ABSTRACT Regulatory policies governing the safety of genetic engineering (rDNA) and the resulting products (GMOs) have been contentious and divisive, especially in agricultural applications of the technologies. These tensions led to vastly different approaches to safety regulation in different jurisdictions, even though the intent of regulations—to assure public and environmental safety—are common worldwide, and even though the international scientific communities agree on the basic principles of risk assessment and risk management. So great are the political divisions that jurisdictions cannot even agree on the appropriate triggers for regulatory capture, whether product or process. This paper reviews the historical policy and scientific implications of agricultural biotechnology regulatory approaches taken by the European Union, USA and Canada, using their respective statutes and regulations, and then critically assesses the scientific underpinnings of each. This paper reviews the principle of confidentiality and the rights of access by patients to their medical records. Confidentiality has been germane to the ethics of medical practice since the time of Hippocrates but the nature of the legal obligation of confidence does not have such a clear pedigree. The introduction of cross-border telemedical consultations presents a very real danger to maintaining the confidentiality of medical data. While both the common law and statute law can be used to prevent the unauthorized interception and disclosure of medical data and protect the patient's rights of access and ownership in the UK, it is the harmonization regime of the European Union that will bring comprehensive regulation and legal clarity to the protection of patients' rights within an increasingly international medical 'super-specialty'.

The Statute of Budva dates from the time of Nemanjics. This medieval document was approved at the time Budva was under venetian dominion and remained in force until the end of the Venetian Republic. During 17th century the Statute was translated into the Italian language. The document includes regulations which indicate a concern for the health of the public. Among the regulations is one which prohibit the sale of fisch outside the stalls of the fishmarket presumably to ensure the sale of only fresh fish. Another regulation prohibits the sale of dead animals, the sale of dog's meat instead od wether meat. There is also language indicating a concern for protecting the cleanliness of brooks, rivers and wells. Corporal punishment is mentioned but only with regard to whipping and beheading.

In this case, the Constitutional Court of Germany was requested to determine whether a statute imposing fines on employers who employed women for night work was in violation of Article 3 of the German Constitution, which guarantees men and women equal treatment. The Court ruled that the statute was in violation of Article 3 because night work was equally harmful to men and women, with no differentiation possible on the basis of biological differences. It also held that the statute violated the principle that the State may not perpetuate social role assignments that disadvantage women. Moreover, because the European Court of Justice had already declared similar French legislation impermissible, the Constitutional Court found that the statute was in violation of the law of the European Union, which, it noted, has primacy over national law. On 23 September 1992, the Federal Labor Court of Germany held that the plaintiffs, female employees of the defendant, who performed the same duties as male employees, but were placed in a lower pay class than half of the male employees, had been subject to sex discrimination and were entitled to the difference in pay between the classes for wages already received and to an injunction placing them in the higher pay class. In the fall of 1976 Congress enacted the Resource Conservation and Recovery Act, commonly referred to as RCRA. The objective of the statute is to create an orderly system for the generation, handling and disposal of hazardous waste by means of a comprehensive tracking and record keeping mechanism. RCRA does not regulate directly by statute so much as it delegates rule making authority to the U.S. Environmental Protection Agency. Pursuant to its mandate to develop regulations in accordance with the broad criteria of RCRA, EPA has published extensive regulations. These regulations address hazardous waste generation, transportation, treatment, storage and handling and its final disposal. The statute also offers remedies available to both EPA and the public at large to ensure enforcement of the provisions of RCRA and the EPA regulations. Additionally, it sets guidelines for states to implement their own hazardous waste management programs. This article is intended to introduce this complicated statutory/regulatory package to scientists and health professionals. It outlines the provisions of RCRA and the EPA regulations, abbreviates early judicial decisions interpreting these provisions and sets forth a brief description of various state approaches to hazardous waste management. Medical Emergency Exceptions in State Abortion Statutes: The Statistical Record.

This article attempts to determine, first, whether emergency exceptions in statutes regulating abortion have been abused and, second, whether the standard used in such an exception--subjective or objective--makes a difference in the reported incidence of such emergencies. A review of the statistical data supports two conclusions. First, physicians who perform abortions and have complied with state reporting requirements have not relied upon the medical emergency exceptions in state abortion statutes to evade the requirements of those statutes. Second, the use of an objective standard for evaluating medical emergencies ("reasonable medical judgment") has not been associated with fewer reported emergencies (per number of abortions performed) than the use of a subjective standard ("good faith clinical judgment"). Both of these conclusions may be relevant in drafting other abortion statutes including prohibitions (e.g., post-viability abortions).

This article educates healthcare practitioners on the legal framework prohibiting abusive practices in urine drug testing (UDT) in medical settings, discusses several profit-driven UDT schemes that have resulted in enforcement actions, and provides recommendations for best practices in UDT to comply with state and federal fraud and anti-kickback statutes. The authors carefully reviewed and analyzed statutes, regulations, adivsory opinions, case law, court documents, articles from legal journals, and news articles. Certain facts-driven UDT arrangements tend to violate federal and state healthcare laws and regulations, including Stark law, the anti-kickback statute, the criminal health care fraud statute, and the False Claims Act. Healthcare practitioners who use UDT can help ensure that they are in compliance with applicable federal and state laws by evaluating whether their actions are motivated by providing proper care to their patients rather than by profits. They must avoid schemes that violate the spirit of the law while appearing to comply with the letter of the law. Such a simple self-evaluation of motive can reduce a practitioner's likelihood of civil fines and criminal liability.

Liability for space activities is a much discussed subject and the advent of commercial space operations has only added to its importance. Articles VI and VII Outer Space Treaty, together with Articles II and III Liability Convention, remain the main entry level for state liability for damage arising from private space activities. Few space-faring nations have introduced national space statutes that include a flow down of their international obligations. The European Union (EU) Regulation on the law applicable to non-contractual obligations—hereinafter Rome II Regulation—could harbour developments for liability law in the context of damage resulting from space operations. Space activities were not the main focus of the Regulation but may well turn out to be an interesting spin-off. The Regulation prescribes general rules that will determine the law applicable to damage scenarios where more than one legal system applies. It is important for trans-national tort cases in that it does not limit the rules of applicable law to EU Member States only. This paper focuses on the common rules applicable to damage actions based on torts or other non-contractual obligations as they apply to damage caused by space activities. After an assessment of the relevant international and national law norms, the impact of the Rome II Regulation will be addressed.

Ten years after: is it time to revisit the 1994 OSHA indoor air quality rule?

Approximately 20 million nonsmoking workers are employed in workplaces without restrictions on smoking and are potentially exposed to secondhand smoke--a Class A carcinogen. These workers are largely in the service industry, in southern and western states and in non-urban areas. The Occupational Safety and Health Administration's (OSHA's) 1994 proposal for smoke-free workplaces (withdrawn in 2001) was attacked by many interest groups that may no longer oppose this protection. Federal regulation for smoke-free workplaces is needed for workers, who are not protected by state and local smoke-free laws. This policy could save thousands of lives each year, and prevent significant illness. Twenty-one states have "state plans" that would allow more protective laws. Of the 29 states under OSHA, 11 have comprehensive smoke-free statutes. Changes in the policy environment and in institutions such as unions, restaurant associations, and the tobacco industry since 2001 may improve the prospects for federal action and reduce disparities that currently characterize exposure to secondhand smoke.

The [name removed] District Council Welfare Fund has agreed to pay $1 million to construction workers who have been denied medical coverage for AIDS-related care. The decision establishes self-insured health care benefits programs as covered entities under the Americans with Disabilities Act (ADA). The settlement ends a three-year battle which began in 1992 between [name removed] and fourteen HIV-positive construction workers who were refused medical coverage. The first suit was filed by [name removed]., a construction worker who lost coverage for his HIV-related care in July 1991. At that time, the union fund decided to exclude care for HIV on the grounds that it was too expensive. The Equal Employment Opportunity Commission (EEOC) filed an ADA lawsuit that challenged disability-based distinctions in health insurance. The U.S. Attorney's Office filed a complaint against the union under the Racketeer Influenced and Corrupt Organizations (RICO) statute to end organized crime associated with the union. In late 1994, the government announced a consent decree, settling its racketeering suit against the union. Under the terms of the settlement, [name removed] was awarded $16,000 in damages. In the EEOC case, damages for plan members ranged as high as $50,000.

Recently issued proposed regulations describing how the IRS intends to enforce the intermediate tax sanctions statute of the Internal Revenue Code have important ramifications for integrated delivery systems (IDSs). The regulations' interpretation of who within an IDS may be subject to excise taxes under the statute is broad, basing an individual's risk of being taxed on his or her degree of influence over a given entity within the organization, rather than over the organization as a whole. To protect individuals within an IDS from exposure to intermediate tax sanctions, the organization should understand who is likely to be at risk and take steps to ensure that all transactions with such persons are in compliance with the conditions set forth in the proposed regulations.

Congress assigned the Federal government the responsibility for setting substantive environmental quality standards and the states the responsibility for implementing and enforcing those standards in four statutes--the National Environmental Policy Act; the Federal Water Pollution Control Act; Clean Air Act; and the Noise Control Act. In two recent decisions (EPA v. California ex rel. State Water Resources Council Bd., 96 S. Ct. 2022, 1976 and Hancock v. Train, 96 S. Ct. 2006, 1976) the U.S. Supreme Court considered the extent to which Congress intended these environmental statutes to waive Federal immunity from state regulation. Until April 1, 1979, the Public Service Commission had been vested with exclusive jurisdiction over the regulation of rates and service of utilities. As of that date two new agencies, the Energy Regulatory Commission (ERC) and the Utility Regulatory Commission (URC), have replaced the Public Service Commission. The ERC consists of three full-time members appointed by the governor for four year terms and is responsible for enforcing the provisions of the Kentucky statutes relating to electric and gas utilities. The three-member URC is responsible for enforcing the provisions relating to non-energy utilities such as telephone, sewer, and water utilities. A public appeal has been advanced by a large group of scientists, concerned that science has been misused in attempting to quantify and regulate unmeasurable hazards and risks. 1 The appeal recalls that science is unable to evaluate hazards that cannot be measured, and that science in such cases should not be invoked to justify risk assessments in health, safety and environmental regulations. The appeal also notes that most national and international statutes delineating the discretion of regulators are ambiguous about what rules of evidence ought to apply. Those statutes should be revised to ensure that the evidence for regulatory action is grounded on the standards of the scientific method, whenever feasible. When independent scientific evidence is not possible, policies and regulations should be informed by publicly debated trade-offs between socially desirable uses and social perceptions of affordable precaution. Gaps, inexperience, inconsistencies, and overlaps: crisis in the regulation of genetically modified plants and animals.

The regulation of genetically modified products pursuant to statutes enacted decades prior to the advent of biotechnology has created a regulatory system that is passive rather than proactive about risks, has difficulty adapting to biotechnology advances, and is highly fractured and inefficient--transgenic plants and animals are governed by at least twelve different statutes and five different agencies or services. The deficiencies resulting from this piecemeal approach to regulation unnecessarily expose society and the environment to adverse risks of biotechnology and introduce numerous inefficiencies into the regulatory system. These risks and inefficiencies include gaps in regulation, duplicative and inconsistent regulation, unnecessary increases in the cost of and delay in the development and commercialization of new biotechnology products. These deficiencies also increase the risk of further unnecessary biotechnology scares, which may cause public overreaction against biotechnology products, preventing the maximization of social welfare. With science and society poised to soar from first-generation biotechnology (focused on crops modified for agricultural benefit), to next-generation developments (including transgenic fish, insects, and livestock, and pharmaceutical-producing and industrial compound-producing plants and animals), it is necessary to establish a comprehensive, efficient, and scientifically rigorous regulatory system. This Article details how to achieve such a result through fixing the deficiencies in, and risks created by, the current regulatory structure. Ignoring many details, the solutions can be summarized in two categories. First, statutory and regulatory gaps that are identified must be closed with new legislation and regulation. Second, regulation of genetically modified products must be shifted from a haphazard model based on statutes not intended to cover biotechnology to a system based upon agency expertise in handling particular types of risks.

State laws regarding prenatal syphilis screening in the United States.

The purpose of this study was to assess the frequency and pattern of state laws or regulations regarding prenatal syphilis serologic screening in the United States in 2001. We surveyed the United States for existing laws and regulations regarding serologic screening for syphilis during pregnancy. Testing was compared with 2000 state rates of syphilis in women and newborn infants, with states that had syphilis high morbidity areas, and with national 2000 and 2010 objectives for rates of syphilis. Forty-six of the 50 states (90%) and the District of Columbia have laws regarding antenatal syphilis screening. Thirty-four of the 46 statutes (76%) mandate one prenatal test, usually at the first prenatal visit or early in pregnancy. Twelve laws (26%) include third-trimester testing for all or high-risk women. The presence of high morbidity areas, incidence of early syphilis in women, and rates of congenital syphilis are associated with increasing frequency of legislated antepartum screening. Only 90% of states have statutes that require antepartum syphilis screening, and there is variation in the content of the statutes about the number and timing of tests. States with a heavy burden of infectious syphilis in women tend to require more prenatal testing.

The regulation of medication advertising in Brazil has four weak points. Inspection and punishment of irregularities is carried out a posteriori to the infraction being committed (when the population has already been exposed to a sanitary risk). The fines charged by the Brazilian Sanitary Surveillance Agency (Anvisa) have a derisory value compared to investments in advertising. There is no mechanism that prevents fines from being transferred to prices. The phrase 'If symptoms persist, consult your doctor', rather than warning about the risks of self-medication, encourages using at least the first medication without a prescription, advising a visit to the doctor only if symptoms persist. Anvisa data and academic studies reveal that 90% to 100% of advertising shown in the media contains irregularities. Thus, the Anvisa Collegiate Board of Directors Resolution 102/2000, which seeks to regulate the sector, makes up a system that benefits the infractor and keeps the population at risk. This work analyses alternative regulation, looking at advertising's previous compliance statute through the surveillance system; it studies international statutes and proposes an alteration in the structure of the current model, inserting the logic of sanitary risk prevention.

Teenage use of indoor tanning has reached epidemic proportions. There is no federal ban on teen use; rather, it is left to each state to determine policy. We conducted a state-by-state analysis using data from each state's statutes and regulations and supplementary information from the National Conference of State Legislatures. First, we refined an earlier 35-item instrument to now include 56 items that extensively measures age bans, parental involvement, warnings/information, enforcement, and operating requirements. To grade each tanning law, we developed a uniform scoring system with a goal of providing performance data for future comparisons. As of August 2012, 13 states had no tanning facility statute or regulation for minors. In states with some regulations, teen bans are lax-nearly uniformly, most young children under the age of 14 can legally tan with or without suboptimal parental consent or accompaniment laws. Strong Food and Drug Administration involvement can simplify and unify the inconsistencies that exist among states' indoor tanning laws. Until consistent regulations are promulgated and enforced, such an instrument can provide a benchmark for state investigations into the deficiencies and progress of their laws, as well as facilitate direct comparison between states for research and educational purposes.

The Rhode Island statutes vest in the Public Utility Commission and the Division of Public Utilities the exclusive power and authority to regulate public utility companies in that state. Both bodies have been established within the Department of Business Regulation but are independent of the Department's director and are not under his jurisdiction. The jurisdiction to regulate utilities is shared by the Commission and the Division. The Commission serves as a quasi-judicial tribunal with jurisdiction, powers, and duties to hold investigations and hearings involving rates, sufficiency and resonableness of facilities, gas, electric, water, and pipeline public utilities. The administrator, whomore » is chief executive officer of the Division, is responsible for exercising the jurisdiction, supervision, powers, and duties not specifically assigned to the Commission.
