Medical Emergency Exceptions in State Abortion Statutes: The Statistical Record.

This article attempts to determine, first, whether emergency exceptions in statutes regulating abortion have been abused and, second, whether the standard used in such an exception--subjective or objective--makes a difference in the reported incidence of such emergencies. A review of the statistical data supports two conclusions. First, physicians who perform abortions and have complied with state reporting requirements have not relied upon the medical emergency exceptions in state abortion statutes to evade the requirements of those statutes. Second, the use of an objective standard for evaluating medical emergencies ("reasonable medical judgment") has not been associated with fewer reported emergencies (per number of abortions performed) than the use of a subjective standard ("good faith clinical judgment"). Both of these conclusions may be relevant in drafting other abortion statutes including prohibitions (e.g., post-viability abortions).

We evaluated bills against 4 benchmarks: broad product definitions that contemplate future developments in the market, citations to a specific packaging standard, stated penalties for violations, and express grants of authority to a state entity to enforce the packaging requirements. Our findings showed that 3 states meet all 4 benchmarks in their enacted legislation. We encourage states to consider these benchmarks when revising statutes or drafting future legislation.

To retrospectively assess the qualitative and quantitative high-resolution 3-T magnetic resonance imaging (MRI) findings in nonsymptomatic baseball pitcher draft picks. Institutional review board-approved and HIPAA compliant study. Three-Tesla MRI of the dominant shoulder of 19 asymptomatic baseball pitcher draft picks and detailed clinical examination was performed before contract signing. Two radiologists performed independently qualitative and quantitative evaluation of shoulder structures. Descriptive statistics were performed. Sixty-eight percent (13/19), 32% (6/19), and 21% (4/19) of the baseball pitcher draft picks showed tendinopathy, partial thickness tendon tear of the supraspinatus, and acromioclavicular joint osteoarthritis, respectively. Glenohumeral subluxation, glenoid remodeling, and Bennett lesion were present in 53% (10/19), 79% (15/19), and 21% (4/19) of the subjects, respectively. Interclass coefficient was 0.633 to 0.863 and κ was 0.27 to 1. In asymptomatic baseball pitcher draft picks, 3-T MRI frequently shows abnormalities involving rotator cuff tendons, the coracohumeral, inferior glenohumeral, labrum, and osseous structures.

Following a report from the Secretary General in May 1993, the United Nations Security Council adopted Resolution 827 and its Statute establishing an International War Crimes Tribunal for the Former Yugoslavia (ICTY) located in The Hague, The Netherlands. Although such action has been discussed in the past, this is the first time the international community has established a tribunal to indict and try individuals for war crimes. The crimes had been previously "created" by multilateral international treaties. The ICTY Rules of Procedure and Evidence allowed for "any special defense, including that of diminished or lack of mental responsibility." Precise legal parameters of the defense were not specified. In 1998, a defendant at the ICTY "Celebici" Trial named Esad Landzo raised the defense of diminished mental responsibility. The Celebici Trial Chamber thus became the first legal body to consider reduced mental capacity as it applies to international criminal law. This article is an examination of the application of the affirmative defense of diminished responsibility at the ICTY and relates the process to the need for further definition of mental incapacity defenses at the newly established International Criminal Court (ICC). At the ICC preparatory commission, drafting material elements of crimes was emphasized, with less consideration given to mental elements. That diminished capacity and diminished-responsibility defenses have often confused scholars and practitioners alike is explored in this article with suggestions for further directions.

Ground water and the law - some selected annotated references

The strictly "legal" literature of ground-water use and control -except for a few essays in certain of the law reviews- is quite limited. A larger and more pointful source of information and analysis is the legal-scientific writings of the geologists, hydrologists, meteorologists, engineers and others. When new statutes are to be drafted by legislatures, and new decisions are to be made by courts on this subject, such literature may well be of far greater importance than legal precedents unfounded on scientific fact. This may be demonstrated by the character and scope of the legal-scientific literature of ground water, just one branch of water science, but one which is of major importance to any thoughtful consideration of water use and control.

The flow in the Turbine-99 Kaplan draft tube was thoroughly investigated at three workshops (1999, 2001, 2005), which aimed at determining the state of the art of draft tube simulations. The flow is challenging due to the different flow phenomena appearing simultaneously such as unsteadiness, separation, swirl, turbulence, and a strong adverse pressure gradient. The geometry and the experimentally determined inlet boundary conditions were provided to the Turbine-99 workshop participants. At the final workshop, angular resolved inlet velocity boundary conditions were provided. The rotating non-axi-symmetry of the inlet flow due to the runner blades was thus included. The effect of the rotating angular resolution was however not fully investigated at that workshop. The first purpose of this work is to further investigate this effect. Several different inlet boundary conditions are applied - the angular resolved experimental data distributed at the Turbine-99 workshop, the angular resolved results of a runner simulation with interpolated values using different resolution in the tangential and radial directions, and an axi-symmetric variant of the same numerical data. The second purpose of this work is to compare the results from the OpenFOAM and CFX CFD codes, using as similar settings as possible. The present results suggest that the experimental angular inlet boundary conditions proposed to the workshop are not adequate to simulate accurately the flow in the T-99 draft tube. The reason for this is that the experimental phase-averaged data has some important differences compared to the previously measured time-averaged data. Using the interpolated data from the runner simulation as inlet boundary condition however gives good results as long as the resolution of that data is sufficient. It is shown that the difference between the results using the angular-resolved and the corresponding symmetric inlet data is very small, suggesting that the importance of the angular resolution is small. The results from OpenFOAM and CFX are very similar as long as the inlet data resolution is fine enough. CFX seems to be more sensitive to that resolution.

The authors review Wisconsin statutes related to human immunodeficiency virus (HIV) testing in primary care, including the areas of written informed consent, documentation of consent, testing without consent, testing of minors, disclosure of test results without the consent of the test subject, reporting requirements, discrimination, access by insurance companies and third-party payors to HIV test results, and civil liabilities and criminal penalties associated with violation of HIV-related state statutes. During the course of the HIV epidemic in Wisconsin, many individuals (service providers, legislators, consumers and advocates) supported the enactment of HIV-related legislation. Today, Wisconsin has some of the nation's most comprehensive HIV legislation. These laws have set a legal framework that balances the rights of individuals with protection of public's health. The relatively low seroprevalence of HIV infection in Wisconsin can be attributed, in part, to the state's HIV-related legislation. While Wisconsin HIV legislation is broadly focused, much of it is concerned with HIV testing. This article examines common questions as they pertain to HIV testing in primary care and to the following areas addressed by state statutes: counseling and referral for health and support services [Wisconsin statute s. 252 14(3)] informed consent for testing or disclosure [Wisconsin statute s. 252.15(2)] written consent to disclose [Wisconsin statute s. 252.15(3) & (4)] testing without consent of the test subject [Wisconsin statute s. 252.15(2)] confidentiality of an HIV test [Wisconsin statute s. 252.15(5)] reporting of positive test results [Wisconsin statute s. 252.15(7)] discrimination [Wisconsin statute s. 252.14(2)] civil and criminal liabilities [Wisconsin statute s. 252.14(4); 252.15(8) & (9)].

The Government published its long-awaited draft Bill on the creation of a new criminal offence of corporate manslaughter shortly before the May 2005 general election. The Bill was included in the Queen's Speech after the general election and, with a Labour government back in power, the new offence could be on to the statute book as early as 2006. The Home Affairs Committee and the Work and Pensions Committee announced ajoint inquiry to consider and report on the Bill. This is expected to be completed by the end of 2005. Pressure for reform of the law relating to manslaughter and corporate killing arose out of a series of high profile fatal accidents, including several rail crashes. There has been said to be an increasing concern amongst the public that companies and organisations are not being held sufficiently accountable for deaths caused by their criminal negligence. The author acted in the first of the major cases, representing the directors accused of manslaughter following the Herald of Free Enterprise capsize disaster in 1987.

Medication advertising in Brazil. Can it be regulated?

The regulation of medication advertising in Brazil has four weak points. Inspection and punishment of irregularities is carried out a posteriori to the infraction being committed (when the population has already been exposed to a sanitary risk). The fines charged by the Brazilian Sanitary Surveillance Agency (Anvisa) have a derisory value compared to investments in advertising. There is no mechanism that prevents fines from being transferred to prices. The phrase 'If symptoms persist, consult your doctor', rather than warning about the risks of self-medication, encourages using at least the first medication without a prescription, advising a visit to the doctor only if symptoms persist. Anvisa data and academic studies reveal that 90% to 100% of advertising shown in the media contains irregularities. Thus, the Anvisa Collegiate Board of Directors Resolution 102/2000, which seeks to regulate the sector, makes up a system that benefits the infractor and keeps the population at risk. This work analyses alternative regulation, looking at advertising's previous compliance statute through the surveillance system; it studies international statutes and proposes an alteration in the structure of the current model, inserting the logic of sanitary risk prevention.

The operation of Francis turbines in part load conditions causes high fluctuations and dynamic loads in the turbine and especially in the draft tube. At the hub of the runner outlet a rotating vortex rope within a low pressure zone arises and propagates into the draft tube cone. The investigated part load operating point is at about 72% discharge of best efficiency. To reduce the possible influence of boundary conditions on the solution, a flow simulation of a complete Francis turbine is conducted consisting of spiral case, stay and guide vanes, runner and draft tube. As the flow has a strong swirling component for the chosen operating point, it is very challenging to accurately predict the flow and in particular the flow losses in the diffusor. The goal of this study is to reach significantly better numerical prediction of this flow type. This is achieved by an improved resolution of small turbulent structures. Therefore, the Scale Adaptive Simulation SAS-SST turbulence model - a scale resolving turbulence model - is applied and compared to the widely used RANS-SST turbulence model. The largest mesh contains 300 million elements, which achieves LES-like resolution throughout much of the computational domain. The simulations are evaluated in terms of the hydraulic losses in the machine, evaluation of the velocity field, pressure oscillations in the draft tube and visual comparisons of turbulent flow structures. A pre-release version of ANSYS CFX 17.0 is used in this paper, as this CFD solver has a parallel performance up to several thousands of cores for this application which includes a transient rotor-stator interface to support the relative motion between the runner and the stationary portions of the water turbine.

In 1994, Michigan's Court of Appeals was asked to rule on three circuit court decisions involving Michigan's statute criminalizing assisted suicide and violations of the statute by Jack Kevorkian, M.D. The cases, consolidated on appeal, were Hobbins v. Attorney General, wherein the assisted suicide statute was declared unconstitutional; People v. Kevorkian (Docket No. 171056), wherein charges that Kevorkian had violated the statute by assisting in a suicide were dismissed; and People v. Kevorkian (Docket No. 172399), wherein additional charges that Kevorkian had violated the statute by assisting in another suicide were dismissed. In declaring the Michigan statute unconstitutional, two of the three circuit court judges held that individuals had a constitutional right to commit suicide. The Court of Appeals affirmed that the statute was unconstitutional because, by creating a commission to study end-of-life issues as well as specifically criminalizing assisted suicide, it violated the one-object provision of the Michigan Constitution. The court held, however, that there is no constitutional right to suicide, reversing the two circuit court orders in this respect.
The bribery statute: a new weapon against Medicare fraud.

A May 2000 U.S. Supreme Court decision determining when a Federal bribery statute can be used to fight Medicare fraud has ramifications for healthcare providers. In Fischer v. United States, the Court concluded that healthcare providers that participate in Medicare are considered to receive benefits as set forth in the bribery statute and thus can be prosecuted for fraudulent activities against the government under the statute. The statute mandates a fine, imprisonment for up to 10 years, or both for anyone convicted under it. Provider organizations that receive Medicare payments and business associates of such organizations should be aware that the government may step up its use of the bribery law in prosecuting fraudulent activity. In addition, although the case pertained specifically to healthcare providers that participate in Medicare, providers that do not participate in Medicare may wish to evaluate the advisability of accepting other Federal funding because of the possible reach of the bribery statute.

The initiative leading to the establishment of the International Astronautical Federation (IAF) was taken in 1949 by the Stuttgart based Gesellschaft für Weltraumforschung (GfW), who proposed to other astronautical societies that a conference should be arranged to establish mutual co-operation. The British Interplanetary Society (BIS) agreed to organize such a conference in London in 1951, but in the interim the Groupement Astronautique Français (GAF) arranged a preliminary meeting to set up the agenda for the London meeting and to define its objectives. Representatives from astronautical groups in seven European countries and one South American society met in Paris in October 1950. Their meetings were preceded, on 30 September, by a large public gathering organized by the GAF, in the Sorbonne and was designated the Premier Congrès International d'Astronautique, a style which was to be adopted, in its English translation, for the subsequent annual conferences of the IAF. The representatives agreed that the objective of the London conference should be to create a federation of autonomous national astronautical societies, whose main purpose would be to provide an annual forum where these societies would meet. The London conference in September 1951, held in the City of Westminster, following the Paris precedent, was designated the IInd International Astronautical Congress. Astronautical and rocket societies from the ten countries were represented and became signatories to the agreement founding the IAF on 4 September 1951. The London congress set the pattern for subsequent congresses, in particular introducing technical lecture sessions. At the IIIrd Congress, held in Stuttgart, the first under the aegis of the newly founded IAF, a constitution was agreed and a Finance Committee was elected. The Constitution established that the Federation should be registered in Switzerland and be governed by a council of voting members—one only from each country. Subsequent congresses saw the gradual introduction of familiar federation institutions. At Zurich in 1953 a Credentials Committee, to screen applications for membership, was introduced and the publication of a regular journal proposed. The following year's congress at Innsbruck marked the establishment of the Astronautica Acta. In 1955 at Copenhagen the scope of membership was broadened to include institutional membership. The VIIth IAF Congress in Rome saw the introduction of the Nominations Committee to recommend candidates for the annual election of officers. The 1957 congress at Barcelona was the first astronautical conference of the space age, immediately following the launching of Sputnik 1. That congress saw the first formal submission of a proposal to set up an International Academy of Astronautics (IAA) though this was not discussed. At the Amsterdam congress in 1958, the number of papers increased to 80 and parallel sessions were introduced. The Xth Congress returned to the City of Westminster where a resolution founding the IAA was adopted, naming Theodore von Kármán as its Director. Immediately, editorial responsibility for the Astronautica Acta was transferred to the IAA from the Federation, taking effect from 1 January 1960. At the same congress a resolution founding an International Institute of Space Law (IISL) was approved. It was also resolved that the Federation should set up its headquarters in Paris. The XIth Congress at Stockholm had, as it main items of business, the inauguration of the IAA and the IISL. Proposals for the structure and statutes of the Academy were duly approved and 45 founding members appointed. The IISL statutes were also approved. The draft of a new IAF constitution, which had been scrutinized at spring meetings of the officers, was referred back to the committee. One of the main features of the draft had been the introduction of a Bureau made up of IAF officers and, ex-officio, the Director of the IAA and the President of the IISL. Pending the eventual adoption of the new Constitution, the Bureau would function informally. In 1961 the Federation as we know it today emerged beginning with the spring meeting in Paris, held in premises shared by the IAF and IAA, and with the Executive Secretariat in place. The main business was for the informal Bureau to meet with the committee responsible for the draft of the new constitution, to amend it to a form acceptable to all member societies. This done, the proposed new Constitution was submitted to the ensuing congress in Washington D.C. The XIIth Congress saw the IAF emerge from its adolescence to adult status. The new Constitution was approved and the Bureau was formally established. Henceforth, the plenary gathering of member societies was designated the General Assembly and reference to the IAF Council discontinued. A radical innovation was the creation of the International Programme Committee with future responsibility for planning and co-ordinating the congress technical lecture sessions. At Washington the first task of the Bureau was to draw up the Terms of Reference and the functional duties of this committee which have remained substantially unchanged.

Civilian and common law judges differ substantially in their approach to the resolution of issues concerning bioethics and health sciences. Whereas the civilian judge will first take into account the legislative source, his common law counterpart will most probably first look at judicial precedents for guidance. In both systems, however, the legislative drafting technique differs substantially and has a direct impact on judicial interpretation of the law. Both systems also differ in the way that judicial decisions are drafted and rendered. In the common law tradition, judges draft their own opinion, leaving the possibility of dissent which, in turn, helps to better illustrate contentious issues and may have an influence on social awareness of difficult problems. Finally, in bioethics, legislation should be preferred if only for a question of social legitimacy, since decisions are then taken by elected representatives. However, this type of legislation should be subject to periodical review to better adapt its rules to the evolution of science and society.

In recent period, the new Czech Atomic Law is in the final stage of preparation, and the author expects that Parliament of the Czech Republic will approve it in the first half of the year 1996. Partly the law deals with new distribution of responsibilities among bodies involved in utilization of nuclear energy and ionizing radiation, the state and local authorities. The new provisions include also radioactive waste management activities. These provisions clarify the relations between radioactive waste generators and state, and define explicitly duties of waste generators. One of the most important duties is to cover all expenses formore » radioactive waste management now and in the future, including radioactive waste disposal and decommissioning of nuclear facilities. The law establishes radioactive waste management and decommissioning funds and the new, on waste generators independent radioactive waste management organization, controlled by state, to ensure the safety of inhabitants and the environment, and a optimization of expenses. Parallel to the preparation of the law, the Ministry of Industry and Trade prepares drafts of a statute of the radioactive waste management organization and its control board, and of the methodology and rules of management the radioactive waste fund. First drafts of these documents are expected to be complete in January 1996. The paper will describe recent practice and policy of the radioactive waste management including uranium mining and milling tailings, amounts of waste and its activities, economical background, and safety. A special attention will be paid to description of expected changes in connection with the new Atomic Law and expected steps and time schedule of reorganization of the radioactive waste management structure in the Czech Republic.« less

Doctors, clinics, pregnant minors, and the mother of a pregnant minor filed suit in District Court to enjoin enforcement of Minnesota's abortion statute. The plaintiffs objected on due process and equal protection grounds to subdivisions of the statute mandating either that both parents of a minor be notified of her pending abortion, or, in lieu of two-parent notification, that a court authorize the abortion after determining that the minor is capable of giving informed consent. The District Court declared the entire statute unconstitutional. The Court of Appeals reversed, ruling that the provision for judicial bypass of the two-parent notification requirement was valid and saved the statute as a whole. In a 5-4 decision, the U.S. Supreme Court affirmed the Court of Appeals judgment. It concluded that while the two-parent notification requirement in itself violated the Constitution, the statute was rendered constitutional by the judicial bypass provision.

The purpose of this article is to describe the state elder abuse statutes in the United States and Washington DC during 2011-2012. The last review of elder abuse statutes occurred in 2001; thus, a reexamination is warranted given the increased awareness of elder abuse at the state and national level and the growing number of older adults in the United States. This descriptive study analyzed the following components of elder or dependent abuse statutes: definitions, reporting requirements, training, and consequences for failure to report. It was determined that differences remain in how states respond to elder abuse at the community-based level.

We performed numerical simulation of flow in a laboratory model of a Francis hydroturbine at three regimes, using two eddy-viscosity- (EVM) and a Reynolds stress (RSM) RANS models (realizable k-ɛ, k-ω SST, LRR) and detached-eddy-simulations (DES), as well as large-eddy simulations (LES). Comparison of calculation results with the experimental data was carried out. Unlike the linear EVMs, the RSM, DES, and LES reproduced well the mean velocity components, and pressure pulsations in the diffusor draft tube. Despite relatively coarse meshes and insufficient resolution of the near-wall region, LES, DES also reproduced well the intrinsic flow unsteadiness and the dominant flow structures and the associated pressure pulsations in the draft tube.

In this article we examine how federal agencies use adaptive management. In order for federal agencies to implement adaptive management more successfully, administrative law must adapt to adaptive management, and we propose changes in administrative law that will help to steer the current process out of a dead end. Adaptive management is a form of structured decision making that is widely used in natural resources management. It involves specific steps integrated in an iterative process for adjusting management actions as new information becomes available. Theoretical requirements for adaptive management notwithstanding, federal agency decision making is subject to the requirements of the federal Administrative Procedure Act, and state agencies are subject to the states’ parallel statutes. We argue that conventional administrative law has unnecessarily shackled effective use of adaptive management. We show that through a specialized ‘adaptive management track’ of administrative procedures, the core values of administrative law—especially public participation, judicial review, and finality— can be implemented in ways that allow for more effective adaptive management. We present and explain draft model legislation (the Model Adaptive Management Procedure Act) that would create such a track for the specific types of agency decision making that could benefit from adaptive management.

We present and explain draft model legislation (the Model Adaptive Management Procedure Act) that would create such a track for the specific types of agency decision making that could benefit from adaptive management.

Increasing public confidence in the U.S. Nuclear Regulatory Commission (NRC) as an effective and independent regulator is an explicit goal of the Agency (1). Consistent with long-established mechanisms and procedures, NRC provides the public access to its decision-making process. Recently, during the course of a rulemaking required by statute, NRC examined its means for inviting public access as well as the NRC staff's effectiveness in furthering public confidence in it's actions as a regulator. When developing new, site-specific regulations for the proposed geologic repository at Yucca Mountain, Nevada, NRC's Division of Waste Management found it necessary to adapt and improvemore » its efforts to inform and involve the public in NRC's decision making process. Major changes were made to the way in which technical staff prepare for speaking to general audiences. The format used for public meetings was modified to encourage dialogue with participants. Handout and presentation materials that explain NRC's role and technical topics of concern in plain language were developed and are regularly updated. NRC successfully applied these and other institutional changes as it completed final regulations for Yucca Mountain and while developing and introducing a draft license review plan for public comment.« less

Pursuant to Section 78 German Criminal Code, criminal offences under Section 220a (genocide) and Section 211 (murder) are not subject to a statute of limitations. To the extent that prosecution is subject to a statute of limitations, the period of limitation is thirty years in the case of acts punishable by imprisonment for life. After the expiration of the period of limitation, evidence and investigation records relevant for the offence may no longer be available. Once a homicide is statute-barred, main proceedings may be opened only, if the elements of murder are present. The problems arising from the statute of limitations are discussed on the basis of a case on which the author had to give an export opinion. The homicide was committed in Amsterdam in 1967. In 2004, after the period of limitation had expired in The Netherlands and--as far as manslaughter is concerned, also in the Federal Republic of Germany--a meanwhile 60-year-old man accused himself of having committed the offence (manual strangulation of a tied male). After the expiration of the statute of limitations the results of the police investigations and the autopsy report were no longer available. How the offence might have been committed and whether the elements of murder were present therefore had to be discussed on the basis of still available photographs of the crime scene and the victim. After studying these pieces of evidence, the criminal court decided that the accused had actually committed a voluntary homicide, but that it was no longer ascertainable, if the elements of murder were fulfilled. The issues relevant to legal medicine are presented against the background of the problems associated with the statute of limitations.

In December 1994, the Michigan Supreme Court decided a group of cases comprising constitutional challenges to a Michigan statute against assisted suicide and prosecutions of Dr. Jack Kevorkian for his role in two incidents of suicide. The court rejected arguments that the statute infringed a right of "personal autonomy" under the Fourteenth Amendment to the US Constitution; it noted that, although US Supreme Court opinions indicate that decisions to withdraw or reject life-sustaining treatment are constitutionally protected, a legal difference exists between permitting death to occur by natural means and taking affirmative steps to end life. The Michigan court also decided that Kevorkian could not be charged with murder for supplying only the means by which suicide occurred, but he could be charged with a common law crime of assisting in suicide although the statute outlawing such actions became effective only after the suicides occurred. Because suicide was a crime under the prerevolutionary English Common Law, which forms the foundation of Michigan law, assisting in suicide is also a residual crime under the "savings clause" of the Michigan statutes, which incorporates common law crimes into the law of that state when no superseding statute exists.

Congress assigned the Federal government the responsibility for setting substantive environmental quality standards and the states the responsibility for implementing and enforcing those standards in four statutes--the National Environmental Policy Act; the Federal Water Pollution Control Act; Clean Air Act; and the Noise Control Act. In two recent decisions (EPA v. California ex rel. State Water Resources Council Bd., 96 S. Ct. 2022, 1976 and Hancock v. Train, 96 S. In 1991, the South Dakota Legislature enacted a living will statute. Included is a pregnancy provision that prevents pregnant women from obtaining the full benefit of the statute. A South Dakota Attorney General's opinion was released discussing the conflict of laws problems posed by the statute. That opinion, however, did not address the more important question of the constitutionality of the pregnancy provision. This comment analyzes the pregnancy provision under the Due Process, Equal Protection, and the Establishment Clauses and concludes that South Dakota's pregnancy provision is unconstitutional under all three doctrines.

This presentation introduces a draft plan for characterizing commercial data products for Earth science research. The general approach to the commercial product verification and validation includes focused selection of a readily available commercial remote sensing products that support Earth science research. Ongoing product verification and characterization will question whether the product meets specifications and will examine its fundamental properties, potential and limitations. Validation will encourage product evaluation for specific science research and applications. Specific commercial products included in the characterization plan include high-spatial-resolution multispectral (HSMS) imagery and LIDAR data products. Future efforts in this process will include briefing NASA headquarters and modifying plans based on feedback, increased engagement with the science community and refinement of details, coordination with commercial vendors and The Joint Agency Commercial Imagery Evaluation (JACIE) for HSMS satellite acquisitions, acquiring waveform LIDAR data and performing verification and validation.

The common carp, Cyprinus carpio, is one of the most important cyprinid species and globally accounts for 10% of freshwater aquaculture production. Here we present a draft genome of domesticated C. carpio (strain Songpu), whose current assembly contains 52,610 protein-coding genes and approximately 92.3% coverage of its paleotetraploidized genome (2n = 100). The latest round of whole-genome duplication has been estimated to have occurred approximately 8.2 million years ago. Genome resequencing of 33 representative individuals from worldwide populations demonstrates a single origin for C. carpio in 2 subspecies (C. carpio Haematopterus and C. carpio carpio). Integrative genomic and transcriptomic analyses were used to identify loci potentially associated with traits including scaling patterns and skin color. In combination with the high-resolution genetic map, the draft genome paves the way for better molecular studies and improved genome-assisted breeding of C. carpio and other closely related species.

High-resolution genetic and physical maps are invaluable tools for building accurate genome assemblies, and interpreting results of genome-wide association studies (GWAS). Previous genetic and physical maps anchored good quality draft assemblies of the domestic cat genome, enabling the discovery of numerous genes underlying hereditary disease and phenotypes of interest to the biomedical science and breeding communities. However, these maps lacked sufficient marker density to order thousands of shorter scaffolds in earlier assemblies, which instead relied heavily on comparative mapping with related species. A high-resolution map would aid in validating and ordering chromosome scaffolds from existing and new genome assemblies. Here, we describe a high-resolution genetic linkage map of the domestic cat genome based on genotyping 453 domestic cats from several multi-generational pedigrees on the Illumina 63K SNP array. The final maps include 58,055 SNP markers placed relative to 6637 markers with unique positions, distributed across all autosomes and the X chromosome. Our final sex-averaged maps span a total autosomal length of 4464 cM, the longest described linkage map for any mammal, confirming length estimates from a previous microsatellite-based map. The linkage map was used to order and orient the scaffolds from a substantially more contiguous domestic cat genome assembly (Felis catus v8.0), which incorporated ∼20 × coverage of Illumina fragment reads. The new genome assembly shows substantial improvements in contiguity, with a nearly fourfold increase in N50 scaffold size to 18 Mb. We use this map to report probable structural errors in previous maps and assemblies, and to describe features of the recombination landscape, including a massive (∼50 Mb) recombination desert (of virtually zero recombination) on the X chromosome that parallels a similar desert on the porcine X chromosome in both size and physical location. In dealing with applicants and employees, administrators must comply with handicap and pregnancy discrimination statutes, any union collective bargaining agreement, and any state or local statutes specifically directed at protecting certain classes of handicapped persons. The first sex offender civil commitment legislation passed in Washington State in 1990. Since that time, 21 additional jurisdictions in the USA have passed similar statutes. Although considered controversial by some, the statutes have withstood legal scrutiny at the state and federal levels. These statutes have been found constitutional in large part because they offer treatment to those individuals detained under them. In the 25 years since sex offender civil commitment became a reality, significant advances in sex offender assessment and treatment have shaped the landscape of the associated treatment programs. This article reviews current practice in programs that treat individuals detained under these laws and provides a framework in which these programs are delivered.

This article educates healthcare practitioners on the legal framework prohibiting abusive practices in urine drug testing (UDT) in medical settings, discusses several profit-driven UDT schemes that have resulted in enforcement actions, and provides recommendations for best practices in UDT to comply with state and federal fraud and anti-kickback statutes. The authors carefully reviewed and analyzed statutes, regulations, adivsory opinions, case law, court documents, articles from legal journals, and news articles. Certain facts-driven UDT arrangements tend to violate federal and state healthcare laws and regulations, including Stark law, the anti-kickback statute, the criminal health care fraud statute, and the False Claims Act. Healthcare practitioners who use UDT can help ensure that they are in compliance with applicable federal and state laws by evaluating whether their actions are motivated by providing proper care to their patients rather than by profits. They must avoid schemes that violate the spirit of the law while appearing to comply with the letter of the law. Such a simple self-evaluation of motive can reduce a practitioner's likelihood of civil fines and criminal liability.

We have confirmed our earlier finding that the probability density function (pdf) of ice freeboard in the Arctic Ocean can be converted to a pdf of ice draft by applying a simple coordinate transformation based on the measured mean draft and mean elevation. This applies in each of six 50-km sections (north of Greenland) of joint airborne laser and submarine sonar profile obtained along nearly coincident tracks from the Arctic Basin north of Greenland and tested for this study. Detailed differences in the shape of the pdf can be explained on the basis of snow load and can, in principle, be compensated by the use of a more sophisticated freeboard-dependent transformation. The measured "density ratio" R (actually mean draft/mean elevation ratio) for each section was found to be consistent over all sections tested, despite differences in the ice regime, indicating that a single value of R might be used for measurements done in this season of the year. A series of state-level statute changes have allowed pharmacists to provide influenza vaccinations in community pharmacies. The study aim was to estimate the effects of pharmacy-based immunization statutes changes on per capita influenza vaccine prescriptions, adult vaccination rates, and the utilization of other preventive health services. A quasi-experimental study that compares vaccination outcomes over time before and after states allowed pharmacy-based immunization. Measures of per capita pharmacy prescriptions for influenza vaccines in each state came from a proprietary pharmacy prescription database. Data on adult vaccination rates and preventive health utilization were studied using multiple waves of the Behavioral Risk Factor Surveillance System (BRFSS). The primary outcomes were changes in per capita influenza vaccine pharmacy prescriptions, adult vaccination rates, and preventive health interventions following changes. Between 2007 and 2013, the number of influenza vaccinations dispensed in community pharmacies increased from 3.2 to 20.9 million. After one year, adopting pharmacist immunization statutes increased per capita influenza vaccine prescriptions by an absolute difference (AD) of 2.6% (95% CI: 1.1-4.2). Adopting statutes did not lead to a significant absolute increase in adult vaccination rates (AD 0.9%, 95% CI: -0.3, 2.2). There also was no observed difference in adult vaccination rates among adults at high-risk of influenza complications (AD 0.8%, 95% CI: -0.2, 1.8) or among standard demographic subgroups. There also was no observed difference in the receipt of preventive health services, including routine physician office visits (AD -1.9%, 95% CI: -4.9, 1.1). Pharmacists are providing millions of influenza vaccines as a consequence of immunization statutes, but we do not observe significant differences in adult influenza vaccination rates. The main gains from pharmacy-based immunization may be in providing a more convenient way to obtain an important health service. Published by Elsevier Ltd.

Introduction Beaucoup d'enfants vivant avec le VIH ont été infectés par leurs mères. Pour prévenir la transmission verticale les femmes doivent d'abord connaître leur statut sérologique VIH.L'objectif de cette étude était de déterminer la proportion de statut VIH inconnu à la naissance et d'identifier les facteurs associés. Méthodes C'est une étude transversale réalisée dans 10 structures sanitaires de Lubumbashi de Juin à Septembre 2010. La taille de l’échantillon était de 602 accouchées. Les statistiques descriptives usuelles et la régression logistique ont été utilisées. Résultats Parmi les accouchées, 52,5% ignoraient leur statut sérologique. Parmi elles, 62,9% accepteraient de faire le test VIH à la maternité. La proportion des femmes avec un statut sérologique VIH inconnu était significativement plus élevée chez celles qui n'avaient pas suivi de CPN (Odds Ratio ajusté (ORa) = 5,8; Intervalle de Confiance (IC) 95%: 1,7-19,8); chez celles qui avaient un bas niveau d'instruction (ORa = 1,5; IC 95%: 1,1-2,1) et chez celles qui ne savaient pas que la transmission verticale du VIH pouvaient se faire au moment de l'accouchement (ORa = 1,5; IC 95%: 1,0-2,4). Conclusion La proportion de femmes qui accouchent sans connaître leur statut sérologique au VIH est encore importante, malgré le fait que le dépistage du VIH soit proposé lors des CPN. Dans les zones à haute séroprévalence de VIH, aucune femme ne devrait accoucher sans être dépistée au VIH. Ce serait une opportunité manquée. PMID:22891083
The inclusion of disability as a condition for termination of parental rights.

All 50 states and the District of Columbia have statutes outlining the grounds for terminating parental rights (TPR) in relation to child abuse and neglect. Although recent research has found that parents with disabilities are not more likely to maltreat their children than parents without disabilities (Glaun & Brown, 1999; Oyserman, Mowbray, Meares, & Firminger, 2000), studies have found very high rates of TPR of parents with disabilities (Accardo & Whitman, 1989). The objective of this study is to examine how states are including disability in their TPR statutes. This study used legal document analysis, consisting of a comprehensive Boolean search of the state codes of the 50 states and District of Columbia (DC) relating to TPR, using the most recent state code available on Lexis-Nexis in August 2005. TPR and related statutes were searched for contemporary and historical disability related terms and their common cognates, such as: "mental," "disability," "handicap," and "incapacity." Two researchers independently conducted the searches, and the searches were reconciled. A code list was then developed to measure for inclusion of disability, preciseness, scope, use of language, and references to accessibility or fairness. Statutes were then reanalyzed, and groupings developed. Thirty-seven states included disability-related grounds for termination of parental rights, while 14 states did not include disability language as grounds for termination. Many of these state codes used outdated terminology, imprecise definitions, and emphasized disability status rather than behavior. All of the 14 states that do not include disability in TPR grounds allowed for termination based on neglectful parental behavior that may be influenced by a disability. The use of disability language in TPR statutes can put an undue focus on the condition of having a disability, rather than parenting behavior. This paper recommends that states consider removing disability language from their statutes, as such language risks taking the emphasis away from the assessment based on parenting behavior. Durian (Durio zibethinus) is a Southeast Asian tropical plant known for its hefty, spine-covered fruit and sulfury and onion-like odor. Here we present a draft genome assembly of D. zibethinus, representing the third plant genus in the Malvales order and first in the Helicteroideae subfamily to be sequenced. Single-molecule sequencing and chromosome contact maps enabled assembly of the highly heterozygous durian genome at chromosome-scale resolution. Transcriptomic analysis showed upregulation of sulfur-, ethylene-, and lipid-related pathways in durian fruits. We observed paleopolyploidization events shared by durian and cotton and durian-specific gene expansions in MGL (methionine γ-lyase), associated with production of volatile sulfur compounds (VSCs). MGL and the ethylene-related gene ACS (aminocyclopropane-1-carboxylic acid synthase) were upregulated in fruits concomitantly with their downstream metabolites (VSCs and ethylene), suggesting a potential association between ethylene biosynthesis and methionine regeneration via the Yang cycle. The durian genome provides a resource for tropical fruit biology and agronomy.
