The use of quantitative structure-activity relationships (QSARs) for deriving the predicted no-effect concentration of discrete organic chemicals for the purposes of conducting a regulatory risk assessment in Europe and the United States is described. In the United States, under the Toxic Substances Control Act (TSCA), the TSCA Interagency Testing Committee and the U.S. Environmental Protection Agency (U.S. EPA) use SARs to estimate the hazards of existing and new chemicals. Within the Existing Substances Regulation in Europe, QSARs may be used for data evaluation, test strategy indications, and the identification and filling of data gaps. To illustrate where and when QSARs may be useful and when their use is more problematic, an example, methyl tertiary-butyl ether (MTBE), is given and the predicted and experimental data are compared. Improvements needed for new QSARs and tools for developing and using QSARs are discussed.

This study develops data on the acute aquatic toxicity of selected biodiesel fuels which may become subject to environmental effects test regulations under the US Toxic Substances Control Act (TSCA). The test substances are Rape Methyl Ester (RME), Rape Ethyl Ester (REE), Methyl Soyate (MS), a biodiesel mixture of 20% REE and 80% Diesel, a biodiesel mixture of 50% REE and diesel, and a reference substance of Phillips D-2 Reference Diesel. The test procedure follows the Daphnid Acute Toxicity Test outlined in 40 CFR {section} 797.1300 of the TSCA regulations. Daphnia Magna are exposed to the test substance in amore » flow-through system consisting of a mixing chamber, a proportional diluter, and duplicate test chambers. Novel system modifications are described that accommodate the testing of oil-based test substances with Daphnia. A number of seemingly routine decisions, often made at the level of the plant manager and even below, can turn into costly compliance traps under the Toxic Substances Control Act (TSCA). TSCA is a federal statute designed to give the U.S. Environmental Protection Agency (EPA) information and control over commercial chemicals. Originally passed in 1976, the regulations it supports have been reworked at various times over the years. EPA is on the hunt for TSCA violators. In a December 1992 blitz,more » EPA assessed combined TSCA penalties of $9 million against 22 major chemical companies, including several of the top 20 international producers. According to a recent EPA press release, these actions are only the first in a series of planned enforcements initiatives. The ITC has been an independent advisory committee to the EPA Administrator since enactment of the Toxics Substances Control Act (TSCA) in 1976. The ITC identifies and coordinates U.S. Government data needs for TSCA-regulable chemicals, and makes recommendations to the Administrator for priority testing consideration. Chemicals recommended by the ITC are added to the TSCA Priority Testing List that is revised semi-annually in Reports to the Administrator. In recent Reports, the ITC added alkylphenols (APs) and ethoxylates to the Priority Testing List. About 500 million pounds are produced annually for industrial processing, cleaning and personal care products. APs have been detected in the tissues of fish from the Great Lakes, and one AP (nonylphenol) causes vitellogenin gene expression in trout hepatocytes. Numerous APs and ethoxylates were recommended by the ITC because data are needed on: (1) chemical composition, (2) environmental fate of parent chemicals and impurities, and (3) health and ecological effects (including toxicokinetics and endocrine-modulating effects). In response to the ITC's recommendations, two activities have ensued. First, the EPA promulgated rules requiring manufacturers, importers and processors of APs and ethoxylates to submit production and exposure reports, and unpublished health and safety studies, for review. Second, the Alkylphenols and Ethoxylates Panel of Chemical Manufacturers Association (CMA) and the ITC formed a Dialogue Group to discuss the data needs. Data needs and activities initiated by the Dialogue Group will be presented.

A field study to evaluate the performance of three commercially available particulate matter (PM) continuous emission monitors (CEMs) was conducted in 1999-2000 at the US Department of Energy (DOE) Toxic Substances Control Act (TSCA) Incinerator. This study offers unique features that are believed to enhance the collective US experience with PM CEMs. The TSCA Incinerator is permitted to treat PCB-contaminated RCRA hazardous low-level radioactive wastes. The air pollution control system utilizes MACT control technology and is comprised of a rapid quench, venturi scrubber, packed bed scrubber, and two ionizing wet scrubbers in series, which create a saturated flue gas that must be conditioned by the CEMs prior to measurement. The incinerator routinely treats a wide variety of wastes including high and low BTU organic liquids, aqueous, and solid wastes. The various possible combinations for treating liquid and solid wastes may present a challenge in establishing a single, acceptable correlation relationship for individual CEMs. The effect of low-level radioactive material present in the waste is a unique site-specific factor not evaluated in previous tests. The three systems chosen for evaluation were two beta gauge devices and a light scattering device. The performance of the CEMs was evaluated using the requirements in draft Environmental Protection Agency (EPA) Performance Specification 11 (PS11) and Procedure 2. The results of Reference Method 5i stack tests for establishing statistical correlations between the reference method data and the CEMs responses are discussed.

The California Air Resources Board appointed an Oxidant Calibration Committee for the purpose of evaluating the accuracy of the different agency calibration procedures. The committee chose UV absorption photometry as the reference method for ozone measurement. Interagency comparisons of the various iodometric methods were conducted relative to the ultraviolet standard. The tests included versions of the iodometric methods as employed by the Air Resources Board, the Los Angeles Air Pollution Control District, and the EPA. An alternative candidate reference method for ozone measurement, gas phase titration, was also included in the test series.

Section 5 of the Toxic Substances Control Act (TSCA) requires that manufacturers and importers of new chemicals must submit a Premanufacture Notification (PMN) to the U.S. Environmental Protection Agency 90 days before they intend to commence manufacture or import. Certain information such as chemical identity, uses, etc., must be included in the notification. The submission of test data on the new substance, however, is not required, although any available health and environmental information must be provided. Nonetheless, over half of all PMNs submitted to the agency do not contain any test data; because PMN chemicals are new, no test data is generally available in the scientific literature. Given this situation, EPA has had to develop techniques for hazard assessment that can be used in the presence of limited test data. EPA's approach has been termed "structure-activity relationships" (SAR) and involves three major components: the first is critical evaluation and interpretation of available toxicity data on the chemical; the second component involves evaluation of test data available on analogous substances and/or potential metabolites; and the third component involves the use of mathematical expressions for biological activity known as "quantitative structure-activity relationships" (QSARs). At present, the use of QSARs is limited to estimating physical chemical properties, environmental toxicity, and bioconcentration factors. An important overarching element in EPA's approach is the experience and judgment of scientific assessors in interpreting and integrating the available data and information. However, a significant number of the industrial chemicals under the jurisdiction of TSCA have sufficient volatility to affect availability in fortified test diets and consequently the test results. A person who intends to import or process any of the seven PBDEs included in the proposed SNUR, as part of an article for a significant new use would be required to notify EPA at least 90 days in advance to ensure that the Agency has an opportunity to review and, if necessary, restrict or prohibit a new use before it begins. EPA is also proposing a test rule under TSCA that would require any person who manufactures or processes commercial pentabromodiphenyl ether (c-pentaBDE), commercial octabromodiphenyl ether (c-octaBDE), or commercial decaBDE (c-decaBDE), including in articles, for any use after December 31, 2013, to conduct testing on their effects on health and the environment. EPA is proposing to designate all discontinued uses of PBDEs as significant new uses. The test rule would be promulgated if EPA determines that there are persons who intend to manufacture, import, or process c-pentaBDE, c-octaBDE, or c-decaBDE, for any use, including in articles, after December 31, 2013.

Dr. Michael P. Wilson of UC Berkeley delivered his keynote address before the general assembly of the American Industrial Hygiene Conference and Exhibition (AIHce) in Portland, Oregon, in May 2011. Here, Dr. Wilson again discusses the political and economic drivers of occupational disease in the United States and proposes a role for AIHA in helping to highlight and resolve them. He proposes that until these underlying drivers are acknowledged and ameliorated, the toll of occupational disease will persist, despite the hard work of industrial hygienists in the workplace. Among these drivers, Dr. Wilson points to the decline of labor rights and unionization; economic inequality; economic insecurity; political resistance to public health protections for workers, notably the OSHA and NIOSH programs; and weaknesses in the Federal Toxic Substances Control Act of 1976 (TSCA). Of these, Dr. Wilson calls on the AIHA to participate in the historic effort to rewrite TSCA. He points to weaknesses in TSCA that have produced a chemicals market dominated by the function, price, and performance of chemicals, with little attention given to their health and environmental effects. Under these conditions, he argues, hazardous chemicals have remained economically competitive, and innovation in inherently safer chemicals-in green chemistry-has been held back by a lack of market transparency and public accountability in the industry. TSCA reform has the potential to shift the market toward green chemistry, with long-term implications for occupational disease prevention, industrial investment, and renewed energy in the industrial hygiene profession. Dr. Wilson proposes that, like previous legislative changes in the United States, TSCA reform is likely to occur in response to myriad social pressures, which include the emergence of the European Union's REACH regulation; recent chemicals policy actions in 18 U.S. states; growing support from downstream businesses; increasing public awareness; and a social movement that reaches across traditional boundaries. Dr. Wilson urges the AIHA to involve itself in this effort by building alliances with professional associations and other groups that share similar goals.

Nanomaterials exemplify a new class of emerging technologies that have significant economic and social value, pose uncertain health and environmental risks, and are entering the marketplace at a rapid pace. Effective regimes for regulating emerging technologies generate information about known or suspected hazards and draw on private sector expertise to guide managers' behavior toward risk reduction, even in the absence of clear evidence of harm. This paper considers the extent to which the federal Toxic Substances Control Act (TSCA) accomplishes those objectives. It offers the approach of the Massachusetts Toxics Use Reduction Act (TURA) as a possible supplement to TSCA, filling gaps in agency knowledge and private sector capacities. TURA is notable for its focus on chemicals use and hazard and its emphasis on strengthening firms' internal management systems. Given the current deadlock in Congressional efforts to modernize federal laws such as TSCA, the role of state laws like TURA merit attention. Absent definitive information about risk, a governance strategy that generates information and focuses management attention on reducing hazards is worth considering.

In this paper, we present an overview of a proposed collaboration between the National Aeronautics and Space Administration (NASA) and the European Space Agency (ESA), which is designed to facilitate the introduction of commercial-off-the-shelf (COTS) radios for smart-sensing applications into international spaceflight programs and projects. The proposed work will produce test hardware reference designs, test software reference architectures and example implementations, test plans in reference test environments, and test results, all of which will be shared between the agencies and documented for future use by mission planners. The proposed collaborative structure together with all of the anticipated tools and results produced under the effort is collectively referred to as the Smart Sensor Inter-agency Reference Testbench or SSIART. It is intended to provide guidance in technology selection and in increasing the related readiness levels of projects and missions as well as the space industry.

The Environmental Protection Agency is asserting regulatory control over the commercial production of genetically-engineered microorganisms, such as oil-eating bacteria, intended for release into the environment. EPA's legally-complex claim that such organisms are "new chemical substances," and thus subject to the Toxic Substances Control Act (TSCA), raises a challenge to the adequacy of regulation by the National Institute of Health's Recombinant DNA Advisory Committee (RAC) over the commercial and ecological implications of environmental release. Industry, which has been voluntarily adhering to the RAC guidelines, is reluctant to challenge application of the relatively lenient TSCA requirements but eager to see the legal uncertainties resolved.

Sludge from tank bottoms containing PCB`s, radioactivity and hazardous constituents are present in several tanks at one of the National Laboratories. Disposal of the material can proceed if the material is removed from TSCA regulations by decreasing the concentration of the PCB`s to {le}2 ppm. ON the bench scale, this sludge was treated by the DECHLOR/KGME{sup {trademark}} chemical dechlorination process. The levels of PCB`s were reduced to below 2 ppm, allowing the material to be managed outside the TSCA regulations. RUST believes that this is the first successful chemical dechlorination of a radioactive, RCRA listed, PCB bearing waste. A pilotmore » scale unit is available to provide on-site treatment of the remaining waste. Because of the small amounts of waste, treatment costs are high on a per unit volume. As a result of these high costs and other concerns the client is investigating potential non-treatment options of delisting the waste of obtaining a waiver. In the event that this particular waste cannot be delisted or a waiver is not granted, then dechlorination of the waste to remove it from TSCA regulations remains a viable option to allow the material to be disposed.« less

Seven of these chemical substances are subject to TSCA section 5(e) consent orders issued by EPA. This action requires persons who intend to manufacture, import, or process any of these 78 chemical substances for an activity that is designated as a significant new use by this rule to notify EPA at least 90 days before commencing that activity. The required notification will provide EPA with the opportunity to evaluate the intended use and, if necessary, to prohibit or limit that activity before it occurs.

This research aimed to understand how cooperation and collaboration work in interagency arrangements using a case study of the public management of food security and nutrition in Bogotá, Colombia. This study explored the available scientific literature on Collaborative Governance within the Public Management body of knowledge and the literature on Cooperation from the Sociobiology field. Then, proposals were developed for testing on the ground through an action-research effort that was documented as a case study. Finally, observations were used to test the proposals and some analytical generalizations were developed. To document the case study, several personal interviews, file reviews and normative reviews were conducted to generate a case study database. Collaboration and cooperation concepts within the framework of interagency public management can be understood as a shared desirable outcome that unites different agencies in committing efforts and resources to the accomplishment of a common goal for society, as seen in obtaining food and nutrition security for a specific territory. Collaboration emerges when the following conditions exist and decreases when they are absent: (1) a strong sponsorship that may come from a central government policy or from a distributed interagency consensus; (2) a clear definition of the participating agencies; (3) stability of the staff assigned to the coordination system; and (4) a fitness function for the staff, some mechanism to reward or punish the collaboration level of each individual in the interagency effort. As this research investigated only one case study, the findings must be taken with care and any generalization made from this study needs to be analytical in nature. Additionally, research must be done to accept these results universally. Food security and nutrition efforts are interagency in nature. For collaboration between agencies to emerge, a minimum set of characteristics that were established during the merging of the public management and sociobiology fields of knowledge and validated by means of a case study must be accomplished. An Interagency (NASA/DOE/DOD) technical panel has been working in 1991 to evaluate nuclear thermal propulsion (NTP) concepts on a consistent basis, and to continue technology development project planning for a joint project in nuclear propulsion for Space Exploration Initiative (SEI). This paper summarizes the efforts of the panel to date and summarizes the technology plans defined for NTP. Concepts were categorized based on probable technology readiness data, and innovative 'proof-of-concept' tests and analyses were defined. While further studies will be required to provide a consistent comparison of all of the NTP concepts, the current status of the studies is presented.

The terrorist attacks of September 11 and the anthrax mailings a month later prompted a sweeping response by the federal government to improve the preparedness of the US to meet the potential threat posed by a terrorist using a biological agent. This response transcended traditional interagency boundaries, creating new opportunities while producing unique fiscal and leadership challenges. The National Interagency Confederation for Biological Research has made significant progress over the past 12 years because of its ability to adapt to the need for interagency cooperation and overcome many of these challenges. As construction of the National Interagency Biodefense Campus at Fort Detrick nears completion, the US has the capability to pursue a unique whole-of-government approach to the development of medical measures to counter the threat of bioterrorism. In addition to the high-level support of many in the federal government, the key success factors for this effort have been (1) a critical mass of leaders with the right leadership characteristics, (2) development of a compelling vision and accompanying narrative understood and articulated by all partnering organizations, and (3) recognition of the need for a partnership office to do the important communication and collaboration work in the organization to synchronize the information available to all the partners. NASA LeRC was selected to lead nuclear propulsion technology development for NASA. Also participating in the project are NASA MSFC and JPL. The U.S. Department of Energy will develop nuclear technology and will conduct nuclear component, subsystem, and system testing at appropriate DOE test facilities. NASA program management is the responsibility of NASA/RP. The project includes both nuclear electric propulsion (NEP) and nuclear thermal propulsion (NTP) technology development. This report summarizes the efforts of an interagency panel that evaluated NTP technology in 1991. Other panels were also at work in 1991 on other aspects of nuclear propulsion, and the six panels worked closely together. The charters for the other panels and some of their results are also discussed. Important collaborative efforts with other panels are highlighted. The interagency (NASA/DOE/DOD) NTP Technology Panel worked in 1991 to evaluate nuclear thermal propulsion concepts on a consistent basis. Additionally, the panel worked to continue technology development project planning for a joint project in nuclear propulsion for the Space Exploration Initiative (SEI). Five meetings of the panel were held in 1991 to continue the planning for technology development of nuclear thermal propulsion systems. The state-of-the-art of the NTP technologies was reviewed in some detail. The major technologies identified were as follows: fuels, coatings, and other reactor technologies; materials; instrumentation, controls, health monitoring and management, and associated technologies; nozzles; and feed system technology, including turbopump assemblies.

A critical enabling technology in the evolutionary development of nuclear thermal propulsion (NTP) is the ability to predict the system performance under a variety of operating conditions. This is crucial for mission analysis and for control subsystem testing as well as for the modeling of various failure modes. Performance must be accurately predicted during steady-state and transient operation, including startup, shutdown, and post operation cooling. The development and application of verified and validated system models has the potential to reduce the design, testing, and cost and time required for the technology to reach flight-ready status. Since Oct. 1991, the U.S. Department of Energy (DOE), Department of Defense (DOD), and NASA have initiated critical technology development efforts for NTP systems to be used on Space Exploration Initiative (SEI) missions to the Moon and Mars. This paper presents the strategy and progress of an interagency NASA/DOE/DOD team for NTP system modeling. It is the intent of the interagency team to develop several levels of computer programs to simulate various NTP systems. The first level will provide rapid, parameterized calculations of overall system performance. Succeeding computer programs will provide analysis of each component in sufficient detail to guide the design teams and experimental efforts. The computer programs will allow simulation of the entire system to allow prediction of the integrated performance. An interagency team was formed for this task to use the best capabilities available and to assure appropriate peer review.
