Navigating the Clean Water Act: Connectivity and Legal Protection of Aquatic Resources

The Clean Water Act is the principal federal law protecting the integrity of waters in the United States (e.g., rivers, streams, wetlands, lakes). Clean Water Act protection after U.S. Supreme Court decisions in Solid Waste Agency of Northern Cook County (SWANCC) (2001) and Rapanos (2006) is determined based on case-by-case analyses of connections among waters. Determining a water's status as a "water of the US" protected by the Act typically requires data and analysis of characteristics such as its flow, and biological and chemical relationships with downstream waters. When such data is not available, the Clean Water Act might not protect the quality and integrity of the water in question. This raises a number of legal and technical challenges for implementation, as well as questions regarding underlying aquatic sciences. In addition, many of the terms used by the court are not fully consistent with similar scientific terms, potentially causing confusion among policymakers and scientists alike. This presentation will discuss the Clean Water Act, and how currently its protections for aquatic resources are dependent on connectivity with larger downstream waters, particularly for those that do not flow perennially. The presentation will focus on the role science has played in forming and informing policy making, areas where science and policy may not be fully consistent, areas where research is still needed, and provide a policy "dictionary" for scientists interested in working on this evolving issue.

The Safe Drinking Water Act 2011 was introduced in South Australia to provide clear direction to drinking water providers on how to achieve water safety. The Act requires drinking water providers to register with SA Health and develop a risk management plan (RMP) for their water supply that includes operational and verification monitoring plans and an incident notification and communication protocol. During the first year of operation, 212 drinking water providers registered under the Act, including one major water utility and a range of small to medium sized providers in regional and remote areas of the State. Information was captured on water source(s) used and water treatment. Rainwater was the most frequently reported drinking water source (66%), followed by bore water (13%), on-supply or carting of mains water (13%), mixed source (rainwater with bore water backup) (6%) and surface water (3%). The majority of providers (91%) treated the water supply, 87% used disinfection. During the first year of operation, 16 water quality incidents were formally reported to SA Health. These included both microbial and chemical incidents. Case studies presented highlight how the RMPs are assisting drinking water providers to identify incidents of potential health concern and implement corrective actions.

Should the Clean Water Act Follow Stream Water Underground? Managing Beyond the Stream Banks

The Clean Water Act was designed to protect the integrity of surface waters of the United States. Originally limited to solely waters that were traditionally navigable, the jurisdictional bounds of the Clean Water Act have been expanded to include many other ‘waters of the United States,’ some of which are in fact unnavigable. This expansion of the definition of ‘navigable waters’ has brought many litigative challenges to the true jurisdictional limits of the Act. The recent Supreme Court opinions in Rapanos v. United States (2006) and the subsequent interpretation by lower federal courts have set the precedent for a new approach to jurisdictional determinations, where considerations of function and effect act as gatekeepers for inclusion under the CWA. Justice Kennedy’s significant nexus standard from Rapanos (2006) limits jurisdictional coverage under the Clean Water Act to ‘waters that have a significant nexus with traditional navigable waters.’ Thus, establishing a ‘significant nexus’ between a water body in question and traditionally navigable waters satisfies the requisites needed for inclusion within the scope of the Clean Water Act. By and large there has been a lack of consideration for the near subsurface components of streams when discussing the application of the significant nexus standard. We propose that hyporheic zones, a volume of alluvial aquifer that hosts the exchange of stream water, should be covered under the Clean Water Act, since these zones are intimately connected with their adjoining surface waters and facilitate many processes that are key to supporting healthy stream ecosystems and good water quality. Given the opinions rendered in Rapanos (2006) and the guidance offered by the EPA and Corps following the decision, we demonstrate that the hyporheic zone fulfills each of the functional and ecological example factors used to establish a significant nexus. This study quantifies local improvements in environmental quality from controlling effluents in the pulp and paper industry. Although it is confined to a single industry, this study is the first effort to assess the actual net benefits of the Clean Water Act pollution control program. An assessment of water quality benefits requires linking regulatory policy, technical effects, and behavioral responses. Regulatory policies mandate specific controls that influence the quantity and nature of effluent discharges. We identify a subset of stream segments suitable for analysis, describe water quality simulations and control cost calculations under alternative regulatory scenarios, assign feasible water uses to each segment based on water quality, and determine probable upper bounds for the willingness of beneficiaries to pay. Because the act imposes uniform regulations that do not account for differences in compliance costs, existing stream quality, contributions of other effluent sources, and recreation potential, the relation between water quality benefits and costs varies widely across sites. This variation suggests that significant positive net benefits have probably been achieved in some cases, but we conclude that the costs of the Clean Water Act as a whole exceed likely benefits by a significant margin.

Increasing block water pricing, water transfer, and wildlife refuge water supply provisions of the Central Valley Project (CVP) Improvement Act are analyzed in terms of likely farmer response and economic efficiency of these provisions. Based on a simplified partial equilibrium analysis, we estimate small, but significant water conservation savings due to pricing reform, the potential for substantial water transfers to non-CVP customers in severe drought years when the water price exceeds 110 per acre foot (1 acre foot equals 1.234 × 103 m3) and positive net benefits for implementation of the wildlife refuge water supply provisions. The high threshold water price is partly a result of requiring farmers to pay full cost on transferred water plus a surcharge of 25 per acre foot if the water is transferred to a non-CVP user. The act also sets an important precedent for water pricing reform, water transfer provisions, and environmental surcharges on water users that may find their way to other Bureau of Reclamation projects.

In 1974, President Gerald Ford signed into law the Safe Drinking Water Act, the first piece of legislation of its kind to provide a comprehensive regulatory framework for overseeing the nation's drinking water supply. The law has proven instrumental in setting standards for ensuring that the US population can access drinking water that is safe. However, the law delegates much of its monitoring requirements to states, creating, at times, a confusing and complicated system of standards that must be adhered to and enforced. Although it has proven valuable in the safety standards it specifies, the law's administration and enforcement poses tremendous challenges. © 2017 American Medical Association. All Rights Reserved.

The early industries in America generally were established when and where demands for the products of industry arose. Most of the early industries were so located that their increasing requirements for transportation, raw materials, market, labor, and water supply could be satisfied economically. Many of these original plant locations have continued as modern industrial centers and their output has increased manyfold in meeting the demands of our growing Nation. The recent and current industrial expansion and the trend toward the growth of chemical industries, many Of which are heavy users of water, has resulted in a tremendous increase in the total withdrawal of water for industrial use as well as a large increase in the per capita use of water. This increase in industrial water requirement has strained the capacity of the developed water supplies in many areas, and in some instances the adequacy of the potential water supplies is questionable. The Geological Survey is engaged in preparing and publishing a series of reports describing the developed and undeveloped water resources of many important industrial areas. This work was started initially at the request of the National Securities Resources Board as a means to insure that water supplies are adequate for our rapidly expanding industrial development. Although many factors contribute to establishing the feasibility or even the limits of future industrial development, the one relating to available water supply is extremely important. A knowledge of the water requirements of various industries is valuable therefore in planning the logical development in any area where water supply is a critical factor. Thus far very little suitable information on the water requirements of our major industries is available for general planning. An inventory of unit water-use values in industry therefore would be generally helpful and also might tend to stimulate water-conservation methods. To obtain such information

In the American southwest, over-allocated water supplies, groundwater depletion, and potential climate change impacts are major water management concerns. It may therefore seem counterintuitive that the resolution of outstanding senior tribal water claims, essentially reallocating finite water supplies to tribes, could support improved water supply reliability for many water users as is the case with the 2004 Arizona Water Settlements Act. The large size of the settlement and its multiple components translate to significant impacts on water policy in Arizona. Key water management solutions incorporated into the settlement and associated legislation have expanded the water manager's "toolbox" and are expected to enhance water supply reliability both within and outside Arizona's active management areas. Many of these new tools are transferable to water management applications in other states.

The United States's Clean Water Act stipulates in section 303(d) that states must identify impaired water bodies for which total maximum daily loads (TMDLs) of pollution inputs into water bodies are developed. Decision-making procedures about how to list, or delist, water bodies as impaired, or not, per Clean Water Act 303(d) differ across states. In states such as California, whether or not a particular monitoring sample suggests that water quality is impaired can be regarded as a binary outcome variable, and California's current regulatory framework invokes a version of the exact binomial test to consolidate evidence across samples and assess whether the overall water body complies with the Clean Water Act. Here, we contrast the performance of California's exact binomial test with one potential alternative, the Sequential Probability Ratio Test (SPRT). The SPRT uses a sequential testing framework, testing samples as they become available and evaluating evidence as it emerges, rather than measuring all the samples and calculating a test statistic at the end of the data collection process. Through simulations and theoretical derivations, we demonstrate that the SPRT on average requires fewer samples to be measured to have comparable Type I and Type II error rates as the current fixed-sample binomial test. Policymakers might consider efficient alternatives such as SPRT to current procedure. Copyright © 2017 Elsevier Ltd. All rights reserved.

The contribution of hydrological research in South Africa in quantifying green water flows for improved Integrated Land and Water Resources Management is reviewed. Green water refers to water losses from land surfaces through transpiration (seen as a productive use) and evaporation from bare soil (seen as a non-productive use). In contrast, blue water flows refer to streamflow (surface water) and groundwater / aquifer recharge. Over the past 20 years, a number of methods have been used to quantify the green water and blue water flows. These include micrometeorological techniques (e.g. Bowen ratio energy balance, eddy covariance, surface renewal, scintillometry, lysimetry), field scale models (e.g. SWB, SWAP), catchment scale hydrological models (e.g. ACRU, SWAT) and more recently remote sensing based models (e.g. SEBAL, SEBS). The National Water Act of South Africa of 1998 requires that water resources are managed, protected and used (developed, conserved and controlled) in an equitable way which is beneficial to the public. The quantification of green water flows in catchments under different land uses has been pivotal in (a) regulating streamflow reduction activities (e.g. forestry) and the management of alien invasive plants, (b) protecting riparian and wetland areas through the provision of an ecological reserve, (c) assessing and improving the water use efficiency of irrigated pastures, fruit tree orchards and vineyards, (d) quantifying the potential impact of future land uses like bio-fuels (e.g. Jatropha) on water resources, (e) quantifying water losses from open water bodies, and (f) investigating "biological” mitigation measures to reduce the impact of polluted water resources as a result of various industries (e.g. mining). This paper therefore captures the evolution of measurement techniques applied across South Africa, the impact these results have had on water use and water use efficiency and the extent to which it supported the National Water Act of

Aluminum is unique among metals in the way it is obtained from its ore. The first step is to produce alumina, a white powder that bears no resemblance to the bauxite from which it is derived or to the metallic aluminum to which it is reduced by electrolytic action in a second step. Each step requires a complete plant facility, and the plants may be adjacent or separated by as much as the width of the North American continent. Field investigations sf every alumina plant and reduction works in the United States were undertaken to determine the industry's water use. Detailed studies were made of process and plant layout so that a water balance could be made for each plant to determine not only the gross water intake but also an approximation of the consumptive use of water. Water requirements of alumina plants range from 0.28 to 1.10 gallons per pound of alumina; the average for the industry is 0.66 gallon. Water requirements of reduction works vary considerably more, ranging from 1.24 to 36.33 gallons per pound of aluminum, and average 14.62 gallons. All alumina plants in the United States derive alumina from bauxite by the Bayer process or by the Combination process, a modification of the Bayer process. Although the chemical process for obtaining alumina from bauxite is essentially the same at all plants, different procedures are employed to cool the sodium aluminate solution before it enters the precipitating tanks and to concentrate it by evaporation of some of the water in the solution. Where this evaporation takes place in a cooling tower, water in the solution is lost to the atmosphere as water vapor and so is used consumptively. In other plants, the quantity of solution in the system is controlled by evaporation in a multiple-effect evaporator where practically all vapor distilled out of the solution is condensed to water that may be reused. The latter method is used in all recently constructed alumina plants, and some older plants are replacing cooling towers

This paper briefly discusses the more significant provisions of the Fish and Wildlife Coordination Act (1958). It covers pertinent aspects of legislative history, the development and current status (April 1980) of certain policies relevant to administering the Act, and other matters. It is directed primarily to practicing fish and wildlife agency field biologists, planners, and decisionmakers engaged in water resources development activities under the Act. It is not intended to be exhaustive in its treatment. The Fish and Wildlife Coordination Act provides a basic procedural framework for the orderly consideration of fish and wildlife conservation measures to be incorporated into Federal and Federally permitted or licensed water development projects. The principal provisions of the Act include: 1. a statement of Congressional purpose that fish and wildlife conservation shall receive equal consideration with other project features; 2. mandatory consultation with wildlife agencies with a view to achieving such conservation; 3. full consideration by action of the recommendations stemming from consultation; 4. authority for action agencies to implement such recommendations as they find acceptable. The FWCA in effect amends, conditions, or supplements other Federal laws and is thus closely linked in its application and interpretation. It is similarly linked to Federal planning standards and procedures. Because of this, interpretations tend to be flexible and evolve, adapting to changing situations. The following reference matrix outlines selected sections of the Fish and Wildlife Coordination Act which are of particular relevance to planners.

About 3,500 million gallons of water was withdrawn daily in 1955 for use by petroleum refineries in the United States. This was about 3 percent of the estimated daily withdrawal of industrial water in the United States in 1955. An average of 468 gallons of water was required to refine a barrel of crude oil, and the median was 95 gallons of water per barrel of crude charge; withdrawals ranged from 6.5 to 3,240 gallons per barrel. Ninety-one percent of the water requirements of the petroleum refineries surveyed was for cooling. One-third of the refineries reused their cooling water from 10 to more than 50 times. Only 17 refineries used once-through cooling systems. Refineries with recirculating cooling systems circulated about twice as much cooling water but needed about 25 times less makeup; however, they consumed about 24 times more water per barrel of charge than refineries using once-through cooling systems. The average noncracking refinery used about 375 gallons of water per barrel of crude, which is less than the 471-gallon average of refineries with cracking facilities. Refineries are composed of various processing units, and the water requirements of such units varied ; median makeup needs ranged from about 125 gallons per barrel for polymerization and alkylation units to 15.5 gallons per barrel for distillation units. Refinery-owned sources of water supplied 95 percent of the makeup-water requirements. Surface-water sources provided 86 percent of the makeup-water demand. Less than 1 percent of the makeup water was obtained from reprocessed municipal sewage.

Quality requirements for reclaimed/recycled water

Water used during current and previous space missions has been either carried or made aloft. Future human space endeavors will require some form of water reclamation and recycling. There is little experience in the U.S. space program with this technology. Water reclamation and recycling constitute engineering challenges of the broadest nature that will require an intensive research and development effort if this technology is to mature in time for practical use on the proposed U.S. Space Station. In order for this to happen, reclaimed/recycled water specifications will need to be devised to guide engineering development. Present NASA Potable Water Specifications are not applicable to reclaimed or recycled water. Adequate specifications for ensuring the quality of the reclaimed or recycled potable water system is reviewed, limitations of present water specifications are examined, world experience with potable water reclamation/recycling systems and systems analogs is reviewed, and an approach to developing pertinent biomedical water specifications for spacecraft is presented. Space Station water specifications should be designed to ensure the health of all likely spacecraft inhabitants including man, animals, and plants.

The 1995 Water Consumer Protection Act of Tucson, Arizona, USA (hereafter known as the Act) was passed following complaints from Tucson Water customers receiving treated Central Arizona Project (CAP) water. Consequences of the Act demonstrate the uncertainties and difficulties that arise when the public is asked to vote on a highly technical issue. The recharge requirements of the Act neglect hydrogeological uncertainties because of confusion between "infiltration" and "recharge." Thus, the Act implies that infiltration in stream channels along the Central Wellfield will promote recharge in the Central Wellfield. In fact, permeability differences between channel alluvium and underlying basin-fill deposits may lead to subjacent outflow. Additionally, even if recharge of Colorado River water occurs in the Central Wellfield, groundwater will become gradually salinized. The Act's restrictions on the use of CAP water affect the four regulatory mechanisms in Arizona's 1980 Groundwater Code as they relate to the Tucson Active Management Area: (a) supply augmentation; (b) requirements for groundwater withdrawals and permitting; (c) Management Plan requirements, particularly mandatory conservation and water-quality issues; and (d) the requirement that all new subdivisions use renewable water supplies in lieu of groundwater. Political fallout includes disruption of normal governmental activities because of the demands in implementing the Act. This report provides a perspective on the amount of water necessary for conventional gold heap-leach operations. Water is required for drilling and dust suppression during mining, for agglomeration and as leachate during ore processing, to support the workforce (requires water in potable form and for sanitation), for minesite reclamation, and to compensate for water lost to evaporation and leakage. Maintaining an adequate water balance is especially critical in areas where surface and groundwater are difficult to acquire because of unfavorable climatic conditions [arid conditions and (or) a high evaporation rate]; where there is competition with other uses, such as for agriculture, industry, and use by municipalities; and where compliance with regulatory requirements may restrict water usage. Estimating the water consumption of heap-leach operations requires an understanding of the heap-leach process itself. The task is fairly complex because, although they all share some common features, each gold heap-leach operation is unique. Water resource management requires collaborative solutions that cross institutional and political boundaries. This work describes the development and use of a computer-based tool for assessing the impact of additional water allocation from the Gila River and the San Francisco River prescribed in the 2004 Arizona Water Settlements Act. Between 2005 and 2010, Sandia National Laboratories engaged concerned citizens, local water stakeholders, and key federal and state agencies to collaboratively create the Gila-San Francisco Decision Support Tool. Based on principles of system dynamics, the tool is founded on a hydrologic balance of surface water, groundwater, and their associated coupling between watermore » resources and demands. The tool is fitted with a user interface to facilitate sensitivity studies of various water supply and demand scenarios. The model also projects the consumptive use of water in the region as well as the potential CUFA (Consumptive Use and Forbearance Agreement which stipulates when and where Arizona Water Settlements Act diversions can be made) diversion over a 26-year horizon. Scenarios are selected to enhance our understanding of the potential human impacts on the rivers ecological health in New Mexico; in particular, different case studies thematic to water conservation, water rights, and minimum flow are tested using the model. The impact on potential CUFA diversions, agricultural consumptive use, and surface water availability are assessed relative to the changes imposed in the scenarios. The security and privacy requirements of the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and their implications for pharmacy are discussed. HIPAA was enacted to improve the portability of health care insurance for persons leaving jobs. A section of the act encourages the use of electronic communications for health care claims adjudication, mandates the use of new standard code sets and transaction sets, and establishes the need for regulations to protect the security and privacy of individually identifiable health care information. Creating these regulations became the task of the Department of Health and Human Services. Regulations on security have been published for comment. Regulations on privacy and the definition of standard transaction sets and code sets are complete. National identifiers for patients, providers, and payers have not yet been established. The HIPAA regulations on security and privacy will require that pharmacies adopt policies and procedures that limit access to health care information. Existing pharmacy information systems may require upgrading or replacement. Costs of implementation nationwide are estimated to exceed $8 billion. The health care community has two years from the finalization of each regulation to comply with that regulation. The security and privacy requirements of HIPAA will require pharmacies to review their practices regarding the storage, use, and disclosure of protected health care information.

In Europe different types of water are marketed, each strictly defined by EC Directive 80/777 (Natural Mineral Water, Spring and Table Water) or 80/778 (Drinking Water). In Germany, an additional type of water is common in the market: curative/medical water. Product quality and safety, registration as medicine, and pharmaceutical control are defined by the German Federal Medicine Act. A medical water is treated as any other medicine and may be sold only in pharmacies. The use of any water in Germany is controlled and strictly regulated by the Federal Water Act (Fricke 1981). The following requirements are set by the act: (1) No water use without a permit, which is limited in time and quantity. (2) No single or juristic person may own water. (3) Water resources of public interest and their recharge areas are to be protected by the definition of water protection zones. (Natural mineral water is not of public interest and therefore is not required to be protected by the definition of water protection zones, although it represents a market value of more than US2 billion. Medical water is of public interest). The definition of water protection zones impacts private property rights and has to be handled carefully. In order to protect water resources, sometimes the economic basis of a traditional industrial and/or agricultural infrastructure is destroyed. The concerns and needs all citizens, including industry, must be considered in analyzing the adequacy of water protection zones.

This document reports on the activities of States in FY 85 and 86 in developing and implementing State ground-water protection strategies using Clean Water Act Section 106 funds. Every State and all but one territory has participated in the program. Strategies have included emphasis on the need to consolidate State and local agency efforts, and to provide clear policy direction, greater public awareness and education concerning ground-water protection.

Airports are active facilities with numerous on-going operations at their sites. The following operations may adversely affect the water quality of nearby aquatic environments: De-icing runways; de-icing taxiways; de-icing and anti-icing aircraft; aircraft maintenance; and salt de-icer application. Until the amendments to the Clean Water Act of 1972, referred to as the Water Quality Act of 1987, were passed by Congress, the majority of storm water discharges in the US were unregulated. The Water Quality Act of 1987 was promulgated as an effort to manage the pollution resulting from storm water runoff. Many industrial facilities, especially airports, were faced withmore » complex problems in attempting to comply with these new federal regulations. National Pollution Discharge Elimination System (NPDES) permits for airports with more than 50,000 flight operations per year require periodic monitoring of receiving waters and storm sewer outfalls. Impact of Preservation of Subsoil Water Act on Groundwater Depletion: The Case of Punjab, India.

Indian states like Punjab and Haryana, epicenters of the Green Revolution, are facing severe groundwater shortages and falling water tables. Recognizing it as a serious concern, the Government of Punjab enacted the Punjab Preservation of Subsoil Water Act in 2009 (or the 2009 act) to slow groundwater depletion. The objective of this study is to assess the impact of this policy on groundwater depletion, using panel data from 1985 to 2011. Results from this study find a robust effect of the 2009 act on reducing groundwater depletion. Our models for pre-monsoon, post-monsoon, and overall periods of analysis find that since implementation of the 2009 act, groundwater tables have improved significantly. Second, our study reveals that higher shares of tube wells per total cropped area and increased population density have led to a significant decline in the groundwater tables. On the other hand, rainfall and the share of area irrigated by surface water have had an augmenting effect on groundwater resources. In the two models, pre-monsoon and post-monsoon, this study shows that seasonality plays a key role in determining the groundwater table in Punjab. Specifically, monsoon rainfall has a very prominent impact on groundwater.

"The South Fork Nooksack River (SFNR) is an important tributary to the Nooksack River, Bellingham Bay, and the Salish Sea. The South Fork Nooksack River comprises one of the 22 independent populations of spring Chinook in the Puget Sound Chinook Evolutionarily Significant Unit (ESU), which are listed as threatened under the Endangered Species Act (ESA). The population is considered essential for recovery of the ESU. The SFNR has suffered from legacy impacts, temperature exceedances and fine sediment, due to forestry, agriculture, flood control, and transportation facilities. The temperature exceedances threaten spring Chinook salmon survival and as such under the Clean Water Act, this pollution must be addressed through a total maximum daily load (TMDL) regulatory program. Further, climate change is projected to cumulatively add to the existing legacy impacts. Millions of dollars are spent on salmon habitat restoration in the SFNR that primarily addresses these legacy impacts, but few if any restoration actions take climate change into direct consideration. The Nooksack Indian Tribe and USEPA-ORD jointly completed a climate change pilot research project that addresses legacy impacts, ESA recovery actions, CWA regulatory compliance, and salmon habitat restoration in one comprehensive project. Carbon blacks include an important group of industrial carbons used chiefly as a reinforcing agent in rubber tires. In 1953 more than 1,610 million pounds of carbon black was produced, of which approximately 1,134 million pounds was consumed by the rubber industry. The carbon-black industry uses small quantities of water as compared to some industries; however, the water requirements of the industry are important because of the dependence of the rubber-tire industry on carbon black.Two methods are used in the manufacture of carbon black - contact and furnace. The only process use of water in the contact method is that used in pelleting. Water is used also in the plant washhouse and for cleaning, and sometimes the company camp may be supplied by the plant. A survey made during the last quarter of 1953 showed that the average values of unit water use at contact plants for process use, all plant uses, and all uses including company camps are 0.08, 0.14, and 0.98 gallon of water per pound of carbon black respectively.In addition to use in wet pelleting, large quantities of water are required in continuous and cyclic furnace methods to reduce the temperature of the gases of decomposition in order to separate and collect the entrained carbon black. The 22 furnace plants in operation in 1953 used a total of 12.4 million gallons per day for process use. Four furnace plants generate electric power for plant use; condenser-cooling water for one such plant may nearly equal the requirements of the entire industry for process use. The average values of unit water use at furnace plants for process use, all plant uses and all uses including company camps but excluding power generation are 3.26, 3.34, and 3.45 gallons of water per pound of carbon black respectively.Carbon-black plants in remote, sparsely settled areas often must maintain company camps for employees. Twenty-one of twenty-seven contact plants surveyed in 1953 had company camps. These camps used large quantities of

The New South Wales (NSW) Public Health Act 2010 requires water suppliers to implement a drinking water quality assurance program that addresses the 'Framework for management of drinking water quality' in the Australian drinking water guidelines. NSW Health has recognised the importance of a staged implementation of this requirement and the need to support regional water utilities. To date, NSW Health has assisted 74 regional utilities to develop and implement their management systems. The Public Health Act 2010 has increased awareness of drinking water risk management, and offers a systematic process to identify and control risks. This has benefited large utilities, smaller suppliers, and remote and Aboriginal communities. Work is continuing to ensure implementation of the process by private suppliers and water carters.

Based on the daily meteorological data of 124 agricultural meteorological sites during 1977-2010 in Yunnan Province, using recommended Penman-Monteith formula by FAO, water requirement and irrigation requirement index in the growth period of flue-cured tobacco were calculated to analyze their spatial and temporal characteristics and change patterns. The results showed that water requirements of flue-cured tobacco in root extending, vigorous, mature periods and field growth period during 1977-2010 were 76.73-174.73, 247.50-386.64, 180.28-258.14 and 528.18-764.08 mm, respectively, and the water requirement of vigorous period was the highest. The average irrigation demand index of each period was -0.02, 0.38, 0.17 and 0.26, respectively. Effective precipitation could meet the demand of flue-cured tobacco in root extending period. Water requirement of flue-cured tobacco in Yunnan Province decreased annually, and the rates of water requirement under the climate change trend in the four periods abovementioned were -12. 42, -21.46, -7.17 and -47.15 mm . (10 a)-1, respectively. The smallest irrigation demand index was observed in Dehong, and the largest in Diqing. The irrigation demand indexes of Dehong, Xishuangbanna and Puer regions were negative in flue-cured tobacco field growth period. The reference crop evapotranspiration, water requirement and effective precipitation decreased, but the irrigation requirement and irrigation requirement index increased with the increase of latitude. The 1974 Safe Drinking Water Act (SDWA) regulates >170,000 public water systems to protect health, but not >13 million private wells. State and local government requirements for private well water testing are rare and inconsistent; the responsibility to ensure water safety remains with individual households. Over the last two decades, geogenic arsenic has emerged as a significant public health concern due to high prevalence in many rural American communities. We build the case for universal screening of private well water quality around arsenic, the most toxic and widespread of common private water contaminants. We argue that achieving universal screening will require policy intervention, and that testing should be made easy, accessible, and in many cases free to all private well households in the United States, considering the invisible, tasteless, odorless, and thus silent nature of arsenic. Our research has identified behavioral, situational and financial barriers to households managing their own well water safety, resulting in far from universal screening despite traditional public health outreach efforts. We observe significant socioeconomic disparities in arsenic testing and treatment when private water is unregulated. Testing requirements can be a partial answer to these challenges. Universal screening, achieved through local testing requirements complemented by greater community engagement targeting biologically and socioeconomically vulnerable groups, would reduce population arsenic exposure greater than any promotional efforts to date. Twenty-nine steel plants surveyed during 1957 and 1958 withdrew from various sources about 1,400 billion gallons of water annually and produced 40.8 million tons of ingot steel. This is equivalent to about 34,000 gallons of water per ton of steel. Fifteen iron ore mines and fifteen ore concentration plants together withdrew annually about 89,000 million gallons to produce 15 million tons of iron ore concentrate, or 5,900 gallons per ton of concentrate. About 97 percent of the water used in the steel plants came from surface sources, 2.2 percent was reclaimed sewage, and 1.2 percent was ground water. Steel plants supplied about 96 percent of their own water requirements, although only three plants used self-supplied water exclusively. Water used by the iron ore mines and concentration plants was also predominantly self supplied from surface source. Water use in the iron and steel industry varied widely and depended on the availability of water, age and condition of plants and equipment, kinds of processes, and plant operating procedures. Gross water use in integrated steel plants ranged from 11,200 to 110,000 gallons per ton of steel ingots, and in steel processing plants it ranged from 4,180 to 26,700 gallons per ton. Water reuse also varied widely from 0 to 18 times in integrated steel plants and from 0 to 44 times in steel processing plants. Availability of water seemed to be the principal factor in determining the rate of reuse. Of the units within steel plants, a typical (median) blast furnace required 20,500 gallons of water per ton of pig iron. At the 1956-60 average rate of pig iron consumption, this amounts to about 13,000 gallons per ton of steel ingots or about 40 percent of that required by a typical integrated steel plant 33,200 gallons per ton. Different processes of iron ore concentration are devised specifically for the various kinds of ore. An integrated modeling system, developed in the framework of "Hydromentor" research project, is applied to evaluate crop water requirements for operational water resources management at Lake Karla watershed, Greece. The framework includes coupled components for operation of hydrotechnical projects (reservoir operation and irrigation works) and estimation of agricultural water demands at several spatial scales using remote sensing. The study area was sub-divided into irrigation zones based on land use maps derived from Landsat 5 TM images for the year 2007. Satellite-based energy balance for mapping evapotranspiration with internalized calibration (METRIC) was used to derive actual evapotranspiration (ET) and crop coefficient (ETrF) values from Landsat TM imagery. Agricultural water needs were estimated using the FAO method for each zone and each control node of the system for a number of water resources management strategies. Two operational strategies of hydro-technical project development (present situation without operation of the reservoir and future situation with the operation of the reservoir) are coupled with three water demand strategies. In total, eight (8) water management strategies are evaluated and compared. The results show that, under the existing operational water resources management strategies, the crop water requirements are quite large. However, the operation of the proposed hydro-technical projects in Lake Karla watershed coupled with water demand management measures, like improvement of existing water distribution systems, change of irrigation methods, and changes of crop cultivation could alleviate the problem and lead to sustainable and ecological use of water resources in the study area.

The Safe Drinking Water Act and its Amendments have imposed a large number of new regulations on the US drinking-water industry. A major set of regulations currently under consideration will control disinfectants and disinfection by-products. Included in the development of these regulations is an Information Collection Rule and an Enhanced Surface Water Treatment Rule. These rules will require monitoring for microorganisms such as Giardia, Cryptosporidium, and viruses. Certain surface-water systems may be required to remove microbiological contaminants above levels currently required by the Surface Water Treatment Rule. Also included in these rules will be monitoring requirements for disinfection by-products andmore » evaluation of precursor removal technologies. Section 316(b) of the Clean Water Act (CWA) requires that “the location, design, construction, and capacity of cooling water intake structures reflect the best technology available for minimizing adverse environmental impact.” As the U.S. Environmental Protection Agency (EPA) develops new regulations to implement Section 316(b), much of the debate has centered on adverse impingement and entrainment impacts of cooling-water intake structures. Depending on the specific location and intake layout, once-through cooling systems withdrawing many millions of gallons of water per day can, to a varying degree, harm fish and other aquatic organisms in the water bodies from which the coolingmore » water is withdrawn. Therefore, opponents of once-through cooling systems have encouraged the EPA to require wet or dry cooling tower systems as the best technology available (BTA), without considering site-specific conditions. However, within the context of the broader scope of the CWA mandate, this focus seems too narrow. Therefore, this article examines the phrase “minimizing adverse environmental impact” in a holistic light. Emphasis is placed on the analysis of the terms “environmental” and “minimizing.” Congress chose “environmental” in lieu of other more narrowly focused terms like “impingement and entrainment,” “water quality,” or “aquatic life.” In this light, BTA for cooling-water intake structures must minimize the entire suite of environmental impacts, as opposed to just those associated with impingement and entrainment. Wet and dry cooling tower systems work well to minimize entrainment and impingement, but they introduce other equally important impacts because they impose an energy penalty on the power output of the generating unit. The energy penalty results from a reduction in plant operating efficiency and an increase in internal power consumption. As of December 1991, the Patient Self-Determination Act (PSDA) mandated that health care institutions which receive funding from Medicare or Medicaid provide written information about persons' rights to participate in medical decision-making and formulate advance directives. The PSDA required each state "...acting through a State agency, association, or other private nonprofit entity develop a written description of the law of the State (whether statutory or as recognized by the courts of the State) concerning advance directives that would be distributed by providers or organizations under the requirements of [the Act]." This mandate allowed each state considerable flexibility in its approach to the process of writing the state description and to its content. In 1990, the American Bar Association's Commission on Legal Problems of the Elderly prepared and distributed the Patient Self Determination Act: State Law Guide to assist each state in preparing its written description of state law. In follow-up to the distribution of this guide, we conducted a telephone survey with a representative from each state (including the District of Columbia) about each state's process for writing the state law description. This paper presents an evaluation of the process used by the states and of the documents they produced.

Water requirements of the rayon- and acetate-fiber industry

Water is required for several purposes in the manufacture of rayon and acetate fiber. These water requirements, as indicated by a survey of the water used by the plants operating in 1953, are both quantitative and qualitative. About 300 mgd (million gallons per day) of water was used in 1953 in the preparation of purified wood cellulose and cotton linters, the basic material from which the rayon and acetate fiber is made. An additional 620 mgd was used in the process of converting the cellulose to rayon and acetate fiber. The total, 920 mgd, is about 1 percent of the total estimated withdrawals of industrial water in the United States in 1953. The rayon- and acetate-fiber plants are scattered through eastern United States and generally are located in small towns or rural areas where there are abundant supplies of clean, soft water. Water use at a typical rayon-fiber plant was about 9 mgd, and at a typical acetate-fiber plant about 38 mgd. About 110 gallons of water was used to produce a pound of rayon fiber 32 gallons per pound was process water and the remainder was used largely for cooling in connection with power production and air conditioning. For the manufacture of a pound of acetate fiber about 170 gallons of water was used. However, the field survey on which this report is based indicated a wide range in the amount of water used per pound of product. For example, in the manufacture of viscose rayon, the maximum unit water use was 8 times the minimum unit water use. Water use in summer was about 22 percent greater than average annual use. About 8 mgd of water was consumed by evaporation in the manufacture of rayon and acetate fiber. More than 90 percent of the water used by the rayon and acetate industry was withdrawn from surface-water sources, about 8 percent from ground water, and less than 2 percent from municipal water supplies. The impacts of climate change on global irrigation water requirements

Climate change tends to affect the irrigation water requirement of current irrigated agricultural land, and also changes the water availability for current rain-fed land by the end of this century. We use the most up-to-date climatic and crop datasets (e.g., global irrigated/rain-fed crop areas and grid level crop growing calendar (Portmann, Siebert and Döll, 2010, Global Biogeochemical Cycles 24)) to evaluate the requirements of currently irrigated land and the water deficit for rain-fed land for all major crops under current and projected climate. Six general circulation models (GCMs) under two emission scenarios, A1B & B1, are assembled using two methods, the Simple Average Method (SAM) and Root Mean Square Error Ensemble Method (RMSEMM), to deal with the GCM regional variability. It is found that the global irrigation requirement and the water deficit are both going to increase significantly under all scenarios, particularly under the A1B emission scenario. For example, the projected irrigation requirement is expected to increase by about 2500 million m3 for wheat, 3200 million m3 for maize and another 3300 million m3 for rice. At the same time, the water deficit for current rain-fed cropland will be widened by around 3000, 4000, 2100 million m3 for wheat, maize and rice respectively. Regional analysis is conducted for Africa, China, Europe, India, South America and the United States. It is found that the U.S. may expect the greatest rise in irrigation requirements for wheat and maize, while the South America may suffer the greatest increase for rice. In addition, Africa and the U.S. may face a larger water deficit for both wheat and maize on rain-fed land, and South America just for rice. In summary, climate change is likely to bring severe challenges for irrigation systems and make global water shortage even worse by the end of this century. Invertebrate-Based Water Quality Impairments and Associated Stressors Identified through the US Clean Water Act

Macroinvertebrate community assessment is used in most US states to evaluate stream health under the Clean Water Act. While water quality assessment and impairment determinations are reported to the US Environmental Protection Agency, there is no national summary of biological assessment findings. The objective of this work was to determine the national extent of invertebrate-based impairments and to identify pollutants primarily responsible for those impairments. Evaluation of state data in the US Environmental Protection Agency's Assessment and Total Maximum Daily Load Tracking and Implementation System database revealed considerable differences in reporting approaches and terminologies including differences in if and how states report specific biological assessment findings. Only 15% of waters impaired for aquatic life could be identified as having impairments determined by biological assessments (e.g., invertebrates, fish, periphyton); approximately one-third of these were associated with macroinvertebrate bioassessment. Nearly 650 invertebrate-impaired waters were identified nationwide, and sediment was the most common pollutant in bedded (63%) and suspended (9%) forms. This finding is not unexpected, given previous work on the negative impacts of sediment on aquatic life, and highlights the need to more specifically identify the mechanisms driving sediment impairments in order to design effective remediation plans. It also reinforces the importance of efforts to derive sediment-specific biological indices and numerical sediment quality guidelines. Standardization of state reporting approaches and terminology would significantly increase the potential application of water quality assessment data, reveal national trends, and encourage sharing of best practices to facilitate the attainment of water quality goals.
