we provide experimental evidence that bacterial metabolites comprise the chemical signal for larval settlement. Bacteria were isolated from biofilms, purified and cultured according to standard procedures. Bacterial metabolites were isolated from spent culture broth by chloroform extraction as well as by closed-loop stripping and adsorption of volatile components on surface-modified silica gel. A pronounced biological activity was exclusively observed when concentrated metabolites were adsorbed on activated charcoal. Larvae did not respond to waterbome metabolites when prevented from contacting the bacterial film surface. These results indicate that an association of the chemical signal with a sorbent-like substratum may be an essential cofactor for the expression of biological activity. The functional role of bacterial exopolymers as an adsorptive matrix for larval settlement signals is discussed.

The labor tribunal system, which is a form of alternative dispute resolution rather than a type of lawsuit, requires both parties' agreements to settle disputes and maintains a high settlement rate. As most of parties involved in the system are said to expect that labor problems should be settled fairly, it is assumed that they will readily accept the results of fair procedures. However, it seems that laborers who submit claims for compensation have a different concept of justice than employers or company employees in charge of settlements and this determines the attitudes toward the results. This study conducted a survey of participants in the labor tribunal system, and suggest that laborers attribute the validity of this system's results directly to judges, while company representatives attribute it to the procedure conducted by the judges.

Pook se Bos informal settlement and the Cape Town Water & Sanitation Services Department are partnering on an urban sanitation project with a Dutch Consortium consisting of Lettinga Associates Foundation (LeAF), Landustrie Sneek and Vitens-Evides International. The aim of the project is to improve the basic sanitation services provided in informal settlements through the implementation of the MobiSan approach. The approach consists of a communal Urine-Diversion and Dehydration Toilet (UDDT) built in a former sea shipping container. The system is independent of water, electricity or sewerage connection and it is maintained by full-time community caretakers who also act as hygiene promoters. The project seeks to link sanitation services with hygiene promotion in informal settlements while enhancing user satisfaction and reducing costs in providing basic sanitation services. This paper describes the preliminary experiences and lessons learnt during the implementation and evaluation of the MobiSan prototype and discusses its potential for replication. The MobiSan has proved to be an appropriate option by means of dealing successfully with shallow groundwater table, land availability and high settlement densities. In addition it has been demonstrated to be cost-competitive in terms of operating cost compared to chemical toilets.

Viatical Benefits, a viatical settlement company in Fort Lauderdale, FL, is reportedly under investigation by the Securities and Exchange Commission (SEC) for using high-pressure sales tactics to sell policies to investors. The SEC has declined comment, and Egbert Jaeger, the president of Viatical Benefits, has denied any investigation. This investigation follows a preliminary injunction filed by a Federal judge against Life Partners Inc. of Waco, TX, in August. The SEC claimed that Life Partners repackaged life insurance contracts as securities for investors, in violation of Federal securities laws. Viatical settlements enable persons with HIV to sell their life insurance policies at a discount, providing clients with sixty to eighty percent of the face value in cash to use for living expenses. Viatical settlement companies usually act as brokers in the sale of the policies.
Beyond the operating room: a look at legal liability in body contouring procedures.

Malpractice claims affect the cost and quality of health care. In this study, the authors examine legal litigation following body contouring surgery and identify factors influencing malpractice litigation outcomes. The Westlaw legal database was searched for jury verdict and settlement reports related to body contouring procedures and medical malpractice. Cases included for analysis were examined for year of report, geographic location, patient demographics, procedure performed, alleged injury, causes of action, verdict, and indemnity payments. Of 113 cases, the most common injuries sustained were disfigurement (33.6%) and the necessitation of a revision procedure (33.6%). The most common cause of action cited was negligence (84.1%). Median plaintiff ages differed significantly (P = .003) between cases favoring the defendant (44.5 years) and those favoring the plaintiff (36 years). Of the alleged injuries, those cases citing an iatrogenic injury were 2.5 times more likely to result in either damages awarded or settlement (relative risk [RR], 2.5; 95% confidence interval [CI], 1.66-3.80). Cases that cited disfigurement were 87% more likely to result in damages awarded to the plaintiff (RR, 1.87; 95% CI, 1.08-3.26). Based on this study of body contouring litigation, younger plaintiff age and iatrogenic injury strongly favored plaintiffs in either awarded damages or a settlement. Disfigurement favored plaintiffs only in awarded damages. Our study emphasizes the need for adequate communication with the patient explaining realistic aesthetic results and risks of the procedure. In addition, iatrogenic organ injury must be handled expeditiously. Incorporating these recommendations into clinical practice may promote an improved physician-patient relationship while reducing litigatious health care costs.

Epistaxis: the factors involved in determining medicolegal liability.

The purpose of this study was to examine litigation involving epistaxis and analyze factors that determine liability. Jury verdicts and settlements regarding cases involving epistaxis were gathered utilizing the Westlaw database. Factors involved in litigation gathered included demographics, defendant specialty, procedure, alleged cause of malpractice, outcome, monetary award, and other variables. A total of 26 cases were analyzed. The majority of cases (57.7%) were decided in favor of the plaintiff or settled out of court. Total awards amounted to $24,501,252. Average awards for cases decided in favor of the plaintiff were $2,260,893 and ranged from $499,845 to $9,022,643. Settlements averaged $1,084,375 and ranged from $300,000 to $3,800,000. Common causes of malpractice encountered included delay in diagnosis, complications from medical procedures, and failure to recognize complications in a timely manner. Contrary to previous reports analyzing malpractice for varying medical procedures and complications, litigation in epistaxis is more commonly resolved in favor of the plaintiff or resolved through out-of-court settlements. Substantial financial awards and therapeutic complications from blindness to death make epistaxis a candidate for litigation. Of importance from a medicolegal stand is the fact that 30.8% (8) of the patients involved in epistaxis litigation died, either from complications of therapy or from experiencing epistaxis as a complication of another procedure/pathology. Using necessary diagnostic imaging, ensuring proper management techniques, and recognizing complications in a timely manner can serve to limit legal liability and enhance patient safety. © 2013 ARS-AAOA, LLC.

This article deals with the question of theoretical description of behaviour of a single pile rested in a layered soil medium. Particular attention is paid to soil modulus which is used in calculation method for pile load-settlement curve. A brief analysis of the results obtained by laboratory tests to assess soil modulus and its nonlinear variability has been presented. The results of tests have been used in triaxial apparatus and resonant column/torsional shear device. There have also been presented the results of load-settlement calculation for a single pile under axial load with implementation of different models of soil modulus degradation. This study aimed to evaluate factors contributing to medical negligence relevant to craniofacial surgery. Retrospective analysis of verdict and settlement reports on the Westlaw legal database for outcome, awards, physician defendants, and other specific factors raised in malpractice litigation. Of 42 verdicts and settlement reports included, 52.4% were resolved with either an out-of-court settlement or plaintiff verdict, with aggregate payments totaling $50.1M (in 2013 dollars). Median settlements and jury-awarded damages were $988,000 and $555,000, respectively. Payments in pediatric cases ($1.2M) were significantly higher. Plastic surgeons, oral surgeons, and otolaryngologists were the most commonly named defendants. The most common alleged factors included intraoperative negligence (69.0%), permanent deficits (54.8%), requiring additional surgery (52.4%), missed/delayed diagnosis of a complication (42.9%), disfigurement/scarring (28.6%), postoperative negligence (28.6%), and inadequate informed consent (20.6% of surgical cases). Failure to diagnose a fracture (19.0%) and cleft-reparative procedures (14.3%) were the most frequently litigated entities. Medical negligence related to craniofacial surgery involves plaintiffs in a wide age range as well as physician defendants in numerous specialties, and proceedings resolved with settlement and plaintiff verdict involve substantial payments. To assess characteristics associated with various outcomes of malpractice litigation, resulting from injuries sustained during oculoplastic procedures. The Westlaw legal database (Thomson Reuters, New York, NY, U.S.A.) was used to obtain jury verdicts and settlements. Pertinent data were extracted from 69 malpractice cases litigated from 1988 to 2012 involving oculoplastic procedures, including alleged cause of malpractice, outcome, and defendant specialty. The most commonly litigated surgical procedures were blepharoplasty (63.8% of total) and brow lift surgery (11.6%). The most commonly alleged complications included excessive scarring (24.6%), lagophthalmos (24.6%), visual defects (23.2%), and exposure keratitis (21.7%). Plastic surgeons were the most commonly named defendants (46.4%), followed by both comprehensive ophthalmologists and fellowship-trained ophthalmic plastic surgeons (17.3% each). A defense verdict was held in 60.9% of cases, a plaintiff verdict in 31.9% of cases, and a settlement was reached in 7.2% of cases. Blindness, cranial nerve injury, and the allegation of a permanent deficit increased the likelihood of a case being resolved with payment to the plaintiff (Fisher exact tests, p < 0.05). Most litigated oculoplastic malpractice cases were resolved in favor of the defendant, while settlements and plaintiff decisions averaged $455,703. Blepharoplasty constituted two-thirds of cases, with the most frequently cited associated complications being unsightly scarring, lagophthalmos, and visual deficits. An alleged lack of informed consent (30.4%) or the need for additional surgery (39.1%) was present in a considerable proportion of cases, emphasizing the importance of a detailed informed consent and clear communication preoperatively regarding patient expectations.

The respondent female employee charged her employer with discrimination under the Equal Remuneration Act (No. 25 of 1976). She claimed that she was paid less as a stenographer than male stenographers performing the same work or work of a similar nature. The Supreme Court upheld a lower court decision supporting the respondent's claims. It rejected arguments that a) the work of female stenographers was different because they worked in a different place and as confidential stenographers attached to senior executives; and b) the difference in pay was justified under the terms of a settlement between the employer and the respondent's union. It noted that an employer could not deliberately create conditions of work only with the object of driving away women from a particular type of work that they can otherwise perform with the object of paying them less and that union settlements must yield to the provisions of the Equal Remuneration Act. full text
