The Environmental Protection Agency (EPA) granted a Clean Air ACt waiver to DuPont's blendstock of methanol and other cosolvent alcohols for use in unleaded gasoline. The waiver included some stringent fuel volatility requirements to control evaporative emissions that have kept the waiver from becoming the marketing tool for fuel alcohols that everyone expected it to be. EPA seems willing to amend the waiver as long as evaporative emissions controls are kept, but there are some difficult procedural issues to resolve first. he space shuttle Discovery is carrying some 300 waivers to technical specifications as it enters the home stretch of its planned return to flight next month. There were about 6,000 waivers in place when Columbia crashed. Shuttle managers say they are working to reduce the number of waivers remaining by fixing the problems they highlight, a change prompted by the Columbia Accident Investigation Board. In the wake of the accident, NASA has heeded the CAWS recommendation that waivers be the responsibility of an "independent technical authority" (ITA), rather than the shuttle program itself. To carry out the recommendation of the CAIB-which found an inherent conflict of interest in having the same managers make decisions about cost, schedule and safety-then-Administrator Sean O'Keefe designated the agency's chief engineer as the formal ITA. He is responsible for setting, maintaining and granting waivers across the agency. In mid-January, Fred Gregory, then O'Keefe's deputy and now his acting replacement, launched the ITA within NASA under Chief Engineer Rex Geveden, the former program manager on the Gravity Probe B experiment.

Some State Medicaid agencies have implemented home and community-based waiver programs targeting acquired immunodeficiency syndrome (AIDS) patients. Under these initiatives, State Medicaid agencies can provide home and community-based services to persons with AIDS (PWA) as an alternative to more costly Medicaid-covered institutional care. This article evaluates quality of care under the Florida Medicaid waiver for PWA along two dimensions: program effectiveness and client satisfaction. Clients are generally satisfied with their case managers and the range and availability of services. Case managers appear to be well trained. Moreover, the probability of turnover is quite low, despite heavy caseloads and high mortality. The major difficulty faced by clients and case managers relates to the process of becoming Medicaid eligible. PMID:10151885

A Comparative Review of Waivers Granted in Pediatric Drug Development by FDA and EMA from 2007-2013.

The European Union and the United States have different legal frameworks in place for pediatric drug development, which can potentially lead to different pediatric research requirements for the pharmaceutical industry. This manuscript compares pediatric clinical trial waivers granted by the European Medicines Agency (EMA) and the US Food and Drug Administration (FDA). This is a retrospective review comparing EMA's Paediatric Committee (PDCO) decisions with FDA's Pediatric Review Committee (PeRC) recommendations for all product-specific pediatric full waiver applications submitted to EMA from January 2007 through December 2013. Using baseline data from EMA, we matched product-specific waivers with their FDA equivalents during the study period. For single active substance products, PDCO and PeRC adopted similar opinions in 42 of 49 indications (86%). For fixed-dose combinations, PDCO and PeRC adopted similar opinions in 24 of 31 indications (77%). Despite the different legal frameworks, criteria, and processes of determination, the waiver decisions of the 2 agencies were similar in the majority of cases.

The effect of the physician J-1 visa waiver on rural Wisconsin.

One strategy to increase the number of physicians in rural and other underserved areas grants a waiver to foreign physicians in this country on a J-1 education visa allowing them to stay in the United States if they practice in designated underserved areas. The goal of this study is to evaluate the retention and acceptance of the J-1 Visa Waiver physicians in rural Wisconsin. Sites in Wisconsin at which physicians with a J-1 Visa Waiver practiced between 1996 and 2002 were identified. A 12-item survey that assessed the acceptance and retention of these physicians was sent to leaders of institutions that had participated in this program. Retention of J-1 Visa Waiver physicians was compared to other physicians recruited to rural Wisconsin practices by the Wisconsin Office of Rural Health during the same time period. While there was a general perception that the communities were well satisfied with the care provided and the physicians worked well with the medical community, there was a lower satisfaction with physician integration into the community-at-large. This was found to correlate with the poor retention rate of physicians with a J-1 Visa Waiver. Physicians participating in a placement program without J-1 Visa Waivers entering practice in rural communities had a significantly higher retention rate. Physicians with J-1 Visa Waivers appear to provide good care and work well in health care environments while fulfilling the waiver requirements. To keep these physicians practicing in these communities, successful integration into the community is important.

Background The European Union and the United States have different legal frameworks in place for pediatric drug development, which can potentially lead to different pediatric research requirements for the pharmaceutical industry. This manuscript compares pediatric clinical trial waivers granted by the European Medicines Agency (EMA) and the US Food and Drug Administration (FDA). Methods This is a retrospective review comparing EMA’s Paediatric Committee (PDCO) decisions with FDA’s Pediatric Review Committee (PeRC) recommendations for all product-specific pediatric full waiver applications submitted to EMA from January 2007 through December 2013. Using baseline data from EMA, we matched product-specific waivers with their FDA equivalents during the study period. Results For single active substance products, PDCO and PeRC adopted similar opinions in 42 of 49 indications (86%). For fixed-dose combinations, PDCO and PeRC adopted similar opinions in 24 of 31 indications (77%). Conclusion Despite the different legal frameworks, criteria, and processes of determination, the waiver decisions of the 2 agencies were similar in the majority of cases. PMID:27274951

The Texas Medicaid 1115 Transformation Waiver reforms the state's safety net systems by creating a Delivery System Reform Incentive Payment incentive pool for innovative healthcare delivery. The Waiver supports the design and implementation of transformative projects. As part of the Waiver requirements, regions created Learning Collaboratives to collaborate on project implementation and outcomes. This paper describes the experience of one region in adapting the Institute for Healthcare Improvement Breakthrough Series (IHI BTS) model, as a framework for their Learning Collaborative. Implementation of the Learning Collaborative was systematic, multidimensional, and regularly evaluated. Some features of the IHI model were adapted, specifically longer Plan-Do-Check-Act cycles and the lack of a single clinical focus. This experience demonstrates the ability of a region to improve health from a more diverse perspective than the traditional IHI BTS Collaboratives. Within the region, organizations are connecting, agencies are building continuums of care, and stakeholders are involved in healthcare delivery. The initial stages show a remarkable increase in communication and enhanced relationships between providers. At the end of the 5-year Waiver, evaluation of the impact of the regional and cohort Learning Collaboratives will determine how well the adapted IHI BTS model facilitated improvements in the community's health.

EPA may invoke a technical impracticability (TI) waiver at a site when the Agency determines that it is technically impracticable from an engineering perspective to attain cleanup standards within a reasonable time period. The October 6, 1994 TI waiver of ground water cleanup standards at the G.E./Moreau Superfund Site in New York is the first post-Record of Decision (ROD) TI waiver granted by EPA since issuance of the September 1993 guidance on technical impracticability of ground water restoration. In the 1987 ROD, EPA selected natural gradient flushing and treatment as the ground water remedy and estimated that TCE-contaminated ground watermore » within the unconsolidated aquifer at the Site would be restored to drinking water quality within decades. EPA`s subsequent reevaluation showed that cleanup of the ground water would take 200 years or more, regardless of the remedial technology employed, due to the presence of site-specific physical and chemical factors that limit the effectiveness of ground water remediation technologies. Following public participation activities, EPA issued the TI waiver as an Explanation of Significant Differences (ESD) to the ROD. An investigation of implied Miranda waivers and Powell wording in a mock-crime study.

To guard against coerced self-incrimination, the Supreme Court of the United States outlined in Miranda v. Arizona (1966) what arresting officers must convey to custodial suspects for resulting statements to be admissible into evidence. During the ensuing decades, the Court has continued to grapple with the requisite wording and practical enforcement of these Constitutional rights. In Florida v. Powell (2010), the Court upheld the conviction of a defendant whose Miranda warning affirmed that before questioning he had the right to an attorney, but failed to specify that during questioning he had this right as well. In Berghuis v. Thompkins (2010), the Court ruled that the right to silence must be invoked explicitly, while valid Miranda waivers could be "implied" by a suspect's actions as well as words. The current study employed a mock crime design to assess the practical effects of these 2 rulings on waiver decisions. The wording change enabled by Powell had little effect on Miranda knowledge and reasoning. With regard to Thompkins, the type of waiver profoundly affected subsequent decisions: 13.7% exercised their rights following implied waivers versus 81.1% with explicit waivers. Importantly, the implied waiver condition produced much higher percentages of confessions (17.6% vs. 3.8%) and of admissions about incriminating information (29.4% vs. 9.4%). The US Environmental Protection Agency removed a restrictive evaporative index requirement on the Clean Air Act waiver which had been granted to E.I. DuPont de Nemours and Company. On January 17, 1985, EPA granted DuPont a waiver to produce an unleaded gasoline/methanol blend, which contains 5% methanol and 2.5% cosolvent alcohols, provided producers did not exceed an evaporative index designed to limit the release of vapors to the atmosphere. The reconsideration came after a petition by the Oxygenated Fuels Association (OFA) and after EPA reexamined the relevant data. Originally EPA said it did not think the ASTM Standard D439 wasmore » acceptable for controlling the volatility of the methanol blend, because most gasoline being sold actually had a lower volatility. EPA's more recent information, however, shows that volatility levels in commercial gasoline have been rising and are near ASTM's D439 standard. Therefore, applying the ASTM standard to the DuPont blend will mean that evaporative emissions from vehicles using the DuPont blend will be no higher than those from vehicles using other gasolines. The prevalence of Autism Spectrum Disorder (ASD) has increased dramatically, with one in every 68 children in the U.S. currently diagnosed with ASD. Medicaid is the primary public funder of health care services for individuals with ASD. One mechanism state Medicaid agencies can use to craft ASD-specific services is a 1915(c) waiver. This study investigated what state policy makers perceived to be primary success factors and barriers to adopting an ASD specific 1915(c) waiver, as well as what services and supports are available in each state for children and transition-age youth with ASD. Data were collected by contacting state Medicaid directors via email with an electronic survey, with an 84% response rate. Support from state legislators and parents and family members were the primary success factors in adopting an ASD specific waiver. The primary barrier was insufficient funding. States not adopting an ASD specific waiver also perceived that children and youth with ASD were served sufficiently well through other Medicaid benefits. Analysis of specific services indicated that the majority of states provide their services to children and transition age youth with ASD through a 1915(c) waiver for individuals with intellectual or developmental disabilities, often coupled with an ASD specific waiver for children, another 1915(c) waiver for children, and/or a another 1915(c) waiver, most often for children with serious emotional disturbance. Further research is needed to determine which approach(es) is most effective in enhancing access and improving outcomes for children and youth with ASD. Copyright © 2015 Elsevier Inc. On 15 December 2005, the European Medicines Agency (EMEA) launched an "SME Office" to provide financial and administrative assistance to micro-, small- and medium-sized enterprises (SMEs), with the aim of promoting innovation and the development of new human and veterinary medicinal products by SMEs. According to current EU definition of an SME, companies with fewer than 250 employees, and an annual turnover of not more than 50 million euro or an annual balance sheet total of not more than 43 million euro, are eligible for assistance from the SME Office. Incentives available from the EMEA for SMEs, include: Administrative and procedural assistance from SME Office within the Agency; Fee reductions (90%) for scientific advice and inspections; Fee exemptions for certain administrative services (excluding parallel distribution); Deferral of the fee payable for an application for marketing authorisation or related inspection until after the grant of the marketing authorisation; Conditional fee exemption where scientific advice followed and marketing application is unsuccessful; Assistance with translations of the product information documents. At the end of May 2009, more than 380 companies from 21 countries across the European Economic Area (EEA) had SME status assigned by the EMEA. The large majority of companies are developing medicinal products for human use, 16 are veterinary companies, 15 companies are developing products for both human and veterinary use and 38 are regulatory consultants. Since the SME initiative started the Agency has processed more than 130 requests for scientific advice with fee reductions totalling of 6.9 million euro. Regulatory assistance has been provided to more than 170 companies and 12 companies have benefited from the SME translation service. Stakeholders have acknowledged the significant role the SME Office now plays as a service provider. In the period between January 2006 and June 2009, 34 applications for marketing authorization

Proteinuria in aviation personnel: waiver policy in the U.S. Navy.

Proteinuria is a condition occasionally detected both in applicants for military pilot training and in experienced pilots. Medical personnel involved in the care of either group require a standardized policy for the evaluation and aeromedical disposition of proteinuria for these personnel. A literature search was conducted to obtain current information and prognostic data on proteinuria in the general medical literature. Generally accepted waiver principles were then examined to determine if proteinuria should be waivered in aviation personnel. Other agency policies regarding proteinuria in aviation personnel were examined. The biomedical database records at the Naval Aerospace Medical Institute (NAMI) were searched to discover the U.S. Navy's experience in the evaluation and disposition of aviation personnel with proteinuria. A review of the general medical literature revealed general categories of proteinuria (dependent on protein excretion amount and symptomatology) and the presence or absence of systemic disease that correlated well with prognostic data. These categories provided useful criteria to develop an aeromedical policy that was consistent with previous (informal) NAMI policies, generally accepted waiver principles, and the existing policies of other agencies. Using the above results, a recommended policy for aviation personnel with proteinuria was presented. A recommended policy for the evaluation and aeromedical disposition of aviation personnel with proteinuria was developed for both applicants for U.S. Navy aviation duty as well as in those already serving within the U.S. Navy aviation community.

...The Environmental Protection Agency (EPA) is granting the California Air Resources Board's (CARB's) request for a waiver of Clean Air Act preemption to enforce its Advanced Clean Car (ACC) regulations. The ACC combines the control of smog and soot causing pollutants and greenhouse gas (GHG) emissions into a single coordinated package of requirements for passenger cars, light-duty trucks and medium-duty passenger vehicles (and limited requirements related to heavy-duty vehicles). The ACC program includes revisions to California's Low Emission Vehicle (LEV) program as well as its Zero Emission Vehicle (ZEV) program. By today's decision, EPA has also determined that CARB's amendments to the ZEV program as they affect 2017 and prior model years (MYs) are within the scope of previous waivers of preemption granted to California for its ZEV regulations. In the alternative, EPA's waiver of preemption for CARB's ACC regulations includes a waiver of preemption for CARB's ZEV amendments as they affect all MYs, including 2017 and prior MYs. In addition, EPA is including CARB's recently adopted ``deemed to comply'' rule for GHG emissions in today's waiver decision. This decision is issued under section 209(b) of the Clean Air Act (the ``Act''), as amended.
